Abstract

Corporate Social Responsibility (CSR) has become a global issue; however, no definition of CSR is globally accepted. In Indonesia, the concept of CSR is getting stronger, especially after being firmly mentioned in the Law Number 40 of 2007 concerning on the Limited Liability Companies and the Acts Number 25 of 2007 on Investment. In recent years, some companies have implemented the CSR, including in West Lombok. In this case, the success of local government in in improving the prosperity of  the community can only be achieved if all community components take a part, including the companies operating in the region. The application of CSR in the private company in West Lombok especially  the Company of legal entity (PT) is referred to the NTB Provincial Regulation Number 6 of 2012 concerning  on Environment and Social Responsibility of the Company as mentioned in Article 10. The programs include community development and partnership programs for micro, small business and cooperation, and programs that are  directly-related to the public. However, the application is only dominant in the program that is directly-related to the public such as grants, subsidies, social assistance. The CSR programs have not been made to support community development and partnership programs for micro, small and medium enterprises. A non-incorporated company maybe referred to the Law Number 25 article 15 of 2007 concerning Investment Keywords: CSR, Implementation, Private Companies

Abstract

Revisi atas Undang-Undang No 3 Tahun 2020 Tentang Perubahan Atas Undang-Undang Nomor 4 Tahun 2009 Tentang Pertambangan Mineral dan Batubara hasil pembahasan Panitia Kerja telah merombak 143 pasal dari total 217 pasal, artinya ada 82% pasal diubah pada Undang-Undang No 4 Tahun 2009. Undang-undang ini tidak partisipatif dan tidak transparan, sehingga kurang berpihak terhadap penerapan tanggung jawab sosial perusahaan. Penelitian ini betujuan untuk menganalisis serta mengkaji kemunduran pengaturan tanggung jawab sosial perusahaan dalam sektor pertambangan mineral dan batubara. Metode penelitian yang digunakan adalah metode penelitian hukum normatif dengan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian ini menggambarkan bahwa Undang-Undang No 3 Tahun 2020 mengalami kemunduran pengaturan tanggung jawab sosial perusahaan dalam sektor pertambangan mineral dan batubara yaitu: adanya penambahan izin penambangan yaitu Surat Izin Penambangan Batuan, dimana Izin ini akan membuka ruang baru dalam pengelolaan pertambangan, memuat ketentuan baru yang membahayakan ruang hidup masyarakat sebab semua aktivitas mulai dari penyelidikan hingga pertambangan masuk dalam ruang hidup masyarakat, hanya melakukan pengawasan terhadap aspek keselamatan pertambangan saja menghapus aspek dari kesehatan kerja pertambangan, membuka jalan untuk mengkriminalisasi masyarakat yang menolak keberadaan tambang di wilayahnya.

Abstract

This study aims to analyze and examine the juridical implications of the decision of Constitutional Court Number 91/PUU XVII/2020 on the job creation law in the mineral and coal mining sector. The research method used is a normative legal research method with approach legislation. The results illustrate that the juridical implication of the Job Creation Act in the mineral and coal mining sector is that in its decision the Constitutional Court stated that the Job Creation Act was still valid as long as the law-makers made improvements in the procedures for establishing Job Creation Law. In this case, the Constitutional Court has given two years for the legislators to revise the procedure for the formation of the Job Creation Law since the decision was pronounced. If no improvements are made, the Law can be declared unconstitutional permanently. Thus, if Law Number 11 of 2020 concerning job creation is unconstitutional, namely permanently removing coal incentive opportunities, the elimination of coal incentive opportunities must indeed be carried out due to the targets of coal utilization in Article 128A, not power optimization towards clean energy and will increase the portion of coal in the national energy mix and overall will systematically overlap with climate adaptation and mitigation targets and programs as well as the Articles in the Job Creation Act are also infiltrated by the interests of mining and dirty energy businesses.
