Abstract

This research aims to reformulate patent law in Indonesia based on the 12th WTO MC Decision on the TRIPs Agreement related to patent waivers for vaccines in certain circumstances, such as pandemics. Patenting vaccines during a pandemic can hamper efforts to handle the pandemic quickly and effectively and make access to vaccines limited, especially for lower-middle-income countries (LMICs). This can be seen in the implementation of Covid-19 vaccination where there is a gap in vaccination rates and vaccine prices between developed countries and LMICs countries. For example, vaccine supplies in Indonesia as one of the LMICs countries could only meet 24% of the coverage target of 181 million people at the beginning of the Covid-19 pandemic. The patent law in Indonesia has provided flexibility regarding the implementation of patents for vaccines in certain circumstances through the implementation of patents by the government, but in fact it still cannot overcome the scarcity of vaccines in an emergency in Indonesia. This study uses normative (doctrinal) research types with statue, conceptual, and analytical. Based on the results of the research, in order to minimize existing problems so that they do not occur in the future, Indonesia can reformulate the formulation of patent laws in Indonesia based on the TRIPs Agreement, namely first, the regulation that the implementation of patent waivers for vaccines in certain circumstances does not require permission from the patent holder; second, the regulation on determining the amount of remuneration for inventors; and third,  regulation on the prohibition of re-export of vaccines whose patents are ignored.

Abstract

The aim of this research is first to identify cases of personal data leakage as unlawful acts that violate the law. Second, find an ideal concept for cases of leakage of bank customers' personal data based on the burden of proof. This article used a normative (doctrinal) method with statute and conceptual approach. The results of the research show that personal data leakage is a form of unlawful act that can be held accountable provided that the elements are met: the existence of the act, the act being against the law, the existence of an error or negligence (negiglence), the existence of a loss, and a causal relationship between the cause and the loss. Judging from the burden of proof and the applicable regulations, the concept of strict liability is an appropriate concept for cases of leakage of customer personal data because it is shifting the burden of proof so that business actors must prove that they are innocent.

Abstract

Cryptocurrency has become evidence of the rapid growth of the digital economy. This phenomenon has left countries worldwide in a dilemma regarding the legal status of cryptocurrencies. Specifically in Indonesia, cryptocurrency is regulated in a limited manner, creating a gap in legal protection for investors. This research employs a normative research method with a legislative and conceptual approach. The findings of this research indicate that Indonesia tends to position cryptocurrencies in a "limited" capacity, restricting them to being considered investments rather than currency. Nevertheless, due to the legal gaps, there is a need to establish standardized, periodic, and embedded security measures overseen by Bappebti to ensure maximum protection provided by every cryptocurrency wallet service provider. Additionally, it should be mandatory for every service provider to comprehensively insure digital assets to offer financial protection to individuals.

Abstract

Advertising strategies through social media are increasingly being chosen by business actors to market their goods and/or services. The existence of advertising strategies through social media has given birth to a new term known as endorsers. The rapid development in the world of advertising is not balanced by the development of laws in the legislation in Indonesia which is specifically regulated through Law Number 8 of 1999 concerning Consumer Protection. The purpose of this study is to find out the ideal regulation of endorser liability for consumer losses due to promotional actions carried out by endorsers. The research method used in this study is normative legal research with a conceptual approach, a statutory approach, and a comparative approach with the Code of Federal Regulations (CFR) Part 255 on Guides Concerning the Use of Endorsements and Testimonials in Advertising. The results of this study are the urgency for legislation in Indonesia to regulate endorsers in detail and explicitly so that endorsers can be held accountable for promotional actions carried out by them.

Abstract

Abstrak Harta bersama dalam konteks perkawinan campuran merupakan isu hukum yang kompleks dalam sistem hukum Indonesia yang pluralistik. Perkawinan campuran yang melibatkan pasangan dengan perbedaan kewarganegaraan, budaya, atau agama menimbulkan berbagai tantangan hukum, terutama mengenai kepemilikan tanah, hak waris, dan pembagian aset setelah perceraian. Permasalahan ini sering kali menciptakan ketidakpastian hukum dan potensi ketidakadilan bagi pasangan, khususnya pihak asing yang kerap mengalami pembatasan hak kepemilikan. Penelitian ini bertujuan untuk menganalisis bagaimana prinsip keadilan dapat diterapkan dalam pengaturan harta bersama dalam perkawinan campuran, dengan mempertimbangkan perbedaan sistem hukum negara asal pasangan dan kebutuhan untuk melindungi hak individu secara seimbang. Metode yang digunakan adalah pendekatan hukum normatif, dengan fokus pada analisis norma hukum perdata internasional yang berlaku. Data diperoleh melalui studi literatur terhadap undang-undang, peraturan, dan yurisprudensi, serta wawancara mendalam dan analisis kasus untuk menggali aspek teoritis dan praktis dari penerapan hukum. Hasil penelitian menunjukkan bahwa perbedaan sistem hukum antarnegara sering kali menimbulkan ketidakadilan dalam kepemilikan dan pembagian harta. Pembatasan terhadap pasangan asing menjadi hambatan utama. Oleh karena itu, diperlukan harmonisasi hukum perdata internasional, penerapan perjanjian perkawinan yang adaptif terhadap globalisasi, serta reformasi hukum yang inklusif untuk menjamin keadilan dan kesetaraan hak dalam perkawinan campuran. Kata Kunci: Hukum, Hukum Perdata Internasional, Keadilan Hukum, Perkawinan Campuran, Harta Bersama. Abstract Joint property in the context of mixed marriages represents a complex legal issue within Indonesia’s pluralistic legal system. Mixed marriages involving spouses of different nationalities, cultures, or religions pose significant legal challenges, particularly concerning land ownership, inheritance rights, and the division of assets after divorce. These challenges often create legal uncertainty and potential injustices, especially for foreign spouses who face ownership restrictions. This study aims to examine how principles of justice can be applied to regulate joint property in mixed marriages by considering differences in the legal systems of each spouse’s home country and ensuring a balanced protection of individual rights. The research employs a normative legal approach, focusing on the analysis of applicable international private law norms. Data were collected through literature studies of legislation, regulations, and jurisprudence, as well as in-depth interviews and case analyses to gain both theoretical and practical insights into legal implementation. The results reveal that differences between legal systems frequently lead to inequities in property ownership and division. Discriminatory restrictions on foreign spouses pose significant barriers. Therefore, harmonisation of international private law, adaptive prenuptial agreements, and inclusive legal reforms are essential to ensuring justice and equal rights in mixed marriages. Abstract

This study aims to determine and analyze the Notary's responsibility regarding the making of Notarial Power of Attorney to Sell and Deed of Statement indicated as a nominee Deed and legal protection for the parties related to the making of Notarial Power of Attorney to Sell and Deed of Statement containing nominee elements. Using a normative legal research method with a statutory approach and a conceptual approach, this study obtained the result that the Notary's responsibility regarding the making of notarial power of attorney to sell and deed of statement indicated as a nominee deed, namely the notary in carrying out his responsibility as the maker of the deed will be subject to sanctions in accordance with the provisions of the applicable laws. Legal protection that can be carried out by the parties is repressive and preventive legal protection, namely preventive legal protection by making an agreement containing the rights and obligations of the parties, if the agreement is problematic, there are still legal protection efforts that can be taken by both parties, namely repressive legal protection. Studi ini bertujuan untuk mengetahui dan menganalisis terkait tanggung jawab Notaris terkait pembuatan Akta Kuasa Menjual Notariil dan Akta Pernyataan yang terindikasi sebagai Akta nominee Serta perlindungan hukum terhadap para pihak terkait pembuatan Akta Kuasa Menjual Notariil dan Akta Pernyataan yang memuat unsur nominee. Menggunakan metode penelitian hukum normative dengan pendekatan perundang-undangan dan pendekatan konseptuan, penelitian ini memperoleh hasil bahwa Tanggung jawab notaris terkait pembuatan akta kuasa menjual notarial dan akta pernyataan yang terindikasi sebagai akta nominee yaitu notaris dalam melaksanakan tanggung jawabnya sebagai pembuat akta akan dikenakan sanksi sesuai ketentuan undang-undang yang berlaku. Perlindungan hukum yang dapat dilakukan oleh para pihak yaitu perlindungan hukum represif dan preventif yaitu perlindungan hukum preventif dengan membuat perjanjian yang memuat hak dan kewajiban dari para pihak, apabila perjanjian tersebut bermasalah maka masih ada upaya perlindungan hukum yang dapat ditempuh oleh kedua pihak yaitu perlindungan hukum represif.

Abstract

The purpose of this study is to analyze the Legal Policy Establishment of Article 107 Numbers 2 Law Number 11 of 2020 on Job Creation Reviewed From Transfer of Technology Regulation in Article 7 TRIPs. This research is normative legal research by prioritizing statutory approaches and historical approach. The results of the study show that Article 107 Numbers 2 Law Number 11 of 2020 on Job Creation is not by the mandate of Article 7 TRIPs, and implicated for the absence of government interference in technology transfer especially in the field of patents. The legal policy of establishing Article 107 Numbers 2 Law Number 11 of 2020 on Job Creation is influenced by the intervention of other countries and more inclined towards adjusting international trade politics than defending national interests. The most ideal arrangement regarding technology transfer is by the formulation of Article 20 Paragraph (2) Law Number 13 of 2016 concerning Patents, which in essence patents must support technology transfer. Suggestions in this study for the lawmaker should emphasize the necessity for technology transfer in the field of patents through licenses in Indonesian laws and regulations.

Abstract

The purpose of this research is to provide an overview of the legal vacuum (rechtsvacuum) in the proof of heirs as legitimate heirs of a deceased foreign national. This research is normative juridical research. It uses a normative juridical approach with two methods: statutory and conceptual. The sources of legal materials consist of primary sources (legislation), secondary sources (academic manuscripts, legal journals, books, articles), and tertiary sources (legal dictionaries, KBBI). The literature study method is used to search for legal sources. The analysis of legal materials is conducted using teleological interpretation and the specialization construction technique (rechtsvervijnings). The research results show that granting Property Rights (Hak Milik) for apartment units (Sarusun) to Foreign Citizens (WNA) in Indonesia is not new and has long been practiced as an effort to attract investment and provide facilities for foreign nationals who contribute to national development. However, there is a legal vacuum regarding the creation of Inheritance Certificates (Surat Keterangan Waris - SKW) for foreign heirs, which is important for proving their status as legitimate heirs and conducting legal transactions related to the inheritance. To address this legal vacuum, it is recommended that the creation of SKW for heirs of foreign nationals should be carried out before a Notary. The main reason for choosing a Notary is because they have the authority to create authentic deeds, have a wide reach throughout Indonesia, and are not limited by religious factors in creating SKW. Additionally, deeds made by a Notary have stronger legal force compared to SKW in letter form. Therefore, this arrangement is expected to provide legal certainty for foreign nationals owning Sarusun in Indonesia and their heirs.

Abstract

General Background Traditional cultural expressions constitute communal cultural heritage embodying identity, philosophy, and collective memory, requiring legal protection aligned with their communal and sacred nature. Specific Background In Indonesia, traditional batik motifs—particularly the sacred Parang motifs of the Yogyakarta Sultanate—are classified as traditional cultural expressions whose copyright is declared “held by the state” under Article 38 paragraph (1) of Law No. 28 of 2014 on Copyright. Knowledge Gap This formulation contains normative ambiguity, as it does not clearly define whether state authority represents ownership, public trusteeship, or mere administrative control, resulting in weak legal certainty for indigenous custodians. Aims This study examines the legal meaning of the phrase “held by the state” in relation to the protection of sacred Parang batik motifs within the framework of traditional cultural expressions. Results The analysis shows that the provision functions as a declarative norm lacking substantive mechanisms, failing to recognize customary authority, community consent, or benefit-sharing, and thereby permitting desacralization and misuse of sacred motifs. Novelty This research clarifies that state control over traditional cultural expressions should be interpreted as public trusteeship rather than ownership, drawing comparative insights from community-centered protection models in India and Thailand. Implications The findings support the development of a sui generis legal framework integrating customary law, community participation, and administrative facilitation to ensure sustainable and culturally respectful protection of sacred batik motifs. Abstract

The immediate executable judgment (uitvoerbaar bij voorraad) is a form of judgment in civil procedural law that can be executed first, even though it does not yet have permanent legal force (inkracht van gewijsde). In the context of small claims court, the issuance of an immediate executable judgment raises questions regarding its legitimacy and implications for the principles of justice and legal certainty. This research aims to analyze the legitimacy of issuing immediate executable judgment in small claims court cases through juridical aspects. The research method used is normative juridical with a normative legal research approach and a conceptual approach. The data used includes relevant legal regulations, court decisions, and relevant legal literature. The research results indicate that judges have the authority and legitimate legitimacy to issue immediate executable judgment when examining, adjudicating, and deciding small claims court cases while still adhering to the strict terms and conditions outlined in Article 180 paragraph (1) of the HIR and Article 191 paragraph (1) of the RBg junctis SEMA Number 3 of 2000 concerning Immediate Executable Judgment (Uitvoerbaar bij Voorraad) and Provisional, to ensure aspects of legal certainty, usefulness, and justice.
