Abstract

After the fall of Suharto regime, some local governments in Indonesia have adopted Shari’a by-laws. Several studies suggest that this adoption of Shari’a by-laws was influenced mostly by the political motives of the local elites. They used such by-laws as a strategy to gain political supports from Muslim voters. They also used the by-laws to facilitate bribery and electoral corruption using social and religious instruments and to distract people’s attention from ongoing corruption. Although it confirms the political motives behind the adoption of the Shari’a by-laws, this paper suggests that such political motives may not the only factors leading to the introduction of Shari’a by-laws. Based on the study of the political and religious backgrounds of the district heads, who were elected in the local elections between 2008 and 2013, in the six major provinces, this paper indicates that political motives do not play alone. The district heads’ religious backgrounds can be the other important factors contributing to the adoption of Shari’a by-laws by some local governments in Indonesia.Key words: Shari’a by-laws, politics, local governments, Indonesia. AbstrakSetelah jatuhnya rezim Suharto, beberapa pemerintah daerah di Indonesia menerapkan peraturan daerah bernuansa Syariah (perda Syariah). Beberapa kajian berpendapat bahwa pengadopsian perda Syariah ini banyak dipengaruhi oleh motif politik dari para elit daerah. Mereka menggungaka perda tersebut sebagai strategi untuk mendapatkan dukungan politik dari para pemilih Muslim. Mereka pula menggunakan perda tersebut sebagai transaksi suap dan kecurangan elektoral untuk mengalihkan perhatian masyarakat dari korupsi yang tengah berlangsung di Indonesia. Meskipun artikel ini menegaskan adanya motif politik di balik penerapan perda Syariah, artikel ini berpendapat bahwa motif politik tersebut bukanlah satu-satunya factor yang mengarahkan pada permulaan diterapkannya perda Syariah. Berdasarkan kajian pada latar belakang politik dan keagamaan dari para Bupati, yang mana terpilih pada pemilihan umum dari tahun 2008-2013 di enam provinsi besar, artikel ini menunjukkan bahwa motif politik tidak bermain sendiri. Latar belakang keagamaan para Bupati dapat menjadi factor penting lainnya yang berkontribusi pada penerapan perda Syariah oleh beberapa pemerintahan daerah di Indonesia.Kata Kunci: perda Syariah, politik, pemerintah daerah, Indonesia

Abstract

AFTER the previous edition of JILS raised the theme of “Crimes and Society: General Issues on Criminal Law in Indonesia”, in this edition JILS wanted to explore various cases and developments in criminal law enforcement. The complexity of criminal law enforcement in many conditions presents a variety of debates, ranging from legality and non-retroactive principles of law which in certain cases find discrepancies between facts and existing theories. In addition, criminal law which is considered ultimum remedium and has the character of a double-edged sword, on the one hand protects the interests of victims and the public but on the other hand injures the rights of the accused, becomes very complex because of its relation to the protection of human rights. In order to provide the most up-to-date discourse in the development of criminal law enforcement, in this edition we take the theme “Penal Policy and The Development of Criminal Law”. This theme provides a different perspective for readers relating to criminal law policy and formulation of criminal law enforcement. In this edition, we received a large number of articles sent to the editorial desk, therefore it requires considerable time in choosing, reviewing and giving our best feedback and comments to the authors. To highlight the development of criminal law enforcement, this Journal volume is dedicated to discuss several issues related to the penal policy and development of criminal law enforcement.

Abstract

Dalam tata kelola pemerintahan desa, Perdes sangat krusial karena menjadi dasar hukum bagi pelaksanaan berbagai program dan kegiatan desa.Penjelasan tentang tugas dan wewenang Kepala Desa dan anggota BPD di atas menunjukkan bahwa wewenang penetapan Peraturan Desa ada di Kepala Desa.Tetapi penetapan tersebut hanya bisa dilakukan setelah Rancangan Perdes dibahas dan disepakati bersama BPD.Selain itu, inisiatif untuk mengajukan Perdes tidak hanya berada di tangan Kepala Desa, tetapi juga ada di tangan para anggota BPD. Di sini tampak bahwa Kepala Desa merupakan badan eksekutif di tingkat desa, yang bekerja bersama BPD sebagai badan legislatifnya. Di sini kemampuan teknis untuk membuat Perdes tidak hanya menjadi kebutuhan kepala desa atau perangkat desa yang memiliki tugas terkait, namun juga penting diketahui oleh para anggota BPD. Sayangnya, tidak semua anggota BPD memiliki kemampuan teknis untuk menyusun Perdes.Baik karena alasan tingkat pendidikan, maupun karena alasan latar belakang pendidikan yang tidak terkait dengan hukum. Karena itu, kegiatan pengabdian masyarakat yang bertemakan ?Pelatihan Penyusunan Teknis Peraturan Desa Untuk Aparatur Desa Dan BPD di Kecamatan Mrebet Kabupaten Purblalingga? telah dilaksanakan dalam rangka memberikan pemahaman kepada Aparatur Desa dan BPD dalam membuat Perdes.

Abstract

Organisasi mahasiswa merupakan wadah untuk mengembangkan diri mahasiswa. Selain itu, organisasi mahasiswa juga merupakan wadah untuk menyampaiakn aspirasi mahasiswa kepada pemangku kepentingan di Perguruan Tinggi. Saat ini banyak sekali organisasi mahasiswa dan bahkan hampir semua Program Studi mempunyai organisasi mahasiswa. Program Studi Magister Ilmu Hukum juga mempunyai organisasi mahasiswa yaitu organisas mahasiswa Magister Ilmu Hukum. Kenyataannya tidak semua Program Studi Magister Ilmu Hukum mempunyai organisasi tersebut. Menariknya organisasi mahasiswa Magister Ilmu Hukum mempunyai permaslahan yang berbeda-beda. Hal tersebut dikarenakan beberapa faktor yang melatarbelakangi lahirnya permasalahan yang berbeda. Artikel ini mengulas terkait dengan permasalahan yang dihadapi oleh organisasi mahasiswa Magiter Ilmu Hukum. Artikel ini juga memberikan rumusan model penguatan kelembagaan organisasi mahasiswa Magister Ilmu Hukum.

Abstract

today’s global era. While the internationalization of higher educationhas been defined as “the process of integrating an international,intercultural and global dimension into the goals, teaching/learning,research and service functions of a university or higher educationsystem” (Knight, 2014), the internationalization of legal education refersto such a process at the schools of law around the world. Severalfactors have contributed to the increasing need for such aninternationalization of legal education. These factors include theincreasing demand for transnational legal practices and the emergenceof legal problems that occurred across international boundaries. Thisarticle discusses the internationalization of legal education in Indonesia,focusing on the practice of international program offered by Faculty ofLaw at Universitas Negeri Semarang. The article analyzes the strengthsand opportunity of the program as well as its weaknesses and threats.The picture of the international program at the Faculty of Law atUniversitas Negeri Semarang may not reflect the general picture of theinternational programs in many Faculties of Law at Indonesianuniversities. However, it can provide a glance on how theinternationalization of legal education has been practiced by a publicuniversity in Indonesia. The article starts with a discussion ontheoretical views on the internationalization of legal education. Then itpresents why internationalization of legal program is needed and howit should be practiced in the Indonesian context. It then provides acritical analysis on the practice of international law program atUniversitas Negeri Semarang. Some strengths and weaknesses of theprogram are discussed. A recommendation to improve the quality ofthe international program at the Indonesian Faculties of Law ispresented afterwards.

Konflik tersebut pada gilirannya berujung pada terjadinya pro dan kontra di kalangan berbagai kelompok kepentingan. Hal ini bisa dilihat dari berbagai macam polemic di media massa, debat di event-event public, maupun beragam aksi demonstrasi yang dilakukan oleh para pendukung atau penentang kebijakan. Dalam konteksi Indonesia, pro dan kontra tersebut dapat dilihat misalnya dalam proses legislasi UU No. 20/2003 tentang Sistem Pendidikan Nasional dan UU No. 7/2004 tentang Sumber Daya Air.
