Abstract

The establishment of places of worship in Indonesia is a critical issue that intersects with legal and political concerns, yet the regulatory framework governing such establishments remains insufficiently codified. Currently, the guidelines for the establishment of places of worship are outlined in the Joint Regulation of the Minister of Religious Affairs and Minister of Home Affairs Number 9 and Number 8 of 2006 (PBM 2006). However, these regulations are not formal laws and fail to provide adequate legal guarantees and protection for all citizens to practice their religion freely. This study uses a normative juridical approach, employing legal, historical, and conceptual methods to argue that the regulations surrounding the construction of places of worship require a comprehensive legal reconstruction. The research analyzes the issue from a legal-political and land law perspective. From a political-legal viewpoint, it is clear that the PBM 2006 does not align with Indonesia's legal ideals. The regulation contains discriminatory provisions that contradict the principles of a unified state, social justice, democracy, and religious freedom. Places of worship are not only a necessity but also a fundamental expression of belief, guaranteed by the Indonesian Constitution. Therefore, regulations governing the construction of places of worship should be enacted as laws, rather than as ministerial regulations. The study concludes that a formal legal framework for the establishment of places of worship, in the form of a law, is urgently needed. Such a law would ensure equal protection for all citizens and foster social justice, thereby protecting the rights of Indonesia’s diverse population to worship in accordance with their beliefs.

Abstract

This study aims to analyze the effect of the extension of the term of office of the village head on resource management and the performance of village officials in Gandon Village, Kaloran Subdistrict, Temanggung Regency. The formulation of the problem raised includes the effect of the extension of the term of office on the management of village resources and the performance of village officials. The method used in this research is empirical juridical research with a statutory approach and interviews as data collection techniques. The results showed that the extension of the term of office of the village head can provide stability in leadership, which supports more effective planning and implementation of development programs. However, there are challenges in the form of potential delays in elite circulation and gaps in technological understanding among village officials. Community involvement in the decision-making process and transparency in village financial management are important factors to maintain public accountability and participation. This study recommends the need for training for village officials and increased community participation to achieve better development outcomes in the village.

Abstract

Peraturan hukum di Indonesia tidak hanya mengatur warga negara pada umumnya, tetapi pejabat negara juga ikut masuk dalam peraturan hukum. Hal ini merupakan konsekuensi logis dari sebuah bentuk negara hukum yang di anut oleh para the founding fathers dan mothers Republik Indonesia. Pejabat Tata Usaha Negara atau sering kali disebut dengan Pejabat TUN, tidak bisa lepas dari tanggung jawab hukum bilamana pejabat TUN melaksankan kebijakan bertentangan dengan undang-undang. Undang-Undang No. 51 Tahun 2009 tentang Perubahan Kedua atas UndangUndang No. 5 Tahun 1986 Tentang Peradilan Tata Usaha Negara (UU Peradilan Tata Usaha Negara) mengatur terdapat dua jenis eksekusi putusan pengadilan tata usaha negara yang dalam doktrin biasa dikenal sebagai eksekusi otomatis dan eksekusi hierarkis. Dalam eksekusi hierarkis maka dibutuhkan kesadaran hukum dari pejabat pemerintahan untuk melaksanakan putusan peradilan tata usaha negara yang telah berkekuatan hukum tetap. Seringkali pejabat pemerintahan tidak bisa atau tidak mau melaksanakan putusan tersebut dengan berbagai alasan yang membuat seolah-olah peradilan tata usaha negara tidak memiliki wibawa untuk memaksa pemerintah melaksanakan putusannya.

Abstract

Land waqf as a legal institution known in Islamic law has gained a strong position in Indonesian national law based on Law Number 41 of 2014 concerning Waqf. The understanding and practice of land waqf, which has been partly carried out verbally on the basis of mutual trust, has not provided optimal legal certainty and legal protection. In the community, legal literacy is increased in the context of land waqf. Land waqf legal actions that have been carried out based on Islamic law must also be carried out with due regard to national law. The legal act of waqf land must be carried out before the authorized official and registered with the Land Office. The waqf pledge must be made before the registrar of the waqf pledge to be further recorded in the waqf pledge deed. The Waqf Pledge Deed is written evidence in the land registration at the Land Office, as the basis for the issuance of the Waqf Land Certificate. Land Waqf Certificates are issued in order to realize legal certainty and legal protection of land waqf. The regulation of land waqf in the Waqf Law and its implementing regulations further confirms waqf as an important and useful institution for efforts to realize community welfare, in line with the goals of state life.

Abstract

Birokrasi sebagai struktur, sistem, dan tatanan aturan yang ditetapkan dalam mengendalikan aktifitas organisasi pada sistem administratif penyelenggaraan negara dengan arah tujuan peningkatan kualitas pelayanan publik, akuntabilitas kerja, dan terhindar (korupsi, kolusi, nepotisme). Kebijakan pada dasarnya bentuk tindakan, kebijaksanaan, dan keputusan (eksekutif, legislatif, yudikatif) berdasarkan aturan hukum yang berlaku. Era disruptive innovation mengalami perkembangan teknologi informasi komunikasi, pergerakan kebijakan pemerintah berpengaruh besar pada birokrasi pelayanan publik khususnya disektor penerbangan. Hal ini menempatkan kenyataan bahwa tranportasi udara sangat penting sebagai penunjang aktivitas tiap individu diera kini dan dimasa yang akan datang. Harapan besar rakyat mendapat rasa keadilan, kesetaraan, jaminan, perlindungan, kesempatan, keamanan dan kenyamanan setiap pengguna jasa bandar-udara. Ekspektasi birokrasi pelayanan publik sesungguhnya patuh terhadap tatananan sistem prosedur dan aturan hukum yang berlaku untuk kepentingan bersama. Terobosan inovasi modern penyelenggaraan pelayanan publik mengedepankan standar transparansi sebagai bentuk (keadilan, kepastian, jaminan), serta menyiapkan SDM-multifaset yang memberikan pelayanan prima-excellent.

Abstract

The construction of Pantai Indah Kapuk 2 (PIK 2), a waterfront city mega-project in Tangerang, Indonesia, has raised legal, social, and environmental concerns. While designated as a National Strategic Project (PSN) due to its economic benefits, such as job creation and green tourism development, the project has caused significant adverse impacts. Specifically, a 30-kilometer sea fence obstructed access for approximately 4,000 fishermen, resulting in an estimated economic loss of IDR 16 billion since September 2024. This study examines the constitutionality of sea privatization through land certificates (SHM and SHGB) issuance and evaluates government responses to this issue. Using a normative juridical approach, the research analyzes legal frameworks governing coastal resource management, including UNCLOS 1982 and Indonesian laws such as Law No. 27/2007 and Law No. 26/2007. The findings reveal that government actions—sealing the area, dismantling the sea fence with military assistance, and revoking SHM/SHGB—align with regulations but lack systemic coordination. Key issues remain unresolved: criminal prosecution of perpetrators, economic restitution for affected fishermen, and environmental rehabilitation. This article proposes a systemic approach to restoring fishermen's rights through criminal enforcement against illegal actors, financial compensation for economic losses, ecosystem restoration, and strengthening public participation in spatial planning. Drawing lessons Australia's Community Participation Plans (CPP), the study emphasizes inclusive development that balances economic growth with social justice and environmental sustainability.
