Abstract

Salah satu persoalan terkait regulasi di Indonesia adalah adanya tumpang tindih atau disharmoni peraturan perundang-undangan. Problem ini terjadi, baik secara vertikal maupun horisontal. Negara melalui pemerintah sesungguhnya telah melakukan berbagai upaya dalam rangka menyelesaikan problem tersebut. Namun faktanya, disharmoni regulasi masih saja terjadi. Pemerintah perlu melakuka upaya ekstra untuk mengatasi persoalan tersebut. Salah satu yang bisa dilakukan adalah dengan membentuk lembaga independen, yang memiliki kewenangan untuk mecegah dan mengatasi problem disharmoni berbagai produk hukum dan peraturan perundang-undangan di negara ini. Artikel ini menawarkan rumusan lembaga independen yang tepat dan efektif untuk mengatasi masalah tersebut. Pertama, artikel ini akan menguraikan problem disharmoni regulasi dan pentingnya penataan peraturan perundang-perundangan di Indonesia. Kedua, artikel ini menawarkan rumusan lembaga independen yang tepat, dengan kewenangan khusus, untuk mengatasi problem kusut terkait penataan regulasi. Kewenangan tersebut di antaranya meliputi judicial review terhadap berbagai regulasi, sekaligus kewenangan untuk melakukan kajian dan memberikan rekomendasi dalam penataan regulasi.

Abstract

Birokrasi sebagai struktur, sistem, dan tatanan aturan yang ditetapkan dalam mengendalikan aktifitas organisasi pada sistem administratif penyelenggaraan negara dengan arah tujuan peningkatan kualitas pelayanan publik, akuntabilitas kerja, dan terhindar (korupsi, kolusi, nepotisme). Kebijakan pada dasarnya bentuk tindakan, kebijaksanaan, dan keputusan (eksekutif, legislatif, yudikatif) berdasarkan aturan hukum yang berlaku. Era disruptive innovation mengalami perkembangan teknologi informasi komunikasi, pergerakan kebijakan pemerintah berpengaruh besar pada birokrasi pelayanan publik khususnya disektor penerbangan. Hal ini menempatkan kenyataan bahwa tranportasi udara sangat penting sebagai penunjang aktivitas tiap individu diera kini dan dimasa yang akan datang. Harapan besar rakyat mendapat rasa keadilan, kesetaraan, jaminan, perlindungan, kesempatan, keamanan dan kenyamanan setiap pengguna jasa bandar-udara. Ekspektasi birokrasi pelayanan publik sesungguhnya patuh terhadap tatananan sistem prosedur dan aturan hukum yang berlaku untuk kepentingan bersama. Terobosan inovasi modern penyelenggaraan pelayanan publik mengedepankan standar transparansi sebagai bentuk (keadilan, kepastian, jaminan), serta menyiapkan SDM-multifaset yang memberikan pelayanan prima-excellent.

Abstract

The Aboge Islamic community in Onje Purbalingga has been one of the most prominent Aboge communities in Central Java. Every year, this community is the subject of media attention due to its different method for determining the beginning of the months of Ramadan and Shawwal. In Onje, the Aboge used to be the majority. Everyone in the village started their fasting for Ramadan and celebrated their Eid based on the Islamic Aboge calendar. The Aboge imam previously had significant influence on religious and socio-cultural life in the community. However, this influence is waning. The Aboge are no longer the majority in the village. This paper provides an analysis on why Aboge Imams started to lose their religious authority in the community. Why did some members of the community adhere to Aboge Islamic traditions while others did not? Using an ethnographic method, this paper argues that the decline of Aboge leaders' influence is shaped not only by the challenges of modernity, but also a process of bureaucratizing sharī‘ah as well as the weak institution of the local Aboge community.

Abstract

The purpose of this paper is to analyse the fulfillment of the right to rehabilitation for addicts and victims of narcotics abuse in Indonesia in the perspective of the right to a fair trial. The research method used in normative legal research is because the focus is to study written law from various aspects, such as theory, history, philosophy, structure and composition, scope and material, article by article and general explanation, formality and binding force of a law and the legal language used. The approach used in this study is the approach Statute Approach which is an approach to review legislation related to research themes, Analytical & Conceptual Approach which is an approach by studying views and doctrines that develop in legal science. The mechanism for applying rehabilitation sanctions itself is based on an assessment, assessment is known to be an assessment action to find out the condition of residents due to drug abuse which includes medical aspects and social aspects, this is what must be done by law enforcement officials to guarantee their rights as suspects such as the Justice Fair Trial Principle. The central-level Integrated Assessment Team (TAT) is determined by the National Narcotics Agency (BNN), after coordinating with the Ministry of Health, the National Police, the Indonesian Prosecutor's Office, and the Ministry of Law and Human Rights (BAPAS), related to the application of rehabilitation sanctions against addicts and victims of narcotics abuse, after obtaining approval from each of these agencies.

Abstract

The Supreme Court has issued Supreme Court Regulation No. 7 of 2022, which has significant impacts despite generating various societal opinions. It is important to evaluate the implementation of this regulation to ensure the presence and effectiveness of compliance in the electronic court proceedings. The conceptual framework of this research is based on the concepts of e-court services and electronic courts, with the theories employed including policy implementation theory, legal certainty, effectiveness, and legal system theory. The Normative Juridical approach is a legal research method emphasizing the study of norms or legal rules stipulated in legislation. The findings indicate that the implementation of e-court services is outlined in Supreme Court Regulation Number 7 of 2022. Courts must prepare skilled judges and provide adequate infrastructure. The implementation of e-court has successfully increased the efficiency of legal processes and reduced the administrative and financial burden on the parties involved in cases. This research concludes that the implementation of e-court services has brought about increased efficiency in the proceedings of religious civil cases. Recommendations for improvement include conducting evaluations to ensure that all case resolutions through e-court services comply with the letter from the Director General of the Religious Courts Agency dated June 7, 2024, No. 1295/DJA/HK2.6/VI/2024.

Abstract

Upaya membumikan Pancasila di negeri ini masih menghadapi banyak tantangan. Salah satunyaterlihat dari adanya perlakuan diskriminatif yang diterima kelompok-kelompok minoritas, sepertiJemaat Ahmadiyah dan pengikut Syiah. Artikel ini bertujuan untuk merumuskan merumuskanstrategi membumikan Pancasila, terutama dalam upaya melindungi kelompok agama ataukeyakinan minoritas. Ada tiga pembahasan yang dikaji dalam tulisan ini yaitu (1) pemaksaan dankriminalitas terhadap kelompok minoritas; (2) ruang publik untuk ekspresi semua kelompok; dan(3) strategi membumikan Pancasila untuk melindungi minoritas. Ada tiga strategi yangdirekomendasikan dalam artikel ini: (1) Penanaman nilai-nilai Pancasila harus lebih dilakukansecara bottom up; (2) Penguatan jiwa Pancasila dengan menjadikan negara atau pemerintahsebagai lokomotif; dan (3) Penguatan peran pemerintah dalam rangka menjaga kesinambungandan keberlanjutan upaya membumikan Pancasila. Peran pemerintah dapat dilakukan salahsatunya melalui peran BPIP. Namun demikian, perlu ada penguatan BPIP secara kelembagaandan kewenangan. Hal ini agar BPIP mampu menjadi lokomotif bangsa dalam membumikanPancasila. Simpulan dalam penelitian ini terdiri dari tiga hal sebagai jawaban terhadappermasalahan.

Abstract

Indonesian universities are increasingly expected to enhance their international reputation, particularly in comparison to Malaysian institutions, which have achieved higher global rankings. Key indicators of international recognition include publications, citations, and research. This study aims to compare the use of digital media by universities in Indonesia and Malaysia in supporting these indicators. The research will address three main questions: the role of government regulations and facilities in both countries in shaping university reputation, how universities utilize their official websites or portals, and the similarities and differences in digital strategies. A qualitative comparative approach will be applied, using primary data from regulations and university portals, along with secondary sources such as interviews, literature, and media. Relevant regulations include Indonesia’s Higher Education Law and Malaysia’s Education Act 1996. This study focuses on the digital presence of Universitas Negeri Semarang (Indonesia) and Universiti Teknologi MARA (UiTM) Malaysia. While both institutions utilize digital platforms, UiTM has shown more advancements in e-learning and digitizing administrative processes. In contrast, Universitas Negeri Semarang continues to improve its digital content to enhance accessibility and interactivity. By analyzing these approaches, this study seeks to highlight best practices and areas for improvement, ultimately contributing to the broader effort of strengthening Indonesian universities’ global standing.

Abstract

Micro, Small, and Medium Enterprises are business activities that can expand employment and provide extensive economic services to the community. They can also play a role in equalizing and increasing public income, promoting economic growth, and contributing to national stability. In addition, Micro, Small, and Medium Enterprises are one of the main pillars of the national economy that must get the most opportunities, support, protection, and development as a form of firm partiality to the people's economic business groups, without neglecting the role of Large Enterprises and State-Owned Enterprises. In Law No. 11 of 2020 concerning Job Creation, simplification of Business Permissions through Integrated Online Licensing (Online Single Submission). Mergosari Village became the first to produce batik with a typical Wonosobo motif through the Batik Mergosari community named Batik Carica Lestari. The problems partners face include the lack of knowledge and understanding of small- and medium-sized business actors in Mergosari Village regarding the legal aspects of business actors, which still need to be improved. The solution to this problem is to provide education using lectures and seminars with village officials and small and medium enterprises of Mergosari Village, and small and medium enterprises should have a Business Master Number (NIB). The method of service is to provide education through socialization and mentoring practices.

Abstract

The objective of this article is to examine the extent to which the implementation of Islamic law in Aceh has affected the civil rights of non-Muslim groups. Its focus is on their access to bureaucracy and public services after the implementation of Islamic sharia. The article seeks to answer these questions: (1) What is the opinion of the non-Muslim communities in Aceh on the implementation of Sharia law and its impacts on their lives in Aceh? (2) Do they experience discrimination when it comes to bureaucracy, government, and access to public services after the special autonomy status granted in Aceh? (3) What is the strategy for strengthening access to bureaucracy and public services for non-Muslim community in Aceh? To answer this question, the author conducted research using a qualitative approach with a purposive sampling technique involving seven informants ranging from local bureaucrats, interfaith leaders and non-moslem NGO to utilizes in-depth explanation to assess the accessibility of public services and bureaucratic systems under the implementation of Sharia law. The article indicates that there has been a shifting opinion among non-Muslims in Aceh before and after the implementation of Islamic Sharia in Aceh. Before the implementation of Islamic law, they had a slanted view of Islamic law. But after the implementation of Islamic Sharia, their views have changed positively. When dealing with bureaucracy and public services, non-Muslims generally do not feel any discrimination. However, there have been instances where non-Muslims faced difficulties in obtaining permits for activities.
