Abstract

The role of a leader and his ability to manage an institution are benchmarks for the success of that institution. This research aims to analyze the extent of involvement of Islamic boarding school leaders in managing learning. In detail, the researcher wants to describe the role of Islamic boarding school leaders in planning learning, implementing learning and their role in coordinating and evaluating post-learning processes. The reason the researcher raised this theme was based on the fact that an Islamic boarding school leader has busier activities outside the Islamic boarding school environment, than within his own Islamic boarding school environment. So that the management of the institution is entrusted to subordinates. The research method used is descriptive qualitative research. The data collection techniques are through interviews, observation and documentation studies. The collected research data is then analyzed by reviewing all the data obtained in the field and arranged in a more systematic manner. The results of the research show that Islamic boarding school leaders have carried out their role as fully as possible in managing learning in accordance with the leadership's functions and duties which are based on functions in management.

Abstract

The prohobition of TikTok Shop in Indonesia has sparked debate over licensing and Shariah compliance. This article emphasizes the importance of using Shariah principles in social e-commerce at TikTok Shop. This research aims to analyze the rationale behind this from the perspective of fiqh and economic justice. This research uses a juridical-normative approach by analyzing relevant regulations using a descriptive-analytical method. Data was collected through a literature review, highlighting the importance of considering maslaha to maintain market stability and economic justice. The banning on TikTok Shop to ensure Shariah compliance to achieve economic justice. Government regulations or policies are beneficial, extending beyond mere prohibitions and restrictions. As commerce evolves with the expansion of digital platforms, it becomes imperative to establish clear regulations to accommodate this ongoing development.

Abstract

This research aims to examine the concept of Ulil Amri as described in the Quran and Sunnah, and how obedience to Ulil Amri is applied in the context of nationhood, particularly within modern political systems. The research uses a qualitative method with a descriptive-analytical approach, focusing on the interpretation of religious texts and related literature. Primary data sources include the Quran, Hadith, and the commentaries of classical and contemporary scholars, such as Ibn Qayyim, Al-Tabari, and Yusuf Al-Qaradawi. The main findings indicate that obedience to Ulil Amri has clear limitations, particularly when leaders do not govern in accordance with Islamic law. Additionally, the concept of Ulil Amri faces challenges in the modern era, especially in countries that do not fully implement Sharia law. The role of scholars in ensuring that leaders' policies remain aligned with Islamic values has become increasingly significant. The research concludes that obedience to Ulil Amri remains relevant; however, Muslims must balance this obedience with constructive criticism through the principle of Amar Ma’ruf Nahi Munkar when necessary. Consequently, this study suggests that the concept of Ulil Amri in Islam can be dynamically applied within the framework of modern governance.

Abstract

Produk halal menjadi penyumbang terbesar perekonomian negara. Hal ini tentunya harus menjadi perhatian utama pemerintah dalam mengembangkannya. UMKM di Indonesia dengan berbagai produk halalnya mendapat perhatian khusus dari pemerintah di Indonesia. Tujuan dari penelitian ini adalah untuk menjelaskan perhatian negara dalam hal regulasi yang ada terkait UMKM dan pertumbuhan ekonomi Indonesia. Penelitian ini merupakan penelitian kepustakaan yang menggambarkan pendapat para praktisi. Hasil kajian menunjukkan bahwa pemerintah telah memberikan perhatian kepada para pelaku usaha di Indonesia yang dibuktikan dengan aturan-aturan yang ditetapkan dan dilaksanakan di Indonesia. Untuk kemajuan produk halal UMKM dan pertumbuhan ekonomi di Indonesia, masyarakat Indonesia dapat bergerak di bidang produk halal dan harus mampu bersaing sebagai produsen serta memperhatikan berbagai aspek, baik komunikasi, teknologi, pasar, dan lain-lain.

Abstract

The challenge of mandatory halal regulations contained in Law Number 33 of 2014 concerning Halal Product Guarantees (UU JPH) and its derivatives, means that products entering, circulating and being traded in Indonesian territory must be halal certified. However, until now there are still micro and small enterprises (MSEs) in Indonesia that have not fulfilled this requirement. So the Indonesian government, in this case BPJPH, needs Pentahelix synergy by providing stricter outreach to business actors in its implementation. The aim of this research is to reveal the challenges faced by micro and small enterprises (UMK) throughout Indonesia in fulfilling halal certification obligations. The method used in this research is analytical descriptive analysis, namely describing and analyzing the challenges of micro and small enterprises (UMK) throughout Indonesia in fulfilling halal certification obligations. The research results prove that based on the JPH regulations, there are 3 product groups that must be halal certified as of October 17 2024, namely first, food and beverage products. Second, raw materials, food additives and auxiliary materials for food and beverage products. Third, slaughtered products and slaughtering services. For micro and small enterprises (UMK) throughout Indonesia who have not carried out their halal certification obligations, they will be subject to sanctions in the form of written warnings, administrative fines, and the withdrawal of goods from circulation. It was stated that the sanctions applied were in accordance with the provisions in PP No. 39/2021 concerning the Implementation of the Halal Product Guarantee Sector. Abstract

This study aims to determine Islamic philanthropy in a modern context. Islamic philanthropy is taken from the religious doctrine of the Qur'an and hadith as a human and religious commitment so that Islamic charity appears as zakat, infaq, alms, and endowments. This type of research is qualitative with a literature study method. Data collection techniques in literature study are through books, articles, journals, and research reports related to the problem being researched. The results of the study found that in Indonesia, practices in zakat, waqf, infaq, and sadaqah (Ziswaf) are seen as economic symbols of justice and democracy, being able to place economic resources in their proper place. In conclusion, Islamic philanthropy in the modern context is a stylish way of managing one's social generosity in the context of carrying out muamalah activities among fellow human beings.

Abstract

Along with the advancement of information and communication technology (ICT), the form of public participation has undergone a significant transformation from conventional to digital. This study aims to analyze the effectiveness of the implementation of digital-based public participation (e-Participation) in Indonesia, as well as to evaluate the regulatory and implementation challenges that hinder the realization of democratic, inclusive, and comprehensive public participation. The research method used is a normative juridical method (legal research) with a conceptual statute approach and a bibliography study. The results show that in its implementation, e-Participation in Indonesia still faces various obstacles, both from ambiguous regulations and from technical limitations and public participation. Based on factual data and findings, e-Participation has not been fully able to encourage broad and sustainable public involvement in the policy-making process. Therefore, reformulation and optimization of e-Participation are needed, both normatively through strengthening the legal framework, and technically through improving digital infrastructure, public literacy, and coordination between government agencies.

Abstract

The purpose of this study is to analyze the reconstruction of Islamic sharia implementation policies during the Islamic Empire in Indonesia from the perspective of siyasah syar'iyyah and their relevance to Indonesian government policies in regulating Islamic financing instruments in Cash Waqf Linked Retail Sukuk (CWLS Retail). The statutory approach and descriptive analysis are used in this research. Sources of data were obtained from various literary materials both from books, journals and the internet, as well as other relevant sources regarding the politics of Islamic law (siyasah syar'iyyah) during the Islamic period and its relevance to the regulation of Islamic financing instruments in Indonesia, especially with regard to the application of retail sukuk cash waqf (CWLS Retail). The results of the study show that first, the political application of Islamic law during the Islamic empire in Indonesia was carried out through the politics of the king's power (ruler). Second, the application of political Islamic law has relevance to current Indonesian government policies, namely in regulating Islamic financing instruments for Cash Linked Retail Sukuk (CWLS Retail), where the Government through various Islamic policies is embodied through laws, government regulations, MUI Fatwa, and other regulations. However, implementing this policy requires 6 variables of Islamic politics (siyasah syar'iyyah) in the opinion of Ibn Khaldun, namely mutual synergy between law, government, society, economy, development and justice.

Abstract

The increasing number of civil disputes in Indonesia has created an urgency to find more effective dispute resolution methods to alleviate the burden on the judiciary. This study aims to compare the effectiveness of mediation and arbitration in dispute resolution, as regulated by Supreme Court Regulation No. 1 of 2016 and Law No. 30 of 1999. The normative juridical method was chosen to analyze the relevant legal framework to understand the strengths, weaknesses, and legal impacts of these two methods. This analysis also includes Roscoe Pound’s theory of legal efficiency and Satjipto Rahardjo’s progressive law approach, which emphasizes the importance of legal adaptability. Through this approach, the study is expected to provide comprehensive insights to assist legal practitioners, business actors, and the public in selecting the most appropriate method for efficiently resolving civil disputes. The research finds that mediation and arbitration have distinct advantages in resolving civil disputes in Indonesia; mediation is effective for maintaining relationships and cost-efficiency, while arbitration provides legal certainty with final decisions. Mediation, though fast, relies on formal agreements to be binding, whereas arbitration is more costly and does not permit appeals except under certain circumstances. Understanding these strengths and limitations helps stakeholders choose the most appropriate method to achieve substantive justice and efficiency in practice.
