Abstract

Penelitian ini dilatarbelakangi ketidakjelasan  makna larangan campur tangan urusan peradilan dalam Pasal 3 ayat (2) UU No. 48 Tahun 2009 tentang Kekuasaan Kehakiman yang berimplikasi pada arah makna tersebut, dimana dalam prakteknya telah banyak kasus-kasus  dalam tingkat ketatanegaraan dan peradilan yang nota bene dapat diselaraskan dengan Contempt ofCcourt/CoC.  yang mempengaruhi kewibawaan hakim dan badan peradilan. Metode yang digunakan melalui penelitian hukum bahan-bahan hukum, dengan analisis preskriptif. Tujuannya adalah untuk mengetahui dan menganalisis hubungan campur tangan dalam Pasal 3 ayat (2) UU No., 48 Tahun 2009 tentang Kekuasaan Kehakiman berkaitan dengan Contempt of Court, dan diperlukannya kebijakan hukum pidana ke depan.Adapun hasil dan pembahasan ditemukan bahwa antara makna campur tangan urusan peradilan pada Pasal 3 ayat (2) undang-undang di atas hakekatnya tidak berbeda dengan perbuatan penghinaan pengadilan (contempt of court) dimana terdapat sebagian masyarakat yang memandang hal tersebut berbeda, misalnya adanya upaya untuk menyusun pengaturannya melalui RUU CoC dan perubahan KUHP yang mengatur Tindak Pidana dalam Penyelenggaraan Peradilan. Kebijakan hukum pidana yang mengadopsi hukum sebagai satu kesatuan sistem sangat kompeten dalam mengatur implikasi atas norma Pasal 3 ayat (3) undang-undang di atas dengan cara mengusulkan perubahan undang-undang tersebut sebagai hukum pidana khusus ke depan. Kesimpulannya bahwa terdapat hubungan antara Pasal 3 ayat (2) UU No. 48 Tahun 2009 tentang Kekuasaan Kehakiman dengan perbuatan penghinaan pengadilan untuk menentukan arah perubahan UU No. 48 Tahun 2009 tentang Kekuasan Kehakiman melalui Pasal 3 ayat (2) UU tersebut yang hasilnya sebagai kebijakan hukum pidana (hukum pidana khusus).

Abstract

This study aims to find out the sustainable cultural development: the future of balinese adat village posterior the enactment of law number 6 year 2014 concerning village . This research is done empirically juridically, that is by collecting data by researching and examining legal implications posterior the enactment of Law Number 6 of 2014 regarding Village. In the sense of Explanation Article 6 Act Number 6 Year 2014 that stating: “This provision is intended to prevent the intersection in regions in term of authority, institutional duplication between Desa and Desa Adat within the same region, In contradiction, in case the Balinese and the Bali regional government as well is intended to chose the desa adat/desa pakraman to be registered with the hope to the only receive a village financial empowerment every year from the Government, should personally advice that there will be a number of legal consequences with the fate and future of existence and the life of desa adat/desa pakraman as a social and cultural system of Balinese Hindu community in particular and the whole traditional adat communities in the multicultural country of Indonesia in general.

Abstract

The essence of the environment is actually the essence of human life. It refers to the air, water, land, forest, river, lake, coast, sea, oil and gas, mining and mineral, flora and fauna (biological diversity) and everything within the earth and natural resources contained therein. It is, therefore, human environment defined as a unity of the spatial entity with all objects, potentials, conditions and living organisms, including man and his behavior, which influence the continuance of the life and welfare of human being and other living organisms. Abstract

Konsep gugatan perwakilan masyarakat (Class Action) pada mulanya hanya dikenal di negara-negara yang menganut sistem hukum Anglo-Saxon atau Common Law System, seperti Inggris dan Amerika Serikat. Untuk pertama kali gugatan Class Action diatur dalam Supreme Court Judicature Act pada tahun 1873 di Inggris. Kemudian, konsep tersebut diadopsi oleh Amerika Serikat dan dituangkan dalam United State Federal of Civil Procedure pada tahun 1938. pada tahun 1966 dinyatakan secara eksplisit dalam Pasal 23 dari US Federal Rule of Civil Procedure tersebut, khususnya yang mengatur tentang prosedur gugatan Class Action

Abstract

Indonesia telah dikenal sebagai negara yang memiliki keragaman budaya, tercermin dari kekayaan budaya yang meliputi kebhinnekaan suku bangsa, agama, bahasa, dan juga keragaman stratifikasi kehidupan sosial masyarakatnya. Motto Bhinneka Tunggal Ika merupakan refleksi empirik dari keragaman kehidupan sosial dan budaya yang membentuk identitas bangsa Indonesia. Hukum adat adalah salah satu dari produk budaya bangsa Indonesia, khususnya kebudayaan idiil, yang membentuk identitas hukum asli masyarakat Indonesia. Dalam kaitan dengan kebijakan pembangunan hukum nasional semestinya hukum adat menjadi referensi yang patut diperhitungkan untuk memperkaya substansi hukum nasional, karena fakta kemajemukan hukum dalam masyarakat adalah keniscayaan yang tidak dapat dipungkiri dalam dalam kehidupan hukum di Indonesia. Artikel ini mencoba untuk memberi pemahaman yang lebih holistik mengenai kedudukan dan kapasitas hukum dalam kebijakan pembangunan hukum nasional dalam negara dan bangsa yang bercorak kemajemukan budaya.Indonesia has been well known as a multicultural country inSoutheast Asiaregion in term of its ethnic, religion, racial and social stratification. It is, therefore, Unity in Diversity is reflected as an official motto of the State in order to describe the empirical social and cultural diversity ofIndonesia. The diversity refers to a cultural configuration which reflect the Nation identity ofIndonesia, forming elements of cultural capital as well as cultural power that generate the life of Nation State of Indonesia. In the effort of National Law development then questioned whether the existence of adat law as living law and product of culture can be accounted as instrument for enriching substance of National Law? The article attempts to offer answer of the above fundamental question by employing legal anthropology approach with the purpose of obtaining a better understanding holistically regarding the development of National law in multicultural country toward a more just and equitable of State law ofIndonesiain particular.

Abstract

This article analyzes the Indonesian government agrarian reform program to realize equitable and development based on social justice for all the people of Indonesia, viz. the social forestry program. Legally the implementation of the social forestry program must bring maximum benefits to the community around the forest. This article uses the sociological juridical method and takes research locations in the jurisdiction of KPH Probolinggo, BKPH Senduro, and BKPH Kraksaan East Java Regional Division. The results showed that the social forestry program is very important to be implemented, but there are still some problems that need to be fixed.

Abstract

The system of living together creates culture, as each member of the group feels bound to one another. Indigenous communities are groups of people who interact in social relations with a common culture, territory, and identity. In East Sumba, the lack of recognition and protection through the Permendagri has led to differences in perception between indigenous peoples and the government regarding customary land and state assets. Over three decades, national development focusing on economic growth has resulted in disputes between the government, business actors, and indigenous communities. The Permendagri has not yet addressed the dispute resolution process, and no local regulation exists for the transfer of unregistered customary land, creating a legal vacuum. This study uses socio-legal research methods to examine the reality of dispute resolution of customary land rights between the government and the Anamburung Customary Law Community of East Sumba. The research concludes that disputes over customary land rights in this community involve various historical, social, and legal factors, and the lack of socialization regarding customary land status and boundaries allows powerful groups to claim land as state property without community consent.

Abstract

Indeed, corporations serve as the primary consumers of resources and the primary contributors to environmental damage. Indonesia incurs substantial economic losses as a consequence of environmental damage. Corruption frequently contributes to the deterioration of these conditions, resulting in fiscal ramifications for the government that are attributable to environmental damage. This study aims to examine the state financial losses incurred by states as a result of environmental damage. This is normative-jurisprudential research. This research shows that environmental damage ultimately results in a financial loss for the state and must be recouped by the violating corporation. The deterioration of this circumstance is frequently correlated with corruption, leading to financial losses for the government due to environmental damage. Therefore, a comprehensive legal framework is required to maximize the recovery of this damage. Enhancing regulatory transparency concerning the distribution of state funds and calculating losses will ensure the legal validity of efforts to enforce environmental legislation in response to corporate violations. Furthermore, environmental damage affects the populace's well-being, resulting in economic and health repercussions and reduced state revenue. To promote sustainability, the government must regulate financial impacts through education and a greater focus on MSME business lines.

Abstract

This study aims to examine the historical and cultural aspects of Sad Kerthi as a legal terminology that is part of the traditional knowledge of indigenous people in Bali, one of Indonesia’s culturally richest provinces. The recognition and respect for indigenous communities have been a significant topic outlined in Article 18B paragraph (2) of the 1945 Constitution. This Article underpins legislations and regulations aimed to empower indigenous communities to exercise self-governance in their social context within the framework of the contemporary globalised society. By using socio-legal research methods with a statute approach and legal facts, this research finds that the lack of a legal definition of Indigenous people adversely impacts the self-determination of Indigenous people in Indonesia. At the same time, the common problems faced are not unequivocal, by considering Bali, Sad Kerthi as local wisdom is incorporated in Bali Province Act 15/2023. This legislation is further broken down into local regulations that allow Balinese communities to preserve their social structures and self-determination in everyday activities. Based on legal evidence collected from three different types of customary villages in Bali, which are Baliaga, Apanage, and Anyar, the indigenous communities in each of these traditional villages are autonomous and enjoy specific privileges maintained since their ancestors.

Abstract

This research examines the impact of the over-tourism phenomenon on the sustainability of customary law communities in Bali Province, Indonesia. Bali, as one of the most popular tourist destinations in the world, has experienced a significant surge in the number of tourists in the last few decades. This phenomenon triggers various problems, including pressure on the environment, socio-cultural changes, and threats to the sustainability of traditional communities that have long maintained local traditions and values. This research finds that increased tourism has a negative impact on the sustainability of local ecosystems, reduces the traditional practices of indigenous communities, and threatens the local wisdom that is the basis of their cultural identity. This research highlights the need for tourism management strategies that are more sustainable and sensitive to local culture to protect the sustainability of traditional communities in Bali. Therefore, this research offers a new perspective on preserving traditional legal communities in Bali through a tourism management approach that is centered on local values, which has not been widely discussed in previous studies.
