Abstract

This study explores the development of more equitable and humane regulations for addressing personal drug misuse in Indonesia, emphasizing a humanist perspective and the principles of restorative justice. Employing a normative legal research methodology, the study critically examines Articles 111–127 of Law Number 35 of 2009 on Narcotics. It also incorporates a comparative analysis of drug policies in countries that have successfully implemented decriminalization and mandatory rehabilitation, such as the Netherlands and Portugal. The findings highlight the limitations of Indonesia's repressive approach, which often exacerbates social marginalization and fails to address the root causes of addiction. In contrast, the rehabilitative models adopted by the Netherlands and Portugal have proven more effective in reducing the negative impacts of drug abuse and fostering reintegration into society. To alleviate the burden on the criminal justice system and promote a more inclusive society, this study recommends legislative reforms that prioritize social rehabilitation and reintegration over punitive measures. These changes aim to shift Indonesia's drug policy toward a more compassionate and effective framework, balancing public health, social equity, and justice.

Abstract

This study aims to find out the sustainable cultural development: the future of balinese adat village posterior the enactment of law number 6 year 2014 concerning village . This research is done empirically juridically, that is by collecting data by researching and examining legal implications posterior the enactment of Law Number 6 of 2014 regarding Village. In the sense of Explanation Article 6 Act Number 6 Year 2014 that stating: “This provision is intended to prevent the intersection in regions in term of authority, institutional duplication between Desa and Desa Adat within the same region, In contradiction, in case the Balinese and the Bali regional government as well is intended to chose the desa adat/desa pakraman to be registered with the hope to the only receive a village financial empowerment every year from the Government, should personally advice that there will be a number of legal consequences with the fate and future of existence and the life of desa adat/desa pakraman as a social and cultural system of Balinese Hindu community in particular and the whole traditional adat communities in the multicultural country of Indonesia in general.

Abstract

Introduction: One of the important principles regulated in the Bankruptcy Law and Postponement of Debt Payment Obligations is the Going Concern Principle, which can enable a business entity or individual to run again even though it has fallen into bankruptcy, in this case the assets belonging to the debtor can be managed by the curator to obtain income as an effort to fulfill the debtor's debts. gradually to creditors.Purposes of the Research: This research aims to analyze just legal protection for debtors who are respondents to bankruptcy in the Bankruptcy Law and Postponement of Debt Payment Obligations.Methods of the Research: The type of research used is normative juridical, examining positive legal norms with the concept of law as it is written in the book, namely by conducting studies of statutory regulations and literature studies.Results Main Findings of the Research: The application of the principle of business continuity in bankruptcy cases and postponing debt payment obligations is within the framework of legal protection for debtors and has a positive impact on increasing the company's economic value which in turn is used to pay debts to its creditors.

Abstract

Abstrak Penelitian ini mengkaji implikasi hukum dari Pasal 78 Peraturan Pemerintah Nomor 39 Tahun 2023, khususnya terkait ketidakjelasan batas waktu pembayaran ganti rugi dalam pengadaan tanah untuk kepentingan umum. Ketentuan tersebut memungkinkan penundaan tanpa batas waktu yang jelas, sehingga menimbulkan ketidakpastian hukum dan mengancam hak konstitusional pemilik tanah. Tujuan penelitian ini adalah untuk menganalisis dampak normatif dari kekaburan tersebut serta merumuskan formulasi pengaturan yang lebih pasti secara hukum dan adil secara prosedural. Dengan menggunakan pendekatan yuridis normatif, penelitian ini mengacu pada teori keadilan Aristoteles, konsep kepastian hukum Gustav Radbruch, dan prinsip penafsiran peraturan perundang-undangan. Temuan menunjukkan bahwa frasa “hal tertentu” dalam ayat (6) dan (7) membuka celah interpretasi, memungkinkan penyalahgunaan diskresi, serta berpotensi memicu ketidakpercayaan publik dan konflik sosial. Oleh karena itu, studi ini merekomendasikan revisi pengaturan dengan menetapkan batas maksimal penundaan, pemberian sanksi atas keterlambatan, dan penguatan prinsip transparansi. Kebaruan penelitian ini terletak pada fokus terhadap norma waktu sebagai elemen penting dalam perlindungan hukum, yang selama ini kurang mendapat perhatian dalam literatur pengadaan tanah. Temuan ini menjadi semakin relevan di tengah maraknya sengketa ganti rugi yang terus berulang dan merugikan pemilik tanah di berbagai wilayah Indonesia. Keywords: Pengadaan Tanah, Ganti Rugi, Kepastian Hukum, Keadilan, Peraturan Pemerintah Abstract This study examines the legal implications of Article 78 of Government Regulation No. 39 of 2023, particularly the ambiguity surrounding the time limit for compensation payments in land acquisition for public interest. The provision allows for postponement without a clear temporal boundary, leading to legal uncertainty and undermining the constitutional rights of landowners. The objective of this research is to analyze the normative consequences of such ambiguity and propose a more legally certain and procedurally fair regulatory formulation. Using a normative legal approach, the study applies Aristotle’s theory of justice, Gustav Radbruch’s concept of legal certainty, and principles of statutory interpretation. The findings indicate that the undefined phrase “certain conditions” in paragraphs (6) and (7) creates interpretive gaps, enables discretionary abuse, and risks triggering public distrust and social conflict. Therefore, the study recommends revising the regulation to establish a clear maximum postponement period, impose delay penalties, and reinforce transparency standards. The novelty of this research lies in its focus on temporal norms as a crucial component of legal protection, an area largely overlooked in existing land acquisition literature. These insights are particularly urgent amid recurring compensation disputes that continue to affect landowners across Indonesia. Abstract

The criminal act of terrorism is a crime against humanity, human civilization and constitute a serious threat to the integrity and sovereignty of a nation. In fact, terrorism can be a threat to a state security and sovereignty as well as world peace.It is argued that one of the main causes of criminal acts of terrorism is radicalization. Thus, this paper seeks to analyze the casual link between radicalization and terrorism. This paper determines to what extent does the radicalization affected the criminal acts of terrorism. This research uses a juridical normative method by analyzing legal instruments relating to terrorism and seeks to analyze the reason behind the provided rules.This paper submitted that while radicalization affected terrorism, de-radicalization is urgent in responding to terrorism. This paper also proposes how de-radicalization works in preventing terrorism.

Abstract

Corruption has become a serious problem that harms state finances and hampers development. The purpose of this study is to examine the provisions of Article 20 paragraph (7) jo. Article 18 paragraph (1) of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption. This research uses several approaches including a statutory approach and a case approach. Abstract

This research study aims to examine the COVID-19 vaccination policy which is realized nationally in the perspective of the rights and obligations of citizens. This research method uses a normative legal approach, which combines a statute approach and a conceptual approach. The research findings show that health, including the human rights sector, is guaranteed by the constitution and legislation. The health crisis due to the impact of COVID-19 makes the fulfillment of citizens' human rights in the health sector very urgent to implement. Efforts are made to vaccinate in order to stop the spread of the virus and restore all state activities. The realization of the national vaccination program includes the fulfillment of rights and obligations in health facilities guaranteed in Law No. 6/2018 concerning Health Quarantine and Law No. 4 of 1984 regarding the Outbreak of Infectious Diseases. Citizens' rights to health insurance are stipulated in articles 28 and 34 of the 1945 Constitution. The perspective of the obligation in the vaccination program can be seen from Article 28 J paragraph 1 and also 2, the participation of citizens in vaccination is also included in efforts to provide a defense in accordance with Article 27 of the Constitution. 1945. The public may be subject to sanctions if they intentionally or unintentionally obstruct efforts to overcome the epidemic. Vaccination is expected to increase one's own immunity which will encourage the recovery of health, economy and national activities.

Abstract

A good law is a law that is in accordance with the law that lives in the community (living law) and in accordance with the reflection of the values prevailing in the community. In its development, living law has been accommodated in Article 2 paragraph (1) of the National Criminal Code. This research analyzes the formulation of living law provisions in the community in the National Criminal Code and its implications for Judges in making legal considerations in their decisions. This research uses normative juridical research method with statutory, historical, conceptual, analytical, and case approaches. The results showed that the formulation of Laws Living in Society in the National Criminal Code contained 15 provisions with five variations of terms such as “laws living in society”, “norms of decency”, “values of law and justice”, “local customary obligations”, and “fulfillment of customary obligations”, then the implications of laws living in society in the National Criminal Code have consequences for Judges can be a reference for adjudicating cases involving customary law and additional legal considerations. Although there are no Government Regulations and Regional Regulations regarding laws that live in the community, Judges are still obliged to explore legal values and a sense of justice that live in the community.

Abstract

Introduction: This study examines the reformulation of the provisions of Article 70 of Law Number 11 of 2012 concerning Juvenile Criminal Justice through the perspective of the concept of judicial pardon in order to ensure the protection of children's fundamental rights.Purposes of the Research: The research focuses on an in-depth analysis of the concept of rechterlijk pardon as a legal instrument in handling cases of children in conflict with the law.Methods of the Research: The research was conducted using a normative juridical method through a comparative study of the legal systems of Indonesia and the Netherlands.Results of the Research: The research findings indicate that the application of judicial pardon as regulated in Article 70 contains substantial weaknesses, particularly related to the ambiguity of the parameters of "mildness of the act" and "personal circumstances of the child" which have the potential to cause disparities in judicial practice. Normative reconstruction of these provisions is a necessity in order to ensure legal certainty and optimize protection for children in conflict with the law.
