Abstract

Di Banjar Sari Desa Sidakarya tidak lagi mempunyai tebe yang dapat digunakan sebagai pembuangan dan pemrosesan sampah, sehingga total sampah terkumpul di TPS dan TPA semakin menggunung. Hal ini tidak bias dihindarkan walaupun sudah banyak kebijakan terkait pengelolaan sampah diberlakukan. Tim PKM ingin mendorong dan membangkitkan peran ibu rumah tangga (PKK) agar sampah dipilah mulai dari rumah tangga, jika hal ini berjalan dengan baik maka mekanisme pengelolaan sampah yang lain seperti pengumpulan, pengangkutan, pengolahan atau pemrosesan akhir sampah akan mudah dilakukan. Solusi untuk mengatasi persoalan mitra tersebut adalah dengan penyuluhan dan pendampingan sehingga ibu rumah tangga (PKK) berperan lebih efektif dalam pengelolaan sampah, khususnya pemilahan sampah di mulai dari hulunya yaitu rumah tangga.

Abstract

Isu kekerasan terhadap perempuan dalam perspektif industri kepariwisataan menjadi hal yang memprihatinkan dan menentukan jumlah wisatawan atau masyarakat yang berkunjung ke suatu negara. Banyak negara yang gagal mempromosikan potensi destinasi pariwisatanya karena adanya isu kekerasan terhadap perempuan. Negara-negara seperti Bangladesh, India Selatan, Negara-negara Afrika, dan lain sebagainya adalah kelompok negara-negara yang gagal menarik wisatawan karena terpengaruh isu kekerasan terhadap anak dan perempuan. Dunia pariwisata memang rentan dan sensitive sekali terhadap isu. Bali sebagai tujuan wisata berkelas dunia, bertubi-tubi diserang isu. Berbagai isu pernah menerpa Bali antara lain, kekerasan terhadap anak dan perempuan, isu terorisme Bom Bali I dan II, isu SARS, isu Flu Burung, dan yang terakhir isu Virus Corona 19 yang mampu menjadikan pariwisata bali stagnan. Wisatawan Cina, Australia, dan dari negara lainnya dilarang masuk ke Bali, sehingga Bali secara regional menderita kerugian kehilangan devisa sebesar kurang lebih 3 Triliyun per-bulan. Permasalahan yang ingin diberdayakan dalam pengabdian kepada masyarakat ini adalah, meningkatkan kemampuan para pengurus Desa Adat se Kabupaten Jembrana, khususnya pengurus Desa Adat Tuwed ditingkatkan pemahaman, ketrampilan, dan kesadaran hukumnya untuk menjadi seorang paralegal. Metode yang dipergunakan adalah Focus Group Disscussions dan partisipasi terlibat dalam menangani masalah kekerasan terhadap anak dan perempuan. Simpulan yang dirumuskan adalah, pengurus Desa Adat Tuwed sudah memiliki pengetahuan, pemahaman, ketrampilan, dan kesadaran hukum dalam rangka menangani maalah kekerasan terhadap perempuan.

Abstract

Abstract General Principles Good governance can be a claim in the State Administrative Court even though the existence of AAUPB can be said to be juridical and not formal as described in Article 53 Paragraph 2 of Act Number 51 of 2009 concerning State Administrative Courts. In the life of the AAUPB community can be used as a basis for seeking justice, where if the community feels aggrieved by a State Administrative Decree that does not at all refer to the AAUPB and burdensome the community in making decisions or regulations applied in community life. The problems studied are: Application and how the functions that should be played by AAUPB in the decision and form of legal logic from the side of PTUN judges. If you look at the concept of a Dutch country that implements good governance, in Indonesia the entry into force of AAUPB by looking at the theoretical basis applied in the AAUPB, State Administrative Courts, and Article 53 Paragraph 2 of Law Number 51 of 2009. Results of the study: 1) In the research 06 / G / 2017 / PTUN.DPS the role of AAUPB can be seen in the principle of accuracy, the principle of legal certainty and the principle of professionalism in which officials who are authorized to make decisions regardless of the prevailing historical value. Because in terms of the principle of legal certainty, the principle of professionalism, and the principle of accuracy the decisions issued are burdensome, in this case the community is given the decision issued by the competent authority, 2) in the implementation of the AAUPB to decide a case or dispute that occurs in the Administrative Court The AAUPB country acts as a test tool used by PTUN judges to decide on a case. Conclusions from this study: 1) In the decision No. 06 / G / 2017 / PTUN.DPS implementation or AAUPB function has been running to see from the logic of the panel of judges in implementing AAUPB to decide on a dispute, 2) The judge has acted actively in searching for causes and what which becomes a case by applying AAUPB in a consideration to decide on disputes that occur, without forgetting Emersonfraise that can be used by the government in making a decision that applies to the community. Suggestions from researchers: 1) AAUPB that is used or as a basis for testing instruments for PTUN judges in deciding a case should always be accompanied by regulations that apply in accordance with legislation, 2) the panel of judges must clearly use the legal logic by applying AAUPB as Test equipment decides on a dispute that occurs in the realm of the State Administrative Court. Keywords: Article 53 paragraph (2) law number 51 of 2009; disputes; general principles of good governance; PTUN Abstrak Asas-Asas Umum Pemerintahan yang baik dapat menjadi suatu gugatan dalam Pengadilan Tata Usaha Negara meskipun keberadaan AAUPB dapat dikatakan masih secara yuridis dan belum bersifat formal seperti apa yang dijelaskan dalam Pasal 53 Ayat 2 Undang-Undang Nomor 51 Tahun 2009 tentang Peradilan Tata Usaha Negara. Dalam kehidupan masyarakat AAUPB dapat dijadikan dasar untuk mencari keadilan, dimana jika masyarakat merasa dirugikan dengan Keputusan Tata Usaha Negara yang tidak Sama sekali mengacu pada AAUPB dan memberatkan masyarakat dalam membuat keputusan atau peraturan yang diterapkan dalam kehidupan bermasyarakat. Permasalahan yang dikaji yaitu: Penerapan dan bagaimana fungsi yang seharusnya diperankan AAUPB dalam putusan dan bentuk logika hukum dari sisi hakim PTUN. Jika melihat dari konsep negara belanda yang menerapkan good governance, di Indonesia berlakunya AAUPB dengan melihat landasan teori yang diterapkan dalam AAUPB, Peradilan Tata Usaha Negara, Pasal 53 Ayat 2 Undang-Undang Nomor 51 Tahun 2009. Hasil penelitian: 1) Dalam penelitian Putusan Nomor 06/G/2017/PTUN.DPS peran AAUPB dapat terlihat di dalam asas kecermatan, asas kepastian hukum dan asas profesionalitas yang dimana pejabat yang berwenang membuat keputusan tanpa melihat nilai historis yang berlaku. Karena ditinjau dari asas kepastian hukum, asas profesionalitas, dan asas kecermatan putusan yang dikeluarkan memberatkan, dalam hal ini masyarakatlah yang diberatkan oleh putusan yang dikeluarkan oleh pejabat yang berwenang, 2) dalam penerapan AAUPB untuk memutus suatu perkara atau sengketa yang terjadi di Peradilan Tata Usaha Negara AAUPB berperan sebagai alat uji yang digunakan oleh hakim PTUN untuk memutus seuatu perkara. Simpulan dari penelitian ini: 1) Dalam putusan No 06/G/2017/PTUN.DPS penerpan atau fungsi AAUPB sudah berjalan melihat dari sisi logika majelis hakim dalam menerapkan AAUPB untuk memutus suatu sengketa, 2) Hakim sudah bertindak aktif dalam mencari sebab dan apa yang menjadi perkara dengan menerapkan AAUPB dalam suatu pertimbangan untuk memutus sengketa yang terjadi, tanpa melupakan freies emerssen yang dapat digunakan oleh pemerintah dalam membuat suatu keputusan yang berlaku bagi masyarakat. Saran dari peneliti: 1) AAUPB yang dijadikan atau sebagai dasar alat uji bagi majelis hakim PTUN dalam memutus suatu perkara harusnya selalu didampingi dengan peraturan yang berlaku sesuai dengan perundang-undangan, 2) majelis hakim harus secara jelas dalam menggunakan logika hukum dengan menerapkan AAUPB sebagai alat uji memutus suatu sengketa yang terjadi di ranah Peradilan Tata Usaha Negara. Abstract

As a legal state, every administration of government affairs must be based on applicable law. As a State that embraces decentralization it means that government affairs consist of central government affairs and regional government affairs. This means that there is a set of central government tools and local government instruments, which are given autonomy, namely freedom and independence to regulate and manage regional household affairs. In carrying out the functions of government, it is definitely needed by providers of goods / services that support the optimal performance of the agency. The contract for the procurement of goods / services between PPK and the goods / services provider contains the obligations and rights of the parties in the context of carrying out the procurement of goods / services. In the implementation of contracts, often the goods / services provider does not carry out its obligations perfectly in accordance with what has been stated in the contract. This can result in the unilateral termination of the contract by the PPK, and in this study discussed the procedure for terminating contracts in the procurement of goods / services as well as the legal consequences of unilateral termination of contracts by Commitment Makers (PPK) to providers of goods. This study is a type of Normative Legal Research, using a statutory approach, while the source of legal material is obtained from primary legal materials, namely the applicable legislation and secondary legal material obtained from literature or scientific work that is relevant to the problem appointed. Legal material collection techniques with document studies and legal material analysis are processed systematically and the results are presented in descriptive analysis. From the results of this study it can be concluded that the procedure for unilaterally terminating contracts in the procurement of goods / services contracts is preceded by giving warnings (summons), proving meetings (Show Cause Meeting) and giving Test Cases and legal consequences of unilateral termination of contracts. Contract for the procurement of goods / services is the imposition of administrative sanctions, blacklisted sanctions, civil claims and criminal reporting to the authorities.

Abstract

Provisions for granting grants are contained in the Law concerning Regional Government which states that grants and social assistance expenditures are budgeted in the APBD in accordance with regional financial capacity. To overcome confusion over Government funding recipient object in this case the Ministry of Interior issued a Regulation on the Amendment on Guidelines for Grants. Government P rovincial B ali quite cautious in giving grants to Pakraman. The government should be careful in interpreting whether Pakraman including bodies and agencies which are set in the Regulation. The formulation of the problem raised is 1. What are the conditions for awarding grants in Bali Province? 2. What is the procedure for awarding grants in Bali Province? The type of writing is Legal Normative approach to legislation and legal norms in force, t eknik collection started with an inventory by collecting and organizing legal materials into an information system and using description techniques by describing them first and then analyzing and then concluding. Government Authority Bali Province inside gift grant function for ngkatan meni service and welfare of the community, from the results observations of researchers regarding the process of implementing community grant programs in the city of Denpasar are in accordance with the provisions of the law, but there are still grants and social assistance that are not in accordance with the applicable provisions or requirements that have not been met . The mechanism for granting grants to the Bali Provincial Government is based on the Pergub Hibah and Bansos with apply the logic flow that giving grants to community organizations that are not registered in the ministry will support the existence and development of Balinese culture

Abstract

The problem of village boundaries is indeed often a debate in several areas in Bali, especially those that occur in Tabanan Regency. In Tabanan, boundary problems occur between Bealalang Village, Kediri District, Tabanan Regency and Pangkung Tibah Village, Kediri District, Tabanan Regency. The chaos of the boundary between Belalang and Pangkung Tibah villages began to erupt in 2009. The conflict began with a claim of 18 hectares of land in subak Belong in the Pangkungtibah area. Claims from the locusts are based on ancestral inheritance. This action had ended in the fencing of disputed land. the formulation of the problem in this study is as follows: How to Resolve State Administrative Disputes Through the efforts of State Administrative Courts on Settlement of Village Boundary Cases (Case Study of Decision Number: 12 / G / 2011 / PTUN.Dps.) and How the Judges consider decisions in the Case of a Suit Against the Settlement of a Village Boundary Case (Case Study of Decision Number: 12 / G / 2011 / PTUN.Dps.). The type of research used is the type of normative legal research. The results of the study in this discussion are as follows: State Administration Dispute Resolution Through the efforts of State Administrative Courts to Settle Village Boundary Cases (Case Study of Decision Number: 12 / G / 2011 / PTUN.Dps.) Has not fulfilled legal certainty and a sense of justice, this can be seen from the refusal by the Supreme Court. Abstract

This thesis has a background through democracy that its implementation with elections held by the KPU with its authority at each stage of its election can form KPU regulations and stipulate KPU regulations Number 20 Year 2018 and in the process is considered to violate the higher regulations namely Number Election Law 7 of 2017 here regulates the prohibition of former corruption inmates to become candidates for DPR and DPRD members so that they can explain to the public the noble intentions of the institution towards the noble ideals of the nation about eradicating corruption. This has been a debate in the community, political elites and state institutions. What is the background of the formation of KPU regulations Number 20 Year 2018 and what are the implications of the Supreme Court's decision Number 46 P / HUM / 2018 this study is a normative legal research that is prescriptive and technical or applied. The research approach uses a legal approach and a case approach. The type of research data is secondary data with primary legal material and secondary legal material. Data collection techniques in the form of library studies and data analysis techniques used are deduction with syllogism methods. Through scrutiny of laws and regulations related to the Election Law No. 7 of 2017. After the research material was obtained and collected, the material can be concluded if the background and moral factors of the KPU form the KPU Regulation is in order to obey the noble ideals of the nation in eradicating corruption and giving the public legislative candidates with integrity and being able to carry out the decisions of the Supreme Court through forming KPU regulations No. 31 of 2018 as a substitute.

Abstract

The Civil Service Police Unit in the Province of Bali is indispensable and can be said to be one of the law enforcement officers. The formulation of the problems used in this study are: (1) How is the Function of the Bali Civil Service Police Unit in maintaining peace and public order; (2) How is the strategy of the Bali Province Satpol PP Work Unit in overcoming obstacles in conducting supervision and control. This research was conducted using normative legal research. As for the source and type of material of this research are primary legal materials which are looking at the laws and secondary legal materials written the experts and the results of the scientists are then processed and analyzed descriptively to get a conclusion. Based on the results of the research it can be concluded that the Bali Civil Service Police Unit (Satpol PP) has the function of maintaining and maintaining security and order and also helps the regional head to create a policy regional peace, orderly, and orderly so that the administration of government can run smoothly and the community can carry out its activities safely. The strategy to overcome obstacles in conducting oversight and control is expected to be that SATPOL PP always coordinates with related parties / agencies

Abstract

Abstract—Crime of CPNS fraud is common in both remote and urban areas. This is due to the large number of people who think that work as a civil servant is a safe and secure job. The discussion of this paper includes; What are the factors that lead to criminal acts of fraud from the point of view of law and society, how are sanctions and responsibilities of perpetrators of criminal acts of fraud CPNS. This research is normative research. Legal materials obtained from from the Warmadewa University Faculty of Law Library and the Krisna Law Office Library. Factors influencing fraudulent acts are lack of burden of sanctions or lack of commensurate penalties and poverty factors. Case studies in this paper are taken from the decisions of the Denpasar District Court (Decision Number: 382 / PID.B / 2018 / PN DPS); perpetrators of criminal offenses of CPNS that were enforced article 378 of the Criminal Code concerning fraudulent crimes with sanctions of a maximum of four (4) years in prison. This type of fraud can damage the character and morals of the nation, so the government should pay more attention to it and for the perpetrators to be given appropriate punishment in order to get a deterrent effect. The community is also expected to help law enforcement officials by reporting it if they know that this action was carried out and that law enforcement officers should provide protection for informer.

Abstract

Land purchasing is an activity taken by government in order to build public fasilities, purchasing also done by giving some compesation to society that affected. During purchasing activity never runs smooth , where mostly some people who gets land purchase is not santisfied with the amount of compensation that given by government. Regarding those matters, we may conclude there are 2 problems those are : 1. What Is the juridical basis for land acquistion in the public interest?, 2. How is the mechanism of compesation in land purchasing for public that held by goverment ?. Research that an be used to solve the problem is normatif research method by studying the valid rules. Juridis platform land purchasing is President policy no 71 year 2012 about land enforcement to public needs, the regulation no 2 year 2012 about land purchasing for public developing. Compensation mechanism on land purchasing must be based on the forum between committee and the right holder of the land or plants that’s exist on it, that during the interpretation or the quotation the amount of compensation should be agreed and must be based on the local public price.
