Abstract

In reality, collecting donations often does not match the original purpose of providing the funds. This is a common occurrence and is frequently reported by television, mass media, and online media. In this study, several issues are examined, including the implementation of regulations regarding donations, the legal protection afforded to donors against the misuse of donation funds by recipients, and the solutions for actions taken by recipients who misuse donation funds. The form of this research is normative legal research, utilizing secondary data as its primary source of information. The data analysis used is qualitative descriptive analysis. Legal protection for donors in the context of acts of misuse of donation money by recipients of donations is a complex issue and requires serious attention. On the one hand, existing regulations have provided a sufficient legal framework to protect donors; on the other hand, there are still many challenges to their implementation in the field. Cases of misuse that occur show that the existing regulations are not fully effective in preventing misuse of funds. It is essential to strengthen the supervision and accountability of institutions that collect donations. Transparency in fund management, independent audits, and certification for trusted foundations are some steps that can be taken to increase donor trust. In addition, educating the public about their rights as donors is also crucial in building better legal awareness. With the various solutions proposed, the donation ecosystem in Indonesia can become more efficient and transparent. The public must feel safe and confident that every donation given will be used for the right purpose. Only in this way can we build a healthy and sustainable donation culture in Indonesia.

Abstract

Abstrak: Penyelesaian sengketa terhadap permasalahan pemutusan hubungan kerja (PHK) yang terjadi di Kota Batam dilakukan melalui jalur mediasi adalah merupakan salah satu pilihan penyelesaian per-masalahan yang dilakukan melalui jalur non-litigasi atau diluar pengadilan. Dengan adanya Undang-Undang No. 13 Tahun 2003 Tentang Ketenagakerjaan yang mengatur perlindungan terhadap pekerja untuk mendapatkan hak-haknya sebagai pekerja juga terdapat Undang-Undang No. 2 Tahun 2004 Tentang Penyelesaian Perselisihan Hubungan Industrial. Kedua UU ini sebagai acuan bagi pengusaha maupun pekerja agar menemukan hasil kesepakatan yang sama-sama menguntungkan bagi kedua belah pihak. Kata Kunci: Perusahaan, Pemutusan Hubungan Kerja, Mediasi Abstract: The resolution of disputes over termination of employment problems (layoffs) that occurred in the city of Batam conducted through the mediation is one of the options for solving the problem through non-litigation or out-of-court. In Labor Law No. 13 of 2003 concerning employment which provides protection to workers to obtain their rights as workers is also provided by law no. 2 of 2004 on the settlement of industrial relations disputes. Abstract

The dualism of land management authority between the Batam Indonesia Free Zone Authority (BP Batam) and the Batam Municipal Government has generated persistent legal and administrative challenges in the issuance of Building Use Right Certificates in Batam City. Overlapping authority has resulted in prolonged certification procedures, regulatory inconsistencies, and heightened legal uncertainty, which negatively affect investment realization and the effectiveness of land governance. Despite the existence of comprehensive statutory frameworks, the implementation of HGB certification in Batam continues to encounter structural obstacles arising from fragmented institutional authority. This study aims to examine the impact of the dualism of authority between BP Batam and the Batam Municipal Government on HGB certification services and to propose policy recommendations to enhance legal certainty and administrative efficiency. The research employs empirical legal research using a statutory and phenomenological approach. The findings indicate that the dual authority structure has significantly delayed HGB certification, with more than 1,100 applications pending in 2023 and affected investment values amounting to approximately IDR 2.3 trillion. Divergent documentary requirements, zoning maps, and procedural standards between BP Batam and the municipal government have created duplicative processes and extended verification stages, resulting in certification timelines of up to 180 days for land parcels requiring approval from both authorities. Although BP Batam regulations provide detailed technical guidance and strong formal legal legitimacy, their implementation is frequently misaligned with municipal policies, thereby weakening substantive legal certainty. The study further reveals that limited inter-agency coordination, insufficient integration of information systems, and the absence of binding dispute-resolution mechanisms contribute to recurring land disputes and litigation. The study concludes that resolving land governance dualism in Batam requires regulatory harmonization, clearer delineation of authority, and the establishment of an integrated One Door Service Unit supported by a Batam-specific Online Single Submission system to accelerate certification processes and strengthen legal certainty.

Abstract

This study aims to examine and analyze the liability of business actors for defective products from the perspectives of civil law and consumer protection law. The research is motivated by the increasing circulation of defective products that cause losses to consumers, as well as the weak position of consumers in proving business actors’ fault in product liability disputes. This condition indicates that the existing legal framework has not fully provided effective legal protection and legal certainty for consumers. This research employs a normative juridical method using statutory, conceptual, and comparative approaches, supported by descriptive-analytical specifications through library research. The novelty of this study lies in the integrative analysis between the Consumer Protection Law and the Indonesian Civil Code in constructing a more comprehensive model of business liability for defective products. The results reveal that business liability in defective product cases includes contractual liability, tort liability, and the application of strict liability principles. However, the implementation of strict liability under the Consumer Protection Law has not yet been fully effective because business actors are still allowed to avoid liability by proving that consumer negligence caused the loss. Normatively, this condition weakens consumer protection and creates an imbalance in the burden of proof between consumers and business actors. Therefore, strengthening the formulation of strict liability and harmonizing consumer protection regulations with civil law principles are necessary to achieve more effective, just, and legally certain consumer protection.     Penelitian ini bertujuan untuk mengkaji dan menganalisis pertanggungjawaban pelaku usaha atas produk cacat dalam perspektif hukum perdata dan hukum perlindungan konsumen. Penelitian ini dilatarbelakangi oleh masih maraknya peredaran produk cacat yang merugikan konsumen serta lemahnya posisi konsumen dalam membuktikan kesalahan pelaku usaha dalam sengketa product liability. Kondisi tersebut menunjukkan bahwa pengaturan hukum yang ada belum sepenuhnya mampu memberikan perlindungan hukum dan kepastian hukum yang efektif bagi konsumen. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif, serta spesifikasi deskriptif-analitis melalui studi kepustakaan. Kebaruan penelitian ini terletak pada analisis integratif antara Undang-Undang Perlindungan Konsumen dan Kitab Undang-Undang Hukum Perdata dalam membangun model pertanggungjawaban pelaku usaha atas produk cacat secara lebih komprehensif. Hasil penelitian menunjukkan bahwa pertanggungjawaban pelaku usaha mencakup tanggung jawab kontraktual, tanggung jawab perbuatan melawan hukum, serta penerapan prinsip strict liability. Namun demikian, penerapan prinsip strict liability dalam UUPK belum berjalan secara optimal karena pelaku usaha masih diberikan ruang untuk menghindari tanggung jawab melalui pembuktian bahwa kerugian timbul akibat kesalahan konsumen. Secara normatif, kondisi tersebut menyebabkan perlindungan konsumen belum sepenuhnya efektif dan menimbulkan ketimpangan pembuktian antara konsumen dan pelaku usaha. Oleh karena itu, diperlukan penguatan formulasi strict liability dan harmonisasi pengaturan antara hukum perlindungan konsumen dan hukum perdata guna mewujudkan perlindungan konsumen yang lebih efektif, adil, dan memberikan kepastian hukum.

Abstract

This study aims to analyzes the contractual relationship between wedding organizers (WO) and vendors and examines the resolution of breaches of contract in wedding event cooperation. Previous studies generally discuss breach of contract in broad civil law contexts and have not specifically examined the legal relationship between WO and vendors in the creative service industry. In practice, disputes frequently arise due to delays, unilateral cancellations, service discrepancies, and payment defaults, creating legal uncertainty for the parties. This research employs a normative juridical method using statutory and conceptual approaches through the analysis of legislation, legal doctrines, and relevant literature. The findings reveal that the relationship between WO and vendors constitutes a contractual partnership based on valid agreements under the Indonesian Civil Code, giving rise to reciprocal rights and obligations founded on the principles of freedom of contract, good faith, legal certainty, and contractual balance. Breach of contract commonly occurs in the form of delayed performance, non-conformity of services, unilateral cancellation, and delayed payment. The study further finds that non-litigation mechanisms, particularly negotiation and mediation, are more effective because they are flexible, efficient, and capable of preserving long-term business relationships.   Penelitian ini bertujuan untuk menganalisis hubungan kontraktual antara wedding organizer (WO) dan vendor serta mengkaji penyelesaian wanprestasi dalam kerja sama penyelenggaraan wedding event. Penelitian terdahulu umumnya masih membahas wanprestasi dalam konteks hukum perdata secara umum dan belum secara khusus mengkaji hubungan hukum antara WO dan vendor dalam industri jasa kreatif. Dalam praktiknya, sengketa sering terjadi akibat keterlambatan, pembatalan sepihak, ketidaksesuaian layanan, dan wanprestasi pembayaran yang menimbulkan ketidakpastian hukum bagi para pihak. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual melalui analisis peraturan perundang-undangan, doktrin hukum, dan literatur yang relevan. Hasil penelitian menunjukkan bahwa hubungan hukum antara WO dan vendor merupakan kemitraan kontraktual yang lahir dari perjanjian sah berdasarkan KUHPerdata dan menimbulkan hak serta kewajiban timbal balik berdasarkan asas kebebasan berkontrak, itikad baik, kepastian hukum, dan keseimbangan kontrak. Wanprestasi umumnya terjadi dalam bentuk keterlambatan pelaksanaan pekerjaan, ketidaksesuaian layanan, pembatalan sepihak, dan keterlambatan pembayaran. Penelitian ini juga menemukan bahwa mekanisme non-litigasi, khususnya negosiasi dan mediasi, lebih efektif diterapkan karena fleksibel, efisien, dan mampu menjaga keberlanjutan hubungan bisnis para pihak.

Abstract

This study aims to analyze the regulation of overtime work under Government Regulation Number 35 of 2021 and the effectiveness of legal protection for workers in Batam City. This research is important because the high intensity of overtime practices in Batam’s industrial sector still results in violations of workers’ rights, including unpaid overtime wages and weak worker consent mechanisms. This study employs a normative juridical method through statutory, conceptual, and case approaches analyzed qualitatively using Soerjono Soekanto’s theory of legal effectiveness and Lawrence M. Friedman’s legal system theory. The findings reveal that overtime regulation under Government Regulation Number 35 of 2021 has been normatively comprehensive, yet its implementation remains ineffective due to weak labor supervision, unequal bargaining positions, and an industrial culture that normalizes overtime work. The study concludes that legal protection for overtime work in Batam City remains formal-procedural and has not fully ensured substantive protection for workers. The novelty of this study lies in its integrated analysis of overtime protection through the perspectives of legal effectiveness theory and legal system theory within Batam’s manufacturing-based industrial relations.     Penelitian ini bertujuan menganalisis pengaturan kerja lembur berdasarkan Peraturan Pemerintah Nomor 35 Tahun 2021 serta efektivitas perlindungan hukum terhadap pekerja di Kota Batam. Penelitian ini penting karena tingginya praktik kerja lembur di sektor industri Batam masih menimbulkan pelanggaran hak pekerja, seperti tidak dibayarkannya upah lembur dan lemahnya persetujuan kerja lembur. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus yang dianalisis secara kualitatif menggunakan teori efektivitas hukum Soerjono Soekanto dan teori sistem hukum Lawrence M. Friedman. Hasil penelitian menunjukkan bahwa pengaturan kerja lembur dalam PP 35/2021 secara normatif telah cukup komprehensif, namun implementasinya belum efektif akibat lemahnya pengawasan ketenagakerjaan, ketimpangan posisi tawar pekerja, dan budaya industrial yang menormalisasi lembur. Penelitian ini menyimpulkan bahwa perlindungan hukum kerja lembur di Kota Batam masih bersifat formal-prosedural dan belum sepenuhnya memberikan perlindungan substantif bagi pekerja. Kebaruan penelitian terletak pada analisis efektivitas perlindungan hukum kerja lembur melalui integrasi teori efektivitas hukum dan teori sistem hukum dalam konteks hubungan industrial kawasan manufaktur Batam.
