Abstract

This study aims to analyze the implementation of mediation at the Batam Religious Court based on Supreme Court Regulation Number 1 of 2016 on Mediation Procedures. The research is motivated by the fact that although mediation is mandated as a preliminary stage in every civil case, its effectiveness remains limited due to structural and cultural challenges, particularly the shortage of judges and the low level of public legal awareness. The urgency of this study lies in providing an empirical perspective that complements previous research, which has generally been normative, broad, or limited to specific types of cases. This study uses a normative juridical research method. Using Lawrence M. Friedman’s legal system theory, the analysis reveals an imbalance between the legal structure, which lacks adequate institutional support, the legal substance, which is often treated as a mere formality, and the legal culture, which shows weak societal commitment to mediation as a path to peaceful settlement. The novelty of this research lies in its contextual findings on the concrete implementation of mediation in Batam, filling a gap left by previous studies. The study concludes that strengthening the number and capacity of judges and external mediators, optimizing the substantive application of mediation rules, and enhancing public legal literacy through sustained outreach are essential. These recommendations are expected to reinforce mediation as an effective, fair, and accessible dispute resolution mechanism in line with the principles of simple, speedy, and low-cost justice.   Penelitian ini bertujuan untuk menganalisis pelaksanaan mediasi di Pengadilan Agama Batam berdasarkan Peraturan Mahkamah Agung Nomor 1 Tahun 2016 tentang Prosedur Mediasi. Latar belakang penelitian ini berangkat dari kenyataan bahwa meskipun mediasi diwajibkan sebagai tahapan awal dalam setiap perkara perdata, efektivitasnya masih menghadapi berbagai kendala, terutama keterbatasan jumlah hakim dan rendahnya kesadaran hukum masyarakat. Urgensi penelitian ini terletak pada kebutuhan untuk menghadirkan kajian empiris yang mampu melengkapi penelitian terdahulu yang cenderung bersifat normatif, umum, atau terbatas pada satu jenis perkara. Penelitian ini menggunakan jenis penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa pelaksanaan mediasi secara normatif telah sesuai prosedur, tetapi belum sepenuhnya berjalan efektif. Analisis menggunakan teori sistem hukum Lawrence M. Friedman memperlihatkan adanya ketidakseimbangan antara struktur hukum yang belum didukung kelembagaan memadai, substansi hukum yang sering dipersepsi sekadar formalitas, dan budaya hukum masyarakat yang belum sepenuhnya mendukung penyelesaian sengketa secara damai. Kebaruan penelitian ini terletak pada penjelasan implementasi konkret mediasi di Batam yang mengisi kekosongan penelitian sebelumnya. Kesimpulan penelitian ini menegaskan perlunya penguatan jumlah dan kapasitas hakim maupun mediator eksternal, optimalisasi penerapan substansi hukum agar lebih implementatif, serta peningkatan literasi hukum masyarakat melalui sosialisasi yang berkesinambungan. Rekomendasi tersebut diharapkan dapat mendorong mediasi sebagai instrumen penyelesaian sengketa yang lebih efektif, cepat, sederhana, dan berbiaya ringan.

Abstract

This study aims to analyze the position of standard clauses in manufacturing industry business contracts from a civil law perspective, to assess their conformity with the principles of freedom of contract, fairness, and good faith, and to provide practical recommendations so that these clauses do not harm any party. The background of this research is based on the widespread use of standard clauses unilaterally determined by dominant parties in manufacturing contracts, which potentially create an imbalance in bargaining power and disadvantages for weaker parties. The urgency of this study lies in the need to ensure legal certainty while also providing fair protection in manufacturing business relations, considering that this sector is the main driver of the national economy. The research employs a normative juridical method with a descriptive-analytical specification through library research of primary, secondary, and tertiary legal materials. The findings reveal that while standard clauses provide efficiency, uniformity, and legal certainty, they also pose risks of abuse of dominant positions. The novelty of this study lies in its specific focus on standard clauses in manufacturing contracts, in contrast to previous studies that mainly emphasized consumer protection or MSME partnerships. The conclusion highlights the crucial role of civil law in maintaining a balance of interests between the parties, while the recommendation emphasizes the need for restrictions and adjustments to standard clauses through sectoral regulations or guidelines, so that manufacturing contracts remain efficient, fair, and sustainable.   Penelitian ini bertujuan untuk menganalisis kedudukan klausula (klausul) baku dalam kontrak bisnis industri manufaktur dari perspektif hukum perdata, menilai kesesuaiannya dengan asas kebebasan berkontrak, keadilan, dan iktikad baik, serta memberikan rekomendasi praktis agar klausul tersebut tidak merugikan salah satu pihak. Latar belakang penelitian didasari oleh maraknya penggunaan klausula baku yang disusun sepihak oleh pihak dominan dalam kontrak manufaktur, sehingga berpotensi menimbulkan ketidakseimbangan posisi tawar dan kerugian bagi pihak yang lemah. Urgensi penelitian ini terletak pada kebutuhan menghadirkan kepastian hukum sekaligus perlindungan yang adil dalam hubungan bisnis manufaktur, mengingat sektor ini merupakan penggerak utama perekonomian nasional. Metode penelitian yang digunakan adalah yuridis normatif dengan spesifikasi deskriptif-analitis melalui studi kepustakaan terhadap bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa klausul baku memberikan manfaat berupa efisiensi, keseragaman, dan kepastian hukum, namun juga menimbulkan risiko penyalahgunaan kedudukan dominan; kebaruan penelitian ini terletak pada fokus kajian terhadap praktik klausul baku dalam kontrak manufaktur yang berbeda dari penelitian terdahulu yang lebih banyak menyoroti aspek perlindungan konsumen atau kemitraan UMKM. Kesimpulan penelitian ini menegaskan bahwa peran hukum perdata sangat penting untuk menjaga keseimbangan kepentingan para pihak, sedangkan rekomendasi yang ditawarkan adalah perlunya pembatasan dan penyesuaian klausul baku melalui regulasi atau pedoman khusus agar kontrak manufaktur tetap efisien sekaligus adil dan berkelanjutan.

Abstract

The submission of a procurement request for engineering equipment is, of course, accompanied by a budget plan for the manufacture of the equipment. In practice, many companies that conduct engineering equipment procurement auctions often obtain engineering equipment designs from one tender participant to be used by other tender participants without disclosure. This causes injustice to tender participants whose engineering equipment designs are used without their knowledge or consent. The absence of registration of industrial designs results in no protection of industrial design rights, which can lead to imitation or plagiarism of the design, and there is even the possibility of using the design in the future. Another problem that also arises is that the engineering equipment designed or created is not mass-produced, as it is only produced for specific conditions. The formulation of the problem in this study concerns how to regulate engineering equipment design, how to protect engineering equipment procurement participants from misuse of engineering equipment design, and what solutions are available for addressing misuse of equipment design. The research methodology used was normative research. In Indonesia, industrial design, also known as industrial product design, has been recognized as a distinct entity from copyright. In 2000, a law specifically regulating industrial design was enacted, known as the Industrial Design Law. Additionally, the regulation regarding the layout of integrated circuits is outlined in Law Number 32 of 2000 concerning Integrated Circuit Layout Design. The protection of engineering tool designs can only be carried out through repressive efforts, both criminally and civilly. This protection is only based on whether the engineering tool procurement participant has an industrial design certificate. So that the engineering tool procurement participant firmly owns the legality of the design, solutions that can be taken include: First, the need for preventive legal regulations in the form of obligations from the engineering tool procurement company with the engineering tool procurement participant in the form of a written agreement containing an agreement to maintain the confidentiality of information. Second, there is a need for ease in obtaining industrial design certificates by the Directorate General of Intellectual Property Rights. Third, there is a need for supervision and socialization of all business entities participating in the procurement of engineering tools to prevent the misuse of engineering tool designs.

Abstract

In reality, collecting donations often does not match the original purpose of providing the funds. This is a common occurrence and is frequently reported by television, mass media, and online media. In this study, several issues are examined, including the implementation of regulations regarding donations, the legal protection afforded to donors against the misuse of donation funds by recipients, and the solutions for actions taken by recipients who misuse donation funds. The form of this research is normative legal research, utilizing secondary data as its primary source of information. The data analysis used is qualitative descriptive analysis. Legal protection for donors in the context of acts of misuse of donation money by recipients of donations is a complex issue and requires serious attention. On the one hand, existing regulations have provided a sufficient legal framework to protect donors; on the other hand, there are still many challenges to their implementation in the field. Cases of misuse that occur show that the existing regulations are not fully effective in preventing misuse of funds. It is essential to strengthen the supervision and accountability of institutions that collect donations. Transparency in fund management, independent audits, and certification for trusted foundations are some steps that can be taken to increase donor trust. In addition, educating the public about their rights as donors is also crucial in building better legal awareness. With the various solutions proposed, the donation ecosystem in Indonesia can become more efficient and transparent. The public must feel safe and confident that every donation given will be used for the right purpose. Only in this way can we build a healthy and sustainable donation culture in Indonesia.

Abstract

Abstrak: Penyelesaian sengketa terhadap permasalahan pemutusan hubungan kerja (PHK) yang terjadi di Kota Batam dilakukan melalui jalur mediasi adalah merupakan salah satu pilihan penyelesaian per-masalahan yang dilakukan melalui jalur non-litigasi atau diluar pengadilan. Dengan adanya Undang-Undang No. 13 Tahun 2003 Tentang Ketenagakerjaan yang mengatur perlindungan terhadap pekerja untuk mendapatkan hak-haknya sebagai pekerja juga terdapat Undang-Undang No. 2 Tahun 2004 Tentang Penyelesaian Perselisihan Hubungan Industrial. Kedua UU ini sebagai acuan bagi pengusaha maupun pekerja agar menemukan hasil kesepakatan yang sama-sama menguntungkan bagi kedua belah pihak. Kata Kunci: Perusahaan, Pemutusan Hubungan Kerja, Mediasi Abstract: The resolution of disputes over termination of employment problems (layoffs) that occurred in the city of Batam conducted through the mediation is one of the options for solving the problem through non-litigation or out-of-court. Abstract

The dualism of land management authority between the Batam Indonesia Free Zone Authority (BP Batam) and the Batam Municipal Government has generated persistent legal and administrative challenges in the issuance of Building Use Right Certificates in Batam City. Overlapping authority has resulted in prolonged certification procedures, regulatory inconsistencies, and heightened legal uncertainty, which negatively affect investment realization and the effectiveness of land governance. Despite the existence of comprehensive statutory frameworks, the implementation of HGB certification in Batam continues to encounter structural obstacles arising from fragmented institutional authority. This study aims to examine the impact of the dualism of authority between BP Batam and the Batam Municipal Government on HGB certification services and to propose policy recommendations to enhance legal certainty and administrative efficiency. The research employs empirical legal research using a statutory and phenomenological approach. The findings indicate that the dual authority structure has significantly delayed HGB certification, with more than 1,100 applications pending in 2023 and affected investment values amounting to approximately IDR 2.3 trillion. Divergent documentary requirements, zoning maps, and procedural standards between BP Batam and the municipal government have created duplicative processes and extended verification stages, resulting in certification timelines of up to 180 days for land parcels requiring approval from both authorities. Although BP Batam regulations provide detailed technical guidance and strong formal legal legitimacy, their implementation is frequently misaligned with municipal policies, thereby weakening substantive legal certainty. The study further reveals that limited inter-agency coordination, insufficient integration of information systems, and the absence of binding dispute-resolution mechanisms contribute to recurring land disputes and litigation. The study concludes that resolving land governance dualism in Batam requires regulatory harmonization, clearer delineation of authority, and the establishment of an integrated One Door Service Unit supported by a Batam-specific Online Single Submission system to accelerate certification processes and strengthen legal certainty.
