Abstract

The placement of the Indonesian National Police (Polri) within the constitutional structure—directly under the President or under a ministry—remains a contested issue in Indonesia’s security-sector reform amid a persistent deficit in public trust and human rights protection. This article analyses the direction of police reform and weighs the constitutional consequences of both placement options. Employing a juridical-normative method with statutory, conceptual, case, and comparative approaches, this study examines primary and secondary legal materials, including Constitutional Court Decision No. 19/PUU-XXIII/2025. The study finds that the dichotomy of ‘under the President versus under a ministry’ is a false binary: the quality of democratic policing depends not on the structural locus but on the design of institutional safeguards: namely, guaranteed operational independence of investigation, legally empowered external oversight, and transparency. Comparative evidence from the United Kingdom, Japan, and France shows that police placed under a ministry can remain professional and democratic when such safeguards exist. The article recommends retaining Polri under the President while reconstructing the National Police Commission (Kompolnas) from an advisory body into an oversight body with binding ethical-investigative authority through amendment of Law No. 2 of 2002.

Abstract

Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap anak dari tindakan kekerasan seksual dalam bentuk grooming melalui media game online berdasarkan Undang-Undang No. 17 Tahun 2016 tentang Perlindungan Anak. Grooming merupakan bentuk eksploitasi seksual yang dilakukan secara bertahap dan terselubung melalui manipulasi psikologis, sering terjadi di ruang digital yang sulit diawasi. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang No. 17 Tahun 2016 telah memberikan dasar hukum, namun belum terdapat pengaturan eksplisit mengenai tindak grooming. Oleh karena itu, perlu adanya pembaruan regulasi serta peningkatan literasi digital bagi anak dan orang tua. Penelitian ini merekomendasikan adanya sinergi antara negara, penyedia platform digital, orang tua, dan masyarakat untuk menciptakan ruang digital yang aman bagi anak.

Abstract

This paper discusses the strategic plan of the Indonesian National Police. The purpose of this study is to evaluate the implementation of the National Police grand strategy towards 2025, especially Phase I or known as trust building in the implementation period of 2005-2010 and the second phase of Partnership Building for 5 years 2010-2015, This is done because towards Strive for Excellence in 2016-2025 in building the ability of public trust and public trust to go to the current stage of excellence is difficult to realize because trust building cannot be stable because it depends on legal events involving cases of police members and services of police members in the community.

Abstract

Radicalism and terrorism have created a national security crisis, especially in the current digital era. The era of digitalization has given birth to rapid changes and has had massive effects in various sectors, including the movement of new forms of terrorism. Terrorist groups have changed movement patterns by utilizing the internet, from spreading ideology, recruiting, funding, exchanging information and terror threats. The Internet enables rapid, low-risk, and inexpensive dissemination of information to diverse constituencies. Therefore, appropriate measures are needed to prevent terrorism. However, the implementation of digitalization-based terrorism prevention is currently unable to be realized effectively. If we look at it, since the September 11 2001 terrorist attack on the World Trade Center (WTC), terrorism has become an issue that has been widely discussed in all parts of the world. Almost all countries agree to fight terrorism, because terrorism is contrary to humanitarianism and has caused economic, political and psychological losses.  This research analyzes the government's role in eradicating terrorism in the era of digitalization. It is hoped that this research can contribute to scientific development related to handling terrorism in Indonesia. The aim of the study is to describe the causal factors and formulate steps taken by the government to overcome radicalism and terrorism in Indonesia.

Abstract

Indonesia is facing a critical drug crisis, not only as a consumer but also as a producer of narcotics. Drug abuse, once concentrated in major urban centers, has now permeated even the most remote regions, with an estimated 3.3 million users, or approximately 1.73% of the population. The country has become a primary target for large-scale drug smuggling, with around 80% of illicit substances entering through maritime routes, while the rest are trafficked via air transport and land borders. Beyond mere profit-driven criminal activity, strong indications suggest that drug trafficking is part of a broader covert operation by foreign entities aimed at weakening Indonesia’s national resilience. This operation systematically targets the younger generation, eroding moral integrity and mental strength, ultimately destabilizing the nation from within. While direct evidence of such clandestine foreign involvement remains elusive, numerous indicators point to its existence. However, the challenge lies in the highly secretive nature of these operations, making them difficult to identify and counter. Moreover, Indonesia has yet to fully recognize and address drug smuggling as a potential strategic maneuver orchestrated by external forces. To effectively combat this existential threat, Indonesia must go beyond conventional counter-narcotics efforts and adopt an intelligence-driven approach. A well-coordinated and highly classified counterintelligence strategy is essential to detect, disrupt, and neutralize these clandestine operations. This requires a structured and systematic intelligence framework that integrates advanced methodologies, tactical precision, and covert operational capabilities. By doing so, Indonesia can fortify its national security, safeguard its younger generation, and dismantle any covert attempts to undermine its sovereignty.

Abstract

The development of digital technology has brought about significant transformations to the press system in Indonesia, particularly through the emergence of online media, which has accelerated the distribution of information and expanded public access. However, this development has also raised various legal issues, such as the spread of unverified news, hoaxes, clickbait, and the potential for abuse of press freedom. This study aims to analyze the legal framework governing press freedom in Indonesia, forms of its abuse in online media, and the roles of the Press Council and law enforcement agencies in resolving press disputes in the digital age. The research method employed is a normative legal approach using legislative and conceptual frameworks. The data utilized includes primary, secondary, and tertiary legal sources, which were analyzed qualitatively through legal interpretation and deductive reasoning. The research findings indicate that press freedom in Indonesia has a strong legal foundation through the 1945 Constitution of the Republic of Indonesia and Law No. 40 of 1999 on the Press; however, in practice, it still faces challenges in the form of regulatory overlap with the ITE Law and the Criminal Code. Furthermore, there is a lack of coordination in the handling of press disputes between the Press Council and law enforcement agencies, which has the potential to create legal uncertainty and lead to the criminalization of the press. The rise of digital media has further exacerbated the situation by accelerating the spread of unverified information and blurring the line between professional journalism and user-generated content. Therefore, regulatory harmonization, institutional strengthening, and improved digital literacy are needed to strike a balance between press freedom and legal accountability in the digital age.

Abstract

Advances in information and communication technology have brought about significant changes in the use of social media as a means of communication and information exchange in society. However, these advances have also given rise to new legal issues, particularly regarding the protection of personal data and the manipulation of digital information. This study aims to analyze the forms of legal protection for the personal data of social media users based on Indonesian laws and regulations, as well as to examine the effectiveness of law enforcement against information manipulation from a cyberlaw perspective. The research method used is normative legal research employing both a statutory and a conceptual approach. The results show that legal protection for personal data is regulated by the Electronic Information and Transactions Law and the Personal Data Protection Law, which recognize the right to privacy, the obligations of data controllers, and administrative and criminal sanctions for personal data violations. However, implementation still faces various obstacles, such as low levels of digital literacy among the public and limited oversight. Meanwhile, law enforcement against information manipulation on social media has not been effective due to limitations in legal substance, the capabilities of law enforcement officials, and technological challenges such as deepfakes and the borderless nature of the internet. Therefore, it is necessary to strengthen regulations, enhance the capacity of law enforcement officials, and improve the public’s digital literacy to create more effective legal protection in the digital age.

Abstract

Penelitian ini mengkaji urgensitas rekonstruksi perlindungan hukum terhadap anak berkebutuhan khusus (ABK) sebagai korban kekerasan seksual di Indonesia. Meskipun telah terdapat regulasi yang mengatur mengenai restitusi dan kompensasi, pelaksanaannya masih bersifat fakultatif karena hakim hanya “dapat” memutuskan, bukan merupakan kewajiban hukum. Ketiadaan norma yang mengikat tersebut berdampak pada lemahnya pemenuhan hak korban, ditambah dengan minimnya perhatian pemerintah dalam memberikan dukungan pemulihan secara medis, psikologis, maupun sosial. Penelitian ini menegaskan bahwa orientasi kebijakan selama ini lebih menitikberatkan pada pemberatan sanksi pelaku, sementara hak-hak korban masih terabaikan. Rekonstruksi diperlukan melalui penguatan kewajiban restitusi dan kompensasi, skema pembiayaan negara, mekanisme eksekusi putusan, serta layanan rehabilitasi terpadu bagi korban. Dengan demikian, perlindungan hukum bagi ABK korban kekerasan seksual dapat lebih implementatif, menjamin kepentingan terbaik bagi anak, serta mewujudkan keadilan substantif.

Abstract

Gelar perkara khusus merupakan instrumen kontrol internal Polri yang memiliki kekuatan normatif mengikat bagi penyidik untuk memastikan bahwa proses penyidikan dilakukan secara objektif, profesional, dan akuntabel. Akan tetapi, dalam praktiknya, rekomendasi gelar perkara khusus tidak selalu ditaati oleh penyidik meskipun sifatnya wajib, sehingga menimbulkan potensi penyimpangan prosedural yang dapat berpengaruh pada keabsahan penetapan tersangka. Permasalahan ini menjadi penting terutama setelah Putusan Mahkamah Konstitusi Nomor 21/PUU-XII/2014 menegaskan bahwa penetapan tersangka tidak dapat dinilai hanya berdasarkan terpenuhinya jumlah alat bukti secara kuantitatif, tetapi juga harus diuji melalui standar kualitatif yang menggambarkan proses penyidikan yang sah dan dapat dipertanggungjawabkan. Meskipun demikian, praperadilan dalam praktik sering kali masih berfokus pada aspek formal dan kuantitatif tanpa menilai apakah penyidik telah mematuhi hasil gelar perkara khusus sebagai bagian dari proses kualitatif tersebut. Artikel ini bertujuan untuk menjelaskan kekuatan normatif gelar perkara khusus, mengidentifikasi tantangan penerapannya dalam forum praperadilan, serta menawarkan urgensi harmonisasi antara kontrol internal dan kontrol yudisial. Dengan menggunakan metode penelitian hukum normatif melalui analisis peraturan, aturan internal Polri, putusan praperadilan, dan doktrin pascaputusan Mahkamah Konstitusi, pembahasan menunjukkan bahwa belum terdapat keselarasan antara standar internal Polri dan parameter penilaian praperadilan. Kontribusi ilmiah artikel ini terletak pada argumentasi bahwa hasil gelar perkara khusus perlu dijadikan parameter evaluatif dalam praperadilan agar penyidikan tidak hanya sah secara formal, tetapi juga akuntabel secara substantif.
