Abstract

Abstract

Contemporary debates on Islamic family law increasingly highlight a critical tension between enduring hierarchical legal formulations and evolving demands for gender justice in pluralistic societies. Despite extensive reform efforts, existing frameworks often fail to translate normative equality into substantive justice, particularly in the distribution of spousal rights and obligations. This study addresses this unresolved gap by reconstructing the conceptual foundation of spousal relations in Indonesian Islamic family law through a maqasid al-shariah–based gender justice approach. Using a qualitative normative–socio-legal design, the research analyzes legal texts, scholarly discourse, and institutional practices to examine how spousal roles are constructed, legitimized, and operationalized. The findings demonstrate that the prevailing legal framework remains structurally anchored in a hierarchical paradigm that equates economic provision with authority, thereby institutionalizing asymmetrical power relations and marginalizing non-material contributions. While material welfare is relatively safeguarded, broader maqasid objectives—particularly justice, reciprocity, and human dignity—are only partially realized. Unlike prior studies that address isolated dimensions of marital inequality, this research advances a comprehensive and integrative framework that reconceptualizes spousal relations as dynamic, reciprocal, and context-sensitive. The study thus moves beyond doctrinal critique by exposing the epistemological limitations of existing interpretations and proposing a relational and substantive justice model grounded in the holistic objectives of Islamic law. This contribution not only enriches Islamic legal scholarship but also positions the study within global discussions on gender, legal reform, and ethical governance. Practically, it provides a conceptual basis for developing more equitable and context-responsive legal interpretations in contemporary Muslim societies.

Abstract

Dahor Village possesses significant potential in biological resources; however, these have not been optimally utilized to support community welfare. The excessive use of chemical fertilizers has also had a negative impact on the environment and soil fertility. Limited access to quality fertilizers and a lack of skills in organic waste processing hinder agricultural productivity. The innovation of liquid organic fertilizer (LOF) made from local raw materials emerges as an appropriate solution to these challenges. This activity aims to empower the community of Dahor Village through training and assistance in LOF production to enhance economic self-reliance and support the achievement of the Sustainable Development Goals (SDGs). The method employed involved a participatory approach through outreach, technical training, hands-on LOF production, and evaluation of activity outcomes. The participants included farmer groups, housewives, and village youth. The results showed a high level of enthusiasm from the community, demonstrated by increased knowledge and skills in producing and applying LOF. The community began reducing the use of chemical fertilizers and switching to more environmentally friendly LOF. In addition to improving crop yields, LOF is now marketed locally as a flagship village product. Household incomes increased, and awareness of organic waste management grew significantly. This initiative also strengthened community collaboration and supported a local economy based on green innovation. In conclusion, LOF innovation has proven effective in promoting sustainable agricultural practices, strengthening the village economy, and aligning with the spirit of the Merah Putih Economy and the achievement of the SDGs

Abstract

The rapid development of digital technology has transformed social interaction while simultaneously increasing women’s vulnerability to online gender-based violence, including revenge pornography, cyber harassment, and doxxing. Existing studies in cyberfeminism and digital legal scholarship demonstrate that digital spaces often reproduce patriarchal structures and discriminatory practices against women. Meanwhile, contemporary Islamic legal studies indicate that maqāṣid al-sharī‘ah possesses conceptual flexibility to respond to emerging socio-technological issues; however, these perspectives are rarely integrated systematically within the discourse of Islamic Criminal Law (fiqh al-jināyah). This study aims to reinterpret fiqh al-jināyah through the frameworks of maqāṣid al-sharī‘ah and cyberfeminism in order to construct a more inclusive and adaptive legal paradigm for protecting women’s rights in the digital era. Employing a normative juridical method, this research analyzes primary Islamic legal sources, classical fiqh literature, fatāwā, and Indonesian statutory regulations, including the Electronic Information and Transactions Law (UU ITE), the Personal Data Protection Law (UU PDP), and the Sexual Violence Crime Law (UU TPKS). The study also incorporates contemporary literature on cyberfeminism, digital violence, and gender justice. The findings reveal that the principles of maqāṣid al-sharī‘ah, particularly ḥifẓ al-‘irḍ (protection of dignity) and ḥifẓ al-nafs (protection of life), provide a strong normative foundation for categorizing digital gender-based violence as jarīmah ta‘zīr requiring adaptive sanctions. Furthermore, cyberfeminism contributes a transformative epistemological approach by repositioning women as active agents in legal interpretation and reform. This study ultimately contributes to the reconstruction of Islamic criminal jurisprudence that is gender-sensitive, contextually responsive, and aligned with the realities of contemporary digital society.

Abstract

The rapid growth of online gambling has emerged as a structural threat to family resilience in Indonesia. This article investigates online gambling as a primary catalyst for marital breakdown through the lens of Islamic Family Law, specifically questioning its impact on family stability and the fulfilment of child protection rights. The study utilizes a normative-empirical juridical method, integrating the analysis of Islamic legal norms, such as the Qur'an, Hadith, and the Compilation of Islamic Law (KHI), with empirical data and evidentiary practices from the Bojonegoro Religious Court. Findings indicate that online gambling is prohibited as maisir and constitutes a fundamental violation of the husband’s obligations as qawwam (leader and protector), particularly regarding financial maintenance (nafkah). Furthermore, the study reveals that courts are adopting a progressive legal interpretation of Article 116 letter (f) KHI by accepting digital evidence, such as betting histories and transaction screenshots, to prove the persistent conflict necessary for divorce. The article contributes to legal knowledge by offering a replicable normative-empirical framework for jurisdictions facing digital-era family law challenges. It shifts academic focus from general gambling to the specific, addictive nature of online platforms and provides a basis for legal reform, including mandating psychological counselling for digital addiction within court mediation processes. This study underscores that protecting family resilience requires an integrated approach of legal, social, and religious enforcement.

Abstract

The increasing prevalence of online gambling has created new challenges for Muslim family life and has increasingly appeared in divorce disputes before religious courts in Indonesia. Despite its growing social impact, the legal position of online gambling in divorce cases remains unclear, particularly regarding how courts interpret and apply existing provisions of Islamic family law. This study aims to analyze the legal position of online gambling in divorce cases through the framework of maqāṣid al-sharī‘ah. This research employs a normative legal method using statutory, conceptual, and case approaches, focusing on the analysis of Religious Court Decision Number 123/Pdt.G/2024/PA.Prob and Decision Number 669/Pdt.G/2024/PA.Ska. The findings indicate that although online gambling was alleged in both cases and explicitly admitted by the defendant in the Surakarta case, the courts based their decisions on Article 116 letter (f) of the Compilation of Islamic Law concerning continuous disputes and quarrels rather than Article 116 letter (g) concerning gambling behavior. The analysis further shows that online gambling acquires legal significance primarily through its consequences, including prolonged conflict, neglect of marital obligations, and the deterioration of family relationships. From the perspective of maqāṣid al-sharī‘ah, these consequences are closely related to the protection of family welfare, economic stability, and social harmony. The study highlights the interaction between legal norms, judicial reasoning, and contemporary digital realities in the practice of Islamic family law.
