Abstract

The rapid advancement of technology has resulted in the exponential transformation of social interactions and relations. The ease of access and broad reach have increased internet penetration, particularly among children aged 13-17 in Magelang Regency. While this situation can have positive impacts, the low level of literacy and awareness of the use of digital devices has increased the risk of online-based violence against children. This research focuses on three issues: the conditions and dynamics of online-based violence against children in Magelang Regency, the measures already taken to respond to online-based violence against children in Magelang Regency, and prevention strategies for online-based violence against children from the perspective of fulfilling children's rights and protection in the future. This study employs a qualitative approach with children aged 13-17 years. The research findings reveal that children aged 13-17 years in Magelang Regency experience two forms of violence: cyberbullying and sexual harassment. Low digital media literacy and risky interaction behaviours, coupled with inadequate mitigation efforts, pose a significant potential for an increase in this type of violence in the future. There are seven prevention strategies: digital literacy for children and parents; safe environment and technology; accessibility of services; strengthening regulations and child protection institutions; strengthening coordination and synergy; public awareness; and parental/family participation.

Abstract

The formation of regional regulations (Perda) often ignores the cultural dynamics of local communities, thus triggering regulatory conflicts, as occurred in the case of the KSPN Borobudur and the implementation of policies on agricultural sector in Magelang. This study aims to map the forms of local wisdom values ​​that characterize the social characteristics of Magelang society while constructing a normative framework in the formation of humanistic and responsive Perda. The method used is qualitative with a normative-empirical research type through a conceptual and sociological approach. Data collection was carried out by purposive sampling in three representative locations, namely Gelangan Village (military site), Payaman Village (Islamic boarding school), and Wonolelo Village (mountain agrarian site). The results indicate that Magelang society is divided into three cultural typologies with unique value characteristics: the values ​​of discipline and obedience in the military community; the values ​​of friendliness and religiosity in the Islamic boarding school community; and the values ​​of simplicity and natural-cultural preservation in the mountain agrarian community. These empirical values ​​have been successfully normatively transformed into principles for designing regional laws that are in line with Law No. 12 of 2011, such as the principles of inclusivity, proportionality, and ecological sustainability. This study concludes that the integration of the three-typology of local wisdom is the primary foundation for a progressive-humanist regional legislative model. This normative model constructs three main prerequisites: conceptual reconciliation of positive law with living law from the planning stage, institutionalisation of socio-religious values ​​as mandatory considerations in the Academic Draft, and strengthening the space for substantive public participation to produce responsive and conscientious regional regulations.

Abstract

The phenomenon of criminalizing business decisions within State-Owned Enterprises (SOEs) shows that there is a serious tension between the logic of corporate governance and the goal of eradicating corruption. The Supreme Court Decision No. 121 K/Pid.Sus/2020 regarding the acquisition of BMG Australia by PT Pertamina (Persero) is an example of how managerial actions carried out through legitimate corporate procedures can be construed as criminal acts because they lead to state losses. This study aims to analyze the ambiguity of the criminalization of business risk through a doctrinal legal approach combined with the perspective of legal realism. The research method uses a conceptual analysis of the Business Judgment Rule as a standard of accountability of the board of directors in decision-making, as well as a case approach to the Supreme Court's legal considerations with qualitative analysis techniques based on juridical reasoning. The results of the study show that judges emphasize more on the results of decisions in the form of state losses as an indicator of error, so that the line between economic risk and unlawful acts becomes blurred. This condition poses a potential chilling effect that can hinder the courage of the board of directors in carrying out business strategies in risk-intensive SOEs. This research contributes to the need to reformulate the application of Business Judgment Rule in corporate corruption cases to prevent excessive criminalization of business decisions that are not based on malicious intent or conflict of interest.

Abstract

Penelitian ini bertujuan untuk mengkaji dampak dari pola asuh "Love Toxic Parenting" terhadap hak pendidikan anak dalam perspektif Maqasid Syariah menurut Jasser Auda. "Love Toxic Parenting" mengacu pada pola pengasuhan yang tampak penuh cinta dan kasih sayang, namun justru berdampak negatif terhadap perkembangan anak, khususnya dalam aspek pendidikan. Dalam konteks Indonesia, meskipun Konvensi Hak Anak telah diratifikasi melalui Keppres No. 36 Tahun 1990, pemenuhan hak pendidikan anak masih sering terhambat oleh praktik pengasuhan yang tidak ramah anak. Penelitian ini menggunakan pendekatan hukum empiris dengan metode yuridis-sosiologis dan pendekatan konseptual. Data primer dikumpulkan melalui observasi, wawancara mendalam, dan FGD di SMA 1 Magelang, sedangkan data sekunder berasal dari literatur hukum dan kajian Maqasid Syariah. Diharapkan penelitian ini dapat menghasilkan kontribusi teoritis terhadap pengembangan konsep pengasuhan berbasis maqasid dan memberikan rekomendasi kebijakan pengasuhan ramah anak yang dapat diimplementasikan dalam keluarga dan masyarakat.
