Abstract

Penelitian menggunakan metode yuridis normatif dengan pendekatan kualitatif, menganalisis peraturan perundang-undangan seperti Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika (Indonesia) dan Criminal Law of the People’s Republic of China.

Abstract

Industrial relations arbitration remains limited and has not yet become a primary option for disputing parties. The purpose of this study is to reconceptualize Industrial Relations Arbitration with a focus on procedural and institutional reform. This study begins with more fundamental principles, taking into account the dimensions of worker protection and the urgent need for institutional restructuring of Industrial Relations Arbitration. The research method used is doctrinal legal research with a prescriptive-analytical approach, combining conceptual, legal, and case-based approaches. The findings reveal several problems, such as the limited scope of disputes that can be submitted and the scarcity of qualified arbitrators. The reconceptualization of Industrial Relations Arbitration offers a solution by expanding the absolute competence of arbitration forums to cover all types of labor disputes. This will optimize the forum for resolving disputes between employers and workers as well as conflicts between trade unions. Furthermore, restructuring the institutional framework of Industrial Relations Arbitration is crucial. The establishment of a competent and independent arbitration body will increase the attractiveness and quality of dispute resolution, with the fundamental principle of maintaining harmonious and sustainable industrial relations.

Abstract

Abstract

The meaning of commonality in Class Action (CA) lawsuits in Indonesia, which remains abstractly formulated, leaves room for judges to interpret it differently, potentially leading to "disparities in rulings and legal uncertainty." This research aims to compare the regulation of CA in Indonesia and the United States, specifically regarding the concept of commonality, and to formulate a more concrete and applicable concept for the Indonesian legal system. The normative legal research used in this study employs a legislative and comparative law approach. Based on the study, this research found that in the United States, commonality has developed more clearly through jurisprudence by emphasizing a single core issue (common contention) and the dominance of a shared issue (predominance), unlike Indonesia, which still lacks a definite standard. From this condition, this research takes a firm position that commonality should not be merely interpreted as a general similarity, but rather as a unity of substantive issues that can be proven and resolved collectively in a single decision. On this basis, it is necessary to formulate a norm that is "concrete, measurable, and operational" so that the CA mechanism can truly provide legal certainty.

Abstract

The growing global concern for sustainable development has prompted a major transformation in legal systems and financial regulation, including the Islamic banking sector. Conceptually, maqashid al-shariah and the Sustainable Development Goals (SDGs) share a normative orientation toward promoting public welfare, social justice, and sustainable development. Despite this philosophical convergence, the integration of these two frameworks into Indonesia’s Islamic banking regulatory system continues to face significant normative challenges. The existing legal framework remains predominantly focused on formalistic sharia compliance and the prudential principle, whereas the sustainability dimension has not yet been comprehensively operationalized within Islamic banking regulation. This study aims to analyse the normative gaps in Islamic banking regulation that impede the integration of maqashid al-shariah and the SDGs, while formulating a legal reform model capable of addressing such obstacles. This research adopts a normative legal method, or doctrinal legal research, using statutory, conceptual, and philosophical approaches. It examines several principal regulatory frameworks, including Law Number 6 of 2023 on Job Creation, Law Number 4 of 2023 on the Development and Strengthening of the Financial Sector, sustainable finance regulations, sources of Islamic law, and contemporary legal doctrine. The data are analysed through a normative gap analysis model supported by systematic, teleological, and maqashid-based legal interpretation. The findings indicate that the barriers to integration arise not only from normative deficiencies, but also from regulatory fragmentation, institutional design, and a legal culture that continues to prioritize a formalistic fiqh-based compliance approach. Through the lens of Law and Development Theory, this study argues that Indonesia’s legal structure remains in a transitional phase and does not yet fully support the operational integration of maqashid al-shariah and sustainability principles. Accordingly, this study proposes a legal-operational framework based on maqashid compliance indicators as an adaptive model of legal reform to strengthen the integration of Islamic ethical values and sustainability principles within Islamic banking regulation.
