Abstract

Community service in the form of disseminating Provincial Regulation Number 4 of 2022 regarding the Facilitation of Prevention and Eradication of Narcotics, Narcotic Precursors, and Pyschotropic Substances Abuse (P4GN-PNP) in Sungai Kungan Samarinda City, is one of the efforts by the East Kalimantan Government to impart an understanding to the community about the government’s commitment to minimizing the damage caused by drug abuse. The method of this activity involves presenting the material and conducting discussions on the latest provisions withing the regulation. One notable aspect highlighted by the participant during the dissemination of this regulation is the provision for educational institutions, both public and private, which under the jurisdiction of the Provincial Government, to accept students who have been involved in drug abuses. This serves as concrete evidence of the East Kalimantan Provincial Government’s commitment to supporting the social reintegration process for individuals involved in drug, narcotic precursor, and pyschotropic substance abuse. This initiative receives full support from the East Kalimantan Provincial Legislative Council (DPRD) with the aim of fostering a collective commitment among the residents of Samarinda City to distance themselves from all forms of drug abuses.

Abstract

Penelitian ini mengesplorasi perpekteif hukum terhadap tindak pidana perundungan anak di media sosial, pesatnya kemajuan teknologi dan meluasnya penggunaan platform media sosial telah meningkatkan jumlah kasus perundungan di media sosial secara signifikan, sehingga menimbulkan ancaman besar terhadap kesejahteraan mental dan emosional anak-anak. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum dan pertanggungjawaban pelakunya berdasarkan hukum di Indonesia. Penelitian ini menggunakan metode penelitian yuridis normatif yang mengkaji norma, ,asas, dan peraturan hukum terkait. Dengan menggunakan pendekatan doctrinal, pendekatan undang-undang, dan analisis kasus. Penelitian ini berupaya untuk memberikan pemahaman terhadap perlindungan hukum bagi korban perundungan anak di media sosial, yang diatur di berbagai undang-undang yang mencakup UUD 1945, UU Perlindungan Anak, UU Perlindungan Saksi dan Korban, serta UU ITE. Pertanggungjawaban terhadap pelaku tindak pidana perundungan anak di media sosial melibatkan berbagai aspek hukum yang diatur dalam UU ITE dan UU Perlindungan Anak. Pelaku dapat dikenai sanksi pidana seperti penjara dan denda sesuai dengan pelanggaran yang dilakukan.

Abstract

Legal arrangements regarding drinking water health standards, forms of violations that occur in the field, and law enforcement procedures against business actors who do not fulfill the provisions. This research uses a normative juridical method with an analytical approach to legislation, legal doctrine, and a study of policy implementation practices in the public health sector. The results show that the non-compliance of Refillable Drinking Water Depots with drinking water quality standards both physically, chemically, and micro biologically has the potential to pose a serious risk to consumer health. The Health Law expressly regulates that violations of these provisions can be subject to administrative sanctions in the form of written warnings, fines, and revocation of business licenses, and under certain conditions can be extended to the criminal realm in the form of imprisonment. Law enforcement is carried out through routine supervision by relevant agencies, periodic laboratory testing, and the implementation of a risk management system. In the context of criminal liability, the element of fault (mensrea) is an important requirement that must be proven to be able to ensnare business actors into the criminal realm. The research conclusion emphasizes the importance of strict and consistent application of regulations accompanied by continuous supervision so that the safety of drinking water from refillable drinking water depots is maintained. In addition, education to depot entrepreneurs regarding the obligation to fulfill water quality standards and increasing public awareness of the right to safe, proper and healthy drinking water are preventive strategies that need to be continuously developed in the context of protecting public health.
