Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana formulasi masa jabatan Kepala Desa yang ideal ditinjau dari prinsip Good Governance, Sistem Demokrasi dan perbandingan kekuasaan pemerintahan yang lainnya. Metode penelitian yang digunakan adalah normatif yang merupakan suatu proses penelitian untuk menemukan suatu aturan hukum, prinsip-prinsip hukum untuk menjawab dan menghasilkan konsep baru dalam menyelesaikan permasalahan hukum yang dihadapi. Hasil penelitian menunjukkan bahwa masa jabatan Kepala Desa yang seharusnya dibatasi menjadi 5 tahun dengan maksimal 2 periode berturut-turut. Hal ini tentu sejalan dengan prinsip Good Governance karena mengandung unsur keadilan, prinsip negara hukum yang menjelaskan bahwa sudah seharusnya sebuah kekuasaan itu haruslah dibatasi agar menghindari hal-hal yang tidak diinginkan seperti korupsi, kolusi dan nepotisme, kemudian masa jabatan 5 tahun juga terdapat sirkulasi demokrasi dan membuka ruang bagi masyarakat lain yang merasa dirinya layak untuk maju sebagai Kepala Desa.

Abstract

The elected president appoints state ministers as a token of appreciation to the supporting coalition parties. The total percentage of post-reform for appointing state ministers from political party caolitions is 55,7%. In addition, the Indonesian Survey Institute (LSI) denotes that state ministers from professionals by 78,3% and from political parties or coalitions of political parties by 4.1%. specifically, this research was conducted using normative methods with a statue approach and a comparative approach. The research finding was obtained by comparing two parliamentary systems, namely the Netherlands and  England, and two presidential systems, namely the United States and South Korea. The appointment of state ministers in Indonesia post reform until now has main characteristics apparent in the appointment proves, namely the interest in coalition parties that have supported the party of the current elected president. Therefore, the ideal mechanism for appointing state ministers is to reconstruct Act Number 39 of 2008 concerning State Ministers, establish a special selection, team for ministerial appointments, the selection team proceeds with a sequence of selection, selection based on quality and integrity, and the appointment of state minister candidate by the president.

Abstract

This study aims to analyze the role of the Indonesian Constitutional Court in carrying out its function as a stronghold of law enforcement in Indonesia after the reform era, as well as evaluate the extent to which this institution has succeeded in protecting human rights through its decisions. Methods: This research is categorized as normative legal research with a philosophical and analytical approach. The focus is on rational, critical, and philosophical analysis of the legal issues raised. The analytical descriptive method is used to describe the applicable legislation, legal theory, and positive law enforcement practices related to the problem under study. Results: The results show that the Indonesian Constitutional Court plays an important role in upholding the Constitution and social justice with a careful and balanced approach. Key decisions such as No. 18/PUU-V/2007, No. 75/PUU-XIII/2015, and No. 102/PUU-XXI/2023 highlight the importance of legislative autonomy, legal clarity, and certainty, as well as the presumption of innocence and prudence in political intervention. The application of Aharon Barak's theory of "proportionality," Lon Fuller's "legal certainty," and Alexander Bickel's "judicial restraint" provides insight into ensuring a balance between human rights, legal certainty, and the integrity of due process.

Abstract

Penelitian ini berangkat dari pentingnya implementasi Pasal 32 Peraturan Daerah Kabupaten Gorontalo Nomor 1 Tahun 2024 tentang Pajak Daerah dan Retribusi Daerah. Fokus utama penelitian adalah bagaimana peraturan ini diterapkan untuk meningkatkan Pendapatan Asli Daerah (PAD) Kabupaten Gorontalo, sekaligus mengukur efektivitas, efisiensi, dan keadilan dalam proses pemungutannya. Pendekatan ini diharapkan dapat mengungkap bagaimana peraturan tersebut tidak hanya berjalan di atas kertas, tetapi juga berkontribusi nyata bagi masyarakat. Penelitian ini menggunakan metode hukum normatif empiris, kombinasi menarik antara studi terhadap aturan hukum tertulis dengan pengamatan terhadap kenyataan di lapangan. Dengan kata lain, pendekatan ini tidak hanya membaca teks hukum seperti seorang detektif, tetapi juga melihat bagaimana teks itu berdampak dalam kehidupan nyata—seperti bagaimana teori pajak bertemu dengan kebiasaan harian masyarakat yang suka "lupa bayar" pajak. Hasil penelitian menunjukkan bahwa, meskipun Pasal 32 telah diterapkan sesuai prosedur, beberapa tantangan masih mengintai. Tantangan tersebut meliputi minimnya sosialisasi kepada masyarakat, keterbatasan sumber daya manusia di bidang perpajakan, dan tingkat kepatuhan wajib pajak yang perlu dorongan lebih besar. Untuk menjawab tantangan ini, pemerintah daerah telah mengadopsi berbagai langkah strategis, mulai dari pelatihan aparatur hingga integrasi teknologi digital. Upaya ini diharapkan menjadi "senjata rahasia" untuk memastikan pajak dan retribusi lebih efektif sekaligus diterima dengan baik oleh masyarakat.

Abstract

Penelitian ini bertujuan untuk mengetahui faktor apa yang mempengaruhi penerapan peraturan daerah mengenai penertiban marka jalan. Penelitian ini merupakan penelitian empiris yang menyajikan data berdasarkan fakta lapangan, kemudian dianalis secara dekriptif kualitatif. Hasil penelitian menunjukan bahwa faktor yang mempengaruhi penerapan peraturan daerah mengenai penertiban marka jalan di Kota Gorontalo ialah kurangnya sarana dan rasarana yang mendukung penegakkan hokum terutama berkaitan dengan pelanggaran oleh pengemudi, dan pemberian edukasi kepada pengguna jalan yang tidak bisa membedakan tanda-tanda maupun rambu lalu lintas, termasuk yang sengaja melawan arah dan mengindahkan tempat pemberhentian. Keterbatasan dana pula menjadi kendala pihak satpol PP untuk mengajak kerjasama pihak lainnya dalam melakukan penegakan hukum misalnya dinas perhubungan dalam mengatasi masalah pengadaan tanda atau marka jalan yang ada di Kota Gorontalo. Selain itu, kurangnya kesadaran masyarakat yang berkaitan pula dengan budaya hukum maupun kebiasaan masyarakat itu sendiri. Dimana masyarakat belum menyadari adanya sebuah regulasi. Artinya, masyarakat kurang bekerjasama dalam memaksimalkan peraturan daerah sehingga menjadi faktor penghambat penegakan perda itu sendiri.

Abstract

The purpose of this study is to investigate the rationale and consequences of the strategy of reducing executive authority, particularly that of the president, that was incorporated into the Republic of Indonesia Constitution of 1945 (UUD 1945) via a series of modifications. To comprehend the modifications to the constitution, this study employs a normative or doctrinal approach, concentrating on the analysis of pertinent papers, reports, and literature. According to the findings, these amendments were implemented in reaction to calls for reform and democratization. They sought to build a more balanced system of government with strong principles of checks and balances among the executive, legislative, and judiciary, and they eliminated the sacred and static views of the 1945 Constitution during the New Order era. This embodies the shift in Indonesian governance from a top-down, autocratic system to a bottom-up, democratic one, where checks and balances on the presidency are put in place to forestall any return to autocracy and guarantee greater citizen input into policymaking

Abstract

This article conducts a normative analysis of the Constitutional Court's Decision No. 85/PUU-XX/2022 concerning the establishment of a special electoral court within the framework of legal sovereignty theory. The objective is to scrutinize the decision's compatibility with the principles of legal sovereignty, emphasizing the universal application of law. The normative method is employed, focusing on legal documents, statutes, and constitutional provisions. The study reveals that the decision's implications raise concerns regarding the universal enforcement of law in addressing complex electoral disputes. The absence of a special electoral court challenges the effective resolution of election-related issues. This analysis contributes to the ongoing discourse on the role of legal sovereignty in shaping the electoral dispute resolution system

Abstract

The objective of this paper is to formulate the ideal strengthening of the Attorney General's Office's authority in the fields of civil and administrative law to provide legal assistance in the implementation of strategic projects. This study employs a normative legal research method using several approaches, namely the Statutory Approach, the Conceptual Approach, and the Case Approach. The research utilizes a data analysis technique based on deductive logic with a prescriptive nature. The findings of this paper indicate that the authority of the Attorney General's Office in the fields of civil and administrative law needs to be strengthened in terms of both substance and structure to support legal assistance for national strategic projects. Pursuant to Article 18 of Law No. 11 of 2021, the Attorney General's Office acts as the State Attorney in both litigation and non-litigation matters in the interests of the state and government. This assistance is carried out through the safeguarding of strategic projects and legal risk mitigation. A paradigm shift from a repressive to a preventive approach is crucial to minimize deviations and support sustainable governance. Therefore, coordination among units, supervision, and comprehensive regulations are necessary to ensure transparency and accountability.

Abstract

This study examines the application of the retroactive principle in the issuance of State Administrative Decisions (KTUN) by regional administrative officials amid digitalization in public services. The research aims to examine the legal basis of retroactive application within administrative law and to identify appropriate mechanisms to ensure its benefit for public administration and society. Using a normative juridical method with statutory and conceptual approaches, the research is supported by literature studies on legal documents and regulations. The findings indicate that, under Indonesian administrative law, the retroactive application of KTUN is legally permissible if it meets specific conditions outlined in the Law on Government Administration—primarily to prevent greater harm and/or to protect citizens’ rights. Retroactive KTUN may address discrepancies between the timing of decision issuance and actual administrative activities, especially in a digital governance environment. The study concludes that to ensure legal certainty and accountability, such application must be based on formal mechanisms, including the development of standard operating procedures (SOPs) and the issuance of regional head regulations as normative foundations. These measures are essential to institutionalize retroactive KTUN and ensure its use aligns with principles of legal certainty, public benefit, and good governance in regional government administration.

Abstract

This article examines the shift in local government authority over mineral and coal mining management following the enactment of Law Number 23 of 2014 on Regional Government. The transfer of authority from regency/city governments to provincial and central governments has created normative disharmony between the Regional Government Law and the Mining Law, resulting in legal uncertainty at the implementation level. Using a normative juridical approach and Hans Kelsen’s theory of the hierarchy of norms, this article analyzes the legal validity of the transfer and identifies structural conflicts within the legal system. The findings indicate that the current regulation lacks both hierarchical consistency and functional clarity. Therefore, a reconstruction of the legal framework for mining governance is required to balance the principle of legality with the concept of regional autonomy. A model of limited delegation, sectoral regulatory harmonization, and the application of multilevel governance are proposed as key recommendations to ensure a fair, effective, and constitutional relationship between central and local governments.
