Abstract

Ransomware is a type of malware designed to lock or encrypt victim data so that it cannot be accessed. Once the victim's data is locked, the perpetrator will ask for a ransom to restore access, usually in the form of digital currency such as Bitcoin which is difficult to track. Ransomware crimes are regulated in Article 33 of the ITE Law, however, Article 33 of the Electronic Information and Transactions Law (UU ITE) has weaknesses in its formulation because it does not include specific elements related to ransomware crimes, especially in relation to the element of requesting ransom payments. This creates a lack of legal certainty regarding ransomware crimes so that many cases of ransomware crimes cannot be prosecuted due to legal gaps. The purpose of this study is to provide input to law enforcement, police, prosecutors, judges, and the community and government in Countering the Threat of Ransomware Crimes in Indonesia. Based on the results of the study and discussion, it can be concluded. First, Article 33 of the Electronic Information and Transactions Law only regulates disruption of electronic systems, but does not explicitly include the elements of "extortion" or "demand for ransom payment" which are the core of ransomware crimes. Second, to strengthen the Electronic Information and Transactions Law and Indonesia's legal framework in countering the threat of ransomware, several important steps must be taken. First, one of the main solutions in dealing with ransomware crimes is to add provisions that explicitly regulate this crime in legislation, especially in the Electronic Information and Transactions Law. Keywords: Information and Electronic Transactions Law, Ransomware Crime, Indonesia

Abstract

Judicial Pardon is a legal mechanism that grants judges the discretion to decide a case even when the defendant is formally proven guilty. Unlike the traditional criminal law approach, which emphasizes legality and punishment, Judicial Pardon takes into account personal, situational, and social impact factors related to sentencing. This study employs a normative legal method with a synchronization type, analyzing the alignment of laws and regulations both vertically and horizontally. The findings indicate that the synchronization of judicial pardon within Indonesia's penal system is based on three main foundations: philosophical, juridical, and sociological. Philosophically, judicial pardon aligns with the principles of substantive and restorative justice, ensuring proportional punishment while providing room for the rehabilitation of offenders and the restoration of society. The ideal concept of judicial pardon in Indonesia’s future is crucial for establishing a more just, humane, and responsive criminal justice system. Keywords: Judicial Pardon, Criminal Justice Reform, Substantive Justice, Penal Policy, KUHAP

Abstract

Corruption Crime (Tindak Pidana Korupsi or Tipikor) poses serious threats to state finances, governance, and public trust, prompting its long-standing classification in Indonesia as an extraordinary crime regulated under Law No. 31 of 1999 in conjunction with Law No. 20 of 2001. The enactment of Law No. 1 of 2023 concerning the Indonesian Criminal Code (KUHP), however, marks a significant shift in the regulatory framework of corruption offenses, including changes in criminal sanctions and the integration of corruption into the general criminal law system. This transformation raises critical concerns regarding the future effectiveness of anti-corruption law enforcement and the consistency of criminal policy. This study aims to compare the regulation of corruption crimes under the 2023 Criminal Code and the Anti-Corruption Law, focusing on offense formulation and sanctioning patterns. Using a normative juridical method with a comparative legal approach, this research analyzes the implications of the regulatory shift for anti-corruption strategies in Indonesia. The findings highlight the need for careful legal harmonization to ensure that the reform of the Criminal Code does not undermine the deterrent function and integrity of corruption law enforcement. Keywords: Legal Comparison; Indonesian Criminal Code 2023; Anti-Corruption Law; Corruption Crime; Criminal Sanctions
