Abstract

The principle of the presumption of innocence in the criminal procedure lawin effect in our country contains two purposes. First, to provide protection andguarantees for a human being who has been accused of committing a criminal actduring the case examination process so that his human rights are not raped.Second, to provide guidelines for officers to limit their actions in carrying out anexamination because it is a human being who has the same dignity and dignity asthe person conducting the examination.This type of research is normative juridical research. In this research, theresearcher discusses legal principles, namely the principle of the Presumption ofInnocence, which is the principle in which a person is considered innocent until acourt decision finds him guilty.The conclusions that can be obtained from the results of the research arefirst, actions taken by the police against the occurrence of shootings at the stageof investigating cases of criminal acts of terrorism according to the regulation ofthe National Police Chief and Police Chief, which is the Chief of PoliceRegulation Number 8 of 2009 concerning the Implementation of Human RightsPrinciples and Standards in Carrying Out Police Duties. The Republic ofIndonesia states that the use of firearms can only be used to protect human life.Then this contradicts the Standard operational procedure (SOP) for the use offirearms issued by the Police Criminal Investigation Unit. Second, the LegalImpact on Shootings at the Investigation Stage of Criminal Acts of TerrorismLinked to the Presumption of Innocence, it means the suspect is not necessarilyguilty. Because the right to declare someone guilty is only a court with a decisionthrough a valid legal process. The act was also carried out not in a state of forceddefense, even though the suspect also has the right not to be deprived of hisliberty, except in very special cases. Meanwhile, extrajudicial killings are carriedout not in a state of forced defense and there are also no laws and regulations thatjustify extrajudicial killings even though these acts are committed againstsuspected criminal acts of terrorism, which are included as extraordinary crimes.Keywords: Crime, Terrorism, Presumption of Innocence, Police.

Abstract

Based on the author's observations in the field, it can be seen that in the illegalgold mining area there are former mining excavations in the form of small lakes filledwith yellow-brown water, beside the holes are piled hundreds of cubic stones mixedwith sand from mining residue, while the trees around it looks dry. The law explainsthat the minimum prison term for activities related to the environment is one year, sothat according to the author's assumption, the application of threats in one of thesample cases is less effective. Law enforcement is the efforts taken by the government oran authority to ensure the achievement of a sense of justice and order in society byusing several devices or tools of power, both in the form of laws, to law enforcersincluding the police, judges, prosecutors, and others. lawyer.When viewed from the type, this research is classified as sociological legalresearch, namely research obtained directly from the community or primary dataresearch. The data collection method in this research is the documentation method. Tocollect the data referred to above, the following techniques were used: Libraryresearch. This is done by searching, recordifng, taking inventory, studying data in theform of library materials, and analyzing these data. Observation is a complex process,a process composed of various biological and psychological processes. Observationcan also be said as a method carried out by direct observation of the object of research.From the results of the research and discussion of considerations adjusted toArticle 158 of the Law of the Republic of Indonesia Number 3 of 2020 concerningAmendments to Law Number 4 of 2009 concerning Minerals and Coal in conjunctionwith Article 55 paragraph (1) 1 of the Criminal Code, the elements of the panel ofjudges are considering Not “everyone”, Not “who conducts mining without a permit”,Who commits, orders to do, or participates in carrying out actions. Abstract

Wage is the right of the Worker/Labourer that is received and expressed inthe form of money as a reward from the Employer or employer to theWorker/Labourer which is determined and paid according to a work agreement.agreements, or laws and regulations, including allowances forWorkers/Labourers and their families for a job and/or service that has been orwill be performed. In the provision of wages for workers/labor by employers,violations often occur. One of the violations committed by employers is to giveworkers/laborers wages below the minimum wage. whereas in Article 88 Eparagraph 2 of Law Number 11 of 2020 concerning Job Creation it is clearlystated that; “Entrepreneurs are prohibited from paying wages lower than theminimum wage, and the sanctions are contained in article 185. From 2020 to2022 there were 10 complaints that went to the Riau provincial manpower officesupervisor regarding wage violations.The purpose of this study is to find out howthe law enforcement process is carried out by labor inspectors against wageviolations committed by employers, what are the obstacles to labor inspectors,and to know the efforts made to overcome the wage problem. In addition, thisstudy also examines the role of labor law in solving industrial relations problems.From the results of the research discussion, it can be concluded that theposition of labor law in the Indonesian national legal system can theoretically beseparated into 3 fields, namely the administrative field, the civil field, and thecriminal field. But in practice it must be run simultaneously because it relates toone another. The legal relationship carried out by workers/laborers withemployers is included in the field of civil law. However, during the process ofmaking, implementing, and ending the relationship, the government is supervisedin order to carry out its 3 functions. Abstract

Separatism is an attempt to separate oneself from a country or state. Separatist efforts aim to achieve autonomy or separation to stand alone or to merge with other countries. Which has the aim of separating itself from a region or country, this is done to create an independent region or group and gain its own sovereignty as a new State. The main problems in this research are: Can the separatist movement in Papua qualify as terrorism? What are the obstacles to qualifying the separatist movement as Terrorism?The research method used in this thesis is using normative legal research methods, which is a process to find a rule of law, legal principles, and legal doctrines in order to answer the legal issues faced and by systematically reviewing norms and legal rules and data. from literature study.From the results of the study, there are two main problems that can be concluded. First, the activities of Separatism and Terrorism in the Criminal Code are two different things. Determination of Armed Criminal Groups in Papua or better known as KKB in Papua cannot have legal certainty because it is not in accordance with applicable positive law. Armed Criminal Groups in Papua cannot be prosecuted under Law Number 5 of 2018 because the KKB in Papua is a politically motivated separatist group. Second, law enforcement against these groups will be different from law enforcement in general regulated by the Criminal Procedure Code because the terrorism law is special and deviates from criminal law rules, this is due to the reason that they have political goals, so they cannot be charged under the law terrorism.Keywords : Separatism - Terrorism - Armed Criminal Group.

Abstract

As a form of innovation, information technology is now capable of collecting,storing, sharing and analyzing data. These activities have resulted in various sectors of lifeutilizing information technology systems. Data privacy issues are something that arises whenpersonal data is given to people who are not responsible for committing crimes of misuse ofpersonal data. Privacy is a fundamental human right. Privacy is difficult to define in auniversal sense. Although privacy is difficult to define, the term privacy is used in a broadsense related to the protection of personal data. Thus, it is necessary to increase efforts andefforts to overcome these problems by the police, especially the Riau Regional Police.The purpose of writing this thesis, namely: First, Knowing the law enforcement on the misuseof personal data in Indonesia, Second What are the obstacles in regulating legal protectionagainst misuse of personal data, especially in the formulation of criminal sanctions. Abstract

Fungsi penyelenggaraan pelayanan kesehatan mencakup seleksi fasilitas kesehatan, penyediaan jaringan fasilitas kesehatan, pemberian pelayanan kesehatan secara terstandarisasi, terstruktur, berjenjang, dan terintegrasi. Pemerintah menetapkan regulasi-regulasi yang mengatur standar infrastruktur pelayanan kesehatan, standar pelayanan kesehatan, standar tenaga kesehatan, tarif pelayanan, daftar sediaan obat dan tarif obat, serta standar dan tarif alat medis. Selanjutnya, regulasi-regulasi tersebut menjadi dasar hukum bagi kontrak kerjasama antara BPJS Kesehatan dan fasilitas kesehatan untuk pemberian pelayanan kepada peserta. BPJS menetapkan kriteria seleksi fasilitas kesehatan dan menyeleksi fasilitas kesehatan yang layak untuk bekerjasama. Penetapan kriteria ini bertujuan untuk menjaga kulitas pelayanan kesehatan yang akan didapatkan oleh masyarakat. Oleh karena itu pada proses penyelenggaraannya BPJS Kesehatan berkoordinasi dengan Dinas Kesehatan Kabupaten/Kota setempat, dalam hal mengeluarkan rekomendasi bahwa fasilitas kesehatan tersebut dianggap memenuhi kriteria menjadi mitrakerja/vendor dalam sistem JKN. Peraturan khusus (lex specialis) tentang pengadaan barang jasa pemerintah mempedomani Peraturan Presiden (Perpres) Nomor 12 Tahun 2021 tentang Pengadaan Barang Jasa Pemerintah yang merupakan perubahan dari Peraturan Presiden No 16 Tahun 2018. Adapun petunjuk tertulis dari Perpres ini tertuang didalam Peraturan Lembaga (Perlem) Kebijakan Pengadaan Barang dan jasa Pemerintah (LKPP) Nomor 9 tahun 2018. Dalam Perlem LKPP Nomor 9 tahun 2018 tentang syarat kualifikasi administrasi/legalitas penyedia Barang/Jasa bahwa pimpinan dan pengurus badan usaha bukan sebagai pegawai kementerian/ lembaga/perangkat daerah. Fakta yang ditemukan dilapangan, tidak semua pemilik fasilitas kesehatan swasta mitrakerja BPJS Kesehatan merupakan pelaku usaha non pemerintah, namun ada juga pelaku usaha yang berprofesi sebagai Pegawai Negeri Sipil (PNS) yang mana mereka terlibat secara langsung ataupun tidak langsung didalam proses pengadaan seleksi penunjukan penyedia fasilitas kesehatan swasta dalam sistem JKN. Data ini dapat ditemukan dari informasi yang dipublikasikan oleh BPJS kesehatan, yang dapat diakses oleh masyarakat. Fenomena ini berpotensi terjadinya tindak pidana korupsi (tipikor). Tindak pidana korupsi adalah suatu perbuatan melawan hukum, memperkaya diri sendiri, orang lain, atau suatu badan yang secara langsung atau tidak langsung merugikan keuangan negara, atau diketahui atau patut disangka olehnya bahwa perbuatan tersebut merugikan keuangan negara dan perekonomian negara.

Abstract

Dalam rancangan KUHP yang baru pidana mati merupakan pidanayang bersifat khusus. Karena pidana mati dalam praktek selalumenimbulkan suatu perdebatan. Diantara yang setuju adanyapidana mati tersebut. Bahwa pidana mati menurut pandangan UUD45 setelah di Amandemen dan Undang Undang HAM tidak relevanlagi untuk dipertahankan dalam KUHP nasional yang barn diIndonesia maupun dalam ketentuan diluar KUHP dengan alasan:Karena pidana mati bertentangan dengan jiwa yang ada dalam UUD1945 dan Undang Undang Nomor 39 Tahun 1999 tentangHAM.Bahwa pidana mati menunjukkan ketidakmampuan negaramendidik narapidana kearah yang lebih baik.Bahwa jika teijadikekeliruan dalam putusan Hakim tidak dapat diperbaiki lagi. Bahwapidana mati adalah tidak lain dan pembunuhan yang dilegalisir,sebab Allah melarang melakukan pembunuhan.

Abstract

Malpractice is an act or bad practice, in other words, is a negligence (badpractice) on the part of professionals in carrying out their profession. Thus medicalmalpractice is an act of a doctor who is considered wrong when practicing medicine andviolating legal norms. Criminal liability is imposing a penalty on the maker for an actthat violates a prohibition or creates a prohibited situation. The formulation of theproblem in this study is how medical malpractice is regulated by doctors in handlingCovid-19 patients in Indonesian criminal law and how is criminal responsibility fordoctors who commit medical malpractice in handling Covid-19 patients in Indonesiancriminal law related to justice.The method in this study uses normative legal research methods. This research isalso referred to as library research or document study. It is referred to as research ordocument study because this research is mostly carried out on secondary data in thelibrary.From the results of this study, the first result was that, in Indonesian criminal law,there are no laws and regulations that specifically and in detail discuss medicalmalpractice, especially medical malpractice when a health emergency (pandemic)occurs, such as during Covid-19. Indonesian criminal law still uses existing laws andregulations such as the Criminal Code, Law No. 29 of 2004 concerning MedicalPractice, Law No. 36 of 2009 concerning Health, Law No. 44 of 2009 concerningHospitals, and Law No. 36 of 2014 concerning Health Workers, Therefore, it is time forthe government to carry out reforms in Indonesian criminal law, such as making orupdating laws and regulations regarding criminal acts or medical malpractice actionswhen a health emergency or pandemic occurs such as Covid-19, by making formulationsof criminal acts, criminal liability and sentencing precise and consistent. Second, basedon the 7 cases that have been described and based on the elements of criminalresponsibility, as well as being linked to justice regarding medical malpractice in thehandling of Covid-19 patients, they should be held criminally responsible based onarticles 359, 360 and 361 of the Criminal Code, article 79 letter C of the Law. No. 29 of2004 concerning Medical Practice, Article 126 paragraph (1) and Article 190paragraph (1 and 2) of Law No. 36 of 2009 concerning Health, and Article 84paragraph (1 and 2) of Law No. 36 of 2014 concerning Health Workers. Based on theexplanation of the 7 cases, in the absence of criminal responsibility, it can be concludedthat the main objective of the law is not achieved because there is no justice in the lawthat is created.Keywords: Covid-19, Doctors, Malpractice, Criminal Liability

Abstract

District Court Decision Number 708/Pid.B/2019/PN.Jmb is one of the cases of nationalconcerm. Agrarian conflicts that occur between corporations and civil society often lead to thebringing of the case into criminal justice institutions. Prolonged conflicts cannot be resolved bythe government local area so that the conflict leads to a criminal incident, the agrarian conflictwhich is the root of the problem is forgotten and civil society is considered as an actor of thecriminal event of the Panel of Judges, in assessing the criminal event is seems as if they do notsee the causes of the criminal incident, because The decisions made sometimes omit animportant segment of the emergence of a criminal incident.The purpose of this study is how to apply the law and material truth in the constructionof cases of destruction of facilities and to find out the legal constructions of judges in decidingcases of damage to facilities at the Jambi District Court. The research method used in thisthesis uses normative legal research, namely legal research that examines regulations.Legislation and legal priciples I this normative research, the author conducted research onseveral court legal materials.From the results of this research, it can be conclude that the Judge’s Decision is astatement by the judges as a state official who is given the authority to do so, in the from of acriminal decision if the perpetrator’s actions are proven legally and convincingly guilty in aneffort to make decisions and impose criminal sanctions, of the course the judge hasconsiderations- considerations consisting of juridical considerations, including the indictmentof the Public Prosecutor, the demands of the Public Prosecutor, witness statement, testimony ofthe defendant, and sociological considerations covering the background of the defendant’sactions, the consequences of the defendant’s actions and the condition of the defendant at thetime of committing the act. Analyzing the judges’ considerations in this case, according to theauthor, the judge’s consideartions or judgments in this case are not objective because they arenot based on facts revealed at trial. And the judge has violated the mandate of article 5paragraph (1) Law number 48 of 2009 concerning Judicial Power which states that judges areobliged to explore, follow, and understand legal values and a sence of justice.Keywords : Legal Constructions of Judges, Applications of Law and Material Truth.

Abstract

Incidents of extortion on the road still frequently occur, causing distress tothe community that traverses the Trans-Sumatra Highway in Padang LawasRegency. In this regard, the participation of the Padang Lawas District Police isgreatly needed to address extortion crimes in Padang Lawas Regency, ensuringthat the passing community feels safe and implementing preventive measures toprevent the recurrence of extortion crimes in Padang Lawas Regency.This type of research can be classified into the type of sociologicalresearch which is carried out by direct research at the place being studied toprovide a complete and clear picture of the problem under study. This researchwas conducted at the Padang Lawas District Police, while the population and thesample were parties related to the problems studied in this study, the data sourcesused were; primary data, secondary data, and tertiary data, data collectiontechniques in this study by interviews, questionnaires, and literature study.From the results of this research there are three main things that can beconcluded. Firstly, law enforcement by the Padang Lawas District Police againstextortion committed by thugs has not been carried out properly and effectively.Secondly, the obstacles faced by the Padang Lawas District Police in enforcingthe law against extortion committed by thugs are due to factors such asinadequate infrastructure or facilities to support law enforcement, communityfactors, and a shortage of personnel in the Padang Lawas District Police. Third,the efforts made by the Padang Lawas District Police in overcoming obstacles tolaw enforcement extortion by thugs are utilizing personnel by carrying out goodcooperation between personnel at the Padang Lawas District Police, coordinatingwith government institutions and the community, and conducting legaloutreach/socialization to the public. The author's suggestion, First, is that thePadang Lawas District Police be able to carry out more solid cooperation andcoordination with government institutions and the community. Secondly, thePadang Lawas District Police should maximize patrols and reporting systems.Thirdly, the Padang Lawas District Police and the Padang Lawas Regency LocalGovernment are expected to develop programs to address the underlying causesof extortion carried out by thugs.Keywords: Law Enforcement - Extortion - Committed by Thugs
