Constitutional discourse can not be separated from the discussion on democracy building. The existence of the House of Representatives in Indonesia with its oversight function of government is one manifestation of democracy. With a historical approach juridical writings results of this study concluded that the statute law of political representative institutions is likely to continue to strengthen parliamentary oversight of government functions by providing additional instruments that can be used by the legislature as an institution and the individual members of the House to conduct oversight. The legal political tendencies are in accordance with the ideals of democracy in Indonesia who wanted representation of the people in the context of the embodiment of the people’s sovereignty in a representative body, but does not eliminate the critical power of the people to the ruler.

Tujuan penulisan ini adalah untuk mendeskripsikan konsep negara hukum Indonesia berdasarkan konstitusi yang pernah dan sedang berlaku di Indonesia. Berdasarkan tinjauan normatif dan perkembangan ketatanegaraan Indonesia disimpulkan bahwa sejak awal Republik Indonesia berdiri pilihan konsep negara hukum yang dicitakan adalah negara hukum demokratis yang secara aktif bertujuan untuk mewujudkan perlindungan terhadap segenap bangsa Indonesia dan seluruh tumpah darah Indonesia; memajukan kesejahteraan umum; mencerdaskan kehidupan bangsa; dan ikut serta memelihara ketertiban dunia yang berdasarkan kemerdekaan, perdamaian abadi dan keadilan sosial. Disamping itu, negara hukum Indonesia dipengaruhi Pancasila sebagai kumpulan nilai-nilai dasar yang disepakatu dan menjadi landasan praktek kedaulatan rakyat, yakni Ketuhanan Yang Maha Esa; Kemanusiaan Yang Adil dan Beradab; Persatuan Indonesia dan Kerakyatan yang dipimpin oleh hikmat kebijaksanaan dalam Permusyawaratan/Perwakilan; serta menciptakan keadilan sosial bagi seluruh rakyat Indonesia. Dengan demikian, Negara Hukum Indonesia yang dijalankan haruslah senantiasa memperhatikan aspek ketuhanan, kemanusiaan, persatuan, permusyawaratan dan keadilan. Meski pernah berganti konstitusi dan melakukan perubahan atas konstitusi yang berlaku, namun pilihan konsep negara hukum masih tetap sama yaitu negara hukum aktif atau dinamis dalam mewujudkan kesejahteraan rakyat. Konsep negara hukum demikian dipresentasikan sebagai welvaarstaat, yang adalah kebalikan negara penjaga malam (nachtwachterstaat).

The purpose of this paper is to describe the importance of village-owned enterprises and the management in the interests of rural communities. Referring to the legislation governing the rural , particularly Law No. 6 of 2014, it can be concluded that the village-owned enterprises is a village economic institution that has an important role in the welfare of the community, the village, and the village government. A professional governance that refers to the guidelines in the formation of village-owned enterprises based on legislation is a prerequisite of village-owned enterprises goes properly. Thus the economic activities of village-owned enterprises should ideally be part of efforts to increase local and regional economies within the scope of the national economy. Tujuan penulisan ini adalah untuk mendeskripsikan konsep pengaduan konstitusional di Jerman. Berdasarkan tinjauan normatif dan perbandingan dengan Indonesia, didapatkan fakta bahwa Negara Federal Jerman merupakan salah satu contoh yang tepat dalam hal memahami dan mempraktekkan suatu model perlindungan hak-hak konstitusional warga negara dengan menjalankan mekanisme pengaduan konstitusional (constitutional complaint). Kewenangan untuk memproses pengaduan tersebut dimiliki oleh Mahkamah Federal Jerman. Indonesia sebagai negara yang telah memiliki rumusan perlindungan hak-hak warga negara serta telah menegaskan sebagai negara hukum hendaknya dapat mengadopsi dan mengadaptasikan apa yang telah dijalankan di Jerman dalam hal pengaduan konstitusional. Sebab pengakuan hak-hak dasar warga negara tanpa perlindungan atau mendengung-dengungkan perlindungan tanpa tersedia upaya hukum yang cukup adalah sama-sama pengingkaran terhadap pengakuan dan perlindungan hak-hak dasar setiap warga negara. Hal penting yang dapat diadopsi dan diadaptasikan dari model pengaduan konstitusional di negara Jerman adalah memposisikannya sebagai upaya hukum luar biasa. Tujuan penulisan ini adalah untuk mendeskripsikan pentingnya ketersediaan mekanisme konsultasi publik dalam perumusan kebijakan dan peraturan ditingkat daerah. Tujuan penulisan ini yaitu mendeskripsikan urgensitas perlindungan hak-hak penyandang disabilitas sebagai hak konstitusional dan pentingnya pengaturan hal tersebut dalam peraturan di tingkat daerah. Berdasarkan penelitian normatif dan mengamati kenyataan dalam perkembangan sosial disimpulkan bahwa perlindungan terhadap hak-hak penyandang disabilitas (rights of persons with disabilities) merupakan hak konstitusional sebagaimana dimaksud Pasal 28H ayat (2) UUD 1945, ditegaskan dengan UU ratifikasi konvensi mengenai hak-hak penyandang disabilitas. Perlindungan penyandang disabilitas ditingkat daerah sangatlah penting dituangkan dalam peraturan daerah sebagai sarana keberpihakan pemerintah daerah terhadap penyandang disabilitas, hal ini juga sesuai dengan rumusan UU Nomor 4 Tahun 1997 dan UU Nomor 19 Tahun 2011. Tujuan penulisan ini adalah mendeskripsikan payung hukum pembentukan badan usaha milik desa (BUMDes). Merujuk pada peraturan perundang-undangan yang mengatur tentang pemerintahan desa, disimpulkan bahwa pembentukan BUMDes sebagai lembaga perekonomian desa memiliki landasan hukum yang kuat. Peraturan yang mendasari pembentukan BUMDes terdiri dari undang-undang, peraturan pemerintah, hingga peraturan menteri. Jika diperlukan untuk mengatur lebih lanjut, pemerintah daerah dapat membentuk peraturan daerah tentang BUMDes. Demikian pula ditingkat desa, dapat dibuat peraturan desa tentang BUMDes sesuai dengan keadaan dan kekhasan desa masing-masing.Kata Kunci : Payung Hukum, dan BUMDes

Comparing national development planning as the state policy in the broad outlines in the period before and after the amendment of the Constitution 1945 (UUD 1945) as well as to analyze the position of national development planning guidelines were created after the amendment of the Constitution 1945. Based normative juridical approach, by examining all the rules legislation relating to the legal issues is researched concluded that the First, there are some similarities and differences in the Platform for National Development Planning in the period before and after the 1945 amendment, as for the equation is the substance of the two, whereas the difference lies in the pattern of policy-making, as well as law formulation. Second, the Status Law on National Development Planning System (SPPN) and the regulations under it is official documents which contain the cornerstone of development planning in the era of reforms as a change of planning from documents in the past.Keywords: National Development Planning System, the Constitution 1945

The evaluation of the DPR's oversight function always considered not to represent the will of critical supervision of the people in almost every DPR's performance satisfaction survey. The DPR Committees institutionally the main actor of supervision, but has not been effective. 11 DPR committees compared to 113 work partners suspected to be one of the causes. Committees formed by DPR and can be adjusted according to needs. Based on a comparative approach on regulations in the US Congress and the British Parliament, it is recommended to narrow the oversight work by increasing the number of DPR committees to balance a large number of partners. The division of supervision work into more committees makes the scope of work narrow so that supervision is more focused. Changes in the arrangement of the number of committees in Law 17/2014 and the DPR 2014 Rules of Conduct need to be done by stating the maximum number of five working partners for each committee. The creativity of the committee to form sub-committees in accordance with needs must also be confirmed in the 2014 DPR Rules of Conduct. Such regulation is expected to make the performance of checks and balances between the DPR and the Government be better assessed by the public as a unitary presidential government system, namely a presidential system that better represents the will of the people's supervision.

An independent judicial power is very important as one of the main characteristics of the rule of law, therefore its position must be maintained in Indonesia. The purpose of this paper confirms that any attempt to intervene in the authority of the Supreme Court and the Constitutional Court in the justice system, including intervention from the President, must be considered an unconstitutional act and violates the ideals of the Indonesian rule of law. A review of the President's position in the statutory regulations found the fact that there was still a gap in the infiltration of the President's power over judicial authority. Specifically in two cases, the first relates to the ambivalence of the prosecutor's position that is not as firm as the Police. Second, the constitutional judge selection model. The need to re-arrange the mechanism for selecting constitutional judges derived from the President's proposal so that it can be more aligned with efforts to distance the President's power from the power of the judiciary. In addition to the recommendations to the formers to reorganize the two potential infiltrations, this paper also recommends the institutionalization of public petitions based on Mark Tushnet's ideas about populist constitutional law. The existence of a public petition institution becomes a forum for gathering input and advice in law enforcement and justice. The opening of the President to accept public petitions makes it easier for the people to submit law enforcement issues which, in a sense of people's justice, must be addressed.
