Abstract

Customary law in the national legal system is undoubtedly fundamental to maintaining existence because customary law can also be applied to resolve conflicts in society. This research uses socio-legal methods, and the data obtained is based on data in the field through an interview process with several related parties. In contrast, for legal problems in this society, only some things can be resolved through a customary law approach. For example, in the Dayak indigenous community, several legal problems cannot be resolved according to custom, especially regarding unregistered land rights. These problems certainly cannot be solely resolved using a customary law approach. This certainly shows that customary law cannot necessarily accommodate the interests of Indigenous peoples because this is also closely related to legal certainty. Because they relate to legal certainty, they must be resolved through a positive legal approach, such as submitting a request to the court or an application to the relevant agency. This certainly happens because the legal awareness of regional communities in Indonesia is currently not very good; this leads to legal issues within indigenous communities that cannot be resolved through customary law.

Abstract

Delanggu Village is well-known for its agricultural success, particularly as a producer of the Rojolele rice variety. Delanggu Village, which preserves historical values in the agricultural sector, has the potential for cultural preservation through various artistic events in the form of a farming cultural celebration called the Mbok Sri Festival. However, the preservation and strengthening of agricultural culture has only been limited to the Mbok Sri Festival, which is held once a year. As a result, the establishment and reinforcement of agrarian culture in Delanggu Village is not ideal. As a result, new value developments are required to maximize the preservation of agrarian culture and time-limited tourist trips to Delanggu Village. Based on these issues, the PPK Ormawa KSP "Principium" Team, as a service team, collaborated with Delanggu Village to develop a solution idea in the form of community service and empowerment through the implementation of Omah Rojolele as an integrated means of agricultural history to increase the community's attractiveness. The service and empowerment method used is Participatory Rural Appraisal (PRA), which emphasizes active community engagement in the establishment of agricultural cultural villages. This dedication and empowerment has resulted in the strengthening of Delanggu Village's cultural management institutions, the establishment of Omah Rojolele and the Omah Rojolele Website, the development of village connections through cultural tourism packages, and an increase in village income generation.

Abstract

Technological advancements have driven the growth of the financial industry in Indonesia. A more complex financial system provides benefits but also raises issues, such as the rise of illegal investments by business entities without official authorization. Investment involves allocating capital with the expectation of future profits. The growing middle class and economic development in Cangkring Village have increased public interest in investing. Unfortunately, many are tempted by high returns with minimal capital without considering legality. This community service program, as part of the Tri Dharma of Higher Education, aims to educate the public about legally compliant investments. The activities were conducted through lectures and participatory methods. The results indicate that public awareness of investment remains low due to limited financial literacy. Further education is needed to help people distinguish between legal and illegal investments, ensuring they invest safely and in accordance with applicable laws.

Abstract

Indonesia’s national stability and long-term development face serious threats from terrorism and radicalism. Despite introducing anti-terrorism laws and deradicalization programs, efforts mostly rely on repressive strategies. They often fail to address the ideological roots of the problem. This research aims to assess the need for reforming deradicalization policies within a framework of sustainable peace. Such a framework emphasizes the balance between security, social justice, and human rights. Using a juridical-normative and comparative policy approach, the research looks at Indonesia and Malaysia. The findings indicate that Indonesia’s deradicalization efforts are fragmented, lack inter-agency coordination, and lack a comprehensive, multidimensional foundation. In contrast, Malaysia offers a more cohesive model, characterized by institutional synergy and moderate religious education, achieved through partnerships with Islamic authorities. These findings underscore Indonesia’s need for reforms in deradicalization. Such reforms should integrate structural and psychological interventions, enhance institutional accountability, promote cross-sector collaboration, and encourage public engagement. Achieving sustainable peace against evolving radical threats requires human-centered, law-based approaches to promote long-term resilience and inclusivity.

Abstract

Environmental crimes in Indonesia pose significant risks to both the ecosystem and human welfare. Notwithstanding established legal frameworks, the rights of victims of these offences frequently remain insufficiently addressed. This essay analyzes the current state of victim rights regarding environmental crimes in Indonesia, emphasizing the challenges in their enforcement and suggesting pathways for legal reform. Utilising a green victimology framework, it examines the legislative stipulations for victim compensation, restitution, and rehabilitation, juxtaposing them with international benchmarks. This study employs a normative juridical methodology, complemented by case study analysis and an examination of current regulatory instruments, to identify various structural deficiencies, including normative gaps, ineffective law enforcement mechanisms, and the absence of formal procedures for compensation and substantial victim involvement in legal proceedings. The research identifies key obstacles, including insufficient law enforcement, challenges in establishing causation and quantifying damages, restricted access to justice for marginalized groups, corporate influence, and inadequate support systems for victims. The essay ultimately presents policy proposals aimed at strengthening the legislative framework, enhancing enforcement capabilities, advocating for restorative justice, increasing access to justice, and fostering community empowerment to achieve more sustainable environmental justice in Indonesia.

Abstract

Human being and living quality of their global community very depends on environmental condition. Then, various policies, regulation managements, law enforcement and technical supervision are conducted in attempts of biological environment conservation. However, a single market of such the global industrialization style gives a complex homework in ecological sector. On the Markplus Conference 2015, Hermawan Kartajaya reminded that the global industrialization, like the single market initiated by the AEC is potentially more dangerous than the AFTA (ASEAN Free Trade Area) and CAFTA (China-ASEAN Free Trade Agreement). He stated that if AFTA and CAFTA are concerned only with flow of goods, but MEA covers free flow of goods, people, services and money (capital and investment). Purpose of the writing is actually to show challenges that should be addressed when MEA establishes a single ASEAN market, especially be related to forest fire’s phenomenon. Results of the study showed that forest fire and the single ASEAN market has, consciously or not, created a new myth called rationality of commodity efficiency. Horkheimer and Adorno in their ' enlightenment dialectic' explained that efficiency, in economic, is a principle of market surpassing all kinds of feudal and religious restrictions. Thus, rationality is equated with efficiency. When efficiency is applied in dynamics of capitalist economy, then the entire field of human life is considered a commodity. Consequently, reification is in effect, namely when everything is a commodity so people is no longer enjoying but consuming and consuming without building any social relationships in a real sense. At such nadir, ecological damage is inevitable or it is even considered a reasonable price worth paying. The Law which is essentially an ethical conversation of human beings to produce justice is easily forgotten because of greed. However, all such excesses of reification can be avoided when the law is still pursued progressively, so the law must arrive at radicalism in order to demolish assumptions of law. Thus, it can be concluded that forest should not only be explored for its resources solely according to the reification trap of global industrialization market, but it must be preserved for future human posterity because of considering the deep ecology.

Abstract

In the field of law, the influence of globalization is reflected in the legal politics of procedural law reform, which is currently still in the form of legislation draft. This study aims to analyze the influence of globalization on the reform of Indonesian criminal procedural law in relation to national legal politics. This research is normative legal research, which focuses on studying library materials. Based on the results of a comprehensive study is known, the Draft Criminal Procedure Code includes a new system originating from the western legal system such as adversary system in court trial. Adopting the adversary system into the Draft Criminal Procedure Code is a very revolutionary legal political reform of the criminal procedural law. Various challenges will be faced along with the adoption of the new legal system.  Changes in the legal culture of law bearers is also a key variable in the success or failure of a western legal system implementation. Although the concept of the Criminal Procedure Code is colored by the western legal system, it does not conflict with national legal politics because it reflects universal legal principles, namely equality.

Abstract

This research aims to elucidate how criminal law disparities against perpetrators of sexual violence against children manifest based on Islamic law in Indonesia. The legal disparities indicate that child victims of sexual violence have not received comprehensive legal justice. This study adopts a qualitative descriptive approach, collecting data through exploration and reading online media with the keywords 'sexual violence against children in Indonesia' on the Google search engine. This paper reveals that legal imbalances have undermined the value of justice for child victims of sexual crimes, affecting them both psychologically and physically, and leading to other consequences such as dropping out of school, forced marriage to the perpetrator, and suicide. This study is crucial to bring about justice based on Islamic law for child victims of sexual crimes, juxtaposed with Pancasila justice. It highlights that the criminal legal disparities in cases of sexual violence consistently place children as the disadvantaged objects of legal justice. True legal inequality would not occur if the application of the law is based on Islamic Law grounded in divine values, as the punishment for perpetrators of sexual violence in Islam can be judged as hudud crimes, qhisas crimes, and ta'zir crimes.

Abstract

Kajian pemberantasan korupsi melalui hukum pidana sudah banyak dilakukan, tetapi uraian tentang peran aspek keperdataan masih menyisakan pertanyaan besar. Pada konteks pemberantasan korupsi, aspek keprdataan berwujud Non-Conviction Based (NCB) Asset Forfeiture memungkinkan Jaksa Pengacara Negara untuk membekukan, menyita, atau mengambil alih aset yang diduga berasal dari tindakan korupsi tanpa harus menunggu proses hukum pidana selesai dan pemilik aset dinyatakan bersalah oleh pengadilan. Telaah yang menggunakan jenis penelitian hukum (doktrinal), dengan pendekatan konseptual dan perbandingan hukum ini memanfaatkan bahan hukum primer maupun bahan hukum sekunder yang dianalisis dengan silogisme deduktif. Penelitian menghasilkan dua temuan penting, yaitu diperolehnya ragam masukan konseptual menegnai NCB Asset Forfeiture berbasis perbandingan hukum guna menjawab metode yang dipandang kontroversial karena menimbulkan beberapa masalah hukum dan etika. Kritik bahwa terdapat potensi pelanggaran hak asasi manusia, keadilan, dan penggunaan wewenang yang berlebihan, memang ditemukan. Namun berdasarkan perbandingan konseptual dari UNCAC, USA, Australia yang dipilih sebagai konsep yang mendasari optimasi NCB Asset Forfeiture sebagai alat untuk mencegah pemilik aset mengalihkan atau menyembunyikan harta hasil korupsi sebelum proses pengadilan selesai, potensial diadopsi di Indonesia. Pada konteks Indonesia, optimasi aspek keperdataan dalam NCB Asset Forfeiture penting untuk memastikan bahwa hak-hak individu dan prinsip-prinsip keadilan tetap dihormati, meskipun proses ini berbeda dari proses pidana yang umumnya memerlukan vonis bersalah. Berdasarkan analisis yang dilakukan dihasilkan beberapa cara agar aspek keperdataan dapat dioptimalkan dalam implementasi NCB Asset Forfeiture, yaitu 1).Pemisahan Beban Pembuktian, 2).Standar pembuktian yang Jelas, 3).Pemenuhan hak untuk mengajukan Pembelaan, 4).Otoritas Pengadilan yang Independen, 5).Transparansi dan Publikasi, 6).Upaya hukum yang korektif.

Abstract

Asas ne bis in idem membuat pengadilan dilarang dua kali menjatuhkan putusan terhadap perkara yang sama. Hal ini agar putusan yang dijatuhkan tidak melanggar hak asasi manusia. Putusan Kasasi Nomor 957 K/PID.SUS/2018 adalah salah satu putusan terhadap perkara yang mengandung ne bis in idem, setelah ditemukannya dokumen BA-17 yang diterbitkan Kejaksaan Negeri Manado sebagai berita acara eksekusi putusan pada pengadilan tingkat pertama. Secara teoritis, perkara yang telah berkekuatan hukum tetap dilarang diadili kembali. Penelitian ini bertujuan untuk mengulas, apakah Putusan Nomor 957 K/PID.SUS/2018 merupakan putusan atas upaya hukum kasasi pada perkara ne bis in idem. Penelitian ini merupakan penelitian hukum normatif yang bersifat preskriptif, dan terapan dengan pendekatan studi kasus (case study). Hasil temuan dari penelitian ini adalah adanya kekhilafan hakim dalam mengadili perkara ne bis in idem pada tingkat banding dan kasasi. Peninjauan kembali adalah upaya hukum yang dapat dilakukan untuk memperoleh secercah keadilan terhadap putusan hakim tersebut.
