Abstract

This comparative study examines how customary sanctions are applied in response to traditional law violations in Tenganan Pegringsingan (Bali) and Kajang Tanah Towa (South Sulawesi), and how these sanctions sustain ecological balance and social harmony. The research was conducted using in-depth interviews and participatory observation. Various types of sanctions are regulated by written and unwritten rules (traditional written customary law) of Tenganan Pegringsingan, including dosen, penging, sikang, sapa sumaba, and kesah. Meanwhile, in the Kajang Tanah Towa indigenous community, violations of the pasang (oral customary guidelines) are met with mild to severe sanctions. Serious violations are punished with poko’ ba’bala (base of the whip – for severe violations), tangnga ba’bala (middle of the whip – for moderate violations), and cappa ba’bala (tip of the whip – for minor violations). This study contributes to a deeper understanding of how indigenous legal systems function as effective mechanisms for environmental governance and community resilience.

Abstract

Abstract

The purpose of this study is to conserve the agricultural culture and to review the symbolic meaning and local wisdom in certain agricultural rituals. This research is conducted in Subak Kedua Pasedahan Yeh Lauh, Peguyangan Kangin Village, West Denpasar, Bali. Data is collected using the methods of interview and literature review. From the data collected, there are twenty four ritual steps found that should be performed by the farmers in Bali. Those indicate farmers’ religious nature and appreciation of their cultural tradition. Each ritual from sowing to harvesting contains symbolic meanings and cultural values embraced as the guidance in farming life. From the analyses concerning its ritual and tools used, it is concluded that the symbolic meaning of ritual discourse performed by the farmers are: (1) expressing gratitude to God for all abundant harvest grace; (2) asking permission for farming to the motherland as the manifestation of God in term of the ruler of the land; (3) asking for safety for having a successful agriculture to God (Goddess Sri); (4) offerings to the rice field rulers to be kept away from pests that damage plants; (5) keeping the environmental balance –in the philosophy of Hindu society in Bali, it is one of Tri Hita Karana’s best practices.

Abstract

The existence of Balinese diaspora in East Java spreads across the districts and cities. Some developments that occurred when the Balinese formed diaspora in East Java, among others include implementing the model of religious activities to inculcate religious teachings such as dharma wacana. This paper aims to describe the structure, rhetorical pattern and linguistic characteristics of dharma wacana delivered in religious events in East Java, especially in Surabaya and Sidoarjo. The analysis suggested that the structure of dharma wacana of Balinese diaspora community consisted of an disclosure, content, and closure. The pattern also indicated that the preacher of dharma wacana had taken a variety of ways and measures for each section and had different communicative purposes as well as used different rhetorical functions. This analysis also suggested that there were some repetitions in pattern and measure such as the repetition of the proposition, quotations, arguments, and solicitation. Another rhetorical characteristic of the text of dharma wacana found in this study was that the preacher relied on references (citations) in the holy verses to justify the importance of the topic of dharma wacana. Linguistic characteristics of dharma wacana includes vocabulary of religious genre and code-mixing between subtle Bali language and Bahasa.
