Abstract

ABSTRAKUsulan ekosida sebagai kejahatan kelima International Criminal Court (ICC) memunculkan banyak perdebatan, salah satunya berkaitan dengan sifat ekosentris dari ekosida dan antroposentris kejahatan internasional dalam yurisdiksi ICC. Artikel ini secara sistematis membahas dua masalah pokok, yaitu bagaimana pengaruh pandangan ekosentrisme dan antroposentrisme atas ekosida dalam hukum internasional dan khususnya ICC; dan apa yang menjadi tantangan dan peluang amandemen Statuta Roma atas kejahatan ekosida mempertimbangkan sistem dan praktek ICC cenderung bersifat antroposentris. Dalam rangka menjawab masalah tersebut, penulis menggunakan pendekatan pragma-dialectical dimana argumentasi hukum sebagai bagian dari diskusi yang kritis dari dua sudut pandang yang berbeda, dalam konteks ini adalah antroposentrisme dan ekosentrisme. Hasil penelitian menunjukkan bahwa pandangan antroposentris masih mendominasi dalam pembentukan norma hukum internasional, termasuk dalam sistem peradilan pidana internasional. Hal demikian bertolakbelakang dengan usulan kejahatan ekosida yang bersifat antroposentris dimana kerusakan lingkungan skala meluas, berjangka panjang dan serius menjadikannya kejahatan internasional, tanpa harus manusia harus menderita bahaya dulu akibat kerusakan lingkungan tersebut. Usulan perumusan ekosida sebagai kejahatan internasional dapat dilakukan dengan mengambil jalan tengah yaitu menyeimbangkan antara antroposentris dan ekosentris melalui pandangan polisentris. Namun demikian, terdapat tantangan amendemen Statuta Roma karena adanya perbedaan kepentingan dan pandangan politik masing-masing negara anggota. Namun demikian, meningkatnya kesadaran masyarakat internasional atas lingkungan dan upaya tuntutan kasus-kasus lingkungan oleh NGO dan organisasi lingkungan di negara-negara serta diaturnya amandemen pada Pasal 121 Statuta Roma tetep menjadi peluang yang baik suatu saat ekosida dapat menjadi kejahatan internasional kelima di bawah yurisdiksi ICC.Kata kunci: ekosida; hukum pidana internasional; kejahatan internasional; statuta roma.ABSTRACTThe proposal of ecocide as the fifth crime under the jurisdiction of the ICC has sparked debate, particularly regarding the ecocentric nature of ecocide versus the anthropocentric focus of existing international crimes within the ICC. This article examines two key issues: how ecocentrism and anthropocentrism influence the international norms and practices of the ICC related to ecocide; and what challenges and opportunities are associated with amending the Rome Statute to include ecocide as an international crime, given the inherently anthropocentric tendencies of ICC systems. To address these questions, the author employs a pragmatic-dialectical approach, engaging in a critical discussion that juxtaposes the perspectives of anthropocentrism and ecocentrism. The findings of the study indicate that anthropocentric views continue to dominate the development of international legal norms, including those within the realm of the international criminal justice system. This stands in contrast to ecocide, which has an ecocentric view. The formulation of ecocide as an international crime could be achieved through a balanced approach that integrates both anthropocentric and ecocentric perspectives, adopting a polycentric view. However, the challenge of amending the Rome Statute lies in the diverse interests and political viewpoints of member states. The increasing global awareness of environmental issues, prosecution of ecocide at the national level, and the regulatory framework for amending Article 121 of the Rome Statute present a promising opportunity for ecocide to be recognized as the fifth international crime under the ICC's jurisdiction.Keywords: ecocide; international criminal law; international crime; rome statute.

Abstract

International trade between countries concerns the formation of multilateral relations between various countries to facilitate cooperation in the field of international trade, so international organizations were formed that regulate trade relations between countries so that international trade can be easier, and there are no obstacles in international relations trade between countries, namely the WTO (World Trade Organization). With the formation of the WTO, there are agreements that have been agreed upon by member countries. Indonesia is a member of the WTO and is bound by the provisions established in 1995 which were marked by the ratification of the WTO agreement through Law Number 7 of 1994. Indonesia must comply with all WTO provisions in order to increase market access in other member countries. The Indonesian state has a policy in the form of a halal policy which is regulated in UU/33/2014 concerning Halal Product Guarantees. The existence of a policy stating that all products, both domestic and imported, must be halal certified is considered to be an obstacle to international trade because it is contrary to GATT policy and the TBT Agreement. The method used is normative legal research and the data used is secondary data sourced from primary legal materials and tertiary legal materials. The approach used is a historical, explanatory and legal synchronization approach. Data collection techniques through literature studies and studied using qualitative analysis.

Abstract

The title of this research is the “Imposition of Land and Building Acquisition Duty on Legally Certain Transaction Agreements: Study of the Indonesian Constitutional Court Decision Number 117/PUU-XXI/2023”. The object of this research is the Indonesian Constitutional Court Decision Number 117/PUU-XXI/2023. The objective of this research is to discover whether or not the imposition of Land and Building Acquisition Fee on Sale and Purchase Binding Agreement in the Decision of the Constitutional Court of the Republic of Indonesia Number 117/PUU-XXI/2023 provide legal certainty for the community. The method of this research was the normative or doctrinal legal research which employed the statute approach, conceptual approach, and case approach. This research employed primary and secondary legal materials. Results showed that Land and Building Acquisition Tax is a tax imposed on the acquisition of land and/or building rights. Market value reflects the amount of money the seller, as the owner of the land and building, should receive and the buyer, as the party receiving the rights to the land and building being traded. The results of this study are expected to provide information and solutions for parties who study the legal implications and legal certainty for the community regarding the imposition of Land and Building Acquisition Duty on Transaction Agreements in the Decision of the Constitutional Court of the Republic of Indonesia Number 117/PUU-XXI/2023.

Abstract

Artikel ini bertujuan untuk mengevaluasi ketentuan mengenai kerja sama internasional dalam Statuta Roma 1998, khususnya terkait pelaksanaan surat perintah penangkapan oleh negara-negara anggota. Artikel ini membahas dua permasalahan utama, yaitu kelemahan dalam Bagian 9 Statuta Roma 1998 mengenai kerja sama internasional dan bantuan hukum, khususnya dalam pelaksanaan surat perintah penangkapan; dan bagaimana seharusnya ketentuan tersebut dioptimalkan agar pelaksanaan surat perintah penangkapan dapat dilaksanakan secara efektif. Dalam rangka menjawab kedua permasalahan tersebut, penelitian ini menggunakan pendekatan perundang-undangan, yaitu Statuta Roma 1998; dan pendekatan kasus, yaitu kasus Omar Al-Bashir dan Vladimir Putin. Penelitian ini juga menggunakan teknik penalaran retorika dengan cara memberikan argumentasi-argumentasi yang meyakinkan dalam menjawab permasalahan tersebut. Hasil penelitian menunjukkan bahwa kelemahan struktural dan politis dalam pengaturan kerja sama internasional telah mengurangi efektifitas surat perintah penangkapan. Oleh karena itu, penelitian ini mengusulkan tiga strategi penguatan: yaitu memperluas yurisdiksi OTP melalui prinsip yurisdiksi universal, memperkuat peran Assembly of States Parties (ASP), serta mengoptimalkan keterlibatan Dewan Keamanan Perserikan Bangsa-Bangsa (DK PBB). Penelitian ini juga merekomendasikan bahwa penting bagi International Criminal Court (ICC) untuk melakukan pembaharuan hukum terhadap ketentuan kerja sama internasional dalam Bagian 9 Statuta Roma 1998, baik melalui amandemen, pedoman pelaksanaan yang lebih jelas, maupun bentuk pengaturan lain yang mengikat, guna meningkatkan efektivitas surat perintah penangkapan dan memperkuat komitmen negara anggota.

Abstract

Humanitarian Intervention (HI) is the third pillar of the Responsibility to Protect (RtoP) framework, which frequently invokes the concept of humanity as the fundamental source of legitimacy. However, the absence of clear criteria defining the limit of humanity has led to a double standard in the implementation. Therefore, this study aims to examine two main legal issues, namely the broader legal implications of the principle of humanity in the international legal system and the standard threshold to legitimize the intervention within the RtoP framework. A doctrinal legal method was used with regulatory, conceptual, and case approaches. In addition, interpretative methods were used for legal argumentation. The results showed that the concept of humanity has historically played a crucial role in shaping international law. The evolution of international humanitarian law (IHL) and international human rights law, particularly within the context of international criminal law, is closely related to the concept of humanity. According to this concept, intervention may be justified to prevent and stop humanitarian crises within a specific state to protect the victims. However, only actions that exceed the limits of humanity, including extraordinary acts of cruelty and crimes under universal jurisdiction, can serve as the basis for HI legitimacy. Moreover, the threshold for invoking HI must also include a determination that the state is unwilling or unable to prevent or stop the ongoing atrocities.

Abstract

This research aims to evaluate the use of veto power by the United Nations Security Council (UNSC) concerning human rights violations, particularly atrocity crimes. Permanent member states, such as the United States and Russia, often misuse the veto to protect national interests, undermining the UN’s goals of maintaining international peace and security. Employing a normative legal research method focused on legislation and case studies, the findings reveal that veto usage in atrocity cases obstructs the Security Council’s actions and creates injustices in international law enforcement. The conflicts in Israel-Palestine and Ukraine exemplify how the veto shields human rights violations. The study recommends reforms to the veto mechanism, including establishing an independent assessment body and enhancing transparency in decision-making. Ultimately, it aims to enable the UNSC to more effectively protect human rights and prevent atrocity crimes, contributing to the development of international law and serving as a reference for future research.

Abstract

This study aims, first, to analyze the harmonization of regulatory frameworks between the OECD standard setting concerning algorithmic collusion and the provisions of Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. Second, this study seeks to formulate legal harmonization measures that can be undertaken to address collusive practices arising from the use of artificial intelligence–based pricing algorithms. This research constitutes normative legal research employing a conceptual approach. The findings indicate that there remains a regulatory disharmony between Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition and the OECD standard setting related to algorithmic collusion. Legal harmonization measures may be carried out through the reform of legal instruments as well as the strengthening of the institutional role of the Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha).

Abstract

Kegiatan pendakian Gunung Lawu semakin diminati oleh berbagai kalangan, namun masih minim kesadaran akan risiko dan upaya mitigasi kecelakaan. Kegiatan pengabdian ini bertujuan untuk memperkuat peran aktif masyarakat lokal dan para pendaki dalam mencegah kecelakaan melalui edukasi keselamatan dan identifikasi risiko. Metode yang digunakan meliputi penyuluhan, pelatihan tanggap darurat, serta pembuatan media informasi keselamatan di jalur pendakian. Kegiatan dilakukan bersama para relawan, pengelola basecamp, dan komunitas pendaki di sekitar jalur Cemoro Sewu dan Cemoro Kandang. Hasil kegiatan menunjukkan peningkatan pemahaman peserta terhadap potensi bahaya seperti perubahan cuaca ekstrem, kondisi fisik pendaki, dan minimnya peralatan keselamatan. Selain itu, terbentuk jejaring komunikasi antara masyarakat dan pendaki sebagai upaya deteksi dini dan respon cepat terhadap insiden. Penguatan kolaborasi antara masyarakat lokal dan pendaki terbukti efektif dalam membangun budaya pendakian yang lebih aman dan bertanggung jawab di Gunung Lawu.

Abstract

The objective of this study is to examine the legal protection afforded to Notaries as reporting parties and the reporting obligation of Notaries in money laundering cases. The context of this research is the conflict between the Notary's obligation to maintain the confidentiality of client information in accordance with notary law and the obligation to report suspicious financial transactions to prevent and combat money laundering. This conflict generates legal uncertainty regarding the boundaries of a Notary's accountability and the legal safeguards that are available to them when they fulfil their reporting obligations. The urgency of this study is derived from the necessity of more defined legal regulations to guarantee legal certainty and protection for Notaries while simultaneously bolstering efforts to combat money laundering. This investigation implements a normative juridical methodology that incorporates conceptual and statutory methodologies. The findings indicate that the regulations necessitating Notaries to submit reports must be prioritised through the application of the lex specialis derogat legi generali principle. Consequently, Notaries who report in good faith and adhere to the relevant legal procedures are entitled to legal protection.

Abstract

ABSTRACTASEAN Charter gives new expectation for the protection of human rights in ASEAN. One of the innovations contained in the ASEAN Charter is a provision regulating the promotion and protection of human rights. Regulations concerning the promotion and protection of human rights contained in the preamble, purposes, principles and Article 14 of the ASEAN Charter. ASEAN finally recorded a new history in an effort to promote and protect human rights s15by signing the Terms of Reference (TOR) of ASEAN Intergovernmental Commission on Human Rights (AICHR) as a result of the implementation of the 15th ASEAN Summit to held in Hua Hin , Thailand. However, the formation of AICHR still not perfect. There are a number of weaknesses and challenges that must be completed by the ASEAN countries, especially concerning the strengthening of the mandate and functions of AICHR on human rights protection.ABSTRAKPiagam ASEAN memberikan harapan baru  bagi perlindungan hak asasi manusia di ASEAN. Salah satu inovasi yang terkandung dalam Piagam ASEAN adalah ketentuan yang mengatur pengembangan  dan perlindungan hak asasi manusia. Peraturan mengenai pengembangan  dan perlindungan hak asasi manusia yang terkandung dalam pembukaan, tujuan, prinsip, dan Pasal 14  Piagam ASEAN. ASEAN akhirnya mencatat sejarah baru dalam upaya untuk mempromosikan/mengembangkan  dan melindungi hak asasi manusia dengan menandatangani Kerangka Acuan (TOR) of ASEAN Intergovernmental Commission on Human Rights (AICHR)   sebagai pelaksanaan KTT-15 ASEAN yang akan diadakan di Hua Hin, Thailand. Namun, pembentukan AICHR tidak/belum sempurna . Ada sejumlah kelemahan dan tantangan yang harus diselesaikan oleh negara-negara ASEAN, khususnya pada penguatan mandat dan fungsi AICHR tentang Perlindungan Hak Asasi Manusia.
