Abstract

Religious constitutionalism has recently become a global discussion. Such a trend arises as a result of several countries that have a majority of religious adherents declare their constitution based on certain religions. Thailand, for example, provides special norms about Buddhism (Buddhist constitutionalism), the Vatican has special norms about Catholicism (Catholic constitutionalism), India has special norms about Hinduism (Hindu constitutionalism), Saudi Arabia has norms specifically about Islam (Islamic constitutionalism), and so on. This article analyzes whether or not the Islamic principles have been adopted in the Indonesian Constitution. These principles consist of protecting religion, soul, mind, offsprings, and property. The author uses the five principles as a standard in measuring the entire Indonesian Constitution which constitutes to the teachings of Islam (Islamic constitutionalism). The implementation of Islamic constitutionalism can be identified through articles in the constitution. This study concluded that, in general, the Indonesian constitution could be considered to have agreed to Islamic constitutionalism, although in some cases it still needs to be actualized more.

Abstract

This paper examines the efforts to preserve cultural heritage in Aceh, Indonesia, with a specific focus on Gampong Pande, one of the oldest and most historically significant areas in Banda Aceh, Indonesia. As a site of early Islamic civilization in the region, Gampong Pande holds valuable tangible and intangible cultural assets, including ancient tombs, artifacts, oral traditions, and Islamic scholarly heritage. However, these cultural resources face increasing threats due to urban development, environmental degradation, and a lack of comprehensive preservation strategies. The study explores how the legal frameworks at the national and regional levels, particularly the implementation of Qanun (Acehnese regional regulations), are employed to protect and manage cultural heritage. These legal instruments provide a foundation for cultural governance, yet their effectiveness often depends on enforcement mechanisms and institutional coordination. In parallel, this study emphasizes the critical role of local communities in cultural preservation. It highlights how the residents of Gampong Pande have initiated grassroots movements to protect historical sites, resist commercial encroachment, and revive cultural practices. These initiatives demonstrate the importance of community participation, local wisdom, and intergenerational knowledge transfer in heritage conservation. This research underscores the need for a more integrated and participatory approach that combines top-down legal policies with bottom-up community action. It calls for stronger collaboration among government agencies, civil society, academic institutions, and local leaders to ensure the sustainable preservation of cultural heritage in Aceh. In conclusion, the preservation of Gampong Pande’s heritage means protecting physical structures and maintaining the region’s historical identity, spiritual legacy, and cultural continuity amid ongoing modernization and change. Abstract

After more than a decade of imposing Islamic law in Aceh, appearing various legal problems such as career path of Sharia Police or known as Wilayatul Hisbah (WH). In one hand, WH is faced on commitment of working harder by upholding religious norms as well as national regulations. On the other hands, their career path does not have a future certainty, even futureless. In the Act of Government of Aceh WH positions hand in hand with Satuan Polisi Pamong Praja (Satpol PP), having specific task to uphold general bylaws. Unfortunately in national level there are no single regulations arranging a path of professional career for WH. This fact contributes on hesitation of WH members to pursue their future career. Some of them switch their position to other career paths, having more certainty in national level. From the perspective of budged use, skill training cost for WH members are very expensive. If most of them change their future career, it will be a big loss for national budget, because their skill cannot be used for WH development. Thus, it needs a breakthrough to resolve this problem

Abstract

There are questions regarding the mechanism of fulfilling public position in democratic countries. The main question is how local party and national party can deal with prominent position, is it pointed or elected by party mechanism? This article will explore this main problem, including to fulfil public positions. To answer those questions, writer uses comparative political approach, using Germany as comparative country. In Indonesian, not all public positions regulated by regulations, chiefly in provincials’ level.

Abstract

Penelitian ini berusaha mengurai prinsip siyāsah qaḍhā’iyyah terhadap kewenangan MK dalam pemberhentian Presiden, dan bagaimana relevansi konsep siyāsah qaḍhā’iyyah terhadap kewenangan pemberhentian Presiden melalui MK. Berdasarkan Pasal 7B Ayat (1), pemberhentian Presiden di Indonesia hanya dapat diusulkan oleh DPR kepada MPR, hanya dengan terlebih dahulu mengajukan permintaan kepada MK, untuk diperiksa, diadili, dan diputuskah secara yuridis benar/tidaknya dugaan pelanggaran hukum oleh Presiden/Wakil Presiden. Ketika nantinya putusan akhir MK menyatakan Presiden bersalah, barulah kemudian usul pemberhentian Presiden dapat diteruskan oleh DPR kepada MPR. Sedangkan dalam sistem ketatanegaraan Islam, pemberhentian kepala negara tidaklah melibatkan lembaga yudikatif di dalamnya. Walaupun dalam ketatanegaraan Islam, juga memiliki lembaga peradilan (qaḍhā’iyyah). Untuk menjawab pertanyaan tersebut digunakan penelitian library research dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa, tinjauan siyāsah qaḍhā’iyyah terhadap kewenangan MK dalam pemberhentian Presiden dapat disamakan dengan kewenangan Wilayah al-maẓhālim dalam mengadili berbagai kezaliman, penganiayaan dan kesewenang-wenangan penguasa/kepala negara terhadap rakyatnya. Kemudian, konsep siyāsah qaḍhā’iyyah relevan dengan konsep peradilan di Indonesia. Keduanya sama-sama merupakan peradilan yang merdeka, mandiri, serta bebas dari pengaruh/intervensi pihak manapun. Berdasarkan hal tersebut, maka konsep siyāsah qaḍhā’iyyah relevan dengan kewenangan pemberhentian Presiden melalui MK.
