Abstract

Arrangement and protection for rights of water in constitution of the state become importance because water represent basic rights for all human being which is obliged to protected and fulfilled by state to its citizen. Form of the comittmen of state in arrangement and protection of rights of water can be seen from basic values in the arrangement of rights of the water in constitution, especially on Pasal 33 ayat (3) UUD NRI 1945 and also its management which arranged in UU Nomor 7 Tahun 2004 tentang Sumber Daya Air as implementation of UUD NRI 1945

Abstract

Mineral resources represent natural resources which can not be updated or non-renewable, which means once they are taken out and used up, they cannot return to their initial forms. For this reason, these mineral resources shall be viewed as natural asset and exploiting them shall be conducted wisely. In addition, its management has to consider the future needs. Indonesian government thinks of all its natural resources as capital to add the national income. Unhappily, this matter is done by exploitation and in a massive scale. Operation of mining in Indonesia often generates various negative impacts for the environment, social life, economic, traditional community culture and also local community culture. Moreover, mining concession regions frequently overlaps with rich forest region, which becomes the source and place of living of the traditional community. Therefore, Indonesian government ought to do both preventive or repressive means to reduce these negative impacts, for example by improving mining regulation and giving more attention to environmental management and also to the community, in this case traditional community residing around the mining location. Key words: sumber daya alam (natural resources), tidak dapat diperbaharui (non-renewable), dampak negatif (negative impact), pertambangan (mining).

Abstract

ABSTRAKSI Konsep kepentingan umum menjadi faktor yang sangat penting dalam kegiatan pengadaan tanah bagi pelaksanaan pembangunan di Indonesia, khususnya dalam kegiatan pembangunan yang masuk dalam kategori kepentingan umum. Konsep kepentingan umum bahkan berkembang melalui peraturan perundang-undangan yang diterbitkan oleh pemerintah. Pengaruh perkembangan konsep kepentingan umum ini mempengaruhi implementasi dalam kegiatan kepentingan umum, khususnya pada para pihak yang terkena dampak dari kegiatan untuk kepentingan umum tersebut. Abstract

Rasionalism has an important role in the Indonesian law system which is tend to be positivistic. Legal terminology linking the result of penal circumstantial ratio which arrange human life in order to reach prosperity of society of the state. In this case, rasionalism order that the law terminology has to be excepted by it is logic racionality so that can be understand, to be comprehended and executed by the citizen.

Abstract

The economic independence of the community through Micro, Small, and Medium Enterprises (UMKM) is an important priority that supports social economy. Especially during a crisis and pandemic COVID19, UMKM are one of the business actors who are still able to survive when economic activity declines. However, in this great potential, UMKM actors in the mangrove ecosystem in the Mahakam delta area have weaknesses in legal understanding as evidenced by the incomplete licensing requirements, and also do not have an understanding of the urgency and procedures for making contracts and other legal aspects. Therefore, training is needed to increase the legal capacity of UMKM actors. The method used is a training involving UMKM business actors in three stages; UMKM mapping; provide material on opportunities and challenges for UMKM in mangrove ecosystems and legal knowledge for UMKM; preparation of strategic plans for UMKM for mangrove ecosystems. The results of this activity indicate an increase in the legal understanding of UMKM actors and a strategic plan for strengthening UMKM in the mangrove ecosystem in the Delta Mahakam area has been formulated. This encourages the community to participate in protecting and rehabilitating mangrove areas for mutual prosperity. Keywords: Micro, Small and Medium Enterprises ; Mangrove ; Delta Mahakam

Abstract

Mangrove merupakan kawasan penting bagi kehidupan masyarakat pesisir dan keberlangsungan layanan alam. Namun kondisi ekosistem mangrove di Kawasan Delta Mahakam masih mengalami kerusakan meskipun upaya rehabilitasi telah banyak dilakukan. Salah satu kelemahannya adalah belum adanya payung hukum terkait perlindungan dan rehabilitasi mangrove. Sehingga dibutuhkan upaya hukum berupa penyusunan produk hukum lokal terkait perlindungan dan rehabilitasi mangrove berbasis masyarakat. Pelatihan ini dilakukan melalui dua tahapan, antara lain: pemetaan produk hukum desa, dan penyusunan dengan metode Roccipi. Pemetaan di lima desa menunjukkan belum memiliki produk hukum yang berkaitan dengan rehabilitasi mangrove. Pelatihan produk hukum desa peduli mangrove dengan menggunakan metode ROCCIPI membentuk kesadaran hukum yang dibuktikan dengan keterlibatan seluruh pihak dalam menyusun kanvas desain peraturan desa peduli mangrove di lima desa yang berada di Kawasan Delta Mahakam. Hasil pemetaan dan pelatihan diperoleh data potensi penguatan produk hukum desa dan peningkatan kapasitas aparatur desa dan masyarakat dalam menyusun produk hukum desa peduli mangrove.

Abstract

The decision to build a new capital on the Kalimantan Island called Nusantara caused various conflicts, such as the neglect and marginalization of indigenous peoples and the ignoring of their certainty of access and meaningful participation. This paper explains how the substance of the Nusantara Capital development regulation is to provide full protection to Indigenous peoples or vice versa, how it impacts the protection of Indigenous people's rights, as well as how the affirmative action model fulfills the rights of Indigenous peoples in the Nusantara Capital area. Through a socio-legal approach as the method, the results of the study found that the constitution has regulated the recognition of indigenous peoples, but in the substance of regulations related to the Nusantara capital, the phrases that regulate are very weak. The phrases used do not explicitly ensure the protection of the rights of indigenous peoples, which has an impact on various neglect of the existence of indigenous peoples. As a result, a model of affirmative action is needed for indigenous peoples in the regulation of the Nusantara capital. This includes ensuring access for indigenous peoples to be involved in policymaking. Furthermore, transparency of information in the development of the Nusantara capital is important to formulate policies that accommodate the protection and fulfillment of the rights of indigenous peoples. It is important to ensure the recognition of indigenous peoples and their living space through an affirmative action model regulated by the head of the Nusantara capital authority.

Abstract

This research aimed to find out the urgency and construction of climate change legal reformulation in a sustainable and justice manner. Political legislation related to climate change currently manifests mainly through implementation regulations or even through policy products with less legal standing and binding force than if it is regulated in a law. The method used is normative legal research with a regulatory and conceptual approach. The results show that reformulation is required considering that climate change control efforts have not been effective. The environmental organisations state that various regions are still affected by climate change, experiencing deforestation and depending on the exploitation of natural resources. For these reasons, a new formulation of climate change regulation that ensures justice is to establish an omnibus law on Climate Change. This idea is new, yet still in line with the results of previous studies and research regarding the lack of climate change regulation that is still dispersed in many regulations and/or policies. The omnibus law on climate change is expected to be an instrument of climate change control that has dimensions of justice for society and the environment.

Abstract

Presidential Regulation No. 78 of 2023 on the Amendment to Presidential Regulation No. 62 of 2018 on the Handling of Societal Impacts in the context of Land Provision for National Development has been enacted. Community social impact in this study is land controlled by the community used for national development, both national strategic projects and non-national strategic projects. This research aims to see the implementation of the regulation on the handling of community social impacts in the Archipelago's capital city and the legal consequences on residents' land rights. The research method used is a social legal reserch approach by considering the contribution of doctrinal research by adding factors outside the norms, namely social facts, legal practices and all that influence them. The results of the study explain that the provision of compensation in Presidential Regulation Number 78 of 2023 concerning Handling Community Social Impacts in the Context of Providing Land for National Development is given to residents who do not have a right base and if there is compensation given in this case there are differences in Law Number 2 of 2012 concerning Land Acquisition for Development for Public Interest. The issuance of Presidential Regulation No. 78 of 2023 on Handling Community Social Impacts that the land rights of residents affected by development do not exist and are not recognised, so this shows that affected residents lose their land rights. The issuance of Presidential Regulation No. 78 of 2023 concerning Handling of Community Social Impacts that the land rights of residents affected by development do not exist and are not recognised, so this shows that affected residents lose their land rights and there is no deliberation to determine the amount of compensation, so there is no agreement in determining the amount of compensation for affected communities. The implementation of Community Social Impact Handling in the Framework of Land Provision for National Development in terms of providing compensation without recognition of land rights has the potential to remove people’s basic rights to land, especially residents affected by development projects run by the government.Keywords: Land Provision; National Development; Compensation

Abstract

Land is a basic human right, including for women. As a living space, land occupies a strategic position in the fulfillment of human rights. Constitutionally, women's equal rights to land are guaranteed by law, but in reality, it is neglected and lacks recognition and protection, especially in the natural resource extraction area. Economics that rely on mining extraction have the consequence of widespread ecological and environmental crises that affect people's lives, including vulnerable groups of women. The gender inequality in tenure, ownership, access and control over land has many impacts on women's lives. This research focuses on the law guarantees the recognition and protection of women's human rights to land, and the reality of recognition and protection of women's human rights to land in mining areas. The research findings show that ideally the law provides recognition of equal rights between women and men in access, control, and ownership of land. However, mining regulations provide more convenience for mining business actors, not ensuring protection for the community, especially women. In addition, the male paradigm as the head of the family has led to the marginalization of women in decision-making related to their land and living space. In the midst of conflicts in mining areas, efforts to assert rights and struggle for women's basic rights to land often receive discriminatory treatment and gender bias. The ecological crisis situation is a problem for the protection of women's human rights to land in mining extraction areas.
