Abstract

Perkembangan transaksi jual beli saat ini dengan menggunakan media elektronik telah mengubah wajah hubungan jual beli. Jual beli tidak lagi harus dilakukan pada satu tempat yang sama secara face to face, namun dapat dilaku­kan oleh orang yang berbeda lokasi. Meskipun demikian, ketentuan hukum tentang jual beli tetap berlaku. Perbedaan yang terjadi adalah terkait penyerahan barang (levering) yang telah dibeli tidak dapat dilakukan secara langsung antara penjual dengan pembeli. Menurut ketentuan Pasal 1459 KUHPerdata bahwa “Hak milik atas barang yang dijual tidaklah berpindah kepada si pembeli selama penyerahan­nya belum dilakukan”. Levering pada jual beli online tidak dilakukan dalam waktu yang bersamaan dengan terjadinya kesepakatan dan terdapat peran pihak ketiga dalam levering, yaitu pihak jasa pengiriman barang, hal ini dapat menimbulkan permasalahan hukum terkait tanggung jawab dalam proses peralihan hak terse­but. Tujuan penelitian ini adalah menganalisis pihak yang bertanggung jawab pada proses levering perjanjian jual beli secara online. Menggunakan penelitian yuridis normatif dapat dijelaskan bahwa tanggung jawab dalam peralihan hak pada per­janjian jual beli secara online adalah tanggung jawab pihak penjual kecuali jika diperjanjikan lain

Abstract

Tujuan Penelitian Untuk menganalisis bagaimana bukti kepemilikan saham dalam Perseroan Terbatas sebagaimana diatur dalam Pasal 51 UUPT. dan  apa langkah hukum yang dapat dilakukan terhadap perbuatan organ PT yang meniadakan saham salah satu pemegang saham. Jenis Penelitian  yang digunakan hukum normatif dengan pendekatan Perundang-Undangan Hasil Penelitian Bahwa bukti kepemilikan saham dalam Perseroan Terbatas bentuk kepemilikan saham adalah akta pendirian. Di dalam akta pendirian yang berisi anggaran dasar perusahaan tercantum pemilik saham, berapa lembar atau persen saham dan nilai saham. Kedua Langkah Hukum yang dilakukan terhadap Perbuatan organ Perseroan terbatas dilakukan dengan dua langkah yang pertama melalui perdata yang dapat ditempuh terhadap organ perseroan dengan mengajukan gugatan perbuatan melawan hukum pada Pengadilan Negeri agar dilakukan pemeriksaan terhadap perseroan dalam pasal 138 ayat (1) angka b UUPT, pasal tersebut mengatur bahwa pemeriksaan terhadap perseroan dapat dilakukan dengan tujuan untuk mendapatkan data atau keterangan dalam hal terdapat dugaan bahwa anggota direksi melakukan perbuatan melawan hukum yang merugikan perseroan atau pemegang saham atau pihak ketiga. Yang kedua dengan hukum pidana, organ perseroan terhadap perbuatan salah satu organ perseroan yang melakukan perbuatan tersebut dapat dilaporkan melakukan tindak pidana penggelapan dan penipuan sebagaimana yang diatur dalam Pasal 372 tentang Penggelapan Kitab Undang-Undang Hukum Pidana (KUHP) dan Pasal 378 Kitab Undang-Undang Hukum Pidana (KUHP) tentang Penipuan.

Abstract

Progress in the digital era has made technological advances increasingly sophisticated and rapid so that the use of various digital media is very necessary for society. The shift in activities that were previously carried out conventionally is slowly shifting to online or better known as "online", such as the use of applications zoom as an application for face to face. Activities in the notarial world are also experiencing the impact of changes in this era, which are known as cyber notary. The preparation of the parties' deeds which was previously carried out conventionally has shifted to using online methods as well, thus raising a question about the validity of the identities of the presenters who appear online before the Notary in the process of making authentic deeds in cyber notary. There is a need for synchronous arrangements regarding the conditions for making authentic deeds of the parties which are carried out online. This research is legal research nature perspective, using a statue approach and conceptual approach.

Abstract

Community service in the Compulsory Lecturer Service Program (PDWA) aims to develop the capacity of women in resolving disputes/conflicts and the strategic role of women's involvement in the Mediation House, so that equality of position is created between men and women to obtain opportunities/opportunities and participation in development, especially in facilitating the resolution of disputes and disputes in the community through mediation channels that prioritize deliberation and consensus with an approach that prioritizes peace. Through this service theme, it is hoped that it can inspire women to take a role in the Mediation House. The results of this service activity show that women also have the capacity and ability to become facilitators in resolving disputes in the community through mediation, because in principle women have good communication skills to facilitate the resolution of disputes/conflicts between the parties. Thus, women's participation in the mediation space can be an important investment for a better future in Banjarmasin City, which has a domino effect on increasing women's legal literacy and strengthening social networks (agents of change).

Abstract

Permasalahan akses keadilan bagi kelompok rentan di Kota Banjarmasin disebabkan oleh peraturan bantuan hukum yang belum sepenuhnya efektif, sehingga perlu dilakukan perbaikan Peraturan Daerah yang lebih spesifik, teknis serta implementasi peraturan ini dapat ditingkatkan dengan mempertimbangkan konteks lokal. Penelitian ini menemukan bahwa perbaikan peraturan daerah harus diiringi dengan perubahan Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum sebagai payung hukum utama, serta pentingnya sosialisasi bantuan hukum dan pengenalan istilah "kelompok rentan" kepada masyarakat untuk meningkatkan kesadaran dan pemahaman hak-hak mereka. Dengan demikian, Pemerintah Kota Banjarmasin dapat menyediakan layanan hukum gratis yang lebih responsif dan berbasis teknologi serta kearifan lokal bagi kelompok rentan. Penelitian ini menggunakan metode penelitian yuridis normatif. Pendekatan yang dipilih dalam penelitian ini adalah pendekatan peraturan-perundang-undangan dan pendekatan konseptual. Bahan hukum yang diperoleh kemudian dianalisis dengan metode analisis kualitatif dengan cara menginterpretasi bahan hukum dan memberikan kritik terhadapnya.

Abstract

Government Regulation Number 17 of 2015 concerning Food Security and Nutrition states that the Provincial Government, Regency/City Government, and/or Village Government implement policies and are responsible for the implementation of food security in their respective regions. Food security must be prioritized, and support from the Local Government and the Central Government in maintaining food security is important to prevent food crises. This study aims to analyze the policy of the Regional Government in managing food needs and providing food reserves so as to provide protection for the fulfillment of the right to food in South Kalimantan. Through socio-juridical research methods (socio-legal) using an interdisciplinary or "hybrid" approach between aspects of normative legal research through sociological approaches using qualitative analysis methods, it will be possible to observe the compatibility between das sollen and das sein, namely the integrity of a detailed and careful explanation of legal issues between law in book and law in action. As a form of responsibility, the Provincial Government of South Kalimantan has stipulated Regional Regulation and Regency/City Regulation as well as Regent/Mayor Regulation related to food as a legal basis in making policies/programs/activities related to food management and also providing food reserves so that communities are protected and the rights to their food are fulfilled both in quantity, quality, safe, diverse, nutritious, equitable and affordable. The regulation made is also should not contrary to the religion, beliefs, and culture of the community, so that the community and the individuals are able to live healthy, active, and productive sustainably. The government is also coordinating the agencies/SKPD Regional Government both vertically and horizontally, and carrying out cooperation about this matter with other regions.

Abstract

This study aims to critically examine the institutional position of the Public Prosecutor’s Office as the sole prosecutorial authority (single prosecutor) within the Indonesian criminal justice system. The core legal issue addressed concerns the authority and functional role of the Prosecutor’s Office as the exclusive body responsible for prosecution, particularly as mandated in Article 1 of Law No. 11 of 2021, which amends Law No. 16 of 2004 on the Public Prosecutor's Office of the Republic of Indonesia. Employing a normative legal research method, this study focuses on the analysis of normative ambiguity, using both statutory and conceptual approaches. The findings indicate that the single prosecutor concept normatively reinforces the centralization of prosecutorial powers in the hands of the Public Prosecutor's Office. Nonetheless, ambiguities persist regarding the interpretation of the limits of this authority, especially in its interactions with other law enforcement agencies and in the practical implementation of the dominus litis principle. Therefore, a comprehensive legal interpretation is imperative to prevent overlapping jurisdictions and to uphold the coherence and consistency of Indonesia’s criminal justice system.

Abstract

Food security reflects the extent to which a country or region is capable of providing sufficient, safe, and nutritious food for its entire population. Efforts to strengthen food security are of vital importance in realizing a safe, healthy, and prosperous society. In the context of national development, food security has become one of the main priorities, which undoubtedly requires active support from local governments. This is closely related to the fulfilment of the right to food, which is a fundamental right of every citizen. The issue addressed in this study concerns the forms of food governance implemented by local governments to support food security at the local level. To address this issue, a normative legal research method is employed to examine the policy directions of local governments in ensuring the availability of food that is both adequate and accessible to the community. In ensuring the sustainable fulfilment of food needs, local governments play a strategic role in managing the food system within their regions. This role is realized through policy formulation, regulatory development, and the implementation of programs based on local potential. Thus, local governments can serve as key actors in promoting equitable and sustainable national food security.
