Abstract

A state of emergency is an inevitable circumstance that has arisen in several regions of the world, including Indonesia. In these circumstances, there is widespread abuse of authority manifested by the excessive curtailment of rights and the violation of constitutional norms for declaring emergencies. Thus, it is necessary to have oversight from other state institutions to provide adequate checks and balances. This research aims to measure the supervision of the Indonesian Constitutional Court during a state of emergency. Normative legal research is a type of research that uses a conceptual approach, a case approach, and a comparative country approach. Through the analysis of decisions, cases, and elaboration with the principles of State Emergency Law, this paper finds that of the 3 (three) aspects of judicial supervision during a state of emergency, the aspect of supervision in the form of testing the declaration of a state of emergency is an aspect that is not owned by the Indonesian judiciary. Whereas this aspect is important, the declaration of a state of emergency issued by the President is unconstitutional.

Abstract

Background: Diabetes mellitus is a disease that always increases from year to year. Diabetes mellitus sufferers can experience various kinds of complications which can result in decreased body function, one of which is decreased foot sensitivity. Various efforts can be made to overcome this problem, one of which is the active range of motion (ROM) of the legs. Active foot ROM is a basic movement to increase foot sensitivity in diabetes mellitus sufferers.Purpose: Describe the effect of Range of Motion (ROM) in increasing foot sensitivity in diabetes mellitus sufferers.Methods: The study using descriptive qualitative design with case study approachResults: There was an increase in foot sensitivity score in the three informants. There was also reduction in neuropathy symptoms after undergoing range of motion therapy.Conclusion: Range of motion can be applied to patient with decrease of foot sensitivity so that quality of life of diabetic patient can be improved.

Abstract

This paper analyzes the constitutionality of Law Number 2 of 2020 concerning COVID-19 which was originally passed as emergency legislation in the form of “government regulation in lieu of law”. The COVID-19 Law reaps pros and cons because it is considered to have the potential to give birth to abuse of power in times of crisis. Grounded by final decision of The Constitutional Court, this paper raises three main issues; First, the vital role of judicial power in providing checks and balances in an emergency situation. Second, the prohibition of granting immunity to the practice of irregularities in state finances in times of crisis. Third, the need for a time limit for granting discretion caused by COVID-19 to ensure legal certainty. Through the method used, namely normative juridical, conclusions were obtained regarding the urgency of the role of the power of the Constitutional Court in Indonesia as the protector of the Constitution in the COVID-19 emergency.

Abstract

Tulisan ini membahas tentang dualisme lembaga pelaksana redistribusi tanah di tingkat nasional, yaitu Panitia Pertimbangan Landreform (PPL) dan Tim Pelaksana Percepatan Reforma Agraria Nasional (TPPRAN). Tulisan ini bertujuan untuk menganalisis akar permasalahan dan solusi atas dualisme lembaga pelaksana reforma agraria yang jarang diulas karena kebanyakan kajian berfokus pada masalah dampak kebijakan semata. Dengan menggunakan metode yuridis normatif dengan pendekatan regulasi dan historis, tulisan ini memiliki beberapa temuan. Pertama, dualisme lembaga pelaksana redistribusi tanah berakar dari tumpang tindih regulasi karena regulasi landreform tidak kunjung dicabut setelah kemunculan regulasi reforma agraria. Kedua, perbedaan kewenangan kedua lembaga pelaksana redistribusi tanah terletak pada kewenangan TPPRAN yang lebih teknis seperti menentukan lokasi dan menyelesaikan konflik dalam redistribusi tanah. Tulisan ini merekomendasikan integrasi lembaga pelaksana redistribusi tanah melalui perubahan regulasi dengan memasukkan PPL ke dalam Peraturan Presiden No. 62/2023 atau mengubah keseluruhan regulasi dari level undang – undang agar tercipta kesamaan paradigma dalam seluruh pengaturan mengenai reforma agraria.

Abstract

This article discusses Constututional Court Regulations Number 6 of 2020 which  regulates parties who can be applicants in disputes over the results of Regional election with a single candidate are only candidate itself and election monitors, but ignores the right for community to become applicants. This paper argues that legal standing in disputes over the results of regional head elections with a single candidates should also be given to the community based on: community is a real subject involved in elections, and has an impact on the election of regional heads, the right to argue and actualize themselves in the democratic process, then the state should be able to open an opportunity for the public. The approach method used is normative juridical with secondary data. This paper concludes with the existence of a mechanism that provides access to the public as applicants in disputes over the results of regional elections with one pair of candidates, the community does not only play a role in choosing the options offered by the political system but is able to speak out over the circumstances created by the system.

Abstract

This article analyzes the application of Article 12 of the 1945 Constitution as the constitutional basis for the State of Emergency (Hukum Tata Negara Darurat) in Indonesia. The study is driven by the historical tendency to abuse emergency powers and the marginalization of the legislature’s role in declaring a state of danger. The main question addressed is: How can the provisions of Article 12 be understood and applied within the framework of the Legislative Model to ensure legislative involvement and oversight over presidential emergency powers? The purpose of this study is to explain how Article 12 of the 1945 Constitution can be interpreted within this framework to strengthen legislative oversight and provide a normative foundation for emergency law reform in Indonesia. This research employs a doctrinal method, using conceptual and statutory approaches. The findings show that Article 12 of the 1945 Constitution not only grants authority to the President but also mandates the involvement of the House of Representatives (DPR) in determining the conditions and consequences of an emergency through legislation. The conclusion highlights the urgent need to reform emergency-related regulations in line with Article 12 of the 1945 Constitution and to establish a clear mechanism for legislative oversight.AbstrakTulisan ini menganalisis penerapan Pasal 12 UUD 1945 sebagai dasar konstitusional dalam Hukum Tata Negara Darurat (HTN Darurat) di Indonesia. Kajian ini dilatarbelakangi oleh kecenderungan historis penyalahgunaan kewenangan darurat dan pengabaian peran legislatif dalam penetapan keadaan bahaya. Permasalahan utama yang dikaji adalah: Bagaimana pengaturan dalam Pasal 12 UUD 1945 dapat dipahami dan diterapkan dalam kerangka Legislatif Model guna menjamin keterlibatan dan pengawasan lembaga legislatif terhadap kewenangan darurat Presiden?Tujuan penulisan ini adalah untuk menjelaskan bagaimana Pasal 12 UUD 1945 dapat diinterpretasikan dalam kerangka tersebut, guna memperkuat peran pengawasan legislatif terhadap kewenangan darurat Presiden dan memberikan dasar pembaruan hukum kedaruratan di Indonesia. Metode penelitian yang digunakan adalah doktrinal dengan pendekatan konseptual dan perundang-undangan. Hasil kajian menunjukkan bahwa Pasal 12 UUD 1945 bukan sekadar memberi kewenangan kepada Presiden, tetapi juga mengatur keterlibatan DPR dalam menetapkan syarat dan akibat pelaksanaan keadaan darurat melalui undang-undang. Simpulan menekankan pentingnya pembaruan regulasi dengan karakter kedaruratan yang merujuk pada Pasal 12 UUD 1945 dan memperjelas mekanisme pengawasan legislatif.

Abstract

Legal politics in the formation of a draft law into law requires a mechanism with a process that is not simple. The process of forming statutory regulations is regulated in Law Number 15 of 2019 concerning the Formation of Legislative Regulations. The planning and preparation stage begins with the National Legislation Program (Prolegnas). In the Prolegnas, it is planned and prepared an agenda for any bills which will be the task of the House of Representatives to be discussed for the next 1 (one) to 5 (five) years and are only valid during the term of office of the DPR in that period. Therefore, a mechanism for "inheriting" the bill from the previous period to the next period is needed to ensure the continuity of the bill discussion process or it can be called a " carry-over " mechanism which basically has the main objective of continuing the discussion of the bill so that it reaches the enactment stage. raised in this paper is "What is the process of forming legislation with a carry-over mechanism and its relationship to the general principles of good governance?" The research method used in this journal is normative legal research method, which refers to legal norms contained in laws and court decisions, as well as legal norms prevailing in society. The results of this research show that Prolegnas, as the first step in determining what bills can be drafted using the carry over concept , is a form of legal politics in the formation of laws. It is hoped that the formation of laws through the carry-over concept can perfect the process of forming laws and regulations that pay attention to the effectiveness and sustainability of development planning and are in accordance with the formation of good laws and regulations. Abstract

The Hague Conventions include a general participation clause and is regarded as customary international law, meaning that ASEAN countries are considered bound by the norms contained within the convention. The declaration of war as stated in the Hague Convention III of 1907 was adopted in Article 11 paragraph (1) of the 1945 Constitution of the Republic of Indonesia, which, to date, has not provided further regulations governing the implementation of legislative and executive powers concerning the declaration of war. Therefore, it is necessary to look at the constitutional arrangements for the state of war in ASEAN countries through comparative law study to determine and observe the pattern of these arrangements to be implemented in Indonesia. The results of research regarding the practice of war in 10 ASEAN countries. Firstly, the constitutional pattern in ASEAN countries follows the parliamentary model. Secondly, there are checks and balances between parliament and the government during a state of war. Thirdly, in a state of war or other emergencies, it is necessary to extend the term of office of the parliament and the president. Fourthly, the extension and termination of a state of war or other emergency is in the hands of parliament. Fifthly, the existence of a time limit is necessary during a state of war. Sixthly, exceptions in a state of war include constitutional amendments prohibited, the parliament may not be dissolved, and can restrict or suspend human rights. Lastly, in Indonesia, it is necessary to include the DPD in the declaration of a state of war.
