Abstract

Abstract

Narcotics often cause children to become victims and it also affects the protection of children's rights. This study is intended to see how maqâshid al-syarî`ah views the protection of child victims of narcotics. The method used in this study was a descriptive qualitative approach to explore how paradigms, factors, and implications for the protection of child victims of narcotics. The data in this study was obtained through a search of a search engine google.com with the keyword "maqâshid al-syarî`ah paradigm towards legal protection of child victims of narcotics", then the data was reduced to present the expected results in this study. The analysis of this study shows that legal protection for children victims of narcotics has not been fulfilled; hence, it is not uncommon for children to be used as agents for the sustainability of narcotics trafficking in Indonesia. This study is based on an argument that the protection of children entangled in drug cases is still not optimally provided in terms of prevention, legal process, and punishment of child victims of narcotics. As a result, a maqâshid al-syarî`ah approach is required, to achieve an advantage in providing legal protection regulations for children who have been victims of narcotics in Indonesia.

Abstract

This research aimed to understand the characteristics of the pesantren’s culture, which is based on transnational culture. This study utilized a mixed-methods approach, including interviews with pesantren leaders and students and participant observations within the pesantren community. The findings revealed that transnational culture within pesantren is influenced by global Islamic discourses and practices while maintaining traditional Indonesian cultural elements. Understanding these characteristics is crucial for policymakers and educators to address the evolving landscape of Islamic education in Indonesia. Further research is needed to explore the impact of transnational culture on the development of pesantren in the future. The Salafi’s Islamic Boarding School, Zād al-Maʿād, was chosen as the research site for that purpose. The approach employed in this research is cultural anthropology with data collection tools in documentation studies, observations, and interviews. The findings emphasize the adaptability of Salafi pesantren to local customs and traditions, showcasing a unique blend of global ideology and local practices that contribute to the movement's continued success in Indonesia. Based on qualitative analysis, the boarding school is also an agent of Islamic preaching in spreading Salafi’s understanding and a center for the cadre of Salafi’s preachers from a young age. The Salafi’s network can use its program to organize various international programs.

Abstract

This study aims to examine the responses of pesantren communities in South Sumatra to the discourse of khilafah, particularly how kiai and santri interpret exclusive and inclusive Islamic texts in relation to religion–state dynamics. The research employed a qualitative method with a critical hermeneutic approach, combining in-depth interviews, participatory observation, and documentation studies in five pesantren across three districts. The findings reveal that the pesantren communities do not perceive the khilafah merely as a political project, but as a discourse negotiated through da‘wah, education, and religious authority. Three major patterns of response were identified: (1) support for the nation-state while internalising Islamic values through da‘wah and education; (2) reflective acceptance of the khilafah as an ideal, but with contextual consideration for Indonesia’s pluralistic reality; and (3) normative rejection of both the nation-state and khilafah based on critical views of political failures. These responses demonstrate the active role of pesantren in shaping Islamic discourse, promoting moderation, and safeguarding national unity. The study concludes that pesantren function not only as educational institutions but also as centres of da‘wah and socio-political negotiation that adaptively respond to transnational Islamic ideologies in contemporary Indonesia.
