Abstract

Religious harmony is a fundamental element in maintaining social stability and national unity, especially in a country with religious diversity like Indonesia. This study employs the library research method, analyzing various written sources such as books, scientific journals, research reports, and relevant official documents. A descriptive-qualitative approach is used to explore the supporting and inhibiting factors of religious harmony and examine the implementation of tolerance in society. The study's findings indicate that several factors contribute to religious harmony in Indonesia, including local wisdom values, the role of the government and religious institutions, multicultural education, and strong social interactions. However, several obstacles hinder religious harmony, such as intolerance and radicalism, the spread of religious-based hoaxes, social inequality, and the lack of interfaith dialogue. According to the Religious Harmony Index (Indeks Kerukunan Umat Beragama), Indonesia generally maintains a good level of religious harmony, yet challenges persist in certain regions. This study emphasizes the need for synergy between the government, religious leaders, academics, and society to strengthen religious moderation and prevent potential conflicts. Strategies such as improving digital literacy, strengthening interfaith dialogue, and ensuring social welfare equity must be continuously pursued to maintain interreligious harmony. With an inclusive and participatory approach, Indonesia is expected to remain a country that upholds the values of tolerance in religious life.

Abstract

The philosophy of Islamic marriage is often overlooked by the perpetrators of marriage so that the divorce rate is always high. For example, the Central Statistics Agency (BPS) released data on the divorce rate in Central Java for various reasons, in 2020 it reached 65,815 divorces, in 2021 there will be no less than 65,722. Although comparing to the figures in the previous year, this figure has decreased slightly, it is still said to be high. One way to reduce this number is to require a complete understanding of the philosophy of Islamic marriage. The five pillar mubadalah can be jointly carried out by each husband and wife, so that household harmony can be achieved together. This paper seeks to examine this, where the type of research used is literature review with documentation techniques, the approach used is normative theology with content analysis techniques and drawing conclusions with a deductive thinking framework. The results of this study are that the philosophy of Islamic marriage is parallel to the maqasid sharia of marriage. Maqashid sharia marriage has two dimensions: maqashid ashliyyah or main maqashid, and maqashid taba'iyyah or complementary maqashid. The five pillar mubadalah are tips that need to be considered to create maqashid marriage and a philosophy of Islamic marriage at once

Abstract

Gender merupakan sifat dan perilaku yang dilekatkan pada laki-laki dan perempuan yang dibentuk secara sosial maupun budaya. Permasalahan gender seakan tidak ada habisnya. Banyak isu-isu yang muncul kemudian tertuju pada kesetaraan gender yang dialami antara laki-laki dan perempuan. Tujuan penelitian ini yaitu untuk mengetahui konsep gender dalam tafsir syech mutawalli sya'rawi dan aplikasi hukum sosialnya. Metode yang digunakan dalam penelitian ini adalah library research, yang mana referensi digunakan berasal dari buku, kitab dan jurnal-jurnal. Adapun jenis penelitian yang digunakan dalam penelitian ini adalah yuridis normatif berupa penelitian kepustakaan karena penelitian dilakukan dengan mengkaji mengenai hal-hal yang berkaitan dengan keluarga sakinah dari para ulama. Sementara pendekatannya menggunakan pendekatan pada konsep gender tafsir syech mutawalli sya'rawi. Hasil penelitian ini menunjukkan bahwa Konsep gender dalam tafsir Syekh Mutawalli Sya'rawi memiliki pengaruh yang signifikan dalam hukum sosial. Dalam tafsirnya, prinsip kesetaraan gender yang diatur dalam Al-Qur'an menegaskan bahwa laki-laki dan perempuan diciptakan dari satu jiwa yang sama, sehingga memiliki hak dan martabat yang setara di hadapan Allah. Sya'rawi mengartikan kesetaraan ini tidak hanya sebagai teori, tetapi juga sebagai landasan praktis dalam penerapan hukum sosial.

Abstract

This article discusses the importance of monotheism (tauhid) in the diversity of humanity and its role in social systems and worship. The research objective is to understand tauhid education as an integral part of Islamic education leading to the recognition of God. The method used is qualitative descriptive with a literature study approach, collecting data from books, the Qur'an, and related literature. The findings indicate that tauhid education is essential in shaping individuals who recognize the oneness of God and avoid polytheism, contributing to the unity of humanity. In conclusion, tauhid is the foundation of Islamic civilization that teaches that only Allah is worthy of worship, and tauhid education in schools is expected to strengthen students' beliefs and prevent misunderstandings.

Abstract

This article is the result of library research. This study aims to: track the shafi'iyah school of thought in determining the legal status of pregnant women marriage. This article discusses the reasoning or way of thinking of the Shafi'iyah school in determining the legal status of a pregnant woman's marriage and the status of the child she gives birth to. The claim of this research is that the approach taken by the syafi'iyah school in determining the legal status of pregnant women's marriages uses a textual approach. The source of the law used is the Hadith of the Prophet Muhammad which stipulates that a wife who is still in her husband's marriage contract, every child born to her, even though it is the result of adultery, is considered by law to be her husband's child. The results of this study conclude that a child born before a legal marriage, is considered an adulterous child, cannot be attributed to a father, and each of them cannot be an heir and neither can inherit. If the marriage is carried out to cover the disgrace, if it is carried out before six months of gestation, the status of the baby is considered a legal child according to Islamic law. Abstract

Islamic law has set universally regarding family law issues relating to divorce, but it seems that the difference for women's rights after divorce occurs in a range of applications in the side or the level of legal arrangements, given the differences in social system, cultural system or even the political system in each each country both in Indonesia and in the Islamic world. Comparative analysis of family law related to women's rights after divorce in this article, based on the exposure of legal jurisprudence schools and the positive law in force in countries such as Indonesia, Malaysia Tunisia, Iran, Egypt, Yemen, Turkey, and Iraq, special about the reasons of divorce. In general, these countries legal materials more dominant tendency is patterned Shafi'i schools. However, there are several different opportunities such as: in terms of the chances of divorce, in each country appears once judiciary complicate divorce, meaning to go keperceraian first sought peace efforts were made as strong as possible. Yet in terms of the position of the parties is protected rights before the law (principle of equality before the law) in each country for example in Indonesia and South Yemen, especially in Yemen has also strengthened in its National Constitution that "The State guarantee or protect the legal equality between laki- men with women in all aspects of life, whether political, economic, and social life ".
