Abstract

Introduction: Children are the next generation of the nation who must be protected in order to grow up properly. Handling children's cases through the Juvenile Criminal Justice System has devastating impacts on children's futures.Purposes of the Research: This study aims to analyze the effectiveness of handling children's cases through diversion in the East Java Regional Police and analyze obstacles to handling children's cases through diversion so that solutions are found to achieve maximum diversion implementation as mandated by the Children's Criminal Justice System Law.Methods of the Research: This type of research is sociolegal research with a statutory approach, a conceptual approach, and a comparison approach, namely Law Number 11 of 2012 concerning the Juvenile Criminal Justice System.Results of the Research: The results showed that of the five police and police in the East Java Regional Police area, it showed that not 50% of the handling of children's cases had been successfully resolved through diversion. The causative factors include the non-achievement of the consent of the victim's child and his family. Therefore, the condition of consent of the victim's child and his family in Article 9 paragraph (2) must be abolished because Article 7 paragraph (2) of Law Number 11 of 2012 does not require the consent of the victim's child and his family. In practice is the main obstacle to achieving diversion, should be eliminated in the best interest of the child in accordance with the principles of the Convention on the Rights of the Child.

Abstract

General Background: The criminalization of black magic presents complex challenges at the intersection of law, culture, and religion. Specific Background: Article 252 of Indonesia's National Criminal Code regulates black magic based on claims of supernatural power, punishable by imprisonment or fines. Knowledge Gap: However, there is limited clarity on the role of paranormal witnesses in the evidentiary framework of such crimes, particularly from the perspective of legal certainty. Aims: This study aims to design a model for utilizing paranormal witnesses as supporting evidence in black magic cases. Results: Employing a sociolegal method with legislative and conceptual approaches, supplemented by interviews with East Java Regional Police investigators and religious figures, findings reveal that scientific investigation methods are prioritized over paranormal testimony. In Islamic law, proving black magic requires confession, valid witness testimony, or strong qarinah, with input from ruqyah experts serving only as reinforcement. Novelty: The study introduces a model that aligns with Article 184(1) Jo. 183 of the Criminal Procedure Code, positioning paranormal testimony as non-autonomous, corroborative evidence. Implications: The research proposes establishing a certified paranormal association to ensure formal legality and regulated participation in criminal investigations involving supernatural claims. Highlights: Legal evidence for black magic relies on scientific and sharia-valid proof. Paranormal testimony serves only as supporting (non-primary) evidence. Abstract

General Background: Indonesia's criminal justice system aspires to uphold the principles of simplicity, swiftness, and cost-efficiency. Specific Background: However, these ideals remain inadequately realized, particularly in addressing environmental crimes perpetrated by corporations—cases often burdened by protracted processes and limited effectiveness in restoring state losses. Knowledge Gap: Conventional legal approaches have failed to achieve significant restitution, signaling a need for alternative mechanisms. Aims: This study examines the potential application of the Deferred Prosecution Agreement (DPA) framework as a tool to actualize a more efficient judiciary in prosecuting corporate environmental offenses. Results: Using a normative juridical method with statutory and comparative approaches, the study finds that the DPA offers a concrete, legally feasible means of pursuing compensation while streamlining judicial procedures. Novelty: The research introduces the concept of DPA into Indonesia’s legal discourse as an innovative, non-traditional solution for environmental crime cases involving corporate actors. Implications: The adoption of DPA mechanisms, accompanied by normative and institutional adjustments, could significantly enhance Indonesia's judicial efficiency and environmental accountability frameworks. Highlights: Promotes judicial principles of simplicity, speed, and cost-efficiency. Offers innovative restitution for environmental damage by corporations. Abstract

One of the important updates in the National Criminal Code is the implementation of the conditional death penalty, which provides an opportunity for death row inmates to change their sentence to life imprisonment if they show commendable attitudes and actions during the probation period. The study found that the phrase "commendable attitudes and deeds" refers to sincere remorse, adherence to rules, and positive contributions during the probationary period. However, this article does not yet have clear guidelines or indicators, thus posing challenges in its implementation, including potential subjectivity and inconsistencies in assessments. This study aims to find out how starndart determines commendable attitudes and actions in Article 100 Paragraph (4) of Law Number 1 of 2023 concerning the Criminal Code. The method used in this study is normative juridical using a statutory approach and a conceptual approach. The results of this study are that the phrase "commendable attitudes and deeds" refers to sincere remorse, adherence to the rules, and positive contributions during the trial period. However, this article does not have clear guidelines or indicators, thus posing challenges in implementation, including the potential for subjectivity and inconsistency in assessment. The process of converting the death penalty to life imprisonment involves reports from correctional institutions, third-party testimony, and Presidential Decrees based on the Supreme Court's considerations. This research suggests the development of objective and systematic evaluation standards to ensure legal fairness and consistency.

Abstract

Kekuasaan kehakiman merupakan kekuasaan yang merdeka untuk menyelenggarakan peradilan guna menegakkan hukum dan keadilan. Hakim dan Hakim Konstitusi wajib mengadili mengikuti dan memahami nilai-nilai hukumdan rasa keadilan yang hidup dalam masyarakat. Kejahatan seksual yang terjadi terhadap anak yaitu pedofilia yang dari tahun ke tahun mengalami peningkatan. Pemberian hukuman pidana tambahan berupa kebiri merupakan alternatif terakhir dan dalam pengenaannya pidana tambahan tersebut tidak menghilangkan pidana pokok. Hakim Pengadilan Negeri Mojokerto dengan nomor perkara 69/Pid.sus/2019/PN.Mjk, telah manjatuhkan hukuman 12 tahun penjara dan denda Rp 100 juta serta pidana tambahan berupa pidana kebiri kimia. kepada Moh Aris pelaku pemerkosaan 9 anak di Mojokerto.

Abstract

Tesis ini mengkaji salah satu aspek dari UU Perkawinan Adat, yaitu prosedur untuk melaksanakan pernikahan (proses pelaksanaan pernikahan), antara lain: pernikahan pinang, kawin kawin bersama dan kawin lari dengan paksa, yang semuanya masih berlaku di masyarakat. Dalam penelitian ini, penelitian ini menggunakan Hukum Adat, Hukum Islam dan Hukum Nasional (sesuai dengan UU No. 1 tahun 1974). Menggunakan Hukum Adat karena kejadian itu terjadi di masyarakat adat, sedangkan menggunakan Hukum Islam karena teori Receptio di complexiu mengatakan bahwa Hukum Islam telah menjadi Hukum Adat, untuk mengetahui sejauh mana hukum Islam mengatur masalah pernikahan untuk menikah , kawin lari bersama dan kawin lari dengan paksa. Lembaga Pernikahan Adat di Indonesia telah diakui sesuai dengan amanat Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 Pasal 18 B ayat (2) JO pasal 5 ayat (1) Undang-Undang Nomor 48 Tahun 2009 tentang kekuasaan kehakiman yang menegaskan bahwa hakim dan hakim konstitusi berkewajiban untuk memeriksa, mengikuti dan memahami nilai-nilai hukum dan rasa keadilan yang ada di masyarakat.

Abstract

Penelitian ini bertujuan untuk mengetahui kewenangan dokter yang sesungguhnya sebagai eksekutor tindakan kebiri kimia. Metode penelitian yang digunakan dalam penelitian ini menggunakan metode Yuridis Normatif. Tindak criminal kejahatan kekerasan seksual terhadap anak ini dianggap telah serius, dikarenakan banyak korban anak yang menjadi korban kekerasan dan merusak jiwa anak, merusak masa depan anak dimasa yang akan dating dan merusak kepribadian anak, serta menganggu rasa kenyamanan, ketentraman, keamanan dan ketertiban masyarakat sehingga pemerintah mengatur sanksi pidana bagi pelaku kekerasan seksual terhadap anak. Menanggapi hal tersebut pemerintahan negra Indonesia mengeluarkan UU No. 17 Tahun 2016 yang menetapkan hukuman tindakan kebiri kimia bagi para pelaku tindak pidana kekerasan terhadap anak sebagai suatu kepedulian pemerintah kepada anak. Profesi yang dianggap memiliki keilmuan dan kompetensi terbaik dibidang kesehatan menolak untuk dijadikan eksekutor hukuman tersebut.

Abstract

Tujuan penilitian yaitu menganalisis terkait kdudukan pemegang S H M di wilayah pertambangan serta permasalahan di dalamnya. Mengunakan penelitian normatif dnegan pendekatan yang bresumber pada prundang-undangan, konseptual, dan historis. Melalui penelitian ini stiap hak atas tanah tidak bresifat mutlak, melainkan berfungsi sosial. Sumber daya alam di Indonesia sendiri beraneka ragam dan berlimpah. Dalam hal menjaga dan mmpertahankan sumbr daya alam haruslah senantiasa melindungi dan melestariakan sehinga dapat dimanafatkan kembali nantinya. Kekhawatiran masyarakat terhadap kegiatan pertambangan di wilayah mereka diantaranya, proses pertambangan dikhawatirkan akan merusak lahan pertanian, perkebunan, dan tempat hunian di sekitar pertambangan. Disini kemudian muncul gerakan penolakan pertambangan. UU Minerba masih mempertahankan adanya kriminalisasi terhadap pertambangan tanpa izin seperti contoh pasal 162. UUD Tahun 1945 mngamanatkan kepada Negara bahwa memebrikan kdudukan trehadap stiap warga negara serta memberikan kesejahtraan bagi rakyatnya. Pemahaman demikian penting agar pemerintah lebih selektif dalam membrikan izin usaha pertambangan. Pemahaman dan penguasaan materi perundang-undangan bagi setiap aparat penegak hukum menjadi salah satu indikator keberhasilan penegakan hukum.

Abstract

Melindungi Anak dari sistem paradilan formal adalah tanggung jawab negara didukung masyarakat. Anak adalah amanah yang harus dijaga, demi terciptanya generasi yang berkualitas. Meningkat kasus Anak berkonflik dengan hukum hingga anak harus menjalani proses pidana sampai vonis pemidanaan akan mengancam kualitas generasi masa depan bangsa. Hukum masih dipandang adil bila pelaku dipenjara dan korban dianggap puas, sehingga substansi hukum hanya fokus pada upaya pemidanaan. Angka kasus Anak berkonflik hukum dikabupaten Jombang juga cukup tinggi, mendorong langkah urgensi terbentuknya kelembagaan Posko Sambung Rasa Desa yang bisa mensolusikan problematika persoalan Anak dengan konsep mediasi penal berbasis masyarakat desa. Model ini dapat menjadi contoh baik dalam menyelamatkan Anak dari stikmatisasi negatif di masyarakat serta efektif mencegah kepadatan penanganan perkara di tingkat aparat penegak hukum. Model penyelesaian perkara seperti ini juga efektif untuk meredam perasaan dendam diantara para pihak dan masyaraat tetap rukun harmonis

Abstract

Sexual violence against children is a serious crime that threatens the fundamental rights of children to grow and develop optimally. One of the critical issues in such cases is the claim of “consent” from the victim, which perpetrators often use to avoid criminal liability. However, legally, children are considered incapable of giving valid consent to sexual activities. This article aims to analyze the criminal liability of perpetrators of sexual violence against children when invoking the defense of consent, as well as to examine the legal framework protecting children from sexual exploitation. This research employs normative legal methods with a statutory and conceptual approach. Data sources include national regulations, international legal instruments, and academic literature. The analysis is conducted deductively to produce systematic legal arguments. The results of the study indicate that consent given by a child in the context of sexual activity is legally invalid due to cognitive and emotional immaturity. Regulations such as the Child Protection Act and the Law on the Crime of Sexual Violence (UU TPKS) affirm that sexual violence against children remains a criminal offense, regardless of claims of consent. Perpetrators may be subject to severe criminal sanctions, including chemical castration and the installation of electronic monitoring devices
