Abstract

This study analyzes the use of Google Maps as a business information platform and its impact on the financial record-keeping systems of Micro, Small, and Medium Enterprises (MSMEs) in Aek Kota Batu Village. The study is grounded in MSME assistance activities conducted during the Community Service Program (Kuliah Kerja Nyata), which revealed increased business visibility through digital information, yet limited improvement in financial recording practices. The research aims to examine how Google Maps influences business information accessibility and its implications for MSMEs' financial record-keeping systems. A qualitative case study approach was employed through field observations, interviews with MSME owners, and documentation conducted during the KKN program. The findings indicate that Google Maps enhances customer reach and transaction intensity, which indirectly encourages MSMEs to begin implementing financial record-keeping practices, although these remain simple and unstandardized. The study offers empirical insights into the relationship between location-based business digitalization and the strengthening of MSMEs' financial management at the village level.

Abstract

Penelitian ini fokus pada kajian yuridis terhadap penerapan Undang-Undang No. 1 Tahun 2023 tentang KUHP yang berlaku efektif pada 2 Januari 2026 mengenai tindak pidana seks bebas di kalangan remaja, khususnya terkait mekanisme delik aduan absolut, implikasi sosial yang ditimbulkan, serta urgensi pendekatan restoratif dan edukatif dalam penegakan hukum bagi remaja pelaku seks bebas. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan sosiologis terbatas. Sumber data yang digunakan meliputi bahan hukum primer seperti UU No. 1 Tahun 2023, bahan hukum sekunder dari literatur hukum dan artikel ilmiah, serta bahan hukum tersier seperti kamus hukum. Teknik pengumpulan data dilakukan melalui studi kepustakaan, sedangkan teknik analisis data dilakukan secara deskriptif kualitatif. Penelitian ini menyimpulkan bahwa pasal 411 dan 412 KUHP baru mengkategorikan perzinaan dan kohabitasi sebagai tindak pidana yang bersifat delik aduan absolut, artinya proses hukum hanya dapat dilakukan apabila ada pengaduan dari pihak tertentu seperti suami, istri, orang tua, atau anak. Meskipun bertujuan untuk menjaga moralitas publik, ketentuan ini menimbulkan pro dan kontra di masyarakat, terutama karena menyangkut ranah privat yang sebelumnya tidak diatur dalam hukum pidana nasional. Penelitian ini menyimpulkan bahwa pengaturan Pasal 411 dan 412 memiliki dasar konstitusional yang kuat, namun penerapannya perlu memperhatikan aspek keadilan restoratif dan edukatif, khususnya terhadap pelaku yang masih berusia remaja. Perlu adanya peran aktif dari orang tua, pendidik, dan lingkungan sosial dalam membentuk karakter remaja yang bermoral dan menjauhkan mereka dari perilaku menyimpang. Di samping itu, pendekatan hukum yang digunakan terhadap pelaku remaja sebaiknya lebih mengedepankan pembinaan dan rehabilitasi daripada penghukuman semata.

Abstract

The development of the Islamic economy and finance in Indonesia has led to an increasing need for dispute resolution mechanisms that are effective, efficient, and compatible with Sharia principles. Badan Arbitrase Syariah Nasional (Basyarnas) functions as a non-litigation dispute resolution institution in the field of Islamic economics. This study aims to examine the legal standing of Basyarnas within the national legal system and to analyze strategies for optimizing its role as an out-of-court forum for resolving Islamic economic disputes. Based on a normative juridical review employing statutory and conceptual approaches, and secondary data collected through document analysis, This study finds that the legal existence and strategic role of Basyarnas continue to face various challenges, including the weak recognition of its decisions by judicial institutions, the low level of business actors? literacy regarding Sharia arbitration mechanisms, and limitations in human resources and institutional infrastructure. Therefore, it is necessary to strengthen the regulatory framework governing the legal standing of Basyarnas as a dispute resolution institution, enhance inter-institutional harmonization, improve the competence of Sharia arbitrators, and promote the digitalization of arbitration services as strategic measures to reinforce Basyarnas?s role as an integral part of the Islamic economic dispute resolution system in Indonesia.

Abstract

Iddah is a mandatory waiting time that Muslim women must observe after the dissolution of marriage, whether by divorce or the death of a spouse, prior to being allowed to remarry. This research seeks to examine the notion of iddah through the lens of Islamic jurisprudence (fiqh) and to contrast its regulation under the legal frameworks of Indonesia and Singapore. This study utilizes a normative legal research methodology, including statutory, conceptual, and comparative methods via the examination of Islamic legal sources, statutory regulations, and diverse literature pertaining to Islamic family law. The results demonstrate that the idea of iddah in classical fiqh has a robust normative basis derived from the Qur’an, Hadith, and academic ijtihad, with the objectives of safeguarding lineage, protecting women's rights, and sustaining familial order. Indonesia and Singapore both use classical fiqh principles, namely the Shafi’i school, as the normative foundation for controlling iddah; nevertheless, they diverge in their institutional frameworks, implementation methods, and the incorporation of Islamic law into their legal systems. In Indonesia, the regulation of iddah is integrated into the national legal system through the Compilation of Islamic Law and the Religious Court system, while in Singapore it is implemented through the Administration of Muslim Law Act (AMLA) and the Syariah Court within a dual legal system framework. This study demonstrates that the transformation of fiqh into positive law does not alter the fundamental substance of iddah but rather affects its implementation mechanisms and institutional legal structures in each country.Keyword: Iddah, Islamic jurisprudence, positive law, Indonesia, Singapore.

Abstract

A legal system is a set of interrelated rules that serve to regulate society in order to establish order and justice. This paper aims to explain the concept of a legal system, the types of legal systems that have developed around the world, and a comparison of their application in several countries. The method used is a literature review that analyzes various concepts and theories regarding legal systems. The results of the discussion indicate that, generally, legal systems worldwide are divided into several main types, namely the European Continental legal system (civil law), the Anglo-Saxon legal system (common law), Islamic law, customary law, and mixed legal systems. Civil law emphasizes written law codified in statutes, whereas common law places greater emphasis on court decisions or precedents as the primary sources of law. Additionally, Islamic law is derived from the Quran and Hadith as well as the method of ijtihad in legal reasoning, while customary law arises from living traditions within society. In practice, many countries adopt a mixed legal system as a result of globalization and societal developments. Indonesia itself fundamentally adheres to the civil law system, but in practice is also influenced by customary law and Islamic law, thereby forming a pluralistic legal system.Keyword: legal system, civil law, common law, Islamic law, customary law

Abstract

Marriage in Islamic family law is a fundamental institution that is not only governed by Sharia norms but has also evolved through state intervention in various Muslim countries. This study aims to analyze the role of the state in modifying Islamic family law, particularly regarding marriage, and to examine the forms and implications of these changes in the Islamic world. The method employed is a legal-normative approach with a comparative analysis of family law regulations in several Muslim countries. The results of the study indicate that the state plays a strategic role in codifying, unifying, and reforming Islamic family law to align with social and political demands and the changing times. These modifications include restrictions on polygamy, raising the minimum age for marriage, strengthening women’s rights, and regulating divorce procedures and marriage registration. Although based on Sharia principles, the implementation of Islamic family law in various countries demonstrates diversity influenced by local contexts and state policies. Thus, the state’s role in modifying Islamic family law is not merely administrative but also substantive in creating a legal system that is more responsive to social justice and the protection of human rights. This study confirms that the dynamics of Islamic family law are the result of the interaction between religious norms and state authority within the framework of modernity. Keyword: Islamic Family Law, Role of the State, Turkey, Malaysia, Indonesia, Legal Modifications.

Abstract

The Compilation of Islamic Law (Kompilasi Hukum Islam/KHI) regulates the marriage of women who become pregnant outside marriage under Article 53 without requiring a waiting period (iddah), even though this issue remains a matter of juristic disagreement (ikhtilaf) among Islamic legal scholars, resulting in non-uniform implementation in practice. This study aims to analyze the legal status of iddah for women pregnant outside marriage under Islamic law, examine the regulation of Article 53 of the KHI and its implementation at Offices of Religious Affairs (KUA) and Religious Courts, and assess its implications for legal certainty in Indonesian Islamic family law. The study employs a descriptive-analytical normative-empirical legal research design, combining statutory, conceptual, and Islamic-law approaches through library research with case and sociological approaches through in-depth interviews with five informants at the Medan Amplas District Office of Religious Affairs and the Medan Religious Court. The findings show that jurists are divided into three groups regarding the permissibility of marrying a woman pregnant outside marriage, while Article 53 of the KHI accommodates only one of these positions without expressly addressing the other two. Field findings reveal a clear disparity in understanding: one Marriage Registrar applies the article in a textual-administrative manner without considering iddah, whereas another registrar in the same office continues to recommend tajdid al-nikah on the basis of juristic caution. This disparity is aggravated by the absence of a standardized Standard Operating Procedure and creates a judicial loophole when the man marrying the woman is not the man who caused the pregnancy, requiring judges to refer to Constitutional Court Decision No. 46/PUU-VIII/2010. These disparities lead to non-uniform marriage administration, potential uncertainty regarding the legal status of children, inconsistency in Religious Court decisions, and psychological-religious anxiety within the community. The study recommends clearer implementing regulations or technical guidelines regarding iddah in marriages involving pregnancy outside marriage in order to strengthen legal certainty in Indonesian Islamic family law.
