Abstract

The implementation of investment incentive policies in regional areas often encounters obstacles due to legal uncertainty and inconsistencies in the application of administrative law, which negatively affect investment attractiveness and local economic growth. Effectively designed incentives, such as tax reductions, simplified licensing processes, and other supportive investment facilities, have been shown to increase investor interest in specific regions. This study aims to analyze the role of administrative law in supporting regional investment incentive policies and their impact on economic growth. Using a normative legal approach and qualitative analysis methods, the study reveals that consistent application of administrative law strengthens investor confidence in legal certainty. For example, regions that provide performance-based incentives and ensure legal protection for investments have demonstrated increased investment levels. Conversely, legal uncertainty and a lack of inter-agency coordination often lead to ineffective incentive policies, exacerbate economic disparities between regions, and weaken investment competitiveness. The findings highlight the need for reforms in the administrative legal framework, harmonization of incentive policies, and improved inter-agency coordination to ensure that investment incentive policies effectively promote inclusive and sustainable economic growth across Indonesia. Abstract

The oversight of the Regional General Service Agency (BLUD) in Indonesia has faced various challenges in terms of effectiveness and implementation, which may hinder the achievement of the objectives of transparency and accountability in the management of public finances. The study aims to evaluate the effectiveness of BLUD surveillance by identifying factors that affect regulatory compliance and BLUD performance in the provision of public services. Using a mixed methodological approach, the study combines normative and empirical analysis, as well as using comparative and socio-legal methods to dig up qualitative and quantitative data from various regions in Indonesia. The results of the study show that although the regulatory framework has been adequate, the implementation of surveillance still faces obstacles such as limited resources and less effective inter-agency coordination, which ends with variations in BLUD compliance and performance. The findings reaffirm the importance of strengthening surveillance capacity as well as revising policies that are adaptive to local conditions. Implications of this study include recommendations for enhanced, more integrated, technology-based supervision to support better public finance governance.

Abstract

Asymmetric decentralization in Indonesia is designed to grant special autonomy to regions with unique characteristics; however, its implementation often falls short due to institutional capacity limitations and continued dependence on the central government. This study aims to evaluate the effectiveness of asymmetric decentralization policies in various special autonomous regions of Indonesia, focusing on Aceh, Papua, and Yogyakarta. The research employs a normative and empirical juridical approach, supported by case studies and qualitative data analysis. The findings reveal a significant gap between policy objectives and implementation, attributed to factors such as inadequate local resources and weak coordination between the central and regional governments. The implications of these findings highlight the need to strengthen regional institutional capacity, enhance central government support, and tailor policies to be more context-specific and adaptable to local conditions. This study provides valuable insights for developing more effective and sustainable decentralization policies in Indonesia.

Abstract

In the digital age, political party wing organizations increasingly rely on digital strategies to mobilize young voters; however, legal policies regulating technology use can both support and hinder their effectiveness. This study aims to analyze the impact of legal policies on the implementation of digital strategies in political campaigns. The research employs normative legal analysis with a qualitative approach, reviewing regulations on data privacy, digital political advertising, and political funding. Based on the research findings, it is evident that regulations supporting transparency and compliance play a crucial role in managing data and enhancing public trust. However, overly stringent regulations can reduce the flexibility and effectiveness of the digital strategies employed by political party wings. Therefore, it is essential to implement balanced policies that not only foster innovation but also safeguard individual rights.

Abstract

The increasing frequency and intensity of disasters in Indonesia demands a reformulation of administrative law in disaster management. The gap between the existing legal framework (das sollen) and its implementation on the ground (das sein) hinders the effectiveness of disaster response. This research aims to analyze the need for reformulation of administrative law to improve the effectiveness of disaster management in Indonesia. Using a qualitative approach with a comparative case study design, this research combines legal document analysis, semi-structured interviews, and comparative analysis of international practices. The research results show that the Indonesian legal framework lacks flexibility in accommodating the need for rapid decision-making during emergency situations, as well as weak inter-agency coordination and local capacity. Reformulation of administrative law is needed to balance operational flexibility and legal accountability, as well as integrate disaster risk management into development planning. The implications of this research include recommendations for revising Law No. 24 of 2007, improving inter-agency coordination, strengthening local capacity, and adopting a participatory approach in disaster management.

Abstract

Sistem politik satu partai di berbagai negara menghadapi tantangan dalam pengaturan kepemimpinan dan legitimasi, dengan mekanisme yang bervariasi dari kontrol ketat hingga pendekatan inklusif. Penelitian ini bertujuan untuk membandingkan bagaimana hukum tata negara di negara-negara dengan sistem politik satu partai—termasuk China, Kuba, dan Singapura—mengatur dan mempengaruhi kepemimpinan serta legitimasi pemerintahan. Menggunakan metode penelitian hukum komparatif, penelitian ini menganalisis struktur hukum, regulasi partai politik, dan mekanisme legitimasi yang diterapkan di negara-negara tersebut. Hasil penelitian menunjukkan bahwa meskipun ada persamaan dalam kontrol kekuasaan dan pembatasan oposisi, terdapat perbedaan signifikan dalam mekanisme legitimasi, terutama antara pendekatan yang lebih transparan di Singapura dibandingkan dengan kontrol ketat di China dan Kuba. Implikasi dari temuan ini menyarankan perlunya reformasi kebijakan di negara-negara dengan sistem satu partai untuk meningkatkan transparansi dan partisipasi publik, serta memberikan perspektif tambahan untuk regulasi partai politik di Indonesia.

Abstract

The present study sets out to explore the application of lean governance principles to streamline state ministries' bureaucratic structures, with a focus on reducing waste and optimizing workflow. It is hypothesized that such an approach would enhance the responsiveness of public services, thereby addressing the inefficiencies in decision-making and resource wastage that are often observed in bloated bureaucratic structures, where ministries frequently have overlapping authority. A normative juridical research method was used to foster relevant regulations and assess the compatibility of the concept within the context of government administration. The findings indicate that lean governance can reduce redundancy and improve efficiency through authority restructuring, simplifying bureaucratic processes, and strengthened inter-agency coordination. The implications of this study include the need for regulatory adjustments to support authority restructuring and enhanced information technology to improve transparency and accountability. Consistent implementation of lean governance is expected to create a more responsive and adaptive government, ultimately fostering greater public trust in the public sector.

Abstract

The phenomenon of sole-candidate regional head elections in Indonesia has posed several challenges to democratic principles, particularly with regard to legitimacy, accountability, and public participation. This research aims to analyze the legal implications of regional head elections with sole candidates from the perspective of Administrative Law and evaluate their impact on democracy. The method used in this study is normative legal research, employing a legal and conceptual approach that includes a detailed analysis of election regulations, legal doctrines, and relevant literature studies. This method provides a robust framework for understanding the interplay between regulatory frameworks and democratic principles. The research findings indicate that elections with a sole candidate have the potential to undermine the legitimacy of the elected leader, reduce political accountability, and decrease voter participation rates. As a result, there is an urgent need to reform the electoral regulatory framework in Indonesia. Key recommendations include lowering the nomination threshold to foster competition, increasing transparency in the nomination process to ensure fairness, and strengthening political education to encourage public participation. These steps aim to enhance the quality of democracy and prevent the recurrence of sole-candidate elections in the future.

Abstract

The harmonization process in the formation of regional regulations in Indonesia is designed to ensure alignment between local regulations and national law. However, the centralistic approach often adopted in this harmonization process tends to limit the flexibility of local governments in formulating regulations that suit local needs. This issue raises concerns that the constitutionally granted authority of local governments to create localized regulations may be eroded. This study aims to analyze the impact of a centralistic harmonization approach on the effectiveness of regional autonomy, particularly in the context of local regulation. Using a normative juridical method with a descriptive-analytical approach, this research evaluates legislation, legal documents, and related literature to understand the implications of harmonization on local regulations. The findings indicate that overly centralistic harmonization can hinder innovation and adaptation of local regulations, reducing the capacity of local governments to respond to the needs of their communities. These findings emphasize the need for a more flexible and inclusive harmonization procedure to ensure that local regulations can still function effectively within the national legal framework. The implications of this study suggest that a more balanced approach between centralization and decentralization is necessary to maintain sustainable, adaptive, and responsive regional autonomy.

Abstract

The correctional system in Indonesia faces significant challenges, including overcapacity, low effectiveness of rehabilitation, and a lack of integration of spiritual values. This research aims to explore the application of maqāṣid al-syarīʿah as a value foundation in the reform of the correctional system to enhance the effectiveness of rehabilitation and reintegration of inmates. This research employs a qualitative method with a normative-empirical approach, encompassing an analysis of regulatory frameworks, particularly Law Number 22 of 2022 concerning Corrections and observational techniques. The research results show that maqāṣid al-syarīʿah, with principles such as the protection of life (hifz an-nafs), intellect (hifz al-aql), spirituality (hifz ad-din), lineage (hifz an-nasl), and property (hifz al-māl) provide a holistic framework to support the rehabilitation of prisoners. Programs based on religious values and practical skills have proven capable of supporting individual moral and economic changes, while community involvement through community mentors strengthens social reintegration. However, challenges such as limited resources, cultural resistance to religious-based approaches, and the lack of oversight based on maqāṣid al-syarīʿah indicators hinder optimal implementation. Therefore, this research recommends a revision of more specific regulations, including the provision of religious-based facilities, officer training, and the strengthening of technology-based evaluations. This research includes formulating more humane and inclusive correctional policies in line with Islamic values and universal human rights. By integrating maqāṣid al-syarīʿah, the correctional system in Indonesia can transform into an instrument that is punitive and rehabilitative, creating sustainable social harmony.
