Abstract

This research uses bibliometric analysis to explore the development of criminal law research, revealing patterns and impacts within the justice system. By analyzing scientific literature in this field, the research identifies main trends, influential authors, and emerging topics. The results of co-citation analysis, citation network analysis, and keyword analysis provide insights into the evolution of criminal law research. These findings enhance our understanding of this field, inform future research directions, and contribute to improving the justice system.

Abstract

The Jabodetabek region of Indonesia has had notable growth in the Information and Communication Technology (ICT) sector, primarily due to the efforts of Small and Medium-sized Enterprises (SMEs). SMEs encounter a complex network of legal obstacles that impede their growth and ability to compete. Using a mixed-methods approach that includes both quantitative surveys and qualitative interviews, this study explores these issues. The findings draw attention to important legal difficulties, such as limited access to legal services, contract conflicts, cybersecurity concerns, intellectual property issues, and regulatory compliance. The competitiveness and development of SMEs are significantly impacted by these issues. Comprehensive legal and legislative changes are advised to address these problems. These include simplified rules, strict enforcement of intellectual property rights, effective dispute resolution procedures, cybersecurity assistance, and improved access to legal services. This study highlights the significance of a supportive legal framework for innovation and economic growth, adding to our understanding of the legal aspects of ICT SME development in Jabodetabek.

Abstract

This research delves into the intricate relationship between government regulation, tax policy, and the business life of shops in Suryakencana Market, Bogor. Employing a mixed-methods approach that combines quantitative survey data, financial analysis, and qualitative insights from interviews, this study uncovers the multifaceted impact of government regulations and tax policies on businesses in the market. The results reveal that government regulations impose a significant regulatory burden and compliance costs on businesses, particularly affecting small enterprises. Industry-specific effects further highlight the need for tailored approaches to regulation. Additionally, tax policies influence business operations, with businesses often passing tax costs to consumers, and incentives promoting profitability. Cross-border taxation issues pose challenges to businesses engaged in international trade. These findings provide valuable insights for policymakers and stakeholders, emphasizing the importance of streamlining compliance procedures, supporting small businesses, and offering incentives for innovation and job creation to foster a conducive environment for business growth and sustainability in Suryakencana Market.

Abstract

Studi ini dilakukan di Desa Cimaja, Kecamatan Cikakak, dengan tujuan mendorong partisipasi anak-anak dalam proses seni yang mengedepankan pemahaman tentang alam sekitar.Metode penelitian ini melibatkan kolaborasi langsung dengan anak-anak dari berbagai usia di Desa Cimaja. Teknik ecoprint, yang menggunakan daun dan bahan alami lainnya sebagai pigmen, digunakan untuk menciptakan karya seni unik yang ramah lingkungan. Hasil dari penggunaan teknik ecoprint mampu merangsang kreativitas anak-anak dan memunculkan ekspresi seni yang beragam. Anak-anak tidak hanya menghasilkan karya seni yang menarik secara visual, tetapi juga menunjukkan peningkatan kesadaran akan lingkungan di sekitar mereka. Kolaborasi antara anak-anak, pendidik, dan komunitas lokal dalam pengembangan karya seni ini juga memberikan dampak positif dalam memperkuat hubungan sosial dan pemberdayaan anak-anak.

Abstract

This study explores the pivotal role of Intellectual Property Rights (IPR) in shaping the growth dynamics of Micro, Small, and Medium Enterprises (MSMEs) in Indonesia. Utilizing Structural Equation Modelling with Partial Least Squares (SEM-PLS), the research analyzes the relationships between intellectual property awareness, utilization, innovation, and competitiveness among 110 MSMEs. The findings highlight a significant positive relationship between intellectual property awareness and utilization, a strong link between intellectual property protection and innovation, and a notable impact on competitiveness. Furthermore, the study identifies intellectual property as a partial mediator, providing a nuanced understanding of its role in MSME growth. Practical implications include the need for educational initiatives to enhance IPR awareness, simplified registration processes, and strategic intellectual property management to foster innovation and competitiveness. These insights are crucial for policymakers and MSMEs striving for sustainable growth and a competitive edge in the global market.

Abstract

Social entrepreneurship is one of the effective ways to overcome social problems and empower the local economy, especially among housewives. This community service aims to socialise and improve the knowledge of housewives in Kadudampit Village, Sukabumi, regarding social entrepreneurship and evaluate their interest in engaging in social enterprises. This community service activity was conducted through several stages, including counselling, group discussions, and simulations. The results showed a significant improvement in participants' understanding of social entrepreneurship, with 85% showing a better experience and 60% expressing interest in starting a social enterprise. Despite barriers such as limited capital and technical knowledge, participants felt encouraged to contribute to social-based economic development in their villages. Follow-up recommendations include mentoring programmes and facilitating access to financing to ensure the sustainability of the planned social enterprises.

Abstract

Perkembangan ilmu pengetahuan dan teknologi seiring berjalannya waktu mengalami perubahan yang sangat pesat dan siginifikan. Di era yang serba digital ini, karya-karya yang lazimnya berbentuk fisik dapat ini, karya-karya yang lazimnya berbentuk fisik dapat berubah menjadi bentuk digital. Tujuan dari penelitian ini yaitu untuk mengetahui cara perlindungan hukum terhadap karya cipta dalam era digital dan peran pemerintah dalam mengatasi terjadinya penggandaan karya cipta di era digital. Jenis penelitian hukum yang dilakukan secara yuridis normatif adalah yuridis normatif dimana hukum dikonsepkan sebagai apa yang tertulis dalam peraturan perundang-undangan (law in books) atau hukum dikonsepkan sebagai kaidah atau norma yang merupakan patokan berperilaku manusia yang dianggap pantas. Berdasarkan UUHC Nomor 28 Tahun 2014 Pasal 4 menyatakan bahwa hak cipta merupakan hak eksklusif yang terdiri atas hak moral dan hak ekonomi. Setiap orang yang melaksanakan hak ekonomi terhadap suatu karya wajib mendapatkan izin dari pencipta atau pemegang hak cipta. Upaya perlindungan hukum juga harus sesuai dengan pemberian sanksi yang tegas dan tepat kepada para pelanggar Hak Cipta oleh aparat penegak hukum sesuai dengan aturan perundang-undangan yang berlaku.

Abstract

Penelitian ini dilakukan untuk mengetahui perlunya dibuat dasar hukum khusus mengenai kasus pelecehan secara verbal dan juga untuk mengetahui perlunya peran pendidikan dalam memini- malisir kejahatan tersebut. Penelitian ini dapat diketahui melalui pengisian survei yang dil-akukan selama 3 hari dari tanggal 6-9 febuari 2022 dan diisi oleh 102 responden kemudian disajikan dalam bentuk diagram lingkaran. Berdasarkan hasil penelitian, perlu di buatnya dasar hukum mengenaik kasus tersebut dan juga perlu peranan lembaga pendidikan untuk upaya meminimalisir kasus tersebut. Adapun pasal – pasal yang bisa digunakan dalam menangani kasus perbuatan catcalling adalah Pasal 281 ayat (1) dan (2), Pasal 315 Kitab Undang – Undang Hukum Pidana (KUHP) dan Pasal 8, Pasal 9, Pasal 34 serta Pasal 35 Undang – Undang No. 44 Tahun 2008 tentang Pornografi, walaupun penggunaan pasal –pasal tersebut dapat dijadikan dasar hukum dalam menangani kasus catcalling tetapi belum mampu menjamin kepastian hukumnya secara maksimal. 2. Perlindungan terhadap korban perbuatan catcalling diatur dalam Undang – Undang No. 31 Tahun 2014 tentang Perubahan Atas Undang – Undang No. 13 Tahun 2006 tentang Perlindungan Saksi dan Korban.

Abstract

This research was conducted with the aim of knowing how the position of the mediator as an independent party in case dispute resolution and how the urgency of the mediator's code of ethics in violating the code of ethics. This research uses normative juridical research methods. the position of the mediator has an important role as a neutral party in charge of facilitating dialog between the parties to the dispute. and the Mediator's Code of Ethics has great urgency in the context of dispute resolution as an independent third party. By ensuring that mediators operate with integrity and neutrality, the Code forms the basis for ethical behaviour that supports a fair mediation process. The existence of this independent third party is critical in creating an environment that allows disputants to communicate openly and honestly. The Code of Ethics ensures that the mediator carries out his or her role with fairness, keeps information confidential and avoids conflicts of interest. With the Code of Ethics, the mediator not only acts as a facilitator but also as a holder of high standards in ensuring fairness and openness in dispute resolution. The Mediator Code of Conduct therefore plays a crucial role in upholding ethical norms that ensure trust and success of the mediation process.
