Abstract

Pesantren merupakan model lembaga pendidikan Islam tertua di Indonesia. Pesantren memberikan kontribusi yang sangat signifikan dalam meraih kemerdekaan dan mencetak generasi bangsa yang memiliki kepribadian utuh (intelektual dan akhlak). Jiwa dan nilai yang ditanamkan di pesantren menjadi modal utama bagi para santri untuk merespons dan menghadapi tuntutan yang ada, sehingga dapat exis dan surfing on the chaos. Penelitian ini bertujuan untuk mendeskripsikan bagaimana polarisasi pendidikan pesantren, terutama di Pondok Modern Darussalam Gontor Ponorogo. Gontor berdiri sejak tahun 1926 oleh KH. Ahmad Sahal, KH. Zainuddin Fananie, dan KH. Imam Zarkasy. Di usianya yang ke-90 tahun, Gontor telah melahirkan generasi dan pemimpin umat dalam berbagai lini dan bidang, sehingga layak untuk dipaparkan bagaimana model pendidikan di lembaga tersebut.

Abstract

The indication of began to enter the shubuh prayer time is when emerge the morning dawn and lasted until the sun rises. The sun position when emerge the morning dawn is below the intrinsic horizon marked with a minus sign (-) with the value of a certain height. The Ministry of Religious Affairs has set the sun altitudes of dawn in the shubuh prayer time with minus (-) 19°+ sunrise/sunset altitudes as standard is the reference time of dawn prayers in Indonesia. However, this provision in fact reap discourse in some quarters because it is not in accordance with the phenomenon of morning dawn emergence at the beginning of the shubuh prayer time empirically. This study aims to decide the morning dawn, as the beginning of dawn determinant. The tool used in this study is the Sky Quality Meter (SQM), to detecting the morning dawn emergence as a sign of the beginning of the shubuh prayer time. The results of this study found that the brightness of the sky throughout the night or the morning dawn in Tayu Beach, Pati, Central Java, in the span of four days of observation that is at 4: 31 a.m with an average altitude of the sun is -17°(17°below the horizon).

Abstract

Hilāl is an early marker of the beginning of the Hijriyah/Qamariyah. The existence of the new moon was used as a reference in the preparation of a system of Islamic calendar. The issue of the new moon it is still be an interesting thing to be studied. In fact there is a lot of research and discussion related with hilāl issues. However, it still has not found an appropriate formula to be used as a reference in creating a standardized system of the Islamic calendar. Currently, there are several criteria that offered to make the calendar system. In this paper, will be presented criteria and other perspectives in formulating a Hijriyah calendar, called the Criteria 29. Some examples of simple calculations and discussions in determining the first day of month of the Hijriyah presented briefly. This elaboration of “Criteria 29” hopefully can give an idea and different viewpoints in order to develop Hijriyah calendar.

Abstract

Selama periode Nabi Muhammad SAW, yaitu pada kurun waktu 610-632 M, gerhana matahari telah terjadi delapan kali, yaitu empat kali terjadi pada periode Mekah dan empat kali terjadi pada periode Madinah. Gerhana terjadi bukan karena kematian atau kehidupan seseorang, melainkan suatu tanda atas kebesaran dan keagungan Allah. Gerhana terbagi menjadi dua yaitu gerhana matahari atau disebut dengan kusuf asy-syams, dan gerhana bulan atau disebut dengan khusuf al-qamr. Ketika terjadi fenomena gerhana, baik gerhana matahari maupun gerhana bulan maka seorang muslim disyariatkan untuk melaksanakan ibadah shalat gerhana. Gerhana matahari pernah terjadi pada zaman Nabi SAW yaitu ketika meninggalnya putera beliau Ibrahim Ibn Muhammad. Para ahli hadis dan ahli astronom berbeda pendapat terkait waktu meninggalnya Ibrahim Ibn Muhammad, namun berdasarkan riwayat-riwayat hadis dan data astronomi diketahui bahwa Ibrahim Ibn Muhammad meninggal pada hari senin 27 Januari 632 M atau 29 Syawal 10 H dengan usia 1 tahun 10 bulan (22 bulan).

Abstract

Experts argue that Covid-19 can be categorized as an overmacht so it can be used as a basis for business actors to renegotiate regarding delays in paying their debts to creditors. However, the policies and circumstances mentioned above are not positively proportional to the high number of companies filed for bankruptcy in the Commercial Court during the pandemic. This raises its own problems which on the one hand Covid-19 can be used as a reason for delaying debt payments, but on the other hand it does not prevent the filing of a bankruptcy application for a corporate entity. The purpose of this study is to identify and analyze Covid-19 as an overmacht in a debt agreement as an effort to prevent bankruptcy from the perspective of positive law and Islamic law. This study uses a qualitative research method with a normative juridical approach in which researchers examine theories, concepts, or legal principles related to overmacht in bankruptcy. The results of this study indicate that the overmacht caused by the Covid-19 pandemic and the implementation of Government policies related to the Covid-19 response cannot prevent debtor bankruptcy from both a positive legal perspective and Islamic law. This is closely related to the bankruptcy requirements both in the KPKPU Law and the opinion of the majority of ulama.Keywords: Covid-19, Overmacht, Bankruptcy.

Abstract

A moon (qamar) is one of the heavens rotates the earth whose appearance changes keep pace with the sidereal and synodic movements. The movements provide significant impact on determining the first day of months in Qamariah calendar. Disagreement in determining the first day of months in Qamariah may be caused by differences in comprehending the first visible crescent moon (hilâl). The objective of the research is to provide understanding about the meanings of hilâl in the Qur’an verses and its implication in determining the first day of months in Qamariah. Thematic method in this research is used to gather the Qur’an verses containing the word “qamar” and “ahillah”, and the verses those are related to determination of the first day of months in Qamariah calendar, arrange them into chronological order and deepen the analysis using astronomical approach. The results show that hilâl is a part of phases of the moon appears in the first two or three nights and last of the month. And yet the hilâl that can be a reference in determining the first day of month is the crescent moon phase that first appears after conjuncture. The implication of hilâl meanings in determining the first day of months in qamariah makes a sign for humans to determine their times for prayers and social activities such as beginning and ending fasting of Ramadan, determining time for pilgrimage (ḥajj), determining ‘iddah period for Muslim women, purchase and sale, rental, cropping, and making arrangement or agreement.

Abstract

Transaksi jual beli dalam Islam semakin berkembang seiring dengan semakin berkembangnya zaman dan teknologi. Hal ini tentunya menjadi tantangan bagi umat muslim untuk dapat lebih menelaah lebih jauh terhadap transaksi-transaksi yang sedang berkembang, salah satunya layanan go-food pada aplikasi go-jek. Apakah akad-akad dari pihak-pihak yang terkait sudah sesuai dengan syariat atau sebaliknya. Oleh karenanya penelitian ini bermaksud untuk mengetahui jenis-jenis akad yang terdapat dalam layanan go-food dalam aplikasi go-jek, serta pandangan Islam terhadap akad-akad tersebut. Penelitian ini menggunakan pendekatan kualitatis dengan analisis konsep, di mana peneliti mengumpulkan sumber-sumber bacaan yang memiliki keterkaitan dengan bahasan yang sedang dikaji. Hasil dari penelitian ini, dijumpai bahwa akad sewa menyewa terjadi antara perusahaan go-jek dengan penyedia layanan / pengemudi ojek, antara perusahaan go-jek dengan penjual yang terdaftar dalam layanan go-food, dan antara perusahan go-jek dengan pengguna layanan. Akad jual beli terjadi antara pengguna layanan go-food dengan penjual makanan, dan antara penyedia layanan / pengemudi ojek dengan penjual yang terdaftar dalam layanan go-food. Sedangkan akad wakalah terjadi antara pengguna layanan go-food dengan penyedia layanan / pengemudi ojek.

Abstract

The movement of the sun, the earth, and the moon on their each orbites have caused a natural fenomenon called an eclipse. Rasulullah SAW taught his followers to take a pray when this situation comes. Many 'ulamas have a different opinions in one or two case  order to do the eclipse prayer, for example when the eclipse couldn't be seen because it hindered by clouds or if it's cloudy. One of the ulama's opinion which will be reviewed is the opinion of Ibnu Hajar al-Haitami. The aim of this research is to find out the fiqh of eclipse prayer in the study of Islamic Law, later Haitami's opinion concerning the implementation of eclipse prayer when it's cloudy. Qualitative approach used in this research with concept analysis, where researcher acumulate literatures that relates with the topic. The result of this reseach known that there are no significant differences in fiqh of eclipse prayer in the study of Islamic Law, but if it's cloudy when the eclipse happening, Haitami's argue that eclipse prayer keeps held when the eclipse happens before the cloudy. Meanwhile, if the cloudy happens from the begining to the last seconds of eclipse, the eclipse prayer not applied.

Abstract

The system of inheritance distribution in Islamic law, normatively, between men and women is 2:1. Meanwhile, the traditional inheritance system of the Cipicung Girang community, Cidadap District, Bandung City, where the majority of the population is Muslim, has divided men and women equally, namely 1:1. Another uniqueness of the system is that the house they live in belongs to the child who is the last to take care of his parents. The problem is, the customary inheritance system is used by the majority Muslim population. This study aims to analyze the factors that influence public awareness in the distribution of inheritance. This study uses a mix-method with interactive analysis techniques and assisted by Smart PLS software to test the relationship between variables. This study found that inheritance follows the local traditional system because girls take care of their parents, while men are busy working. Another finding is that literacy factors have a greater influence on people's awareness and loyalty compared to religiosity and perceptions of inheritance.

Abstract

Abstract. The fourth sect as a the bigger segt in islam and approved in Indonesia. Is islam thought the fourth sect has different each other and in this research is about the differentiation of the deadline of isha prayer. There is three opinions. First is until before morning prayer, second until middle nighrt and the last is until one-third of the night. Kemenag does not decided the deadline of prater, and only provide the criteria og the beginning of prayer. Rhe method used to in determine the beginning of isha prayer not only quran and hadist however astronomy or hisab method. This research use qualitative research method and descriptive analysis and literature review. And the result of this research is the priest of fourth sech has a different judgement to decide the deadline for prayer. And Kemenag only explain the criteria the beginning of prayer. Abstrak. Madzhab arba’ah kita kenal sebagai madzhab 4 imam yang terbesar dan diakui di Indonesia, dalam khazanah fiqih Imam arba’ah terdapat perbedaan, dan perbedaan yang diangkat di sini adalah tentang batas akhir waktu salat isya, ada yang berpendapat sampai akhir, sampai pertengahan dan sepertiga malam. Kemenag tidak menentukan batasan akhir waktu salat isya, namun hanya memberikan kriteria awal waktu salat isya, metode yang digunakan dalam penentuan awal waktu salat isya kemenag bukan hanya merujuk pada Al-Qur’an dan hadits namun menggunakan metode astronomis atau kita kenal hisab. Metode yang digunakan dalam penelitian ini adalah metode penelitian kualitatif yang bersifat deskriptif analisis, teknik data yang dikumpulkan melalui studi kepustakaan. Hasil dari penelitian ini adalah para ulama madzhab arba’ah berbeda pendapat dalam menentukan batas akhir waktu salat karena melihat dari beberapa hadits yang mereka rujuk, dan kemenag hanya menjelaskan awal waktu salat saja menurut kriteria yang kemenag jelaskan.
