Abstract

The discuss about PPHN, it is closely related to its legal product, because the success or failure of the PPHN concept is very influential by what legal product is the basis for the rules. This research focuses on finding the ideal format for setting up PPHN in the Indonesian legal system. The formulation of the problem in this research are: First, what are the supporting and inhibiting factors for the implementation of PPHN in Indonesian laws and regulations?; Second, what is the ideal model for implementing PPHN in Indonesian laws and regulations? This study uses normative legal research which results in the conclusion that there are several potential supporters and obstacles in implementing this PPHN, both in the 1945 Constitution of the Republic of Indonesia, TAP MPR, and the legislative act. The ideal format for setting up the PPHN is through a legislative act based on the existence of the TAP MPR which specifically sets the boundaries of the direction of development (the direction of the state) as implicitly stated in the constitution. The affirmation of the boundaries of the direction of the country's direction is intended to ensure the achievement of the concept and direction of sustainable national development.

Abstract

Introduction to the Problem: Education is said to be one of the major keys to development and civilization. Concerning this, the Nigeria and the Uganda governments had sought to enhance and facilitate tuition fees of tertiary education of peasant citizens, by enacting the Student Loan Act, Unlike the Uganda Education Loan Act, there seems to be a gridlock in accessing education loans in Nigeria. Purpose/Study Objectives: In this regard, this study examines the issues concerning the Nigeria and Uganda tertiary education loan act, with a view of taking a leap from the Uganda student loan act in improving on the Nigeria student loan act. Design/Methodology/Approach: In this regard, the study adopts a hybrid study method, 406 questionnaires were sent to respondents residing in Nigeria and Uganda. The results obtained were analyzed using a descriptive and analytical method. Findings: The study identified significant flaws in the Nigeria Loan Act that risk undermining its intended purpose, whereas the Uganda Tertiary Education Loan Act offers a more effective framework, granting students better access to loans and scholarships. Consequently, the study concludes that Nigeria should adopt key aspects of Uganda’s model, particularly its student-friendly provisions, to improve access to educational financing. It therefore recommends that Nigerian policymakers reform the existing loan system by integrating successful elements from Uganda’s approach, ensuring greater equity and efficiency in supporting students’ academic pursuits. Abstract

Cloud Seeding is a recent scientific discovery on weather modification and alteration that aims to enhance rainfall in addressing drought and climate change issues. However, despite this potent discovery there are several legal issues yet to be addressed in the usage of cloud seeding. Hence, the study examines the legal issue arising from cloud seeding. The study adopts a doctrinal method of study, relying on primary and secondary research material, such as laws, journal articles, internet articles, and other relevant research material. The data obtained were analyzed using a descriptive and analytical method. The study found that cloud seeding is a potential means of curtailing the incidence of drought and desertification caused by climate change arising from harmful industrial and human activities. However, the study also found that several legal issues may arise in utilising cloud seeding, which includes a lack of comprehensive international law regulating cloud Seeding, the inability of the existing laws to address transboundary issues, liability, impose due compliance and sanction of wrong utilising cloud seeding that adversely alter the natural state of the environment. Concerning this the study concludes and recommends that there is a need for a unified global legal framework to ensure the responsible use of cloud seeding and effective regulation.

Abstract

Religious radicalism poses a significant threat to social harmony and security, especially in rural communities where access to educational resources and legal guidance can be limited. This study, explores the use of Islamic recitation groups (pengajian) as a platform for preventing the spread of religious radicalism in Blumbungan Village, Pamekasan. The research focuses on empowering the community, Quran teachers, and local officials through legal counseling and training to build a comprehensive understanding of Islam and to identify early signs of radicalism. The activity aims to train the general public, religious educators, and village officials to understand Islam in its entirety, emphasizing tolerance and the importance of protecting the community from extremist ideologies. The method centers around two main activities: first, providing training to deepen participants’ understanding of Islam, and second, assisting the community in detecting and addressing the spread of radical Islam. These efforts help ensure that individuals can recognize extremist ideologies early and prevent their influence, protecting the village from potential religious extremism. Implemented over three months, the community service activities in Blumbungan Village have shown significant impact, enhancing the community’s capacity to independently prevent the spread of radicalism. The collaboration between the village government and Islamic recitation groups proves to be an effective approach to countering radical ideologies at the village level. This study contributes to the broader effort to strengthen local resistance against radical Islamism by leveraging legal education and religious practice, ultimately fostering a more resilient, tolerant, and united community.

Abstract

The essence of human rights is to protect and ensure the glory and dignity of people. So it becomes important human rights principles stipulated in the legislation in order to guarantee the state of human rights can be implemented optimally. However, there are some parties who deliberately rammed by the Islamic Human Rights as a product of the Liberals are opposed to the Sharia. In fact, both Islam and human rights, aimed at ensuring the glory and dignity of man as the principles “maqhasidu al-syari`ah” are the main objectives the implementation of Islamic law. This paper aims to prove that human rights are not contrary to Islam because it has been expressly stipulated that one-on-one purpose in religion is upholding human dignity. This paper uses legal research methods that reveal the fact that Islam protects personal rights of his people so that the necessary regulatory and enforcement of human rights in the Indonesia. Hakikat hak asasi manusia (HAM) ialah untuk melindungi dan menjamin kemuliaan dan martabat manusia. Sehingga menjadi penting prinsip-prinsip HAM diatur dalam peraturan perundang-undangan agar jaminan negara terhadap HAM dapat dilaksanakan secara maksimal. Meski demikian, terdapat beberapa pihak yang sengaja membenturkan HAM dengan Islam seolah HAM merupakan produk kaum Liberal yang bertentangan dengan Syariah Islam. Padahal, baik Islam maupun HAM, bertujuan untuk menjamin kemuliaan dan martabat manusia sebagaimana prinsip-prinsip maqhasidu al-syariah yang menjadi tujuan utama diberlakukannya syariah Islam. Tulisan ini bertujuan untuk membuktikan bahwa HAM tidak bertentangan dengan Islam karena telah diatur secara tegas bahwa salah-satu tujuan dalam beragama ialah tegaknya martabat kemanusiaan. Tulisan ini menggunakan metode penelitian hukum normatif yang mengungkap fakta bahwa Islam melindungi hak-hak pribadi umatnya sehingga diperlukan pengaturan dan penegakan HAM dalam kontek negara hukum Indonesia.

Abstract

Karapan Sapi is known as a cow racing contest on Madura Island, which has a high selling value when the cow wins. Karapan Sapi is internalized in people's lives and requires protection for cows as (living) animals. The aim of this research is to determine the protection of cow race animals from the perspective of East Java Governor's Instruction No. 1/INST/2012. The research method used is normative legal research. The results of this research state that the protection of animals (cows) in the implementation of the Karapan Sapi is regulated in Article 302 of the Criminal Code; Article 66A of the Animal Husbandry and Health Law; and Article 92 letter b PP 95/2012. East Java Governor's Instruction No. 1/INST/2012 in terms of content is quite effective, but not effective enough to completely eradicate violence and mistreatment of cows, because there is still a gap for minor violence to be carried out.

Abstract

Village development is the implementation of the ideals of the Indonesian state to improve the welfare of village communities. In order to carry out village development so that it can run well, regularly and effectively, it must be done by first making a village development plan. In carrying out village development planning, village communities must be involved. The focus of the research is Legal Awareness and Community Participation in Village Development Planning in Plakaran Village, District Grumpy Sampang Regency, using social and legal research methods, while the results of this research are that the implementation of village development in Plakaran village does not fully involve the community, whereas community involvement will provide new values ​​and new ideas that are in accordance with community needs, so with community involvement in planning to implementation of village development will provide legal awareness to the community so that they can work together to build a better village.

Abstract

ABSTRAKKeberadaan Putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 merupakan langkah progresif dalam upaya menghentikan segala kebijakan diskriminatif negara terhadap status hukum aliran kepercayaan, yang dianggap sebagai produk budaya di luar kualifikasi agama resmi negara. Penelitian ini menggunakan metode penelitian hukum normatif dengan metode pendekatan konsep, pendekatan kasus, dan pendekatan perundang-undangan. Argumentasi dalam Putusan Nomor 97/PUU-XIV/2016 ialah bahwa pembedaan pengaturan antara agama dan kepercayaan dalam ketentuan Pasal 28E ayat (1) dan Pasal 28E ayat (2) UUD NRI 1945 memberikan implikasi hukum yang meletakkan agama dan aliran kepercayaan pada konsepsi yang berbeda, dan pembedaan ini juga menempatkan aliran kepercayaan bukan bagian dari konsepsi agama. Di samping itu, adanya kata hubung "dan" yang diapit oleh kata "agama" dan "kepercayaan" menjadi penegas bahwa keduanya memang setara.Kata kunci: aliran kepercayaan; hak beragama dan berkepercayaan; hak-hak sipil.   ABSTRACTThe existence of Constitutional Court Decision Number 97/PUU-XIV/2016 is a progressive step in an effort to stop all state discriminatory policies against the legal status of the indegenous faiths (beliefs), which considered as a cultural product outside the state official religious qualification. This research uses normative legal research methods with conceptual, case study, and statutory approaches. Decision Number 97/PUU-XIV/2016 argues that the different conceptions in the provisions of Article 28E paragraph (1) and Article 28E paragraph (2) of the 1945 Constitution have implied legal consequences in which indegenous faith is not a part of religion concept. On the other hand, the existence of the conjunctions "and" between the term "religion" and "belief" confirms that the two concepts are equal.Keywords: indigenous faith; religious and belief rights; civil rights.

Abstract

Health is widely regarded as a form of wealth and a fundamental human right that governments must protect. In response to global infectious diseases, the international community has increasingly relied on vaccine development as a strategy to mitigate major health threats. However, public concerns such as those raised by Dr. Wahome Ngare’s medical team regarding the safety of certain vaccines highlight the urgent need for strong legal and institutional mechanisms to safeguard public health. Against this backdrop, the study examines Uganda’s legal framework for protecting citizens’ health rights and explores the structural challenges that may hinder the effectiveness of these laws. Using a doctrinal research method, the study draws on primary and secondary legal materials and analyzes them through descriptive and analytical approaches. The findings reveal that unsafe vaccines can pose severe risks to human health. The Ugandan government is legally obligated, under both international and domestic law, to ensure that vaccines circulating within the country are safe and effective. Despite this mandate, several obstacles limit the implementation of health protections, including constitutional barriers to the application of international law, bureaucratic delays in enforcing national regulations, resource constraints, and low public awareness of the health reporting system. The study concludes by reaffirming the need to strengthen the protection of Ugandans’ health rights. It recommends that the government address these challenges by domesticating reliable international legal standards, reducing internal legal bureaucracy, and improving public awareness of health reporting mechanisms. This research contributes to the broader understanding of how Uganda’s legal and institutional structures support public health rights, while identifying gaps, accountability issues, and policy challenges related to vaccine safety and public trust.
