Abstract

Disiplin kerja merupakan komponen kunci dalam peningkatan kinerja Aparatur Sipil Negara (ASN) yang berperan strategis dalam tata kelola pemerintahan. Penelitian ini bertujuan untuk menganalisis implementasi Peraturan Pemerintah No. 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil di lingkungan Badan Pendapatan Daerah (Bapenda) Kabupaten Lampung Utara serta mengidentifikasi faktor-faktor penghambatnya. Metode yang digunakan adalah pendekatan hukum normatif dengan teknik studi pustaka dan telaah dokumen yang dianalisis secara kualitatif melalui pendekatan yuridis. Hasil penelitian menunjukkan bahwa pelaksanaan peraturan tersebut menghadapi berbagai tantangan, antara lain keterbatasan infrastruktur teknologi, kurangnya pemahaman ASN terhadap regulasi, resistensi terhadap perubahan, lemahnya sistem pengawasan, serta budaya kerja yang belum mendukung kedisiplinan tinggi. Untuk mengatasi kendala tersebut, diperlukan strategi seperti peningkatan infrastruktur, sosialisasi berkelanjutan, pendekatan partisipatif, penguatan monitoring, serta pengembangan budaya kerja melalui pelatihan dan insentif. Penelitian ini merekomendasikan penerapan prinsip-prinsip Good Governance sebagai dasar dalam memperkuat tata kelola Bapenda agar tercapai pelayanan publik yang berkualitas dan tujuan pembangunan daerah yang berkelanjutan.

Abstract

Terorisme merupakan ancaman global yang terus berevolusi secara signifikan, ditandai dengan perkembangan pola, jaringan, dan strategi yang semakin kompleks, termasuk penyebaran ideologi ekstremisme di dalam lembaga pemasyarakatan. Penelitian ini bertujuan untuk menganalisis efektivitas strategi pengamanan terhadap narapidana terorisme di Lapas Kelas IIB Way Kanan serta mengidentifikasi tantangan implementasinya. Pendekatan yang digunakan adalah hukum empiris dengan metode kualitatif deskriptif-analitis, melalui wawancara mendalam, observasi partisipatif, dan studi dokumentasi, serta dianalisis menggunakan Teori Sistem Hukum Lawrence M. Friedman yang menyoroti aspek struktur, substansi, dan budaya hukum. Hasil penelitian menunjukkan bahwa efektivitas pengamanan didukung oleh sinergi antara pengawasan berlapis berbasis teknologi, pemisahan narapidana, pembatasan komunikasi eksternal, serta pelaksanaan program deradikalisasi yang melibatkan konseling dan pembinaan psikososial. Namun, ditemukan sejumlah kendala utama, termasuk keterbatasan sumber daya manusia, anggaran yang minim, lemahnya pelatihan petugas, serta belum optimalnya koordinasi lintas lembaga.

Abstract

The clash on September 7, 2023, between Rempang residents and security forces (POLRI, TNI), which ended with the arrest of 43 residents, mirrors the conflict that occurred between the residents of Wadas Village, Bener Subdistrict, Purworejo Regency, Central Java, and the Central Java Regional Government on February 8, 2022. The violence perpetrated by security forces against the residents of Rempang Island occurred when the company, escorted by security, unilaterally staked out Malay customary land in 16 traditional villages on Rempang and Galang Islands in the Riau Archipelago, covering an area of 17,600 hectares. This included 10,028 hectares of protected forest, or about 45.84% of the total land area, which they had occupied since 1834. According to the head of Batam Concessionaires (BP), Muhammad Rudi, the Eco City development plan has been underway since 2004. At that time, PT. Makmur Elok Graha and Xinyi Glass Holding Ltd. (July 2023), the exclusive rights holders, became the private entities partnered with the government (September 12, 2023), receiving an 80-year concession from the government. The government's actions of land seizure and violence demonstrate a form of power arrogance that tends toward abuse of power, under the pretext of protecting a 381 trillion investment, while ignoring the rights of citizens as stipulated in the 1945 Constitution and the Basic Agrarian Law. The government's actions represent forms of Neo-Colonialism and Neo-Capitalism occurring during the Jokowi administration. This situation underscores that the law is no longer equal; the law has collapsed, becoming merely a symbol that only favors power.

Abstract

This study aims to Investigate the application of restorative justice in minor theft cases as reflected in dicision Number 2/Pid.C/2025/PN.Kbu with emphasis on the legal basis and judicial reasoning underlying the court’s verdict. This research employs normative legal research using statutory and case approaches. Primary legal materials consist of court decisions and legislation, on the other hand secondary legal materials include relevant literature and scientific journals. The results indicate that the application of restorative justice in this case was realized through judicial consideration of the agreement reached between the defendant and the victim, admission of guilt, and commitment not to reoffend. The judge based the decision on statutory provisions governing adjudication based on restorative justice and also considered sociological aspects and the objectives of sentencing. The study concludes that the use restorative justice in minor theft cases can promote restoration, balance, and legal benefit without neglecting legal certainty

Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas pelaksanaan rehabilitasi bagi penyalahguna narkotika jenis sabu di Kabupaten Lampung Timur. Permasalahan penyalahgunaan narkotika merupakan isu multidimensional yang berdampak pada aspek kesehatan, sosial, dan penegakan hukum. Undang-Undang Nomor 35 Tahun 2009 telah menegaskan bahwa penyalahguna narkotika wajib menjalani rehabilitasi medis dan sosial sebagai upaya pemulihan. Namun, dalam praktiknya, pelaksanaan rehabilitasi belum berjalan optimal. Penelitian ini menggunakan metode hukum empiris dengan pendekatan undang-undang dan pendekatan sosiologis, serta dianalisis menggunakan teori efektivitas hukum Soerjono Soekanto. Hasil penelitian menunjukkan bahwa efektivitas rehabilitasi masih terhambat oleh beberapa faktor, yaitu ketidakkonsistenan penerapan hukum, kurangnya koordinasi antar aparat penegak hukum, keterbatasan sarana dan fasilitas, rendahnya kesadaran masyarakat, serta budaya hukum yang masih berorientasi represif. Selain itu, faktor ekonomi dan dukungan keluarga juga turut memengaruhi keberhasilan proses rehabilitasi. Oleh karena itu, diperlukan upaya komprehensif melalui peningkatan kapasitas aparat, penyediaan fasilitas, penguatan koordinasi antar lembaga, serta perubahan paradigma masyarakat agar rehabilitasi dapat berjalan secara optimal dan berkelanjutan.

Abstract

This research develops and tests a digital twin (DT)-based smart aquaculture system for mud-free eel farming through the integration of IoT sensing, artificial intelligence (AI)-based prediction, edge computing, and solar energy-based automation. The approach used is experimental systems engineering, which includes system design, hardware and software implementation, virtual replication, and physical-digital two-way synchronization. The system utilizes ESP32-based pH, temperature, dissolved oxygen (DO), ammonia (NH₃), and turbidity sensors, MQTT communication, and Raspberry Pi edge computing. Water quality prediction is performed using long short-term memory (LSTM) and random forest regression. The dataset consists of 30 days of real-time data covering water quality, actuator activity (aerator, pump, feeder), and energy production and consumption by IoT sensors and energy meters. Results show that LSTM excels by R² = 0.94; RMSE = 0.14; MAPE <5% and synchronization latency <1.5 seconds. Solar energy integration reduces energy consumption by 54 67%, whilst automation increases eel survival rate by 78% to 91%. The novelty of this research lies in the first integrated implementation of DT, AIoT, and solar energy-based automation in mud-free eel farming. The proposed framework provides a precise, scalable, and sustainable solution for the development of modern aquaculture.

Abstract

This study examines the implementation of criminal law in handling juvenile knife-carrying offenses within the Indonesian juvenile justice system, using North Lampung Regency as an empirical case. Adopting a qualitative socio-legal research design, the study analyzes how statutory criminal norms are applied in practice and how their implementation is shaped by institutional, social, and cultural contexts. Primary data were obtained through semi-structured interviews with law enforcement officials, probation officers, and juveniles in conflict with the law, while secondary data consisted of statutory regulations, judicial decisions, and relevant scholarly literature. The findings indicate that juvenile knife-carrying cases are formally processed in accordance with Emergency Law No. 12 of 1951 and juvenile justice regulations, with procedural safeguards for children generally observed. However, the effectiveness of law enforcement is influenced by limited community participation, low legal awareness, and persistent cultural perceptions that normalize the carrying of sharp weapons. These factors contribute to a predominantly reactive enforcement model that emphasizes post-offense handling rather than preventive intervention. The study further reveals a structural tension between the deterrent function of criminal law and the rehabilitative objectives of juvenile justice. This research concludes that juvenile knife-carrying offenses represent an interdisciplinary legal issue that cannot be effectively addressed through doctrinal criminal law alone. A more integrated approach, combining criminal law enforcement, juvenile justice principles, and socio-cultural considerations, is required to achieve sustainable crime prevention and child-centered justice.

Abstract

This study examined the dynamics of handling criminal cases involving juveniles carrying sharp weapons in North Lampung, Indonesia, using a qualitative socio-legal case study approach. The research aimed to analyze how formal legal norms are implemented in practice and how social and contextual factors influence law enforcement decisions involving children in conflict with the law. Primary data were collected through in-depth interviews with judicial actors, probation officers, and juveniles involved in sharp weapon possession cases, complemented by document analysis of relevant laws and court decisions. The findings indicate that although statutory provisions serve as the primary legal basis, their application is significantly shaped by judicial discretion, local social norms, and concerns regarding the long-term impact of punitive sanctions on juveniles. In rural and agrarian contexts, sharp weapons are often perceived as tools for daily use or self-protection, creating ambiguity between lawful and unlawful possession. This condition presents challenges for law enforcement and highlights the limitations of rigid punitive approaches. The study further demonstrates that rehabilitative and restorative justice-oriented responses, supported by inter-agency coordination and community engagement, are more consistent with the objectives of juvenile justice and child protection. This research contributes to socio-legal and juvenile justice scholarship by providing contextualized empirical insights from a rural setting and offers policy-relevant recommendations for developing more adaptive, humane, and sustainable legal responses to juvenile offending.

Abstract

The phrase "For the Sake of Justice Based on Belief in the One Almighty God" serves as the foundational principle for the administration of justice in Indonesia and appears as the irah-irah (heading) in court decisions issued by the Supreme Court of the Republic of Indonesia. This study examines how this principle is reflected or not reflected in first-instance corruption case rulings. Through a normative legal research approach, this study employs the theory of justice as its analytical framework. Focusing on decisions from the Tanjungkarang and Banda Aceh District Courts, it finds that judicial reasoning in these cases often lacks legal arguments that embody the values of justice rooted in belief in the One Almighty God. The study argues that a judicial decision with integrity must go beyond a mere recital of the facts and legal elements of the indictment. It should also offer moral reasoning that acknowledges the accused as a human being with dignity and inherent rights to justice, truth, and fair treatment. The analysis also highlights instances where judges, in applying Indonesia’s anti-corruption laws, appear to act not in accordance with religious moral values, but rather under the influence of external interests. Such actions, including legal simplification, selective application, and even corrupt practices such as bribery, compromise the moral foundation of judicial decisions and result in unjust outcomes. Theoretically, this research affirms that to realize justice in its truest form, judges must draw upon divine moral principles as a source of inspiration and guidance. Only then can court decisions reflect both human dignity and substantive justice.

Abstract

This study examines work-skill development for death row prisoners in Indonesian correctional institutions from the perspectives of correctional law, labour law, and human rights. The central gap addressed in this article is the absence of a specific legal framework that determines whether, how, and under what safeguards death row prisoners may participate in work-skill development programs. This study uses normative legal research with statutory, conceptual, and case approaches. The legal materials are analyzed through grammatical, systematic, and teleological interpretation, combined with doctrinal reasoning on the hierarchy of norms, restriction of rights, and state responsibility. The analysis shows that Indonesian correctional law recognizes prisoners’ rights to guidance, occupational safety, wages, or work-performance premiums, while human rights law requires humane treatment and protection of inherent dignity. However, the current framework does not specifically regulate death row prisoners, creating legal uncertainty, institutional discretion, unequal access, and risks of exploitation. The novelty of this article lies in the formulation of “custodial vocational protection” as a normative model that distinguishes rights-based work-skill development from ordinary employment and exploitative prison labour. This article argues that death row prisoners are not workers in a conventional employment relationship, but they remain legal subjects whose participation in correctional work programs must be voluntary, safe, non-discriminatory, psychologically assessed, fairly incentivized, and institutionally accountable.
