Abstract

The integration of blockchain-based smart contracts technology has emerged as an innovative solution in banking. The utilization of blockchain technology and smart contracts offers great potential in improving operational efficiency and compliance with Shariah principles in Islamic banking products. Overall, blockchain-based smart contracts have the potential to overhaul the traditional way of providing Islamic banking services, by providing more efficient, transparent, and inclusive solutions. This research emphasizes the need for technological readiness and supportive policies for the successful implementation of this technology in the Islamic banking sector. This article discusses the potential use of smart contracts in strengthening automation and sharia compliance in Islamic banking products, focusing on the role smart contracts can play in increasing Islamic financial inclusion and expanding access to Islamic banking services and how prepared Islamic financial institutions are to adopt blockchain technology and smart contracts. That way, the utilization of blockchain-based smart contracts integration can be seen as better to bring significant changes in the Islamic banking sector, both in terms of increasing efficiency and in strengthening sharia principles which are the main foundation of the Islamic financial system.

Abstract

Sharia-based Fintech Peer-to-Peer (P2P) Lending is developing as a digital financial innovation that aims to increase financial inclusion in accordance with Islamic principles. This research aims to analyze the regulation of Fintech P2P Lending in sharia economic law, evaluate the implementation of sharia contracts, and assess its contribution in realizing Maqashid Syariah. This research uses a normative juridical method with a literature study approach that refers to regulations, Fatwas of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI), and related literature. The results showed that the regulation of sharia Fintech P2P Lending still needs strengthening, especially in the aspects of legal certainty and supervision. The implementation of sharia contracts such as Murabahah and Musyarakah has been implemented, but still faces challenges of transparency and propriety. Fintech P2P Lending has the potential to support Maqashid Syariah, especially in fair financial distribution and consumer protection. Regulatory optimization and sharia contract innovation are needed so that Fintech P2P Lending can further contribute to the sharia-based financial system

Abstract

This study examines the use of narcotics in the medical field from the perspective of Indonesian positive law and Islamic law. Narcotics have the potential to cause dependence and abuse, but they also have therapeutic benefits such as reducing pain and assisting in the anesthesia process. In Indonesian positive law, regulations regarding narcotics are contained in Law Number 35 of 2009, which allows their use for medical and research purposes under government supervision. Meanwhile, in Islamic law, narcotics are classified as intoxicating substances that are forbidden to use, except in emergency conditions when no other halal drugs are available. This study uses a normative juridical method with a literature study approach through a literature review of legislation, legal literature, the Qur'an, and Hadith. The results of the study show that both legal systems have similar views, namely allowing the limited use of narcotics for humanitarian purposes with strict supervision and legal responsibility.

Abstract

Pemberian kredit multiguna merupakan bagian dari aktivitas perbankan yang memegang peranan penting dalam menunjang kebutuhan konsumtif nasabah. Dalam praktiknya, baik bank konvensional maupun bank syariah memiliki pendekatan yang berbeda dalam menyalurkan dana kepada masyarakat, yang masing-masing memiliki konsekuensi yuridis tersendiri. Artikel ini bertujuan untuk menganalisis bentuk dan karakter risiko hukum yang melekat dalam pemberian kredit multiguna serta membandingkan mekanisme mitigasi risiko yang diterapkan oleh bank konvensional dan bank syariah. Penelitian ini menggunakan metode pendekatan normatif dengan analisis yuridis terhadap peraturan perundang-undangan, fatwa syariah, serta literatur hukum yang relevan. Hasil kajian menunjukkan bahwa risiko hukum dalam bank konvensional umumnya berkaitan dengan ketidaksempurnaan perjanjian kredit dan wanprestasi debitur, sedangkan dalam bank syariah, risiko hukum lebih banyak bersumber dari kesalahan penerapan akad dan ketidaksesuaian dengan prinsip syariah. Upaya mitigasi dilakukan melalui penguatan struktur perjanjian, verifikasi agunan, hingga keterlibatan Dewan Pengawas Syariah pada bank syariah. Perbandingan ini memberikan pemahaman yang lebih mendalam mengenai perlunya penyusunan kerangka hukum yang responsif terhadap dinamika praktik pembiayaan konsumtif di sektor perbankan.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan denda pada layanan Shopee PayLater (SPayLater) dalam perspektif Ushul Fiqih dengan pendekatan Maslahah Mursalah. Layanan Buy Now Pay Later (BNPL) seperti SPayLater memudahkan konsumen dalam transaksi digital, namun menimbulkan persoalan hukum terkait denda keterlambatan yang dianggap menyerupai riba. Penelitian ini menggunakan metode hukum normatif-analitis melalui studi kepustakaan, dengan sumber hukum primer berupa Al-Qur’an, Hadis, Ijma’, dan Qiyas, serta literatur sekunder terkait hukum Islam dan perlindungan konsumen. Hasil penelitian menunjukkan bahwa penerapan denda SPayLater belum sepenuhnya sejalan dengan prinsip syariah, karena denda dijadikan bagian dari keuntungan perusahaan, bukan sebagai sanksi edukatif. Berdasarkan kaidah al-darar yuzāl (segala bentuk kemudaratan harus dihilangkan) dan konsep Maslahah Mursalah, denda hanya dapat dibenarkan jika bersifat mendisiplinkan, tidak eksploitatif, serta digunakan untuk kepentingan sosial. Dari sisi hukum positif, perlindungan konsumen diatur melalui UU No. 8 Tahun 1999 dan POJK No. 77/2016, namun implementasinya masih menghadapi tantangan seperti rendahnya literasi hukum dan ketidakseimbangan posisi antara konsumen dan pelaku usaha

Abstract

Legal protection of women's rights in marriage from the perspective of Islamic Law in Indonesia is a crucial aspect in ensuring justice and gender equality within the family environment. This article examines various women's rights in marriage such as the right to dowry, maintenance, consent to marriage, protection from violence, and the right to file for divorce in accordance with the provisions of Law No. 16 of 2019, as an amendment to Law No. 1 of 1974, and the principles set forth in the Compilation of Islamic Law. Although normative regulations accommodate these rights, various challenges remain in practice, particularly due to the strong patriarchal culture, narrow interpretation of religious texts, and lack of legal education for women. The study employs a qualitative approach with juridical and socio-cultural analysis of the application of Islamic law in society. Findings indicate that structural and socio-cultural barriers remain major obstacles to the effective protection of women's rights. Therefore, this article recommends contextual and inclusive fiqh renewal, strengthening law enforcement by religious courts, and public education to raise legal awareness and gender equality. Through the adoption of these recommendations, it is projected that legal protection for women in marriage will be more optimal and in accordance as guided by the principles of justice within Islamic law and Indonesian national law.

Abstract

Penelitian ini bertujuan untuk menganalisis konsep ijma’ sebagai landasan penting dalam Ushul Fiqih dengan menelaah mekanisme verifikasi kesepakatan ulama, otoritas mujtahid, batas temporalitas ijma’, serta isu kehujjahan dan kodifikasinya dalam literatur fiqih klasik maupun kontemporer. Melalui metode kualitatif berbasis studi kepustakaan, kajian ini menelusuri pandangan ulama dalam karya-karya ushul fiqih dan melakukan analisis normatif-teologis berdasarkan Al-Qur’an, hadis, dan prinsip dasar hukum Islam. Hasil penelitian menunjukkan bahwa ijma’ memiliki kedudukan epistemologis dan normatif yang kuat sebagai sumber hukum ketiga setelah Al-Qur’an dan Sunnah karena berfungsi menjaga konsistensi hukum, stabilitas pemikiran, dan mencegah perbedaan pendapat ekstrem. Namun, problem autentisitas ijma’, perdebatan mengenai kelayakan mujtahid, serta isu temporalitas kesepakatan menjadi tantangan dalam menentukan validitasnya. Dalam konteks modern, ijma’ tetap relevan sebagai mekanisme pengembangan hukum Islam yang adaptif terhadap perubahan sosial dan kebutuhan umat. Konsep ijma’ mu‘assir ditawarkan sebagai pendekatan alternatif berbasis maqasid al-syari‘ah untuk menghadirkan fleksibilitas hukum tanpa meninggalkan prinsip syariat. Dengan demikian, ijma’ bukan hanya warisan klasik, tetapi juga instrumen dinamis yang berpotensi memperkuat dan menyesuaikan hukum Islam dengan tantangan kontemporer.

Abstract

Pregnancy outside of marriage is a social phenomenon that raises legal, moral, and religious issues. From an Islamic legal perspective, pregnancy resulting from adultery is considered a major sin, but Islam still provides room for repentance and protection of dignity for women who experience it. In Indonesia, cases of pregnancy outside of marriage are often resolved through marriage, but the legal status of such marriages and the status of the children born from them often cause debate. This study applies a normative-descriptive method with a literature review approach that refers to laws and regulations, fatwas (religious edicts) issued by Islamic scholars, Constitutional Court decisions, and various relevant academic studies. The results of the study show that according to Islamic law, women who become pregnant outside of marriage still have the right to marry, either to the man who impregnated them or to another party who is willing to take responsibility. However, the child's lineage remains with the mother. In the Indonesian positive legal system, Article 43 paragraph (1) of Law Number 1 of 1974, reinforced by Constitutional Court Decision Number 46/PUU-VIII/2010, stipulates that children born outside of marriage have a civil relationship with their mother and biological father, provided that the relationship can be proven through scientific means. Thus, both Islamic law and national law emphasize the importance of protecting women and children born out of wedlock through legal means.

Abstract

This study examines the role of Islamic law in the formation and development of positive law in Indonesia, which historically, philosophically, and constitutionally holds a crucial position within the national legal system. As an integral part of Indonesian society, Islamic law has contributed to various aspects of regulation, particularly in the areas of family law, Islamic economics, and Islamic philanthropy. Through an analysis of regulations such as the Marriage Law, the Zakat Law, the Waqf Law, and the Islamic Banking Law, this study demonstrates that sharia principles such as justice, welfare, and legal certainty are relevant to the objectives of national law, which is based on Pancasila and the 1945 Constitution. However, harmonization between Islamic law and positive law still faces challenges, including legal pluralism, differences in interpretation, and institutional limitations. Based on this discussion, this study recommends strengthening sharia-based legislation, increasing the capacity of Islamic legal institutions, legal literacy, and contextual ijtihad to ensure that Islamic law plays a growing role in the development of a just, modern, and Indonesian-characterized national law.
