Abstract

Taukil al-wali is delegating marriage guardianship rights to the office of Religious Affairs (KUA) officials or community leaders. The local community widely accepts this practice because religious and traditional leaders legitimize it. This study aims to examine the community's view of the departure of the guardian (wali) after taukil al-wali and review this phenomenon from the perspective of legal anthropology. The research used a qualitative method with a legal anthropology approach. Data were obtained through observation, interviews, and documentation. The findings show that the people of Batursari Village view marriage as a sacred event, so the guardian delegating his marriage guardianship rights to KUA officials or community leaders is considered to have to leave the assembly for the marriage contract ceremony. This view is based on a limited understanding of the law of taukil al-wali, the influence of religious leaders, and respect (tabarukan) for those given a mandate. The guardian's departure is considered a valid condition for marriage; if not fulfilled, the marriage is deemed invalid and must be repeated. Local cultural values also influence this practice. Unwritten customary law becomes the community's main guideline in taukil al-wali. The strong influence of cultural values causes people's compliance with customs more dominant than formal rules. In conclusion, the guardian's departure after taukil al-wali reflects religious norms and local cultural integration. The legal anthropology perspective shows the important role of custom in shaping the distinctive marriage practices in the Batursari Village community.

Abstract

The integrality of the criminal justice system must be realized in every aspect of sub-systems, in substance, structure, and legal culture. In this respect, in the process of criminal justice, the three sub-systems’ integrality are required so that the criminal justice system is capable to produce fair legal decisions in the process of law enforcement in Indonesia. Until such a policy is undertaken, the law will always be harsh against the poor and weak against the rich. This paper discusses criminal objectives integrality in Indonesian criminal justice system and its influence in the integrated criminal justice system. Using a normative juridical method, this paper demonstrates that each sub-system of criminal justice (the Police, Prosecutors, Courts, and the prison) is in line with the main objectives of criminal law enforcement as found in various laws that govern the institutions.

Abstract

Salah satu golongan yang berhak menerima zakat adalah kelompok al-muallafah qulubuhum atau muallaf. Namun, dalam hal ini para ulama fikih berbeda pendapat mengenai siapa yang masuk dalam kategori muallaf; apakah bagian muallaf pada masa sekarang sudah gugur ataukah masih berlaku; dan apa ‘illah diberikannya harta zakat kepada golongan muallaf. Di kalangan masyarakat Muslim sendiri, telah berkembang pengertian bahwa keberlakuan bagian zakat untuk golongan muallaf hanyalah untuk mereka yang baru masuk Islam sebagai penguat iman. Dengan menggunakan metode istinbat al-ahkam dengan penekanan utama pada teori naskh dan ‘illah, penelitian ini mengkaji ulang pendapat para ulama fikih tentang muallaf, terutama mengenai gugur atau tidaknya bagian muallaf pada masa kini, dan ‘illah diberikannya zakat kepada kelompok ini. Dengan metode ini, penulis akan menyesuaikan pendapat para ulama fikih tentang ada atau tidak adanya naskh dalam masalah muallaf dengan teori naskh. Sedangkan untuk teori ‘illah, akan digunakan ketika menganalisa ‘illah-‘illah yang disampaikan oleh para ulama fikih dengan menelusuri ulang al-Qur’an maupun hadis yang diduga mengandung ‘illah diberikannya zakat kepada muallaf. Untuk mengetahui ada atau tidaknya ‘illah dimaksud dalam al-Qur’an maupun hadis, penulis akan menggunakan masalik al-‘illah yang notabene merupakan bagian dari teori ‘illah. Kesimpulan dari penelitian ini adalah bahwa bagian zakat untuk golongan muallaf tetap berlaku sampai sekarang dengan ‘illah ta’lif al-qulub bi al-Islam. Sedangkan orang-orang yang masuk dalam kategori muallaf adalah mereka yang baru masuk Islam dan non-Muslim. Kesimpulan ini memunculkan temuan bahwa zakat tidak hanya sebagai ibadah maliyyah ijtima’iyyah, tetapi juga ibadah maliyyah da’watiyyah dalam kerangka mempertahankan, menyebarkan dan melestarikan agama Islam.

Abstract

Discussions on "suluk" have been extensively covered by scholars and experts in the field of Sufism. However, it becomes particularly intriguing when "suluk" is examined by scholars known for their expertise in Islamic jurisprudence or fiqh, like Zainuddin al-Malibari. In several Sufi literary works, "suluk" places greater emphasis on the process, spiritual activities, or practices aimed at reaching Allah SWT. Consequently, its practical application often encounters errors due to misinformation. In his book "Hidāyat al-Adhkiyā’", Zainuddin al-Malibari delves into the misunderstandings faced by individuals undertaking "suluk". This research aims to document a concept of "suluk" within the treasury of Sufism from the perspective of a fiqh expert. It also aims to address the deficiencies in previous research articles. This study employs a library research approach, where collected data comprises both primary (main) and secondary (supporting) sources. Zainuddin al-Malibari's book "Hidāyat al-Adhkiyā’" serves as the primary data source, while secondary sources include books, journals, and various internet resources discussing Zainuddin al-Malibari's thoughts. The research findings highlight that Zainuddin al-Malibari's concept of "suluk" encompasses three components: Sharia, Ṭariqat, and Ḥaqiqat. To attain ma’rifat Allāh, an individual undertaking a spiritual journey (salik) must firmly abide by Sharia initially. Even upon reaching the stage of understanding the Ḥaqiqat, Sharia remains a responsibility to be upheld Pembahasan mengenai suluk banyak ditulis oleh ulama atau sarjana di bidang tasawuf. Tetapi menjadi menarik apabila suluk dibahas oleh ulama dan sarjana yang dikenal sebagai ahli fikih atau ahli yurisprudensi Islam, Zainuddin al-Malibari. Dalam beberapa literatur tasawuf, suluk lebih menekankan proses atau kegiatan spiritual atau praktik menuju Allah Swt. Sehingga tidak jarang dalam penerapannya terdapat kekeliruan yang disebabkan mis-informasi. Dalam kitab Hidāyat al-Adhkiyā’, Zainiddin al-Malibari menjelaskan tentang kesalahpahaman seseorang yang menempuh suluk. Penelitian ini ingin mendokumentasikan suatu konsep suluk dalam khazanah tasawuf menurut pandangan ahli fikih. Serta melengkapi kekurangan dari artikel penelitian yang ada sebelumnya. Jenis penelitian pustaka (library research) merupakan penelitian yang dipakai pada penelitian ini. Umumnya, pada penelitian kepustakaan (library research) ini, sumber data yang dihimpun dalam melengkapi penelitian ini terdiri dari data primer (pokok) dan data sekunder (penunjang). Kitab Hidāyat al-Adhkiyā’ Zainuddin al-Malibari adalah sumber data primer. Sedangkan sumber data sekundernya berupa buku, jurnal dan beberapa sumber dari internet yang memuat pemikiran Zainuddin al-Malibari. Hasil dari penelitian ini bahwa konsep suluk Zainuddin al-Malibari melalui tiga bagian: Syariat, Tarekat, dan Hakikat. Agar sampai kepada ma’rifat Allāh, seorang yang melakukan pengembaraan spiritual (salik) harus kokoh dalam menjalankan syariat terlebih dahulu dan meskipun nantinya sudah sampai pada bagian hakikat, syariat masih tetap menjadi tanggung jawab untuk dijalankan.

Abstract

The Indonesian state has legal provisions of religious freedom contained in the constitution and its derivatives legislation. This article aims to discuss religious freedom in Indonesian legislation from the perspective of maqāṣid hifẓ al-dīn. This study is the result of qualitative research using a content analysis approach. From the results of the discussion, it is known that the freedom of religion in Indonesian legislation includes freedoms to choose belief (Belief in One Supreme God), to worship, and to express religion. These provisions are in line with hurriyyah al-'i'tiqād Ibn 'Āsyūr and al-ḥurriyyah fī al-dīn al-Zuhailī regarding freedom of worship but are not in accordance with al-Zuhaili's opinion about freedom of belief, an area of personal choice when one may choose to be religious or not. The contradiction occurs because all Indonesian citizens must believe in One and Only God as the first precept of Pancasila and make six religions as religions recognized by the State as contained in Presidential Decree No. 1/1965 (PNPS Act). Therefore, it is necessary to reconstruct the law and values of religious freedom contained in the PNPS Act, especially in its implementation.

Abstract

Abstract The legal renewal of waqf land management in the northern coastal area of Central Java is very important because there are legal problems with the practice of waqf land management. The research identified legal problems in the management of waqf land in the northern coastal area of Central Java and the solutions. The benefits of research as a novelty on waqf law enforcement and waqf land management so that waqf land can be managed optimally. This type of research is field research, using an empirical juridical approach, the data needed is primary and secondary data, the data is analyzed qualitatively and concluded inductively. The results of the study show that the legal problems of waqf land management in the northern coastal region of Central Java, namely; waqf practices occur orally; the community is not yet fully aware of the waqf laws set by the state and do not fully support the management of waqf land; there is an attitude of the heirs not supporting the heir as waqif; unprofessional nadzir resources; the nadzir's attitude in the management of waqf assets is not yet transparent and accountable; the legality of the validity of the nadzir has not yet been realized; and PPAIW has not carried out its duties optimally. The solution; carry out legal renewal of waqf land management by improving institutional aspects, juridical regulations, nadzir resources, support for facilities and infrastructure as well as government policies so that the objectives and benefits of waqf land can be felt by the community. Abstract

Female circumcision is a tradition that has been running since Islam existed in Indonesia. The scholars who oblige female circumcision with the tendency of QS. Al Nahl:123 with other verses that show to follow the teachings of Ibrahim (as).  The emergence of this regulation on the ban on circumcision has sparked controversy between state regulations and support by women activists and the WHO on an international scale. This study aims to measure the authority of evidence in the madhab shafiiyah which requires it very urgently from the point of view of the interpretation of maqāṣidī. The research method uses library research by collecting verses and hadiths that are the basis for female circumcision. By looking at the aspects of maqāṣidī using the interpretation approach of maqāṣidī. It is concluded that first: the prohibition of female circumcision is not justified because there is no evidence that leads to haram based on the analysis  of the interpretation of maqashidi, but it is necessary to pay attention if there is a madharat that occurs. Second: The problem of female circumcision is in a way that does not exist in the circumcision law itself so it has many negative effects, so what needs to be regulated is the circumcision procedure with the right medicine, third: Female circumcision is part of Islamic law, so its prohibition causes the elimination of something that has been regulated in Islam.

Abstract

Assessment in early childhood education is an assessment process carried out to determine the improvement of children's development. This study focuses on children's language development. This study aims to identify effective assessment methods in measuring the language development of early childhood at RA Al-Fur'qon Prabumulih. This study is a field study with a descriptive qualitative approach. While the data collected through in-depth interviews, participatory observation, and documentation. Not only that, children aged 4-5 years here already understand simple instructions and are able to answer basic questions given by the teacher. In addition, the results of the study also found that the combination of direct observation in daily activities, the use of portfolios, game-based assessments, and parental involvement are the most effective methods at RA Al-Furqon Prabumulih. These methods are considered capable of providing a comprehensive and natural picture of children's language abilities. However, the use of assessment technology is still limited and needs to be improved. While the inhibiting factor is the lack of collaboration between teachers and parents in the field. So that the assessments carried out only apply in schools. This study implies the need for teacher training and integration of digital technology in improving the quality of early childhood assessment.

Abstract

Character education is a demand in national education to build and cultivate good character in students. This research aims to find out the character values in the story of Muhammad Al-Fatih and how to implement the values of character education in the story of Muhammad Al-Fatih in today's education. This research uses qualitative methods which produce descriptive data through two types of approaches, namely library research and field research. Data collection techniques in this research used observation, interview and documentation techniques. Interviews were conducted with students and teaching staff. The results of the research show that there are character education values in Muhammad Al-Fatih that are relevant to the 18 character education values according to the Ministry of National Education. The results of field research at MTs Masyariqul Anwar Caringin show that students' attitudes, manners and behavior are improving. Learning the History of Islamic Culture through the exemplary story method of the character Muhammad Al-Fatih integrates 8 character education values, namely religious, discipline, curiosity, hard work, creativity, independence, democracy and responsibility.
