Abstract

Perbankan merupakan salah satu pilar penting dalam perekonomian Indonesia, bank adalah badan usaha yang menghimpun dana dari masyarakat dalam bentuk simpanan dan menyalurkan kepada masyarakat untuk meningkatkan taraf hidup masyarakat. Bank berfungsi untuk menyalurkan dana dari pihak yang berlebih kepadapihak yang membutuhkan masalah yang sering terjadi di kalangan masyarakat adalah kredit macet. Kredit macet adalah kondisi dimana debitur baik itu perorangan maupun organisasi tidak mampu membayar utang atau cicilan pinjaman. Dalam upaya mengurangi risiko kredit macet, bank sering meminta adanya penjamin sebagai pihak ketiga yang bertanggung jawab melunasi kredit apabila debitur gagal memenuhi kewajibannya. Penjamin memiliki peran penting dalam mengurangi resiko kerugian bank. Dalam pelaksanaan tanggung jawab ini sering memahami kendala karena kurangnya pemahaman dari pihak ketiga mengenai peran dan tanggung jawab mereka. Oleh karena itu perlu di lakukan penguatan terhadap regulasi dan edukasi bagi penjamin untuk meningkatkan kepercayaan dalam sistem perbankan. Dalam penelitian kali ini menggunakan metode penelitian hukum normatif yang mengkonsepkan hukum sebagai peraturan perundang-undangan atau norma yang memberikan bagaimana perilaku manusia yang layak dan pantas.

Abstract

This article explores the judicial considerations and decisionmaking process regarding a petition for gender reassignment at the Batam District Court, exemplified by Case Number 176/Pdt. P/2024/PN Btm. The analysis encompasses legal aspects, presented evidence, principles of justice, and the societal impacts of the court's decision. The study utilizes a descriptiveanalytical approach to examine the legal framework, notably the Law No. 24 of 2013 on Population Administration, and evaluates medical and psychological evidence supporting the petitioner's gender identity. Additionally, comparative analysis of previous cases aids in understanding the application of Indonesian law concerning gender reassignment. The conclusion emphasizes the importance of a fair and legally sound decision that respects societal norms and ensures equitable outcomes for all stakeholders

Abstract

Land is something that is very meaningful for the lives of living creatures, especially humans, from the past until the future. Therefore, it is important to have clear legal rules to regulate it. In Article 16 paragraph (1) of the UUPA, there are several types of land rights, namely: Ownership Rights, Cultivation Rights, Building Use Rights, and Use Rights, Rental Rights, Land Clearance Rights, and Forest Product Harvesting Rights. Land rights are rights owned by every land owner provided they have a certificate as strong evidence. Property rights are the strongest and most fulfilled rights. Business entities in the form of limited liability companies are currently in great demand, but problems often occur regarding land use due to the reduction in the status of Land Ownership Rights to Building Use Rights experienced by limited liability companies. The transition process also often experiences obstacles. For this reason, this research uses normative juridical research methods which focus on studying the application of rules or norms in positive law with a statutory approach and legal norms relating to land rights by Limited Liability Companies.

Abstract

This legal study aims to describe and study the problem about the the role of National Narcotics Agency (BNN) in enforcing the law against the perpetrators of the abuse of narcotics for himself (users) in Indonesia. This research is a normative law descriptive qualitative approach. This research uses primary and secondary data. Data collection techniques used by way of literature study. Data analysis techniques used in the writing of this law is qualitative. These results indicate the role of National Narcotics Agency (BNN) in enforcing the law against the perpetrators of the crime of drug abuse in terms of Act No. 35 of 2009 on Narcotics.

Abstract

Child sexual abuse is a very complex and sensitive issue in society. The rapid development of society and the increase in crime have an impact on interactions that often violate the law, creating a sense of security, peace and order in society. The crime of sexual abuse of minors is committed by adults and children themselves, and is an important problem to be discussed. The purpose of this study is 1. to find out the efforts made by law enforcers in overcoming sexual abuse of minors 2. to find out how the application of sanctions against perpetrators of criminal acts of sexual abuse of minors. This research uses normative juridical methods, namely legal research conducted on legal norms contained in laws and regulations relating to the criminal offense of child abuse and the provisions of the law. The results of research and discussion show that law enforcement efforts in overcoming child abuse include several steps, namely: conducting investigations and investigations, prosecution of perpetrators, analyzing and considering in deciding cases, conducting supervision and monitoring to correctional institutions and focusing on victim protection with strict law enforcement. The application of criminal sanctions against perpetrators of child abuse through several stages, namely the process of investigation and investigation of investigation and prosecution.

Abstract

Special Economic Zones (SEZs) in Indonesia serve as strategic instruments to attract domestic and foreign investments and accelerate economic growth in specific regions. Legal certainty within SEZs, encompassing regulatory stability, transparent licensing procedures, and effective legal protection, plays a crucial role in shaping investor perceptions and decisions. This research employs a normative juridical research method, focusing on the study of applicable legal norms or rules to analyze, interpret, and examine relevant legal principles. The findings indicate that investor perceptions of legal certainty are significantly influenced by regulatory complexity and consistency, transparent licensing procedures, and adequate legal protections. Investors tend to favor investment environments offering clear regulations, efficient licensing processes, and robust legal protections to mitigate investment risks. Based on these findings, it is recommended to enhance regulatory transparency and consistency, streamline licensing processes, strengthen legal protections, and improve investor education on SEZ regulations and legal protections. These steps are expected to enhance the attractiveness of SEZs as competitive and sustainable investment destinations, contributing significantly to regional economic growth.

Abstract

The process of returning a motorized vehicle as evidence in a criminal case at the Batam District Prosecutor's Office. This research aims to describe and analyze the process of returning motorized vehicles, starting from confiscation, storage, to returning them to their legal owners. The research method used is the normative legal method with secondary data, including primary legal materials (legislation), secondary legal materials (books and journals regarding the return of evidence), and tertiary legal materials (articles and internet news) and through interviews with officers. Batam District Prosecutor's Office. The research results show that the process for returning motorized vehicles at the Batam District Prosecutor's Office has been clearly regulated in statutory regulations and the Attorney General's Circular Letter. This process generally runs smoothly and orderly. However, in some cases, there are obstacles encountered in the process of returning motorized vehicles, such as a lack of complete vehicle documents, as well as a lack of complete data such as the vehicle owner's cellphone number which can no longer be contacted. The Batam District Prosecutor's Office has made efforts to overcome these obstacles.

Abstract

Management of Sedimentation Results in the Sea, Sedimentation Results in the Sea are sediment in the sea in the form of natural material formed by weathering and erosion processes, which are distributed by oceanographic dynamics and deposited which can be taken for use prevent disruption of ecosystems and shipping. The use of marine sedimentation in its regulation refers to the business licensing aspect issued by the Minister by establishing planning documents, regulated in the Regulation of the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia Number 33 of 2023 concerning Implementing Regulations of Government Regulation Number 26 of 2023 concerning Management of Sedimentation Results in the Sea. In managing and protecting the sea, every activity at sea pays attention to the balance and preservation of the sea, if a violation occurs, it is subject to administrative and criminal sanctions. Criminal liability for illegal sand exports refers to Article 158 of Law Number 4 of 2009 concerning Mineral and Coal Mining, beside, several primary legal materials can be used for law enforcement against sand mining, namely, the Criminal Code (KUHP), Law Number 32 of 2009 concerning Environmental Protection and Management, and the other national regulations that has same meaning of this crime.

Abstract

Special Economic Zones in Indonesia are zones that are provided with special facilities to increase investment and national competitiveness. Special economic zones consist of several zones, including export processing zones, logistics zones, industrial zones, technology development zones, energy zones and other economic zones. The use of foreign workers in special economic zones has limitations and potential, which need to be understood so that the benefits can be maximized. These limitations include regulations and compliance, regulatory compliance, and local energy absorption. Meanwhile, the potential for using foreign workers in special economic zones includes technology and skills, easier access to foreign workers, regional economic development, and increasing company productivity.

Abstract

Development is one way to create people's welfare. Therefore, the results of development must be able to be enjoyed by all people as a form of increasing physical and spiritual welfare in a fair and equitable manner. To stimulate economic growth and focus investment policies, the government is aggressively creating Special Economic Zones (KEK) in various regions. It is hoped that people can feel the maximum benefits. Batam City has a strategic location, one of which is Rempang Island which has a lot of potential that can be developed, both in the tourism, economic and social sectors. However, there are misunderstandings between local communities and the government, giving rise to quite serious conflicts due to territorial struggles. So there is a need for efforts to protect the rights of people affected by the clearing of land for investment purposes on Rempang Island, Batam, which can be done with preventive efforts, repressive efforts or prosecution efforts. So this research uses normative juridical research methods, namely focusing on the analysis of doctrine, norms and the application of certain legal principles in dealing with certain legal subjects. With a statutory regulation approach and conceptualization method, it uses technical analysis of legal materials to solve frozen problems.
