Abstract

Publication efforts are possible using information systems, especially those that are digital-based. The existence of a new model in the realm of village fund management publications will realize accountable and transparent village fund management. Therefore, this service is carried out in the form of counseling on planning and using village funds based on accountability values, Microsoft-based village financial management training and the formation of village information media. The final result of the implementation of the service which forms a digital-based village information social media is one form of realizing transparency and accountability in the use of village funds. The existence of this series of activities is a step in realizing accountable and transparent management of village funds so that it will avoid misuse of village funds as well as provide space for community participation in supervising the management of village funds. In addition, this media will provide space for community participation in monitoring the use of village funds carried out in various forms of programs and activities.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi hak-hak orang dengan gangguan jiwa (ODGJ) dalam pemilu di Indonesia, dengan fokus pada pengakuan dan perlindungan hak pilih mereka. Metode yang digunakan dalam penelitian ini adalah metode normatif, yang melibatkan analisis terhadap peraturan perundang-undangan, dokumen resmi, serta literatur hukum yang relevan. Pendekatan ini memungkinkan peneliti untuk memahami dan menginterpretasikan ketentuan hukum yang berlaku serta mengevaluasi penerapannya dalam konteks hak-hak ODGJ. Hasil penelitian menunjukkan bahwa meskipun secara hukum ODGJ memiliki hak yang sama dengan warga negara lainnya, termasuk hak untuk memilih dalam pemilu, terdapat tantangan signifikan dalam implementasinya. Beberapa regulasi dan putusan pengadilan mendukung hak pilih bagi ODGJ, namun praktik di lapangan menunjukkan adanya hambatan dalam memastikan bahwa hak-hak ini benar-benar terlindungi dan diimplementasikan dengan baik. Oleh karena itu, penelitian ini mengidentifikasi perlunya upaya lebih lanjut dalam mengatasi masalah-masalah ini, termasuk meningkatkan kesadaran dan partisipasi masyarakat serta memperbaiki mekanisme perlindungan hukum bagi ODGJ dalam pemilu.

Abstract

Penelitian ini bertujuan untuk memahami dampak perubahan konstitusi terhadap struktur ketatanegaraan dan implementasi hukum di Indonesia, dengan fokus pada serangkaian amandemen terhadap Undang-Undang Dasar 1945. Metode yang digunakan adalah analisis dokumen melalui studi literatur yang relevan, termasuk analisis historis dan perbandingan dengan teori perubahan konstitusi. Hasil penelitian menunjukkan bahwa amandemen konstitusi telah secara signifikan mengubah konstitusi yang semula bersifat rigid menjadi lebih fleksibel, memperkuat prinsip-prinsip demokrasi dan supremasi hukum melalui pembentukan lembaga-lembaga baru seperti Mahkamah Konstitusi dan Komisi Yudisial. Perubahan ini juga mengubah hubungan kekuasaan antar lembaga negara, mengurangi sentralisasi kekuasaan eksekutif, dan memperluas otonomi daerah, sehingga memungkinkan adaptasi yang lebih baik terhadap perubahan sosial, politik, dan ekonomi.

Abstract

This study discusses the role of the police in handling criminal acts of theft committed by minors, with a focus on the implementation of diversion as an alternative dispute resolution in accordance with the mandate of Law No. 11 of 2012 on the Juvenile Criminal Justice System. The research employs a juridical-empirical method with a qualitative descriptive approach, using literature study, interviews with law enforcement officers, and field data analysis. The findings of the study reveal several key points: first, the police play a strategic role as the initial gatekeepers in determining the course of cases; however, they are still constrained by a lack of competent juvenile investigators, specialized detention facilities, and limited support from psychologists or social workers. Second, the implementation of diversion in juvenile theft cases has not been optimal, due to resistance from victims or their families who perceive justice can only be achieved through formal criminal prosecution. Third, the legal culture that remains retributive, the lack of understanding among law enforcement officers and the public regarding restorative justice, and the weak coordination between institutions (police, prosecutors, judges, and social institutions) lead to many juvenile cases continuing to court, even though they meet the criteria for diversion. Nevertheless, the research also finds that successful diversion can have a significant positive impact: children are spared from criminal stigma, victims receive recovery, and social order is restored to harmony. Therefore, comprehensive reform is needed through capacity building for law enforcement, strengthening supporting facilities, and public education, so that the implementation of diversion truly becomes an instrument of justice that protects the future of children.

Abstract

This study aims to reconstruct the implementation of Article 33 of the 1945 Constitution through the framework of Ordnungspolitik developed by Franz Böhm and Walter Eucken. The study is grounded in the existence of imbalances in the normative, institutional, and functional dimensions of Indonesia’s economic system, which hinder the realization of the principles of solidarity and social justice. This study uses a normative legal methodology with a conceptual and comparative approach to legal thought. The analysis examines the comprehensive text of the amendments to the 1945 Constitution, sectoral regulations (such as the Job Creation Law and the Mining and Energy Law), as well as Constitutional Court rulings related to the economy. Data is analyzed qualitatively to align the principles of the German economic order (Ordoliberalism) with the values of the Indonesian Constitution. The novelty of this study lies in offering a new interpretive model for Article 33 of the 1945 Constitution by positioning the state as the architect of the market order (rather than merely a passive actor or regulator). Its innovation lies in integrating the substantive rule of law of Ordnungspolitik to limit the concentration of private economic power, which often distorts the constitutional mandate. The results show that Ordnungspolitik provides operational instruments for Indonesia to achieve distributive justice through two main channels: (1) strengthening the independence of competition oversight agencies to the level of constitutional institutions, and (2) codifying economic laws that guarantee market access rights for small businesses. This interpretation shifts the paradigm of Article 33 from mere symbolism regarding “cooperatives” to a binding norm that obligates the state to undertake structural interventions to maintain market integrity. The conclusion is that integrating the principles of Ordnungspolitik into the national legal system can serve as a solution to Indonesia’s economic institutional failures. This study recommends restructuring economic public policy to prioritize healthy competition and the protection of social rights as an inseparable legal order.

Abstract

The development of digital technology has encouraged the increasing use of electronic transactions in various walks of life, including in rural areas. However, the rapid utilization of digital transactions has not been balanced with an adequate level of public understanding of the law, causing various legal risks such as online fraud, misuse of personal data, and legal uncertainty in electronic agreements. This community service activity aims to improve the legal literacy of the community through educational assistance and legal consultation related to legal protection in digital transactions. The method used is in the form of legal counseling and direct consultation held in Mekar Jaya village, Duhiadaa District, Pohuwato Regency, involving village officials and the general public. The results of the activities show that the public has been actively using digital transaction services, but still has a limited understanding of the legal rights and obligations as digital consumers. Through practical and contextual education, people are beginning to understand the importance of personal data protection, the validity of electronic agreements, and dispute resolution mechanisms in digital transactions. This legal assistance and consultation proved to be effective in increasing the legal awareness of the public and strengthening their position in facing the risks of digital transactions. This activity is expected to contribute to creating a secure, fair, and equitable digital transaction ecosystem, as well as being a model for sustainable legal service in the era of digital transformation.
