Abstract

Sea transportation to Mursala Island constitutes the primary access supporting marine tourism in Central Tapanuli Regency. However, the operation of small-scale vessels in open waters directly facing the Indian Ocean, combined with weak enforcement of maritime safety regulations, has generated significant legal and safety risks for passengers as consumers. This study examines the legal protection of consumers against risks arising from illegal ferry services to Mursala Island within the framework of Indonesian consumer protection law. Employing an empirical juridical approach, the research integrates statutory, conceptual, and case analyses. Data were collected through field observations, semi-structured interviews with service providers and passengers, and examination of relevant legislation and legal literature. The findings reveal four interrelated categories of risk: geographical and weather-related hazards, technical deficiencies of vessels, absence of proper business licensing, and weak legal protection mechanisms. The study demonstrates that consumer protection remains largely formalistic, as passengers often lack adequate safety facilities, clear safety procedures, transparent information, and enforceable compensation mechanisms. In practice, liability is frequently resolved informally without legal certainty, thereby weakening consumers’ legal position. This research contributes to the discourse on consumer protection in maritime tourism by highlighting the regulatory gap between normative legal frameworks and operational realities in small-scale coastal transport services. Strengthening governmental supervision, enforcing compliance with maritime safety standards, and institutionalizing clear liability mechanisms are imperative to ensure substantive consumer protection.

Abstract

Law No. 33 of 2014 concerning Halal Product Guarantee requires mass-produced products to be halal certified. Refillable drinking water products in Padang Bulan Selayang I Village do not have adequate halal certification and labeling. This study aims to determine the regulations regarding halal certification requirements for water depots and the implementation of halal certification at water depots in Padang Bulan Selayang I Village. This study is an empirical legal study using a living case studies and statute approach. Data were collected through interviews and document studies, then processed and analyzed qualitatively. The results of this study show that, of the ten business actors interviewed, not a single water depot in Padang Bulan Selayang I Village has been halal certified, even though, as mandated by Article 4 of the Halal Product Guarantee Law, water depots are among those that are required to have halal certification. This shows that the legal awareness of water depot business actors in Padang Bulan Selayang I Village is still low and not in line with Law Number 33 of 2014 concerning Halal Product Guarantee.

Abstract

Perkembangan industri musik digital meningkatkan nilai ekonomi lagu, namun menimbulkan persoalan perlindungan hak ekonomi pencipta akibat tumpang tindih kewenangan antara LMKN dan LMK dalam penarikan royalti berdasarkan UU No. 28 Tahun 2014 dan PP No. 56 Tahun 2021. Penelitian ini bertujuan menganalisis konflik kewenangan penarikan royalti antara LMKN dan LMK serta menilainya dari perspektif maslahah sebagai ukuran keadilan dan kemaslahatan perlindungan hak ekonomi pencipta. Jenis penelitian ini adalah hukum normatif dan pendekatan yang digunakan adalah statute approach dan conceptual approach. Sumber data diperoleh melalui studi kepustakaan (library research) yang meliputi bahan hukum primer, sekunder, dan tersier. Seluruh bahan hukum dianalisis secara kualitatif dengan metode deduktif. Hasil penelitian menunjukkan bahwa mekanisme penarikan royalti saat ini belum sepenuhnya memberikan kepastian hukum dan kemaslahatan bagi pencipta lagu karena belum tegasnya batas kewenangan antara LMKN dan LMK, rendahnya transparansi distribusi, serta belum optimalnya sistem pencatatan penggunaan lagu. Diperlukan harmonisasi regulasi dan penguatan sistem terpusat yang transparan, akuntabel, dan berkeadilan agar perlindungan hak ekonomi pencipta lagu dapat terwujud sesuai prinsip maslahah.
