Abstract

This study examines the effectiveness of the International Criminal Court (ICC) in addressing terrorism and its implications for international law enforcement. Based on the 1998 Rome Statute, the ICC has limited jurisdiction as terrorism is not explicitly categorized as an international crime. A normative legal research method with legislative and conceptual approaches was employed to analyze international legal instruments and the ICC’s role. Findings reveal that the ICC can indirectly address terrorism through crimes against humanity, but its effectiveness is hindered by the absence of a universal definition of terrorism, jurisdictional limitations, and insufficient ratification of the Rome Statute. The implications highlight the ICC’s contribution to strengthening international legal norms and fostering global cooperation, though amendments to the Rome Statute are needed to explicitly recognize terrorism as a core crime. The conclusion underscores the necessity of harmonizing terrorism definitions and legal reforms to enhance the ICC’s role in enforcing international law.

Abstract

Genocide is a serious crime against human rights and is recognized as a norm of jus cogens in international law, binding all states without exception. The 1948 Genocide Convention obligates participating states to prevent and punish perpetrators of genocide, regardless of the location of the act or the nationality of the perpetrator. However, the implementation of this obligation is often hindered in international legal practice, particularly when citizens of a state commit genocide beyond its territorial jurisdiction. Issues of jurisdiction, sovereignty, and political complexities frequently pose challenges in enforcing justice and accountability for genocide perpetrators. This paper explores the responsibility of states regarding their citizens who commit genocide abroad, analyzing relevant international laws and principles.

Abstract

This study examines the interplay between the principle of state sovereignty and the jurisdiction of the International Criminal Court (ICC) in enforcing law against international crimes. Using a normative-qualitative method and literature review approach, the research finds that state sovereignty is no longer absolute due to the evolution of international law, particularly in human rights protection. The ICC serves as a complementary mechanism (complementarity) when national judicial systems are unwilling or unable to prosecute international crimes. However, the ICC's effectiveness remains constrained by political factors and resistance from non-party states to the Rome Statute.

Abstract

State sovereignty over airspace according to international law is complete and comprehensive. However, in practice, the use of unmanned aircraft (drones) has not been specifically regulated through international regulations or conventions. The slow development of drone regulations is due to the absence of laws and standards from the International Civil Aviation Organization (ICAO). This study aims to examine the legality of drones crossing state borders and Yemen's responsibility for the actions of the Houthi rebels. This study uses a normative legal method with a descriptive approach, using secondary data analyzed qualitatively, and drawing conclusions deductively. The results of the study show that although drones are equated with aircraft in their regulations, the term drone has not been explicitly regulated in national or international air law.

Abstract

The phenomenon of incest as a form of sexual violence against children within the family environment is a serious issue that often remains hidden, as it occurs in private spaces and is accompanied by emotional pressure and power dominance. Children as victims are placed in a highly vulnerable position—physically, psychologically, and socially. The crime of incest remains difficult to address effectively because the current Indonesian Penal Code (KUHP) does not explicitly regulate incest as a distinct criminal offense. However, Indonesia has enacted the Child Protection Law, the Law on the Elimination of Domestic Violence (PKDRT), and the Law on Sexual Violence Crimes (UU TPKS), which can be applied to cases of incest. This research aims to explore two main problems: how legal protection for child victims of incest is regulated under Indonesian legislation, and what challenges exist in the law enforcement process concerning incest cases involving children. This study employs a normative legal research method with a descriptive-analytical and legal-political approach. Data were collected through a literature review of statutory regulations, legal doctrines, scholarly journals, and institutional reports. The findings reveal that although legal norms provide a framework for protection, the implementation is hampered by evidentiary limitations, familial pressure, insufficient sensitivity among law enforcement officers to the psychosocial conditions of child victims, and the pervasive influence of patriarchal values. Therefore, comprehensive legal reform is urgently needed one that centers on the rights and recovery of victims through trauma-informed and restorative justice approaches.

Abstract

Asas pelayanan yang baik merupakan salah satu dari asas-asas umum pemerintahan yang baik. Pelayanan publik sangat mempengaruhi kesejahteraan masyarakat di Republik Indonesia dikarenakan kehidupan masyarakat dari lahir hingga meninggal dunia pasti membutuhkan pelayanan publik. Salah satu pelayanan publik yang paling mendasar adalah pembuatan E-KTP yang digunakan masyarakat untuk melanjutkan pendidikan, membuka usaha, mengurus pernikahan, hingga syarat untuk mendapatkan bantuan sosial. Teknik pengumpulan data pada penelitian ini adalah dengan observasi, wawancara, dan dokumentasi. Berdasarkan penelitian melalui aspek yang didasari penerapan Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik, pelayanan yang diberikan oleh Dinas Kependudukan dan Pencatatan Sipil Kota Bengkulu sudah berkualitas baik dikarenakan sudah sesuai dengan aspek daya tanggap (responsivness), aspek jaminan (assurance), dan aspek empathy. Namun berdasarkan penerapan Peraturan Presiden Nomor 95 tahun 2018 Tentang Sistem Pelayanan Berbasis Elektronik menunjukkan bahwa aplikasi pembuatan E-KTP milik Dinas Kependudukan dan Pencatatan Sipil tersebut tidak sinkron terhadap notifikasi yang masyarakat dapatkan.

Abstract

The rise of online gambling in Indonesia has created serious family and legal problems. When husbands become addicted, financial neglect, debt accumulation, and domestic conflict often lead to divorce, leaving women as the most affected group. This study analyzes legal certainty and women’s protection in divorce cases caused by online gambling from both Islamic and positive law perspectives. Using a normative juridical method with statutory, conceptual, and case approaches, the research examines relevant laws and Religious Court decisions in Bengkulu. The results show that legal certainty is guaranteed through consistent court procedures and statutory frameworks such as the Marriage Law, Government Regulation No. 9 of 1975, the Compilation of Islamic Law, and the ITE Law, which classify gambling as a legitimate ground for divorce. Women’s protection is realized through iddah maintenance, mut’ah, custody rights, and division of joint property. This study’s novelty lies in integrating Islamic and national law analyses to reveal how legal certainty principles are operationalized in court practice to ensure substantive justice for women affected by online gambling–related divorces.

Abstract

Penelitian ini membahas dan meneliti mengenai patologi sosial didalam perilaku menyimpang Generasi Z di negara Indonesia yang dimana tumbuh dan berkembang di tengah perkembangan teknologi digital yang pesat serta perubahan sosial yang signifikan. Generasi Z menghadapi berbagai tantangan psikososial, seperti kecemasan, stres, dan depresi akibat paparan intensif terhadap media sosial, tekanan standar sosial yang tinggi, serta ketidakpastian masa depan yang memengaruhi kestabilan mental dan perkembangan karakter mereka. Berbagai fenomena negatif seperti kecanduan digital, cyberbullying, perilaku agresif, penyalahgunaan narkoba, dan perilaku berisiko lainnya muncul sebagai manifestasi patologi sosial. Selain itu, tekanan sosial dan kesenjangan dalam ekspektasi diri serta lingkungan turut memperparah kondisi tersebut. Pendekatan normatif didalam penelitian ini bertujuan untuk mengidentifikasi berbagai faktor penyebab patologi sosial serta implikasi sosial, psikologis, dan moral bagi Generasi Z. Hasil penelitian ini diharapkan dapat menjadi landasan pengembangan strategi edukasi, intervensi, dan pencegahan yang lebih efektif agar Generasi Z mampu membangun ketahanan mental serta karakter yang sehat, bertanggung jawab, dan berdaya saing di tengah tantangan kompleks di masa depan. Upaya kolaboratif diantara keluarga, sekolah, pemerintah, dan masyarakat sangat diperlukan untuk menangani dinamika ini secara berkelanjutan demi mewujudkan generasi penerus bangsa yang berkualitas dan adaptif.

Abstract

Penggunaan smartphone di kalangan remaja pada era modern semakin meningkat seiring dengan perkembangan teknologi yang pesat. Fenomena ini membawa dampak signifikan tidak hanya dalam aspek positif seperti kemudahan komunikasi dan akses informasi, tetapi juga menimbulkan berbagai patologi sosial yang mengganggu fungsi sosial dan psikologis remaja. Penelitian ini mengkaji berbagai bentuk dari patologi sosial yang muncul akibat penggunaan smartphone secara berlebihan, seperti kecanduan digital, penurunan kemampuan interaksi tatap muka, serta peningkatan resiko gangguan mental seperti stres, kecemasan, dan depresi. Selanjutnya penelitian ini juga menyoroti dampak negatif pada produktivitas akademik dan pola perilaku remaja, termasuk munculnya perilaku agresif, cyberbullying, serta penyebaran konten negatif dan hoaks yang berkontribusi pada kerusakan moral dan norma sosial. Metode penelitian yang digunakan yaitu metode normatif dengan studi literatur dan analisis terhadap data sekunder dari berbagai sumber terpercaya. Penelitian ini menyimpulkan perlunya implementasi strategi edukasi digital dan program pengawasan yang tepat guna untuk mengurangi dampak negatif smartphone, sehingga penggunaan teknologi dapat mendukung perkembangan remaja yang sehat secara sosial dan psikologis di era modern.

Abstract

This study analyzes the trafficking of Indonesian Migrant Workers (TKI) and Female Migrant Workers (TKW) abroad as a social pathology and the effectiveness of legal protection. Despite regulations such as Law No. 21 of 2007 and Law No. 18 of 2017, illegal agents, non-procedural departures, exploitation, and limited victim access to legal protection remain. This normative study uses literature and legal document analysis to identify gaps between regulation and implementation in the socio-economic context of migrant workers. Findings show TKI atau TKW trafficking is a systemic social issue influenced by poverty, low education, and limited employment alternatives. Effective legal protection requires strengthened regulations, agent supervision, public education, capacity building, international intervention, and socio-economic rehabilitation for victims. The study provides policy recommendations to enhance migrant worker protection and sustainably prevent human trafficking.
