Abstract

Cessie merupakan mekanisme pengalihan hak piutang dari kreditur lama kepada kreditur baru yang diatur dalam Pasal 613 Kitab Undang-Undang Hukum Perdata. Dalam praktiknya, cessie kerap digunakan dalam proses pengalihan piutang bank yang dilikuidasi kepada pihak ketiga. Penelitian ini bertujuan untuk menganalisis implikasi hukum cessie terhadap status dan kedudukan hukum kreditur baru atas piutang bank yang dilikuidasi. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa cessie yang dilakukan sesuai dengan ketentuan hukum mengakibatkan beralihnya seluruh hak dan kewajiban kreditur lama kepada kreditur baru, termasuk hak penagihan atas debitur. Namun demikian, dalam konteks likuidasi bank, kedudukan kreditur baru tetap bergantung pada keabsahan perjanjian cessie serta pemenuhan asas keterbukaan dan perlindungan hukum bagi debitur. Oleh karena itu, kepastian hukum dalam pelaksanaan cessie sangat diperlukan guna menjamin hak kreditur baru tanpa mengabaikan perlindungan hukum bagi pihak debitur.

Abstract

Putusan pengadilan dalam perkara perdata memiliki akibat hukum yang signifikan terhadap para pihak yang bersengketa, khususnya terhadap kedudukan kreditor dan debitor dalam sengketa perjanjian. Penelitian ini bertujuan untuk menganalisis akibat hukum putusan perdata terhadap hak dan kewajiban kreditor dan debitor, serta implikasinya terhadap hubungan hukum para pihak. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa putusan perdata tidak hanya berfungsi sebagai sarana penyelesaian sengketa, tetapi juga menentukan kepastian hukum mengenai pemenuhan prestasi, perlindungan hak, serta tanggung jawab para pihak berdasarkan perjanjian yang telah disepakati. Putusan pengadilan dapat menguatkan, mengubah, atau menghapus kedudukan hukum kreditor dan debitor sesuai dengan amar putusan dan pertimbangan hukum hakim. Oleh karena itu, pemahaman terhadap akibat hukum putusan perdata menjadi penting guna menjamin keadilan dan kepastian hukum dalam pelaksanaan perjanjian.

Abstract

Although the efficiency of credit settlement through the parate execution mechanism of Hak Tanggungan has been widely discussed, studies that specifically examine disparities in judicial decisions arising from the lack of transparency regarding the breakdown of outstanding debt prior to auction remain limited. This study aims to analyze, from a juridical perspective, the judicial reasoning used to determine the remaining debt in the execution of Hak Tanggungan in Decision Number 78/Pdt.G/2024/PN Tjk jo. Number 120/PDT/2024/PT TJK. The research adopts a normative juridical approach with a statute and case approach design, using primary and secondary legal materials selected through purposive sampling. Data were collected through library research and document study, then analyzed qualitatively-normatively using deductive reasoning. The findings show that, formally, the High Court progressively annulled the District Court’s inadmissible (N.O) decision in order to separate the unlawful act (Perbuatan Melawan Hukum, PMH) dispute from the legal regime governing auction buyer protection. However, substantively, the appellate judges became trapped in procedural formalism by validating the auction solely on the basis of evidence of the dispatch of a demand letter, without scrutinizing the absence of a detailed breakdown of the debtor’s remaining debt. These results contribute to the development of substantive justice theory by clarifying the limits of a creditor’s objective good faith and affirming that transparency regarding the details of outstanding debt is an indispensable precondition for the validity of security enforcement. The study concludes that clearer jurisprudential guidelines from the Supreme Court are needed to standardize judicial assessment of Hak Tanggungan execution and recommends strengthening transparency and prudential principles in banking practice. The implications include theoretical contributions to the literature on security law and banking prudence, practical implications for the judiciary, and opportunities for further empirical research on the sociological impact of unilateral execution.

Abstract

Although land disputes frequently occur, studies that specifically discuss the clash of claims between a good-faith purchaser in an underhand sale and the seller’s heirs who base their claim on a will remain limited. This study aims to analyze the fulfillment of the elements of an Unlawful Act (Perbuatan Melawan Hukum [PMH]), the legal considerations of the panel of judges, and the legal consequences of Decision of the Tanjung Karang District Court Number 115/Pdt.G/2023/PN Tjk. This study employed a normative legal approach with a judicial case study design. Data were collected through library research and document study covering primary, secondary, and tertiary legal materials, and were then analyzed qualitatively. The results showed that the heirs’ act of continuing to physically control the land unilaterally fulfilled all elements of an Unlawful Act as regulated in Article 1365 of the Indonesian Civil Code. The judges’ considerations emphasized the evidentiary strength of the payment receipt and certificate compared with the argument based on a unilateral will, although the claims for compensation and dwangsom were rejected because they were not supported by proof of actual loss. These findings affirm that a sale and purchase that has been fully paid has legally binding force and can nullify conflicting inheritance claims, while also strengthening the application of the nemo plus juris principle in the settlement of ownership disputes. The implications of this study indicate the importance of legal protection for good-faith purchasers as well as the need for the prompt registration of transfer of rights to minimize similar disputes in the future.
