Abstract

This article examines the phenomenon of re-voting and recounting of ballots. Re-voting and recounting ballots is likened to an unpredictable stage of the electoral process because on particular districts, besides that with the devotees not all doing this. Re-voting and recounting ballots will add or even repeat either part or possibly all of the work that has been done by the Electoral Commission. Re-voting and recounting ballots could be due to constitutional court rulings, recommendation of bawaslu, and the state of force majeure. This will have an impact on budget addition, logistical willingness, voter attendance, longer conflicts and the integrity and professionalism of the Electoral Commission at stake. If the re-vote and the recount of the ballots are included in the stages of the election process and determined the date will result if the Constitutional Court decides outside the schedule of the process stages then it is feared that the date is not in accordance with the stages, Meanwhile, if the re-vote and recount of ballots do not become mandatory stages in the election, it is feared that with the simultaneous elections in 2024 the impact that occurs cannot be anticipated properly by the Election Commission. Abstract

This research aims to discuss the authority of Gakkumdu in the Election Justice system , the urgency of having a Gakkumdu Center in handling election crimes and the problems that hinder the effectiveness of Gakkumdu itself . The method used in this research is normative juridical . The results of this research are that Gakkumdu is an institution that handles election criminal disputes consisting of elements from Bawaslu, the Police and the Prosecutor's Office. The existence of Gakkumdu is very important to realize secret-free, honest and fair direct general elections as a means of democratization. This is also a form of legal certainty in handling election crimes based on agreed mechanisms. However, unfortunately, various problems actually hampered Gakkumdu's effectiveness, resulting in plans to disband Gakkumdu itself. This problem is related to three legal components, both in terms of substance, structure and legal culture. In fact, Gakkumdu's role is very important in ensuring democratic elections. So the dissolution of Gakkumdu will further worsen the situation where there is no certainty about how to handle election crimes themselves, which will lead to public distrust of state officials. Abstrak Penelitian ini bertujuan untuk membahas tentang kewenangan Sentra Penegakkan Hukum Terpadu (Sentra Gakkumdu) dalam sistem Peradilan Pemilu. Urgensitas adanya Sentra Gakkumdu dalam penanganan tindak pidana pemilu serta permasalahan yang menjadi penghambat efektifitas Gakkumdu itu sendiri. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian ini adalah Gakkumdu merupakan lembaga yang menangani sengketa tindak pidana pemilu yang terdiri dari unsur Bawaslu, Kepolisian, dan Kejaksaan. Keberadaan Gakkumdu itu sangat penting untuk mewujudkan pemilu langsung umum bebas rahasia jujur dan adil sebagai sarana demokratisasi. Hal ini juga sebagai suatu bentuk kepastian hukum dalam penanganan tindak pidana pemilu berdasarkan mekanisme yang telah disepakati. Namun sayangnya berbagai permasalahan justru menghambat efektifitas Gakkumdu sehingga berujung pada rencana pembubaran Gakkumdu itu sendiri. Permasalahan itu terkait tiga komponen hukum baik dari segi substansinya, strukturnya, maupun budaya hukumnya. Sejatinya peran Gakkumdu sangat penting dalam menjamin pemilu yang demokratis. Maka sudah seharusnya Gakkumdu tidak dibubarkan demi memberikan kepastian dalam penanganan tindak pidana pemilu itu sendiri sehingga nantinya akan membangun kepercayaan masyarakat terhadap sistem hukum negara.

Abstract

Ketaatan etika dan moral mempunyai hubungan fungsional dengan ketaatan pada hukum. Tujuan penelitian ini untuk menganalisis latar belakang terjadinya degradasi moral pejabat negara dan pengaruhnya terhadap sikap warga negara serta tindakan apa yang harus dilakukan terkait fenomena ini. Penelitian ini menggunakan metode penelitian yuridis-normatif. Hasil analisis menunjukkan bahwa keserakahan dan ketamakan merupakan akar permasalahan terjadinya degradasi moral pejabat negara. Berdasarkan sejumlah data dan penelitian bahwa karakter pejabat dalam menyikapi tugasnya semakin terkikis sehingga tercipta degradasi moral yang mengakibatkan penurunan sikap aktif dan kontributif dari warga Negara. Ketidakpatuhan menjadi sikap yang diwajarkan oleh masyarakat karena mereka mengacu pada para oknum pejabat negara tersebut. Oleh sebab itu, perlu adanya penegakan hukum yang bersih dan tidak memihak mengenai beretika. Tindakan-tindakan menyimpang dan menyeleweng dari oknum pejabat negara harus ditindak secara tegas serta diberikan sanksi yang setimpal karena berdampak kepada masyarakat, yakni warga negara Indonesia. Sistem hukum di Indonesia akan berfungsi dengan baik jika nilai etika dan moral ditegakkan di setiap sektor kenegaraan.

Abstract

Abstract:  The settlement of cases resulting from the Regional Head Election (Pilkada) is still within the authority of the Constitutional Court. In deciding this case, the Constitutional Court made explicit regulations regarding the procedural law of the trial as outlined in the Constitutional Court Regulations. One of the problems that arise in the examination (trial) of disputes over the results of the regional elections is that the application submitted by the losing party (applicant) turns out to be the wrong object (error in objecto). This error usually occurs because the object being sued is not the final decision on the election results. This research is a normative juridical research that aims to examine the attitudes and decisions of the Constitutional Court regarding requests for disputes over Regional Head Elections (Pilkada) that are Error In Objecto. The result of this study is that the Plaintiff in making the application must clearly not be mistaken in determining the object. In the case/dispute over the results of the regional elections, the object of the lawsuit is the final decree of the General Elections Commission regarding the determination of the results of the election results and not others. Accuracy in making posita and petitum is very important because wrong posita and petitum will lead to the wrong and fatal determination of the object of the application. When this is the issue, the Constitutional Court will not accept the application because it is not authorized. An error in determining the object of this application in procedural law is termed error in objecto, so accuracy as an applicant, respondent, or related party is needed. The recommendation given is that the plaintiff should be more careful in making applications and the revision of the application given by the Constitutional Court at the preliminary hearing, can be used by the applicant to correct his application so as not to incorrectly determine the object of the application/error in objecto.

Abstract

Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan (statute approach) untuk menyoroti wacana masa perpanjangan jabatan kepala desa. Hasil penilitian ini menunjukkan bahwa Diskursus perpanjangan jabatan kepala desa yang semula 6 tahun menjadi 9 tahun bertentangan dengan semangat konstitusi dengan adanya pembatasan kekuasaan (limitation power) jika ditinjau dari teori abbuse of power bahwa kekuasaan yang lama akan menimbulkan penyalahgunaan kewenangan yang membuka pintu terjadinya korupsi yang semakin masif, selain itu kekuasaan akan tersentralisasi ke salah satu orang atau kelompok tertentu. Periodesasi jabatan kepala desa 6 tahun selama maksimal 3 periode itu sudah cukup panjang, jika kepala desa mempunyai kinerja baik maka masyarakat akan memilihnya di periode berikutnya. This research is a normative research using a statute approach to highlight the discourse on the extension of the term of office for the village head. The results of this study indicate that the discourse on extending the term of office of the village head from 6 years to 9 years is contrary to the spirit of the constitution with the limitation of power . If reviewed from the theory of abuse of power that the old power will lead to abuse of authority which opens the door for increasingly massive corruption, besides that power will be centralized to one particular person or group. The periodization of the village head's office of 6 years for a maximum of 3 periods is long enough, if the village head has a good performance then the community will elect him in the next period.

Abstract

This article aims to discuss efforts to prevent political polarization in the 2024 election year by using library data collection methods. The results of this research are that political polarization can occur in any situation and condition especially during elections, public policy, socio-cultural issues including post-debate issues for the Presidential and Vice Presidential Candidates. The causes of political polarization are none other than political parties, mass media, regional expansion, political context and society's political ideology. Political polarization has positive and negative impacts. However, of these two impacts, there are more negative impacts. The negative impacts that can be caused by political polarization are the creation of divisions, damage to democratic institutions, loss of credibility of political parties, impact on government, and reduced credibility of society, while the positive impacts of political polarization are strengthening relationships and increasing participation in politics. Political polarization will very easily occur when the public or supporters are easily carried away by issues circulating in society such as differences in ideology, choices and principles between one camp and another. Several efforts can be made to prevent political polarization, namely: the public must be able to sort and choose the issues circulating and not be too fanatical about their choices, instill and implement the values of Pancasila, and implement the value of harmonization of Bhinneka Tunggal Ika.

Abstract

Penelitian ini bertujuan untuk membahas Konsekuensi Kepemimpinan Otoriter Terhadap Prinsip-Prinsip Demokrasi; Perbandingan Kebijakan dan Praktik Pemerintahan antara Gaya Pemerintahan Otoriter dan Demokratis; serta implikasi gaya kepemimpinan otoriter di berbagai negara. Menggunakan metode penelitian deskriptif dengan literatur review. Hasil dari penelitian ini adalah Melihat kasus-kasus di negara dengan gaya kepemimpinan otoriter seperti Rusia, Venezuela, Tiongkok, dan Arab Saudi, kita dapat melihat bahwa pemerintahan otoriter seringkali menghasilkan situasi di mana hak asasi manusia menjadi rentan. kepemimpinan otoriter seringkali menciptakan situasi di mana hak-hak individu diabaikan atau bahkan diperlakukan dengan semena-mena. Sehingga perlu adanya kesadaran global tentang isu-isu pelanggaran HAM karena gaya kepemimpinan otoriter, agar semakin besar peluang untuk mendorong perubahan positif dalam perlindungan hak asasi manusia dan pemerintahan yang lebih demokratis di seluruh dunia.
