Abstract

This article critically examines the ideality and effectiveness of Indonesia’s amended Marriage Law in curbing child marriage, a persistent socio-legal issue with deep-rooted cultural and religious dimensions. Despite legal reforms, child marriage continues to occur at alarming rates, raising questions about the law’s capacity to address structural and normative barriers. Employing Lawrence M. Friedman’s legal system theory, this study analyzes the problem through the interrelated dimensions of legal structure, legal culture, and legal substance. Methodologically, this research adopts a normative-empirical legal approach, integrating doctrinal legal analysis with socio-legal inquiry to assess the sources, functionality, and enforcement of relevant legal instruments. Findings reveal a critical tension between the amended law and prevailing cultural norms. In the dimension of legal culture, the entrenched influence of kitab kuning—traditional Islamic legal texts—continues to shape societal attitudes and justify early marriage, thereby weakening the law’s preventive potential. From the perspective of legal substance, the absence of explicit sanctions for violators constitutes a significant legal loophole, undermining the deterrent effect of the amendment. Nonetheless, in the dimension of legal structure, the issuance of Supreme Court Regulation No. 5 of 2019—governing judicial review of marriage dispensation cases—reflects a proactive institutional response aimed at restricting the practice. This study underscores the urgency of harmonizing legal reform with cultural transformation and institutional enforcement. Its contribution lies in highlighting the multi-dimensional challenges of legal ideality in child marriage prevention and offering a systemic framework for more effective policy implementation.

Abstract

This research aims to overcome the decline in congregational participation and revive the role of mosques as centers of religious and social activities. The art of hadron combines praise to Allah and prayers to the Prophet Muhammad SAW with the accompaniment of traditional musical instruments. This research uses qualitative data collection techniques; the author uses observation, interview, and documentation study techniques. The research results show that efforts to prosper the Ki Ageng Mirah Mosque through hadroh art involving KPM INSURI Ponorogo students have had a positive impact. The number of congregants attending to worship and participate in hadroh arts activities has increased significantly, with the high enthusiasm of the younger generation seen from the large number of young people active in hadroh groups and practicing regularly. Hadroh art activities not only liven up the mosque's atmosphere but also strengthen community social ties, generating a sense of belonging and love for the mosque. Now, the mosque functions as a place of worship, study space, and center for creativity and friendship, making it an effective magnet for the prosperity of the mosque.

Abstract

This article discusses Khaled M. Abou El Fadl’s (El Fadl) views on Islamic legal authority and his critique of the fatwa prohibiting women from travelling alone without a maḥram (unmarriageable kin) issued by the Council for Scientific Research and Legal Opinions (CRLO), Saudi Arabia. This research employs a literature review method by analysing several fatwas issued by the CRLO and several of El Fadl’s works as primary sources. The research findings indicate that El Fadl strives to formulate an authoritative and progressive Islamic law. El Fadl criticises the CRLO’s authoritarian fatwa regarding the prohibition of women travelling alone without a maḥram using a hermeneutic framework. El Fadl emphasises that the reader must understand the message of the religious text by connecting the text at the time of its revelation with the current text, considering the text’s competence, meaning determination, and representation. According to El Fadl, the hadith text used as a basis by the CRLO is no longer relevant in the current context because of the sense of security can be overcome on which the fatwa is based. The author argues that El Fadl’s views belong to progressive Muslim thinking. This article is expected to contribute to the discourse on openness and inclusivity in Islam.

Abstract

This article examines the relationship between piety, social pressure, and riya’ among urban Muslim youth in Yogyakarta who use social media to express religiousity, and the way the youth negotiate to deal with the contradiction between displayed piousness and religious norms. Employing a phenomenological approach this article explore the negotiation of ambiguity among urban Muslim youth, in particular the urban students actively involved in lecture series branded "Ngaji Filsafat" conducted by Dr. Fahruddin Faiz. This article argue that not only digital media provide space for youth to express their piety, it also offer bigger social pressure to gain social validation for their (digital) existence, in the form of likes and followers, for instance. The social pressure increases ethical ambiguity, where expressions of online piety can be considered as violating a moral principle of religiosity, namely riya’. Finally, this article contributes to debates on the intersection of religion and media, especially on the aspect of individual negotiation space in responding to biases and dilemmas arising from the hybridity of the two.

Abstract

As one of the demanding discourses of Indonesian Islam, Islam Nusantara has made a further round of Indonesian Muslim polarisation among the proponents on the one side and the opponents on another, let alone in the digital era nowadays. For the Muslim communities, new media are not only used for communication activities but also to assist the da'wa (proselytisation) and its contestation. This paper, thus, aims to portray activities of social media users, particularly Instagram, using the #IslamNusantara hashtag to convey their ideas. This paper seeks to explore the motives of how the Instagram users do involve in the contestation of #IslamNusantara and to what extent they publish their argument to support, criticise, or even refuse the concept of Islam Nusantara. The method used in this article is netnography, analysing a total of 344,000 hashtags #IslamNusantara on Instagram. Finally, this paper anticipates a yet-to-end online contestation among the Muslim communities within a new interest pool: #IslamNusantara.
