Abstract

Digital forensic expert testimony is required by judges to resolve cases related to information technology. However, there are allegations of violations committed by certain parties on several servers such as illegal access, configuration changes, and shutdowns. This is increased by the destruction of crime scene and digital evidence.  In some cases, analyzing the data collected can be time-consuming, and practical understanding is needed by judges to avoid irrelevant questions for digital forensic experts in court. Therefore, this research aims to determine and analyze forensic digital experts in court hearings, the duties and roles of judges in resolving information and technology cases as well as the position of forensic experts in the judicial process. The doctrinal research is sourced from secondary data in the form of Electronic Information and Transaction laws, criminal procedure laws, research reports, books, and scientific journals. The results show that digital forensics expert testimony is needed to assist judges as gatekeepers in obtaining material truth. Practical digital forensic knowledge is used to increase the efficiency of case examination time by avoiding irrelevant questions. Best practices are used in the actions, procedures, handling, and analysis of electronic evidence as well as digital forensic expert testimony in judicial practice.

Abstract

The principle of public information openness is a cornerstone of democratic governance, yet its implementation within Indonesia’s State Administrative Court remains underexplored. This research addresses the urgent need to assess how transparency and public access to information can enhance justice in administrative litigation. In a time when citizen trust in the legal system is fragile, and the accessibility of court decisions is increasingly crucial, the study explores whether the openness of public information can serve as a catalyst for greater accountability and fairness in the administrative justice system. The novelty of this research lies in its critical examination of the relationship between information transparency and judicial effectiveness in the context of administrative courts. By analyzing existing practices and identifying gaps in public access to court processes, the study presents an innovative approach to improving the delivery of justice. Through qualitative case studies and a comparative analysis of international practices, the research proposes actionable recommendations for reform. This study contributes to ongoing discussions on judicial transparency and its impact on public perception, aiming to create a more open, inclusive, and accountable State Administrative Court. The findings suggest that public information openness is not merely a procedural formality, but a fundamental aspect of building trust in the judiciary and empowering citizens in their pursuit of justice.

Abstract

Amid the global upheaval caused by the Covid-19 pandemic, this study navigates the challenges presented by the perilous situation, focusing specifically on the transformation of legal proceedings. The pandemic, posing risks to public health, compelled the imposition of widespread restrictions, limiting various community activities and direct interactions. This shift had profound implications for the justice system, prompting a departure from the conventional practice of open and in-person court proceedings. In response to these unprecedented circumstances, the legal arena saw the emergence of online courts, commonly known as e-courts, as an alternative to traditional court setups. The study seeks to critically examine the effectiveness and legitimacy of e-courts during this tumultuous period. Utilizing a literature study method, the research delves into relevant books and literature, emphasizing the collection of data to assess the harmony between legal court proceedings and information technology in the context of the pandemic. The primary goal is to scrutinize the polemics and challenges surrounding the implementation of e-courts, particularly in the State Administrative Court. As the study unfolds, it reveals a nuanced perspective on the harmonization of legal courts and information technology during the Covid-19 pandemic. The discussion extends to the legitimacy of proof in e-court trials, with a specific focus on the State Administrative Court. The analysis underscores the necessity of maintaining a balance between conventional and electronic trial methods to ensure a comprehensive and reliable legal system. In addition, the research contends that despite the convenience offered by e-courts, doubts persist regarding the legitimacy of evidence presented in electronic trials, particularly in the administrative context. The findings contribute valuable insights that can inform future legislative efforts, guiding the harmonization of legal courts and information technology. Ultimately, the study aims to foster the development of a robust legal framework that addresses the polemics surrounding e-court trials, enhancing their legitimacy and efficacy in the ongoing and post-pandemic era.

Abstract

Research aims: By the end of 2023, Indonesian Central Securities Depository data revealed a significant increase in the number of investors dominated by millennial investors (56.41%). They are categorized as novice investors who have distinctive characteristics from professional investors. This study, thus, aims to examine whether herding behavior dominates the characteristics of novice investors and whether information type and overconfidence bias affect the herding behavior of novice investors.Design/Methodology/Approach: This study used a quasi-experimental 2x2 mixed design on 42 student participants who were members of the Capital Market Study Group. The data obtained were then tested using non-parametric statistics.Research findings: The test results uncovered that herding dominated the investment behavior of novice investors. This behavior was supported by the information type that participants paid attention to in making decisions. However, testing for overconfidence demonstrated that this variable was not the cause of novice investors' herding behavior.Theoretical contribution/Originality: The results of this study contribute theoretically to the investment behavior of novice investors by strengthening the argument that they tend to behave herding when making stock investment decisions. Testing with an experimental design allows researchers to confirm that such herding behavior is reinforced by the preference for the information type they use in decision-making. The results also provide insight into the fact that the overconfidence level of novice investors may be different from that of professional investors.Practitioner/Policy implication: The tendency of herding behavior of novice investors needs attention from the Financial Services Authority as a regulator to consider protection for novice investors who dominate the number of investors in the capital market.Research limitation/Implication: The tests in this study employed non-parametric statistics, which are not as good as parametric tests, so the study results should be understood wisely. Future research needs to consider the adequacy of the sample and use capital market groups in several universities to improve sample quality.

Abstract

Research aims: This study explores the importance of information transparency for funders as parties who provide funding to borrowers' projects. It also analyzes information transparency practices in sharia P2P lending.Design/Methodology/Approach: The study used a qualitative case study, focusing on three sharia P2P lending companies in Indonesia. Data were collected through interviews with parties from three sharia P2P lending companies and 11 funders.Research findings: It was found that information transparency is important for funders, increasing their confidence to invest. In addition, based on multiple agency theory, there is information asymmetry between funders and sharia P2P lending borrowers, which can be reduced by information transparency measures from funders, sharia P2P lending, and borrowers based on cost-benefit considerations. Theoretical contribution/Originality: This research explores the application of information transparency in sharia P2P lending companies, which, as far as researchers are concerned, has not been raised in previous studies. In addition, the study builds a conceptual framework of information transparency in sharia P2P lending companies based on multiple agency theory. Practitioner implication: The research has implications for applying information transparency in sharia P2P lending, which can improve information updates and communication from sharia P2P lending to its funders.Research limitation/Implication: The study only focused on three out of the seven sharia P2P lending in Indonesia. Therefore, the differences in business, focus, and other characteristics of the remaining four were not considered.
