Penegakan hukum pidana terhadap penyalahgunaan narkoba oleh pelaku pengedar merupakan isu krusial yang terus mendapat perhatian pemerintah dan masyarakat. Penelitian ini bertujuan untuk menganalisis mekanisme pengawasan yang diterapkan pada kasus-kasus penyalahgunaan narkoba, terutama jika melibatkan pelaku pengedar narkoba. Metodologi yang digunakan dalam penelitian ini meliputi pendekatan hukum normatif dengan analisis terhadap peraturan perundang-undangan yang berlaku, serta studi kasus terhadap putusan pengadilan terkait. Hasil survei menunjukkan bahwa meskipun berbagai upaya penegakan hukum telah dilakukan, namun masih terdapat beberapa tantangan yang menghambat efektivitasnya, seperti terbatasnya sumber daya penegakan hukum dan kurangnya koordinasi antar lembaga terkait. Kajian ini merekomendasikan peningkatan pelatihan dan kapasitas penegakan hukum, serta peningkatan kerja sama antar lembaga untuk memperkuat upaya pemberantasan peredaran narkoba. Penelitian ini diharapkan dapat berkontribusi dalam perbaikan sistem penegakan hukum pidana di Indonesia, khususnya dalam penanganan kasus kecanduan narkoba. This study examines the roles of cooperative management, the supervisory board, and mediator judges in resolving loan default cases by savings and loan cooperative members. The study utilizes a case study approach, analyzing District Court of Kota Agung Decision No. 3/Pdt.G/2021/PN Kot Dated March 31, 2021. The findings highlight the central roles of cooperative management, the supervisory board, and mediator judges in resolving this case. Cooperative management bears the responsibility for initial handling and reporting issues to the supervisory board. When internal solutions are not reached, the mediator judge plays a crucial role in facilitating a peaceful settlement of the dispute before it proceeds to the judicial process for a final decision. The legal settlement steps taken in this case have followed the Standard Operating Procedure (SOP) in accordance with applicable regulations, effectively involving all three parties.

The election of regional heads and deputy regional heads is one of the things that has sparked attention lately, because the 2024 general elections will soon be held even though the implementation does not coincide with the election of the President and Vice President and the election of legislative members. Nevertheless, there are still many people who compare the election of regional heads and deputy regional heads directly or indirectly considering that the performance results of the regional heads and deputy regional heads have not seen the expected results. In fact, both direct and indirect elections have their own advantages and disadvantages so there is no need to debate because basically both elections are democratic elections

Mafia tanah merupakan salah satu masalah utama yang menghambat kemajuan ekonomi Indonesia. Mafia tanah merampas tanah orang lain dengan cara-cara yang tidak sah seperti memalsukan dokumen atau menyuap pejabat. Akibatnya, banyak masyarakat yang kehilangan tanahnya. Mafia tanah leluasa melakukan aksinya karena memanfaatkan kelemahan sistem pengelolaan tanah yang mudah dimanipulasi. Dalam melakukan aksinya, mafia tanah juga melibatkan oknum pejabat untuk mengamankan aksinya. Metode yang diterapkan dalam penelitian ini menggunakan pendekatan penelitian hukum normatif atau doktrinal. Metode ini menitikberatkan pada kajian yang mendalam terhadap sistem norma hukum yang terdiri dari asas, peraturan perundang-undangan, yurisprudensi, perjanjian, dan doktrin hukum. Data primer berupa Putusan Pengadilan Negeri Tanjungpinang Nomor 144/Pid.B/2022/PN Tpg yang telah inkracht, sedangkan data sekunder berupa pasal-pasal pidana pertanahan yang diatur dalam KUHP dan peraturan perundang-undangan terkait administrasi pertanahan. Kesimpulan yang diperoleh dari penelitian ini adalah: Pertama, hukuman yang dijatuhkan kepada Terdakwa I sudah seharusnya diperberat mengingat perbuatannya dilakukan dengan penyalahgunaan wewenang sebagai Pj Kepala Desa. Pengembalian kerugian negara tidak dapat dijadikan alasan pembenaran atau keringanan hukuman. Sebagai pejabat publik, Terdakwa I mempunyai kewajiban moral untuk melaksanakan tugasnya. Kedua, perlu adanya perbaikan yang signifikan terhadap sistem administrasi pertanahan di tingkat desa, khususnya dalam hal pemeliharaan data kepemilikan tanah. Praktik pergantian buku daftar tanah setiap kali terjadi pergantian kepala desa berpotensi menimbulkan konflik kepemilikan dan permasalahan hukum. Untuk mengatasi hal tersebut, perlu dibangun pangkalan data tanah desa yang terpadu dan berkelanjutan.

Abstract : The relationship between religion and the state in Indonesia is always interesting to discuss even though the First Principle of Pancasila explicitly mentions "Belief in One Almighty God", even this is included again in Article 29 paragraph (1) of the 1945 Constitution. Formulation of the First Principle and Article 29 Paragraph (1) of the 1945 Constitution is of course the starting point for discussing the relationship between religion and the state. This research is different from previous studies related to the relationship between religion and the state. The point of difference is the aim of this research which focuses on the benefits obtained from the issue of the relationship between religion and the state from a legal historical perspective. The research results show that there is a close relationship between religion and the state in Indonesia even though it does not directly mention a particular religion in the 1945 Constitution or other statutory regulations. This relationship can be seen in several quotes from Soekarno's speech on 1 June 1945, the history of the birth of the principle of belief in one and only God, and the presidential decree on 5 July 1959. So, the view that Indonesia is a religiously neutral country is ahistorical. Keywords: Religion, State, Legal History

Currently, in the process of developing artificial intelligence technology, a Deepfake phenomenon has emerged, namely technology that is capable of manipulating images, sounds, and videos realistically so that it will be difficult to distinguish from the original content. Although in the development of artificial intelligence technology it has the potential for positive use, such as in the world of entertainment and education, Deepfake can also pose a major risk in the current technological era, especially in terms of digital identity fraud. With the development of artificial intelligence technology, a new serious problem has arisen, one of which is the misuse of Deepfake which is part of artificial intelligence. The method used in this study is the normative legal research method with the main data source being secondary legal materials consisting of laws and regulations as well as reference books and journals. The results of the study state that the ambiguity of regulations can create legal loopholes that have the potential to be exploited by criminals, while the law enforcement process is hampered by the lack of clear guidelines, adequate tools and human resources. Therefore, strategic and systematic steps are needed to update the legal framework and cross-sector collaboration is needed.

Technological advances and developments that are so rapidly giving birth and giving rise to various problems in family law, such as marriages carried out via online. In most people's view, marriage is a very sacred matter and according to prevailing customs, marriage is carried out directly. At certain times, circumstances demand that it is not in line with the custom of the marriage being carried out, such as very long distances or circumstances that make it impossible to gather during the COVID-19 pandemic. The validity of a marriage is determined by the perfection of the pillars and the conditions for a valid marriage. The existence of a prospective husband, prospective wife, guardian, 2 witnesses and a marriage agreement are the pillars of marriage, and must be carried out in one assembly, according to the consent and acceptance and the guardian does not depend on the terms and times in the future. Interpreting the meaning of an assembly, whether in the same place or at the same time, there are also differences of opinion among Islamic jurists. These differences of opinion lead to differences in establishing marriage laws via online. The first group stated that it was illegal due to caution in matters of the dignity and honor of women which led to legal consequences. The second group stated that it was permissible because they did not have a fundamental difference, only different locations and places of marriage.

After the job creation law, the provisions for sanctions for violations of the law on the prohibition of monopolistic practices and unfair business competition have changed significantly. Criminal sanctions are abolished, and administrative fines are changed to a maximum of 50 percent of net profits or 10 percent of total sales during the period of the violation. This change has attracted the attention of researchers who study from various aspects, including from the accounting aspect. In law, there is one of the famous theories, namely Law is a Tool of Social Engineering, which means that law is a tool for social engineering (changing society for the better). Based on that, the author sees that this study is important to be carried out so that the researcher will produce ideal conclusions and recommendations for future business competition law reform. This research is a normative legal research with a legislative, and theoretical approach. The results of the study show that sanctions according to the business competition law after the job creation law do not support the functioning of the business competition law to achieve positive changes among business actors according to the purpose of the law to prevent the occurrence of monopoly practices and unfair business competition. The author suggests that the provisions of the sanctions be reviewed and reviewed in the future reform of the business competition law so that the business competition law is able to form behavior and culture that prioritizes healthy business competition by prioritizing creation and innovation.

Abstract: This study aims to analyze the position and regulation of action sanctions (maatregel) in the Indonesian criminal law system from the perspective of Relative Criminal Theory. The research method used is normative juridical through literature studies of laws and regulations and legal literature. The results of the study show that although theoretically Indonesia's criminal law adheres to a double track system that places criminal sanctions (straf) and equivalent action sanctions, in the practice of legislation and law enforcement, action sanctions are still positioned as number two and are less accommodated. Traditional criminal sanctions (such as imprisonment) remain the "primadonna" due to the legacy of retributive thinking and public perceptions that think punishment should be retaliative. In fact, from the perspective of Relative Theory, sanctions for actions that are rehabilitative and preventive are considered more effective in improving perpetrators and protecting the community in the long term. The excessive dominance of criminal sanctions has proven ineffective, characterized by high recidivism rates and overcapacity of correctional institutions. The conclusion of this study is that legislation policy reform is needed to better integrate and equalize action sanctions, as well as a paradigm shift among law enforcement and society to shift from a retributive approach to a more rehabilitative and preventive approach in accordance with the principles of Relative Theory. Abstract: The rapid property development in Indonesia is often followed by issues related to land rights abuse by developers, which harms consumers in property transactions. One of the main problems is the sale of land with unclear legal status or land under dispute, leading to the risk of consumers losing their property rights. This study aims to analyze the impact of land rights abuse by developers on consumer protection and the implementation of the Consumer Protection Law in improving dispute resolution mechanisms in cases of developer default. The study uses a normative legal research method with a descriptive-analytical approach, analyzing applicable regulations, legal principles, and relevant legal theories. Data was collected through library research using primary and secondary data sources and analyzed qualitatively. The results indicate that land rights abuse by developers significantly impacts consumers, both financially and psychologically. Developer defaults related to delays, discrepancies in property specifications, and land legal issues increase consumer distrust in the property sector. The implementation of the Consumer Protection Law through the Consumer Dispute Settlement Body (BPSK) can improve dispute resolution mechanisms, although challenges in consumer awareness and the enforcement of BPSK decisions still need to be addressed. Stronger law enforcement and improved transparency will enhance consumer protection. Keywords: Land Rights Abuse, Developer Default, Consumer Protection
