Abstract

Unregistered marriage is an endless problem with non-optimal law enforcement. Meanwhile, the massive impact of unregistered marriage is dangerous and this practice is not committed by one or two people but involves many parties. This research aims to describe parties involved in unregistered marriages and their respective roles. In addition, it provides information regarding unregistered marriage regulations and sanctions and determines law enforcement for the parties involved. This normative research used case approach and statutory approach. The data collection technique is documentation and the analysis technique is deductive and inductive. The results of this study found several parties involved in unregistered marriages. These parties are: first, main actors such as illegal rulers, husbands, and wives or marriage guardians. Second, parties who participate, such as marriage witnesses, brokers, and jockeys. Unregistered marriages are regulated in chapter 1 paragraph (2), chapter 3 paragraphs (1 and 2) of Law no. 32/1954 concerning the enactment of Law no. 22 of 1946 concerning registration of marriages, divorces, and reconciliation in all regions outside Java and Madura, the sanctions are contained in chapter 4 and chapter 45 paragraph (1) letter (a) PP No. 9/1975 concerning the Implementation of Law no. 1/1974 on marriage. Law enforcement against the perpetrators of unregistered marriages has not been optimal.

Abstract

One of the non-tax revenues in Indonesia is generated by services at Immigration Sector which is currently showing significant changes and activities. Public services provided to all citizens must be excellent and in line with the needs of the community itself. This study used a Systematic Literature Review (SLR) with PRISMA Method which also searched for articles using Scopus and ScienceDirect database because those have good reputable nationally and internationally by academics. The study resulted in 2 (two) policies in Immigration through analysis of the results of the search for the article. The first is to improve developing immigration services and the latest innovations from digital Immigration and to promote a humanist approach and accountability for its services and ease of access given. Moreover, monopoly on human resources at Immigration is currently carried out in vital cooperation due to national security and state policy especially related to intelligence analysis. Meanwhile, cooperation with other parties is limited to providing space, education in terms of increasing human resources, and cooperation to exchange information with certain parties. The conclusion of this study led to 2 research results, which are policies to improve services and policies to strengthen immigration. The suggestions for future research are in-depth field research using qualitative or quantitative method on immigration agencies and other contributive factors to state revenue.

Abstract

  Laws and regulations related to trade secrets do not explicitly stipulate that trade secrets can be used as an object of guarantee in banking, causing legal uncertainty for the public and affecting the condition of trade secrets being used as collateral objects and the execution of goods for certain reasons. Writing this article aims to examine and analyze the regulation of trade secrets as an object of guarantee and the execution of trade secrets in the banking. Then, through this article it can provide benefits in the form of juridical understanding related to trade secret legal arrangements as objects of collateral in the banking, contribute literature, and can be considered by the government in establishing laws and regulations related to trade secrets as collateral objects. The legal issue in the form of a veil of norms makes this article use normative legal research methods using a statutory and contextual approach, followed by legal materials in the form of primary, secondary and tertiary legal materials. The results of the study show that trade secrets can be used as collateral in the banking because they have economic value, can be transferred, and have no time limit as long as they are kept confidential. Then related to the execution of trade secrets can be carried out based on the execution of fiduciary guarantees considering that trade secrets can be charged with fiduciary guarantees. The method of execution is through executorial titles, public auctions, and private sales as stipulated in Article 29 of the Fiduciary Guarantee Law. Trade secrets as an object of guarantee have been explicitly regulated and execution of trade secrets can be carried out through private sales and auctions as regulated in the German Lending and Taking Security Act. Based on this explanation, the solution to the legal issues in this article is that Indonesia can amend the Trade Secrets Law by considering German Legislation so as to provide legal certainty for the Indonesian people regarding trade secrets as an object of guarantee.

Abstract

One of the creations protected by copyright is songs and/or music. Legal protection for them is a necessity in order to create a conducive climate to the development of music industry in Indonesia. In order to facilitate song and/or music writers with better control over their works, they can appoint representatives to regulate the management of their royalty, in this case LMKN (The National Collective Management Institute). Law number 28 of 2014 concerning copyrights regulates that copyright can be used as an object of fiduciary guarantee. However, its use is still hampered by the fact that the economic value of music and song copyrights cannot be determined easily, especially if it is used for fiduciary guarantee. Most banks do not accept it for loan collateral. The objective of this research was to analyze the roles of LMKN as the determiner of the economic values of song and music copyrights for the purpose of binding them for objects of fiduciary guarantee. This normative study uses statutory approach, conceptual approach, analytical approach, and futuristic approach. The determination of the economic values of song and music copyrights can be done by LMKN, a one- stop service institution that collects the royalty of music and song in Indonesia. The National Collective Management Institute (hereinafter briefly referred to as LMKN) as an institution that can provide an appraiser of the economic value of Music and Song Copyrights. The use of SILM (a music and song information system and data center) can help the estimation of music and song’s economic value based on the royalty accepted by the art’s creator or copyright holder. The amount of royalty can determine the binding of music and song copyrights for the objects of fiduciary guarantee.

Abstract

Artificial Intelligence (AI) has developed in such a way that it is capable of producing creations and inventions without human intervention through the training of a number of datasets. This normative juridical research aims to look at AI problems from the perspective of AI as a subject and AI results as an object of copyright and patent protection, as well as examining the implications of using creations in datasets to train AI. This research found that AI cannot become a creator and inventor because moral and human rights are reserved for humans, besides that AI cannot take advantage of the economic rights obtained from the protection of creation or patents. This study also found that the use of datasets containing other people’s creations as AI development material has the potential to cause copyright violations. This potential is mitigated by several countries by implementing regulations related to TDM or data scraping for AI machine learning. Finally, this study also found that creations and inventions resulting from AI in general cannot become objects protected by the copyright regime unless they receive direct human contribution or are formulated in statutory regulations such as in the CGW copyright regime in the UK. This research suggests that practices in other countries in copyright and patent protection regimes related to AI can be used as a reference for legal politics in Indonesia to create AI regulations that balance the moral and economic rights of Creators and Inventors with the pace of AI innovation.

Abstract

The enactment of Law Number 22 of 2022 concerning Corrections (Pemasyarakatan), which replaces the previous Law Number 12 of 1995, significantly changes the implementation of Correctional functions, mainly the functions carried out by Probation and Parole Offices. If in the 1995 Law Corrections is only referred to as the final part of the Criminal Justice System, the new Law emphasizes the position of Corrections which are more integrated with the entire criminal justice process, so that Correctional functions are carried out at the pre-adjudication, adjudication, and post-adjudication stages. This amendment to the law is also interesting to be studied conceptually, especially to find out what principles are contained in it that form the basis for implementing the functions of Corrections. In line with this, it is also essential to identify what kind of policy changes should be carried out regarding the functions of Probation and Parole Offices in the future with the existence of new principles and differences of provisions in terms of the implementation of corrections functions. By using conceptual analysis methods, particularly policy detection analysis, which is technically carried out in two stages; first, the analysis stage of the content of the law and second, the theoretical coherence analysis stage, this paper comes to two conclusions. First, this paper finds an affirmation of new principles in Law Number 22 of 2022, namely the principle of restorative reintegration, the principle of evidence-based treatments, the principle of individualization, the principle of continuity, and the principle of collaboration. Second, this paper identifies 5 (five) policy changes that need to be made regarding the function of the Probation and Parole Office according to those principles. The policies that must be implemented can be divided into three groups—first, the need for further operationalization of the restorative reintegration concept described by this law. Second, the need for reformulation of various instruments needed in implementing functions, especially social inquiry reports. Third, the need for facilitative strengthening, especially the quantity and quality of probation and parole officers and other facilitative supports.

Abstract

The case of lesbians in Correctional Institutions is phenomenal and has already come to the attention of all groups; there are also health impacts that threaten the community’s safety if Lesbians are indicated. Lesbian cases, in particular, occur not only in the community but have also penetrated Correctional Institutions (Lapas), so early prevention is needed to maintain security and order in Correctional Institutions. This study will use a Sociolegal Approach; data collection is carried out using interview techniques with prisoners. The data analysis is carried out in the form of a Sociolegal Approach with rules relevant to the topic of discussion. The result is that regulations regarding preventing Lesbians in Correctional Institutions are not found. Still, the researchers found that officers can review granting rights to each prisoner if the prisoner commits an act that disturbs conductivity in the Correctional Institutions. The imposition of a measurable sentence against the prisoner isalso enforced. The vision and mission within Correctional Institutions, which focus on coaching, have also been carried out because coaching is the right of convicts. Guidance is generally not only on the religious side but also on positive activities for self-development in line with the assessment of Community Guidance.

Abstract

The issuance, printing, production, and distribution standards of Indonesian travel documents refer to international standards of travel documents and the Regulation of Minister of Law and Human Rights. However, significant issues have risen that the Indonesian passport holders without the bearer’s signature who applied for German visa were rejected by the Embassy of Federal Republic of Germany in Jakarta. Besides, the stolen and lost Indonesian Passport policy is fragmented between the Indonesian National Police, Immigration offices and the Interpol. Using the document analysis and policy evaluation, this paper investigates the issuance standards of Indonesian travel documents under the ICAO Document 9303 about Travel Documents and the policy and management of the stolen and lost Indonesian travel documents. This study shows the Indonesian travel documents have not fully complied with the ICAO Doc 9303 in which the bearer’s signature is a compulsory either in the biodata page or in additional pages. Data of stolen and lost Indonesian Passport have not been recorded in the Interpol Stolen and Lost Travel Documents (SLTD) database. We propose the infrastructure of the security, cooperation, and management of the SLTD, and all Indonesian travel documents must be redesigned and equipped with the chip features.

Abstract

Terjadinya kekerasan di lembaga pemasyarakatan menimbulkan kekhawatiran akan kembalinya sistem penjara masa lalu. Saat ini, undang-undang telah menetapkan batasan terhadap tindakan petugas untuk mencegah tindakan berlebihan, penggunaan kekerasan dan upaya paksa. Penelitian ini bertujuan memberikan gambaran atas pelanggaran hak konstitusonal warga binaan dan pertanggunjawaban hukumnya. Penelitian ini dikerjakan menggunakan pendekatan yuridis normatif yang melibatkan analisis terhadap peraturan-peraturan hukum dan konseptual. Hasil penelitian menunjukkan bahwa pendekatan pembinaan yang melibatkan tindakan kekerasan tidak selalu efektif dalam menyelesaikan masalah sampai ke akarnya atau memberikan dampak jera yang berkelanjutan, justru menciptakan dampak buruk yang terus-menerus seperti gangguan mental, peningkatan risiko depresi pada narapidana dan menghambat efektivitas program rehabilitasi. Kekerasan terhadap narapidana oleh petugas pemasyarakatan menjadi bukti tidak terpenuhinya hak-hak konsitusional narapidana sebagaimana amanat Undang-Undang Pemasyarakatan bahwa perlakuan terhadap narapidana yang kehilangan kebebasannya harus didasarkan pada prinsip perlindungan hukum dan penghormatan hak asasi manusia yang berlandaskan Pancasila dan UUD NRI 1945. Reformasi yang komprehensif diperlukan dalam sistem pemasyarakatan untuk memastikan hak-hak konstitusional narapidana dapat terpenuhi. Peneliti merekomendasikan agar pemerintah mengupayakan pengawasan dan tindakan tegas terhadap petugas pemasyarakatan. Pengawasan ini memastikan bahwa petugas mematuhi undang-undang, etika profesi, serta hak-hak kemanusiaan dalam menjalankan tugas dengan integritas.

Abstract

Permasalahan keamanan dan ketertiban (Kamtib) di dalam lembaga pemasyarakatan Indonesia, khususnya di Lapas “X” menjadi salah satu kekhawatiran besar. Konflik antar Warga Binaan Pemasyarakatan (WBP), overcrowding, dan peningkatan gangguan kamtib adalah isu serius yang memerlukan perhatian. Penelitian ini bertujuan untuk memahami dan meningkatkan strategi kamtib, dengan menggunakan Lapas “X” sebagai studi kasus. Penelitian ini menggunakan pendekatan kualitatif, melibatkan observasi langsung di lembaga pemasyarakatan dan wawancara dengan narasumber kunci. Tujuan penelitian yaitu untuk mengembangkan solusi praktis dalam meningkatkan keamanan dan menjaga ketertiban di sistem pemasyarakatan. Dengan mengungkapkan tantangan khusus yang dihadapi oleh Lapas “X”, penelitian ini menyumbang kontribusi terhadap upaya peningkatan operasional kamtib di lembaga pemasyarakatan dengan Prison Incident Management (PIM) oleh PBB sebagai acuan. Temuan penelitian diharapkan dapat membimbing penelitian masa depan dan memperdalam pemahaman terkait langkah-langkah keamanan yang efektif. Selain itu, penelitian diharapkan menjadi rekomendasi bagi Ditjenpas untuk meningkatkan dukungannya terhadap lembaga pemasyarakatan di Indonesia.
