Abstract

The Republic of Indonesia Prosecutor's Office Regulation No. 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice is a significant milestone in the reform of the criminal justice system in Indonesia. This study aims to examine the implementation of the restorative justice concept in resolving minor crimes and to assess the effectiveness and challenges faced by law enforcement officials, particularly the prosecutor's office, in implementing this policy. The research method used is a normative juridical approach, using regulatory analysis, case studies, and interviews with legal practitioners. The results indicate that the application of restorative justice provides a more humane and efficient alternative for case resolution, oriented toward restoring relationships between perpetrators, victims, and the community. However, implementation in the field still faces obstacles such as a lack of understanding among officials, resistance to a retributive legal culture, and limited supporting facilities. Prosecutor's Office Regulation No. 15 of 2020 provides a clear legal framework, but synergy between institutions and public education are needed for the optimal implementation of restorative justice principles.

Abstract

Islamophobia has experienced a significant increase in recent times, not only in Western countries but also in Muslim-majority nations. This phenomenon, which constitutes a form of discrimination and irrational fear toward Islam, continues to proliferate rapidly in the digital and globalization era, thereby impacting intercommunity relations. This study examines multicultural dawah strategies as a primary instrument to counteract Islamophobia through inclusive and dialogic approaches. Employing qualitative methods based on content analysis and case studies from diverse contexts, the research identifies strategies such as inclusive education, interfaith dialogue, and the utilization of digital media. The findings indicate that multicultural dawah can reduce stereotypes, foster empathy, and promote social tolerance. The implications of this study include recommendations for dawah practitioners, educational institutions, and policymakers to implement these strategies on a broader scale. This research contributes to efforts in building a harmonious society amidst cultural diversity. Keywords: Multicultural Da'wah Strategies, Countering Islamophobia

Abstract

This study examines the strategic role of Islamic Pawnshops in expanding financial inclusion for Indonesian society through pawn-based financing services. The research employs a qualitative approach with literature study analyzing various sources including scientific journal articles, research reports, and official financial institution publications from 2021-2025. Thematic content analysis was applied to identify patterns, relationships, and main themes related to Islamic pawn service accessibility. Research findings indicate that Islamic Pawnshops contribute significantly to improving financial service accessibility for underserved segments of society, particularly low-income groups and micro, small, and medium enterprise actors. Implementation of rahn contract principles emphasizing justice and transparency without usury elements becomes the main advantage in attracting people who have preferences for Islamic financial products. Digital transformation through online service platform innovation and Gold Bank products has expanded geographical reach and increased operational efficiency. However, challenges such as low digital literacy and limited technology infrastructure remain obstacles that need to be addressed. This research recommends strengthening Islamic financial education programs, developing transparent marketing strategies, and inter-institutional collaboration to optimize the role of Islamic Pawnshops in realizing an inclusive and equitable financial system in Indonesia.

Abstract

The phenomenon of Trafficking in Persons (TIP) targeting Indonesian citizens (WNI) in Cambodia in recent years highlights the vulnerability within the cross-border legal protection system for victims. These cases are predominantly orchestrated by international criminal syndicates utilizing online job scamming schemes, ensnaring hundreds of WNI into economic and psychological exploitation. This study aims to analyze the urgency of the Indonesian government's preventive and corrective measures in combating TIP against WNI in Cambodia, employing a national and international legal approach. The methodology used is normative legal research, incorporating statutory, conceptual, and case study approaches. The research findings indicate that the government's preventive efforts are still reactive and lack comprehensive integration. Conversely, corrective measures, particularly victim handling, have not been adequately balanced with sufficient recovery support (including psychological and legal rehabilitation). This study emphasizes the critical need for synergy between the Governments of Indonesia and Cambodia. Furthermore, harmonization of national laws with the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (Palermo Protocol), is essential to strengthen the protection mechanism for WNI victims of TIP abroad.

Abstract

This study examines the integration of transformational, transactional, and prophetic leadership styles in improving organizational effectiveness at Madrasah Aliyah Negeri 5 Garut. Using a qualitative case study approach conducted from September 25-29, 2025, data were collected through in-depth interviews with principals, vice principals, senior and junior teachers, administrative staff, and students, complemented by observation and document analysis. The findings reveal that the principal predominantly applies transformational leadership through idealized influence, inspirational motivation, intellectual stimulation, and individualized consideration, supported by transactional elements (contingent reward and management by exception) and prophetic values (shiddiq, amanah, and shura). The strengths lie in inspirational leadership oriented toward Islamic educational vision, moral exemplary, innovation encouragement, empathy, and integration of religious and professional values. However, weaknesses persist in uneven participation in deliberation, inconsistent reward systems, leadership centralization, and administrative-focused transactional approaches. Five priority interventions are recommended: transformation toward distributed leadership, development of innovation culture, strengthening communication and participation systems, organizational justice management, and generational bridging programs. The implementation strategy is designed in three phases over twelve months with comprehensive evaluation and monitoring systems to ensure sustainable organizational transformation.

Abstract

Aceh's Qanun, as a legal product of Special Autonomy under Law No. 11/2006, occupies a unique and paradoxical position within Indonesia's national legal framework. Formally, it is hierarchically equivalent to a Provincial Regulation (Perda), yet its substantive authority transcends the limits of ordinary regional autonomy, venturing into domains traditionally reserved for uniform national law—most prominently with the establishment of Islamic criminal law through Qanun Jinayat. This creates a systemic legal dualism where citizens, particularly Muslims, are subject to two concurrent criminal regimes: the national Criminal Code (KUHP) and the Jinayat provisions. Its legislative process reflects this complexity, functioning as a multi-level political arena involving intense negotiations among the Aceh DPRD, the Governor, the Aceh Sharia Court (for syariah-based Qanuns), and the Central Government via the Ministry of Home Affairs' evaluation. This ex-ante control mechanism often prioritizes political and administrative considerations over deep juridical review. While Qanun Jinayat attracts significant scholarly and public attention for its controversial nature, the majority of Qanuns actually govern more technical, secular fields like spatial planning and public services. These face different but equally critical challenges, including regulatory overlaps and weak drafting quality, highlighting a gap between the symbolic prominence of syariah and the practical needs of governance. A fundamental flaw in the system is the weak ex-post control; mechanisms for judicial review are unclear and systematic evaluations of a Qanun's implementation and impact are virtually absent. Consequently, many Qanuns exist and are enforced in a state of persistent legal uncertainty, undermining the very rule of law and equal protection that the legal system aims to guarantee, ultimately posing a continuous challenge to national legal integration

Abstract

This study originates from the recognition of the important role of pesantren as institutions that not only educate students in religious matters but also contribute to economic empowerment and the preservation of local culture, as reflected in the batik training program at Pondok Pesantren Ar-Rifa’iyah Saronggi Sumenep. The research aims to describe and analyze how this batik program fosters students’ entrepreneurial spirit while strengthening character values and creative economic potential rooted in Madurese cultural traditions and Islamic principles. This study employs a qualitative approach using a field research design. The researcher collected data through interviews, observations, and documentation involving the pesantren leaders, batik instructors, students, alumni, and consumers of the students’ batik products, and then systematically analyzed the data to identify relevant patterns. The findings reveal that the batik program operates through stages of strengthening cultural and Islamic values, providing technical training, guiding production processes, establishing industrial partnerships, and facilitating product marketing. These stages not only enhance students’ technical skills but also shape their character to become creative, disciplined, independent, responsible, and socially aware individuals. The integration of Islamic education, the creative economy, and local culture positions the batik activities as an effective model for developing santripreneurs in line with the concept of Islamic Entrepreneurship, with strong potential for replication in other pesantren across Indonesia

Abstract

This study aims to analyze the differences in character education for students in urban and rural schools, referring to Ibn Khaldun's theory on the influence of 'umran (socio-cultural environment) in the formation of morals. The study was conducted using a comparative qualitative approach at SD QISMU (urban) and SDN Larangan Kerta (rural). Data were collected through observation, interviews, and document analysis, then analyzed using qualitative comparative analysis techniques. The results show that character education in urban areas is more formal, structured, and based on school programs with individualistic tendencies due to the influence of digital culture, but is still strengthened through religious habits and collaboration with parents. Meanwhile, character education in rural areas is more natural, communal, and rooted in religious traditions and mutual cooperation, with the important role of Kyai and local Madurese wisdom. These findings are in line with Ibn Khaldun's theory that morals are formed through habits (ta'wid) and role models (uswah) according to the social context. Thus, this study emphasizes the need for character education designs that are contextual, fair, and aligned with Islamic values and the socio-cultural dynamics of students.
