Abstract

The Village funds are part of the State Revenue and Expenditure Budget which are allocated for villages and disbursed through the district/city expenditure budget. During the period of 2015 – 2018, two village heads (village of Malang Rapat and Penaga) were the suspects of corruption cases in Bintan District in the province of Riau Islands. There was no evaluation of the use of the village funds by the district government. The objective of this study was to gain an insight into the use of village funds in the province of Riau Islands. The study problem was how to evaluate the use, impact, and constraints in the utilization of village funds in the province of Riau Islands in 2018 (Case study in Bintan District and Lingga District). This study used a qualitative descriptive method, using interviews and observations for data collection. The results showed that a large portion of village funds was used for physical development in the village, while human development in the village was not yet properly implemented due to the limited allocation of village funds for empowerment and community development. The impact of village funds felt by the community for the addition of physical facilities in the village was significant, while the impact on empowerment and economy of the community was not. The constraints of the usage of the village funds were regulation, human resources, and coordination.

Abstract

The low quality of the Senior Executive Service Officials (SES) of the State Civil Apparatus (Aparatur Sipil Negara/ASN) was due its selection process which was highly political and lack in objectivity, fairness, and transparency. The low quality and competence impeded government activities and made them unable to compete with the private sector. The implementation of the merit system in the selection process of ASN Senior Executive Service (SES) which emphasizes the qualification, competency, performance, as well as fairness and openness, was needed to produce professional Pratama SES. The purpose of this study was to identify and analyze the implementation of the merit system in the selection of SES in the Central Java Provincial Government. The research problem of this study was how the merit system was implemented in the selection process for the SES in the Central Java Provincial Government. The theory utilized in the study was the merit system, on the dimensions of competency, qualification, work performance, and fairness. A qualitative approach was used in this study to describe and analyze the results. The primary data was collected from interviews with the sources, while the secondary data was collected using literature reviews of relevant books, journals, documents, and regulations. The location of the study is the Regional Staffing Unit (Badan Kepegawaian Daerah/BKD) of Central Java Provincial Government. Data analysis was conducted by pattern determination, data reduction, data presentation, and verification/conclusion. The study showed that the merit system in the recruitment process of the Central Java Provincial Government’s Pratama SES was not implemented fully. Some Pratama SES selected using the system were still unable to perform their duties optimally, especially in responding, analyzing, or taking decisions/policy related to their duties. The dimension of the merit system has not yet been fully grasped and carried out, such as qualifications, competencies, and performance assessment.

Abstract

DKI Jakarta Government’s eviction policy is often considered to be wrong or has a negative image (even violating the Human Rights) because eviction is synonymous with riot, coercion, expulsion, and always ends in conflict. Although according to the utilitarianism philosophy, no actions, including evictions, are inherently wrong. All actions or regulations by itself are neutral. What gives moral values to actions or regulations are its consequences. The objective of this study was to determine the positive consequences of eviction actions by using the philosophical perspective of Utilitarianism. The study used descriptive and literature review methods, as well as qualitative approach, the results of the study showed that eviction policies were justified in the utilitarian view, Eviction of a handful of residents living on the riverbanks was done to normalize the riverbank and green areas to save millions of DKI Jakarta residents from floods. The main objective of the eviction was the public interest. Therefore, evictions must be conducted for the greater good, benefiting as many people as possible and carried out in ways that humanize people.

Abstract

The state recognizes and respects indigenous and tribal people and their traditional rights insofar as they are alive and in accordance with the development of society and the principles of the Unitary State of the Republic of Indonesia, as contained in Article 18 B paragraph 2 of the 1945 Constitution. However, the fulfillment of cultural identity and the rights of indigenous people have not been maximized. This study aims to find the conceptual model of the Customary Justice system in an effort to protect the existence of the rights of indigenous people to build the strength of civil society in West Sumatra. This research uses research and development methods. Data retrieval is done by survey, observation, interview, and Focus Group Discussion (FGD) methods. This study found that; 1) Minangkabau people have their own local wisdom in resolving customary disputes, even for a broader range of life issues, long before Indonesia was found, 2) Nagari Customary Justice system is a translation of Customary Limbago which is the life philosophy of Minangkabau people, 3) Nagari Customary Judicial institutional structure is a representation of the existence of the tribe in the Nagari, so that its cultural legitimacy becomes strong. And, 4) the Nagari Customary Justice system is an effort to build the sovereignty of civil society, namely an autonomous, independent, egalitarian, and democratic society. It is hoped that the results of this study will be a guideline in establishing the Nagari Customary Justice institution in West Sumatra.

Abstract

The government issued various regulations to support the development of a creative economy. However, the regulations had not provided a significant impact on the development of the creative economy product in the regions. This study observed the state of the creative economy’s Regional Best Products (Produk Unggulan Daerah/PUD), the effort to develop it and the obstacles to its development in the City of Bandung and Badung District. This study used a descriptive method with a qualitative approach. The data was collected using interviews, FGD, and documentation. The study showed that the development of the creative economy’s regional Best Products was not optimal This was due to the inability of the existing regulation to provide a significant impact, although the regional government conducted various development efforts in line with the capability of the region.

Abstract

This article discusses how inclusive development is translated into policy and regional development planning. Perspectives used are that of the regional government apparatus in-charge of development planning. As a strategic actor in decision making, those in charge of development planning hold an important role in determining what counts as inclusive development, who the targets are, and how such inclusivity could be realized through development programs. The research was conducted in Bandung Regency, one of the regions that experience rapid economic growth, as well as one that is facing the challenges of poverty and the decline of environmental support capacity. The method that was used in this research is the quantitative method to discover the perceptions of government apparatus, which afterwards are confirmed through textual analysis of regional development planning documents. From this initial research, development planning process is suspected to not have optimal public participation, as well as to not have involved marginalized groups, so that policies and programs are less able to accommodate several strategic regional issues. Therefore, there is a need to create a comprehensive effort towards achieving an inclusive development agenda as the primary goal in Bandung Regency development.

Abstract

The regional autonomy implemented for more than two decades is not entirely a success. An evaluation of the regional governance shows that many of the regional heads are tangled in legal cases, have bad financial management, and some other problems in the different levels of government. As such, it is necessary to examine the implementation of the development and supervision policy which aims to ensure the effectiveness of the regional autonomy. This study used a mixed, two stages method, with a quantitative approach using multiple regression analysis and followed by the qualitative approach of triangulation and ASOCA (Ability, Strength, Opportunities, Culture, and Agility) analysis method. The population in this study is the whole autonomous region in Indonesia (542 regions) with a sample of 85 regions. The quantitative analysis showed significant influence between the implementation of policy and development and supervision to the effectiveness of the regional autonomy. The qualitative analysis supported the quantitative analysis result and found new the dominant factors that produce a new model (novelty) called HADI (Human resources, Acceptance, Development, and Innovation) as an alternative model of the development and supervision policy for the effectiveness of regional autonomy. This study concluded that the successful implementation of an effective regional autonomy is very much influenced by the implementation of the policy and that a HADI model could be used as an alternative solution to the problem.

Abstract

This study was about the performance of researchers in the Ministry of Home Affairs’ Research and Development Agency (R & D Unit of the MoHA). This research was motivated by the suboptimal performance of researchers in developing policies in the Ministry of Home Affairs. The purpose of this study was to describe the performance of the researchers and their various efforts on research and development in the Ministry of Home Affairs and Regional Government. This study used Structural Equation Modeling (SEM). The results of this study showed that empowerment has a direct effect on innovation and improvement of the researcher’s performance. This means that more empowerment will lead to an increase in the performance of MoHA and Regional Government researchers indicated by the increase in R & D innovations produced by the researchers. The Organization Commitment had a direct effect on innovation and improvement of the researcher’s performance. This means that a high level of commitment in the organization will lead to an increase in the performance of MoHA and the Regional Government researchers, through the increase in innovations. Innovations had a direct effect on the researcher’s performance. This means that a high degree of innovations will lead to an increase in the researchers’ performance. Together, the increased empowerment and organizational commitment directly influence the performance of researchers. This means that increasing empowerment and organizational commitment at the same time will improve the researchers’ performance. The novelty factor from this study was the theoretical implication that this study strengthens the previous studies, that empowerment directly influenced innovation and enhanced the researchers’ performance, the organizational commitment had a direct effect on researcher innovation and improved the researchers’ performance, innovations directly influenced the researchers’ performance, and that empowerment and the organizational commitment together have a direct effect on the performance of researchers.

Abstract

Government has to pay attention to the fulfillment of children's rights because later they will determine the fate of the nation and state in the future. One of the things that can be done by the Government is by organizing a Child-Friendly City. One significant cluster related to the implementation of a Child-Friendly City is a cluster of essential health and well- being. The Depok City Government through the Health Office has made various efforts to support the realization of a Child-Friendly City in the health sector. The research method used in this study is qualitative with a post-positivist approach. Based on the results of the study, through the target approach in measuring organizational effectiveness by S. B Lubis and Martani Huseini, the Health Office has exceeded the goals set out in the Medium Term Development Plan. The achievement of these targets is inseparable from the factors that influence the organization in carrying out its performance. Based on McKinsey's theory, seven factors influence the Health Office to support Child-Friendly Cities, two of which have gone well, namely, the leader who motivate their subordinates and the budget and technology that supports the implementation of Child-Friendly Cities. But the other five factors have not gone well, namely the Health Office does not yet have a specific strategy related to Child-Friendly Cities, coordination that has not run optimally, lack of Human Resources both in terms of numbers and competencies and the absence of organizational culture specifically for the Office of Health in carrying out its functions. Therefore, the Health Office needs to make improvements from the factors that have not gone well so that Depok City can be a Child- Friendly City. Abstract

There were some problems in the handover of housing Infrastructure, Facilities, and Utilities (PSU (Prasarana, Sarana dan Utilitas)) by developers to local governments. Since the issuance of Minister of Home Affairs Regulation Number 9 of 2009, only small numbers of housing PSU have been handed over by the housing developers to the local government. The objective of this study was to explore some problems related to the handover of the housing PSU which located in Greater Bandung Area, both from the developers and the local governments’ sides. This study used a descriptive - qualitative approach. The primary data collection was conducted with an in-depth interview method to the fourteen developers experienced in housing development in the Greater Bandung Area and three local government officials. The secondary data was collected through the online news along with the regional regulations related to the handover of housing PSU in the districts/cities level of the Greater Bandung Area. The primary and secondary data were analyzed by Qualitative Content Analysis. The study showed that problems came from both developers and local governments’ sides. The developers believed that the bureaucracy for the housing handover was complicated, while the local governments stated there were inconsistencies between the approved site plan and the built PSU. The local governments also have not had mature planning for the housing PSU’s operation and maintenance after the handover. Thus, as the organizer of housing affairs, the governments need to immediately reform the PSU planning and management in terms of its provision, financing, and maintenance.
