Abstract

This research is motivated by the SATRIA CSR (Corporate Social Responsibility) Forum in Banyumas Regency which involves various parties such as local governments, companies, academics, NGOs, and mass media that collaborate in supporting regional development through CSR. Therefore, this paper aims to describe in-depth the governance of the SATRIA CSR Forum in Banyumas Regency in the perspective of collaborative governance. This research uses a qualitative method with a phenomenological approach. The research location was in Banyumas Regency, with the target of the research consisting of government elements, private elements, mass media elements, NGOs, the community, and academics. The selection of informants was carried out using purposive sampling and snowball sampling techniques. The data analysis method used is the interactive analysis. The results found that the existence of internal and external dialogue was good initial progress in the governance of the SATRIA CSR Forum. Even so, there are still some aspects of CSR Forum governance that have not been maximized, such as stakeholder's commitment and the business community's understanding of CSR regulations. Therefore, efforts are needed to get the business community involved in the SATRIA CSR Forum. In this case, the role of local government is one of the keys for the business world to be involved, including by providing understanding to the business community regarding CSR regulations. The results of this study contribute to an understanding of the implementation of collaborative approaches in the context of CSR programs at the local level.

Abstract

The Aceh Special Autonomy Fund, better known as DOKA, was established in 2008. The amount of DOKA increases significantly every year. However, the increase was not followed by an increase in the local economy. As such, there was no significant improvement in the welfare of the people of Aceh. Therefore, this paper seeks to examine the Aceh Special Autonomy Fund’s Management Model. This paper was using qualitative method through FGD, interviews, and documentation. The results of this study showed the need to improve the performance of the Asymmetric Decentralization Policy through Special Autonomy in Aceh Government such as 1) completion of the drafting of implementing regulations; 2) establish a proactive communication and build trust; 3) socialization by the Ministry of Home Affairs related to the Law on Aceh Government (UUPA) in relation to the Law on Oil and Gas, free trade and others; 4) drafting of guidelines in the implementation of special autonomy; 5) facilitates the division of authority between the Aceh Provincial Government and its district/city governments. The recommendation from this study is to list the division of authority of government affairs in detail between the Aceh Provincial Government and its district/city governments, by considering of the characteristics and aspirations of the regions to avoid disputes over authority and overlapping authority.

Abstract

Old-Age Insurance (JHT), which is intended for workers entering the old age, is now widely claimed when workers are still in their early age discussing the implementation of the policy on benefits of Old Age Insurance (JHT) in Indonesia. This study discusses the implementation of policies on benefits of Old Age Insurance (JHT) in Indonesia. JHT is a program in the form of giving cash when participants enter retirement age. In its implementation, there are several obstacles, namely many participants who took the benefits of JHT at a young age. This has led to a shift in the philosophy of JHT as well as the existence of companies that register good programs, wages and labor. The purpose of this study is to analyze the implementation of the JHT benefit policy in Indonesia and what determines the success of implementing the JHT benefit policy. This study used a descriptive qualitative approach with data collection techniques through in-depth interviews and literature studies. In-depth interviews were conducted with several informants including the government, BPJS Employment, participants and employers as well as NGOs. The results of this study, namely the implementation of the JHT benefit policy in Indonesia goes well despite disharmony of regulations and the successful implementation of the JHT benefit policy in Indonesia is strongly influenced by various things including the content and context of the policy itself and compliance with implementers and factual sociological conditions of the community. The conclusion is that implementation is going well even though it still faces both regulatory and compliance constraints, so it needs to be revised PP 60 in 2015, the existence of unemployment benefits so that it does not interfere with JHT and innovative performance is needed from BPJS Ketenagakerjaan.

Abstract

The phenomenon of climate change and global warming is driving the issue of the Sustainable Development Goals developing in countries in the world, including Indonesia. Indonesia is incorporated in the Paris Agreement and follows up with the drafting of laws and regulations which form the basis for implementing TPB in the regions. Profile of achievement of the Serang City Sustainable Development Goals based on the KLJDD KLHS Document shows that there are still 92 indicators (50, 27%) that have not been achieved. Previous research on strategies and road maps to achieve TPB at the regional level is still limited and is the state of the art of this research. The method used is a sequential transformative strategy mix method that is integrated with the TAIDA method as a scenario planning method, by prioritizing qualitative research through literature studies, personal observations, discussions, interviews which are part of the initial process of the TAIDA (tracking, analyzing) method. Followed by quantitative research through descriptive statistics on weight and rating calculations to formulate strategies and road maps (the next process of the TAIDA method: identifying, deciding, acting). The results of this study are that the strategy to achieve TPB is focused on 4 (four) aspects, namely aspects of regulation (synchronization of regulations), funding (potential funding other than APBD along with preparation of regional financial mechanisms), socialization (aimed at the public and all stakeholders through sharing media) and collaboration (initiation of cooperation with all parties and other local governments). The road map consists of 9 (nine) stages, from socializing to promoting best practices.

Abstract

According to previous studies, political dowry was practiced in the 2018 simultaneous regional head elections as found in several cases although policies on the prohibition of rewards have been adopted. This is regrettable because political dowry has fairly destructive impacts. For instance, the local governments formed after the elections will have the potential to be corrupt. This study aims to analyze potential political dowry practices in the 2018 regional head elections, their factors, and the policy implication. The research method used in this study is a qualitative approach with a descriptive content analysis on some secondary data. This study found that potential political dowry practices had occurred in the 2018 regional head elections as found in several cases but were difficult to prove by regulations. The factors of a political dowry practice are three elements as involved in any transactional activity, i.e. seller (political party), buyer (prospective regional head candidate), and system (electoral system). The policy implication is to integrate Law No. 7 of 2017 concerning General Elections, Law No. 10 of 2016 concerning Regional Head and Deputy Regional Head Elections, and Law No. 2 of 2011 concerning Political Parties with reinforcement in several aspects, such as the appointment of an independent institution to be permanently responsible for the financial management of political parties, the system with fair, affordable, and accountable opportunities to attain political leadership positions, the rationalization of political finance, the verification of political parties to support participation in simultaneous regional head elections, the reinforcement of information systems in the financial management of political parties, and the reinforcement of the role and independence of the Elections Supervisory Body (Bawaslu) in handling political dowry practices in regional head elections.

Abstract

Licensing is one way for business actors to formalize business. Without licensing, businesses are unable to move to the formal sector and get a variety of benefits such as coaching programs, tax incentives and getting credit or capital assistance, especially from banks and legal guarantees. Nevertheless, business operators consider that licensing services are still not optimal. Business actors' complaints include inefficient and effective services caused by weak institutional aspects. Institutional improvement of the Capital Investment Agency and the One-Stop Integrated Service (DPMPTSP) to reach the prime point will have an impact on the ease of service and improve the investment climate. The main method used in this study is the Regulatory Impact Assessment (RIA) supported using Regulatory Mapping (Regmap) to determine the regulatory map that contributes to the institutional aspects of DPMPTSP. The results of the analysis revealed that the root cause of the weakness of DPMPTSP's institutions was the absence of DPMPTSP's institutional improvement program. The root causes of these problems contribute to some of the problems in optimizing DPMPTSP institutions such as the Standard Operational Procedure (SOP) that is not updated, the lack of competence of the implementing apparatus, the delay in anticipating changes in regulations of the central authority. Alternative corrective actions from the results of the analysis are the devolution of authority for licensing services, preparation of guidelines for Standard Procedure Norms Criteria (NSPK), institutional regulation updates, preparation of local regulations related to institutional implementation, SOP formulation of licensing services, placement of technical human resources, and development of infrastructure facilities.

Abstract

Identity politics promoted by the 212 Movement has led to increased intolerance in society. This study captured this problem through the perspective of Emmanuel Levinas’ Ethics. According to Levinas, the act of intolerance occurs because we see the Other, not with ideas, ideologies, teachings, doctrines, interests, and religion that should be upheld above all things. Our attachment to the ideas we has about others often makes us fail to treat them as humans because we are prevented from encountering them directly. For this reason, this study aims to find out the negative consequences caused by the 212 Movement through the philosophical perspective of Emmanuel Levinas' ethics. With descriptive methods, literature study, and a qualitative approach, the results of the study showed that identity politics carried out by the 212 Movement could not be justified in ethical relations. The 212 Movement saw other human beings as objects that can be used to achieve their personal or group goals. The movement has controlled and exploited their fellow believers, and not reluctant to carry out hateful propaganda to people outside their group. Levinas ethical relations open a new type of relations that are different from idea-based relations. Encountering others makes us realize that they are not merely skin, flesh, and blood that can be destroyed just like that.

Abstract

Bus Terminal, as a revenue-producing service entity in the regional government jurisdiction, is expected to contribute to the independence of the region in the form of the Regional Government's Own-Source Revenue (Pendapatan Asli Daerah/PAD). However, the performance of the bus terminal’s levy was less than desirable. Furthermore, due to the change of authority over some type of bus terminals, it no longer able to produce revenue for the Regional Government. The authority to raise levies from the bus terminals motivated the regional government to introduce service innovations for the bus terminals under their jurisdiction. One example of such innovation was Tirtonadi Bus Terminal in Surakarta, Central Java. This study objective was to understand the impact of the terminal services innovations on the improvement of PAD in Surakarta, Central Java. The study used descriptive methods with a qualitative approach. The result of the study showed that the innovation in Tirtonadi Bus Terminal services was in the form of modernization of the bus terminal's facilities. The impact of terminal services innovations on the increase of levy collections was not significant. The impact of the innovations on the improvement of services was mainly on the physical aspect. The innovations increase customer satisfaction; however, the number of passengers tend to be stagnant and even slightly decrease. Some problems also appear in relation to the change of authority over the bus terminal, in the form of transfer of personnel, funding, infrastructures, and documents (personil, pendanaan, sarana/prasarana dan dokumen/P3D). The change of the authority has a positive impact on the management of the bus terminal. To reap the benefit, the bus terminal management should be directed to utilize a Public Private Partnership cooperation (PPP), change the revenue base and adopt the transit-oriented development (TOD) approach.

Abstract

Human resources have a pivotal role in a country because it determines the growth and development of an economy. In economic terms, factor of production can be defined as labor, land, and capital, thereforethe quality of human resources does matter to determine the growth and development in a country. Since ASEAN Economic Community has already started in 2015 and it put forward competitive conditions among countries, human development has been attracting a lot of interest. Furthermore, poverty is also considered as an interesting topic in Indonesia because it has been 74 years after Indonesian independence, and poverty is still a difficult problem to alleviate. In 2016, Indonesia is recorded as having the second largest number of poor people in ASEAN. Various programs have been implemented by the regional governments including fiscal decentralization. This paper aims to find the impact of fiscal decentralization on welfare. In this article, we focused on human development and poverty to reflect welfare. We use regional government expenditure, regional government revenue, and balancing funds to measure fiscal decentralization in selected provinces in Indonesia-West Java, Central Java, East Java, Special Capital Region of Jakarta, Special Region of Yogyakarta, and Banten. We found decentralization policy statistically significant affects human development and poverty alleviation. Hence, this information can be used to develop targeted interventions aimed on increasing the regional government revenue and reducing unnecessary regional government expenditure to escalate fiscal space. The fiscal space can be used to fund programs that encourage human development and poverty alleviation.

Abstract

Law No. 6 of 2014 concerning Villages provides opportunities for indigenous communities to form indigenous village governments. Nagaris have an established government system, and yet it is getting blurry and dysfunctional institutionally as rules and regulations concerning village governments change. This study aims to explore and rediscover the nagari government models according to the Minangkabau customs. Data were collected with a mixed-method approach, including survey, observation, interview, and focus group discussion (FGD) methods. This study found that, first, there are two nagari government models in the Minangkabau customs, namely the aristocratic model and the democratic model. Second, the cultural identity of the Minangkabau society is reflected in the concept of banagari, as the traditional system and the government system as an autonomous and independent entity. Third, the nagari government system accommodates two systems that are running simultaneously, namely the state government system and the indigenous government system, in the context of banagari life by using a system that divides the government into three branches, namely an executive, a legislature, and a judiciary.
